PRELIMINARY DOCKET: Examiner Hearing for Thursday, March 17, 2022

Applications for hearing shall be filed at least thirty (30) days in advance of the hearing date. A party who intends to present evidence shall file a pre-hearing statement no later than the close of business on the Thursday prior to the hearing date and serve a copy on the other parties, if any. The hearing examiner will dismiss the application if the applicant does not file and serve a pre-hearing statement as specified above. A party desiring to use projection equipment at the hearing shall contact Florene Davidson, OCD Clerk, no later than seven (7) business days prior to the hearing.

1. 22457 Application of Armstrong Energy Corp. to Designate Burns Xpress, LLC as Operator of Record of the West Pearl State #1 Well, Lea County, New Mexico. Applicant seeks an order removing Armstrong as operator of record of the West Pearl State #1 well and designating Burns Xpress, LLC (“Burns”) as operator of record. Armstrong is the operator of record of the West Pearl State #1 well (“Well”) (API # 30-025-28583). The Well is vertically drilled at 660 FNL and 550 FEL (Unit A) in Section 2, Township 20 South, Range 34 East, Lea County, New Mexico to a depth sufficient to produce the Lea-Delaware, Northeast pool (Pool Code 37584). Armstrong assigned the Well to Burns, but Burns has declined to execute a Change of Operator application (Form C-145) for the Well. In order to prevent waste, protect correlative rights, and ensure that the owner of the Well has legal authority over the Well for purposes of complying with the Division’s regulations, Armstrong should be removed as operator of the Well by the Division and Burns should be designated as operator of record of the Well. The Well is located approximately 26.5 miles west-southwest of Hobbs, New Mexico.
2. 22359 Application of Ascent Energy, LLC to Amend Order No. R-21542, Lea County, New Mexico. Ascent Energy, LLC seeks an order amending Order No. R-21542, issued on November 13, 2020, to extend the well commencement deadline one year, to November 13, 2022. Order No. R-21542 pooled mineral interest owners in the Bone Spring formation underlying a horizontal spacing unit comprised of the W/2W/2 of Section 16 and the W/2W/2 of Section 21, Township 20 South, Range 33 East, N.M.P.M., Lea County, New Mexico, for purposes of drilling the Pony Express Fed. The Unit will be dedicated to the Rambo E2W2 08-17 B1 1H well (“Well”) which will be horizontally drilled from a surface location in the NE/4NW/4 (Unit C) of Section 8 to a bottom hole location in the SE/4SW/4 (Unit N) of Section 17. 8. 22374 Application of COG Operating LLC for Compulsory Pooling, Lea County, New Mexico. Applicant seeks an order pooling all uncommitted mineral interests in the Bone Spring formation underlying a 400-acre, more or less, standard horizontal spacing unit (“Unit”) comprised of Lot 3, the SE/4NW/4 and the E/2SW/4 of Section 4 in Township 25 South, Range 35 East; the E/2W/2 of Section 9 in Township 25 South, Range 35 East; and the E/2SW/4 of Section 33 in Township 24 South, Range 35 East, Lea County, New Mexico. The Unit will be dedicated to the Fez Fed Com 402H well (“Well”) to be horizontally drilled from a surface location in the NE/4NW/4 (Unit C) of Section 16 to a bottom hole location in the NE/4SW/4 (Unit K) of Section 33. The completed interval of the Well will be orthodox. The Well is located approximately 10.5 miles west of Jal, New Mexico.
9. 22594 Application of Colgate Operating, LLC to Pool Record Title Owners Under Order No. R-21440, Eddy County, New Mexico. Applicant seeks an order pooling record title owners under the terms of Division Order No. R-21440. On August 24, 2020, the Division entered Order No. R-21440 (“Order”) in Case No. 21239, which pooled all uncommitted interests in the Winchester; Bone Spring Pool (Pool Code 65010) within the Bone Spring formation in a 320-acre, more or less, standard horizontal spacing unit comprised of the N/2 of Sections 27 and Section 28, Township 19 South, Range 28 East, Eddy County, New Mexico (“Unit”). The Order further dedicated the Unit to the Weaver 27 State Com 121H, 122H, 131H, and 132H wells (“Wells”) and designated Applicant as operator of the Unit and Wells. Since entry of the Order, Applicant has identified record title owners in the Unit that have not been pooled under the terms of the Order. Applicant has undertaken diligent, good-faith efforts to obtain voluntary agreements from the record title owners but has been unable to do so. The Wells are located approximately 19 miles southeast of Artesia, New Mexico.
10. 21967 Application of Devon Energy Production Company, L.P. for compulsory pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order pooling all uncommitted interest owners in the Bone Spring formation underlying a standard 640-acre, more or less, horizontal spacing unit comprised of the N/2 of Sections 23 and 24, Township 20 South, Range 29 East, NMPM, Eddy County, New Mexico. Applicant seeks to dedicate the above-referenced horizontal spacing unit to the proposed initial Tiger Paw 24-23 Fed Com #331H well, to be horizontally drilled from a surface hole location in the NE/4 NE/4 (Unit A) of Section 24 to a bottom hole location in the NW/4 NW/4 (Unit D) of Section 23. The completed interval of the well will remain within 330 feet of the quarter-quarter line separating the S/2 N/2 from the N/2 N/2 to include the additional acreage in this standard horizontal spacing unit. Applicant in the above-styled cause seeks an order pooling all uncommitted interest owners in the Bone Spring formation [Culebra Bluff; Bone Spring, South (Pool Code 15011)] underlying a standard 640-acre horizontal spacing unit comprised of the E/2 of Sections 27 & 34, Township 22 South, Range 28 East, NMPM, Eddy County, New Mexico. This spacing unit will be dedicated to the following proposed initial wells:
•    Warrior Fed Com #123H to be drilled from a surface hole location in the SE/4 SE/4 (Unit P) of Section 22 to a bottom hole location in the SW/4 SE/4 (Unit O) of Section 34.

Also to be considered will be the cost of drilling and completing the wells, the allocation of the cost thereof, as well as actual operating costs and charges for supervision, the designation of applicant as operator, and a 200% charge for risk involved in drilling and completing the wells. Said area is located approximately 9 miles east of Carlsbad, New Mexico.
