PRELIMINARY DOCKET: Examiner Hearing for Thursday, December 16, 2021

Applications for hearing shall be filed at least thirty (30) days in advance of the hearing date. A party who intends to present evidence shall file a pre-hearing statement no later than the close of business on the Thursday prior to the hearing date and serve a copy on the other parties, if any. The hearing examiner will dismiss the application if the applicant does not file and serve a pre-hearing statement as specified above. The well locations are orthodox, and the completed well intervals and take points will comply Statewide rules for setbacks; also to be considered will be the cost of drilling and completing the wells and the allocation of the costs thereof; actual operating costs and charges for supervision; the designation of the Applicant as Operator of the wells and unit; and a 200% charge for the risk involved in drilling and completing the wells. The wells and lands are located approximately 1 mile southeast of Carlsbad, New Mexico.
2. 22079 Application of Back Nine Properties, LLC for Compulsory Pooling, Chaves County, New Mexico. Applicant seeks an order pooling all uncommitted interests in the Devonian formation in a 40-acre standard spacing unit consisting of the SW/4NW/4 of Section 34, Township 11 South, Range 29 East, NMPM, Chaves County, New Mexico. Applicant proposes to dedicate the Unit to the LE Ranch #1 well (“Well”) which will be vertically drilled with a surface and bottom hole location at approximately 1980’ FNL and 270’ FWL, or a legal location within Unit E, of Section 34, Township 11 South, Range 29 East. The completed interval of the well will be unorthodox. Also to be considered will be the costs of drilling and completing the well and the allocation of the costs, the designation of Tamaroa Operating, LLC as the operator of the well, and a 200% charge for the risk involved in drilling and completing the well. 3. 22075 Application of Catena Resources Operating, LLC for Compulsory Pooling, Lea County, New Mexico. Applicant applies for an order pooling all uncommitted mineral interests in the Bone Spring formation in a 320-acre, more or less, standard horizontal spacing unit (“Unit”) comprised of the E/2W/2 of Sections 8 and 17, Township 19 South, Range 35 East, Lea County, New Mexico. The Unit will be dedicated to the Rambo E2W2 08-17 B1 1H well (“Well”) which will be horizontally drilled from a surface location in the NE/4NW/4 (Unit C) of Section 8 to a bottom hole location in the SE/4SW/4 (Unit N) of Section 17. Applicant proposes to dedicate the above-referenced spacing unit to the initial wells: (1) the Caprock Yeso Area CYA W State Com #123H well, and (2) the Caprock Yeso Area CYA W State Com #205H well, to be horizontally drilled from a surface location in the SE/4 NE/4 (Unit H) of Section 7, to a bottom hole location in the SW/4 NW/4 (Unit E) of Section 7.
