PRELIMINARY DOCKET: Examiner Hearing for Thursday, October 7, 2021

Applications for hearing shall be filed at least thirty (30) days in advance of the hearing date. A party who intends to present evidence shall file a pre-hearing statement no later than the close of business on the Thursday prior to the hearing date and serve a copy on the other parties, if any. The hearing examiner will dismiss the application if the applicant does not file and serve a pre-hearing statement as specified above. A party desiring to use projection equipment at the hearing shall contact Florene Davidson, OCD Clerk, no later than seven (7) business days prior to the hearing.

The completed intervals of the Wells will be orthodox. Also to be considered will be the cost of drilling and completing the Wells and the allocation of the costs, the designation of Applicant as the operator of the Wells, and a 200% charge for the risk involved in drilling and completing the Wells. The Wells are located approximately 1.6 miles southwest of Carlsbad, New Mexico.
2. 22172 Application of Alpha Energy Partners, LLC for Compulsory Pooling, Eddy County, New Mexico. Applicant applies for an order pooling all uncommitted mineral interests in the Wolfcamp formation underlying a 640-acre, more or less, standard horizontal spacing unit comprised of the S/2 of Sections 19 and 20, Township 22 South, Range 27 East, Eddy County, New Mexico (“Unit”). The Unit will be dedicated to The Dude 19/20 Fee 203H and The Dude 19/20 Fee 204H wells (“Wells”). 3. 22184 Application of Ascent Energy, LLC, for a Horizontal Spacing and Proration Unit and Compulsory Pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order from the Division: (1) creating a standard 640-acre, more or less, horizontal spacing and proration unit comprised of the N/2 of Sections 20 and 21, Township 22 South, Range 27 East, NMPM, Eddy County, New Mexico, and (2) pooling all mineral interests in the Bone Spring formation, an oil pool, underlying the unit. The proposed wells to be dedicated to the horizontal spacing unit are the Hokie Fee 601H Well, an oil well, to be horizontally drilled from a surface location in SE/4 NE/4 (Unit H) of Section 21 to a bottom hole location in NW/4 NW/4 (Unit D) of Section 20; and the Hokie Fee No. 602H Well, an oil well, to be horizontally drilled from a surface location in SE/4 NE/4 (Unit H) of Section 21 to a bottom hole location in SW/4 NW/4 (Unit E) of Section 20. The well locations are orthodox, and the completed well intervals and take points will comply Statewide rules for setbacks; also to be considered will be the cost of drilling and completing the wells and the allocation of the costs thereof; actual operating costs and charges for supervision; the designation of the Applicant as Operator of the wells and unit; and a 200% charge for the risk involved in drilling and completing the wells. The wells and lands are located approximately 1 mile southeast of Carlsbad, New Mexico.
4. 21565 Application of Caza Petroleum, LLC for compulsory pooling, Lea County, New Mexico. Caza Petroleum, LLC seeks an order pooling all mineral interests in the Bone Spring formation (limited to depths from the top of the Bone Spring formation to the base of the First Bone Spring) underlying a (proximity tract) horizontal spacing unit comprised of the E/2 of Section 27 and the E/2 of Section 34, Township 21 South, Range 34 East, NMPM, Lea County, New Mexico. The unit will be dedicated to the following wells:
(a)    The Caza Gramma 27-34 State Well No. 6H, to be drilled to a depth sufficient to test the Avalon Bone Spring; and
(b)    The Caza Gramma 27-34 State Well No. 7H, to be drilled to a depth sufficient to test the First Bone Spring.
The above two wells will have first take points in the NW/4NE/4 of Section 27 and last take points in the SW/4SE/4 of Section34.
(c)    The Caza Gramma 27-34 State Well No. 9H, to be drilled to a depth sufficient to test the First Bone Spring; and
(d)    The Caza Gramma 27-34 State Well No. 10H, to be drilled to a depth sufficient to test the Avalon Bone Spring.
The above two wells will have first take points in the NE/4NE/4 of Section 27 and last take points in the SE/4SE/4 of Section34.
(e)    The Caza Gramma 27-34 State Well No. 8H, to be drilled to a depth sufficient to test the Avalon Bone Spring.
The well has first and last take points approximately 1320 feet from the East lines of Sections 27 and 34.
Also to be considered will be the cost of drilling and completing the wells and the allocation of the cost thereof, as well as actual operating costs and charges for supervision, designation of Caza Operating, LLC as operator of the well, and a 200% charge for risk involved in drilling, completing, and equipping the wells. The unit is located approximately 12 miles west-southwest of Oil Center, New Mexico.
5. 22048 Application of Caza Petroleum, LLC and Caza Operating, LLC for approval of an overlapping spacing unit in the Bone Spring formation and to allow two operators in a certain well unit, Lea County, New Mexico. Caza Petroleum, LLC and Caza Operating, LLC seek approval of an overlapping spacing unit in the Bone Spring formation (limited to depths from the top of the Bone Spring formation to the base of the First Bone Spring) in a (proximity tract) horizontal spacing unit comprised of the E/2 of Section 27 and the E/2 of Section 34, Township 21 South, Range 34 East, NMPM, Lea County, New Mexico, for purposes of drilling its proposed Caza Gramma 27-34 State Wells. Caza Operating, LLC also requests that it be approved as operator of Bone Spring wells, limited to the above stated depths, in the E/2 of Section 34. The well unit is located approximately 12 miles west-southwest of Oil Center, New Mexico.
6. 22206 Application of Centennial Resource Production, LLC for compulsory pooling, Lea County, New Mexico. Applicant in the above-styled cause seeks an order pooling all uncommitted interests in the Bone Spring formation underlying a standard 240-acre, more or less, horizontal spacing unit comprised of the W/2 E/2 of Section 22, and the W/2 NE/4 of Section 27, Township 24 South, Range 34 East, NMPM, Lea County, New Mexico. Said horizontal spacing unit is to be dedicated to the proposed initial Solomon Fed Com #505H well, to be horizontally drilled from a surface location in the SW/4 NE/4 (Unit H) of Section 27, to a bottom hole location in the NW/4 NE/4 (Unit B) of Section 22. The completed interval of the Solomon Fed Com #505H well will remain within 330 feet of the quarter-quarter line separating the W/2 E/2 from the E/2 E/2 of Section 22, and the E/2 NE/4 from the W/2 NE/4 of Section 27, to allow inclusion of this acreage into a standard horizontal well spacing unit. Also to be considered will be the cost of drilling and completing the well and the allocation of the cost thereof, the actual operating costs and charges for supervision, the designation of applicant as operator of the well, and a 200% charge for risk involved in drilling said well. 7. 22173 Application of Chisholm Energy Operating, LLC for compulsory pooling, Lea County, New Mexico. Applicant in the above-styled cause seeks an order pooling all uncommitted interest owners in the Bone Spring formation underlying a standard 280-acre, more or less, horizontal spacing unit comprised of the SW/4 NW/4 and the W/2 SW/4 of Section 5 and the W/2 W/2 of Section 8, Township 19 South, Range 33 East, NMPM, Lea County, New Mexico. The above-referenced unit will be dedicated to the proposed initial Ram 2-11 Fed 1BS Com #10H well to be horizontally drilled from a surface location in the NE/4 NE/4 (Lot 1) of Section 2 to a bottom hole location in the SW/4 SE/4 (Lot O) of Section 11. The completed interval of the proposed well will comply with Statewide setbacks for oil wells. 10. 22145 Application of Cimarex Energy Co. for a Horizontal Spacing and Proration Unit and Compulsory Pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order from the Division: (1) creating a standard 320-acre, more or less, spacing and proration unit comprised of the N/2 S/2 of Sections 16 and 17, Township 19 South, Range 29 East, NMPM, Eddy County, New Mexico, and (2) pooling all mineral interests in the Bone Spring formation underlying the unit. The proposed well to be dedicated to the horizontal spacing unit is the Parkway 16-17 State Com 3H Well, an oil well, to be horizontally drilled from a surface location in NW/4 SW/4 (Unit L) of Section 15 to a bottom hole location in the NW/4 SW/4 (Unit L) of Section 17. The well will be orthodox, and the take points and completed interval will comply with the setback requirements under the statewide Rules; also to be considered will be the cost of drilling and completing the well and the allocation of the costs thereof; actual operating costs and charges for supervision; the designation of the Applicant as Operator of the well and unit; and a 200% charge for the risk involved in drilling and completing the well. The well and lands are located approximately 2.5 miles southeast of Artesia, New Mexico.
11. 22146 Application of Cimarex Energy Co. for a Horizontal Spacing and Proration Unit and Compulsory Pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order from the Division: (1) creating a standard 160-acre, more or less, spacing and proration unit comprised of the S/2 S/2 of Section 16, Township 19 South, Range 29 East, NMPM, Eddy County, New Mexico, and (2) pooling all mineral interests in the Bone Spring formation underlying the unit. The proposed well to be dedicated to the horizontal spacing unit is the Parkway 16 State Com 4H Well, an oil well, to be horizontally drilled from a surface location in NW/4 SW/4 (Unit L) of Section 15 to a bottom hole location in the SW/4 SW/4 (Unit M) of Section 16. The well will be orthodox, and the take points and completed interval will comply with the setback requirements under the statewide Rules; also to be considered will be the cost of drilling and completing the well and the allocation of the costs thereof; actual operating costs and charges for supervision; the designation of the Applicant as Operator of the well and unit; and a 200% charge for the risk involved in drilling and completing the well. Applicant in the above-styled cause seeks an order from the Division pooling all uncommitted interest owners in the Wolfcamp formation, Purple Sage-Wolfcamp Gas Pool (Pool code 98220), underlying a standard 640-acre, more or less, horizontal spacing unit comprised of the E/2 of Section 2, Township 26 South, Range 28 East, and the E/2 of Section 35, Township 25 South, Range 28 East, NMPM, Eddy County, New Mexico. COG Operating LLC seeks to dedicate the above-referenced horizontal spacing unit to the following proposed wells:
•    The Dolores Fed Com 701H well to be horizontally drilled from a surface hole location in the SE/4SE/4 (Unit P) of Section 2 to a bottom hole location in the NE/4NE/4 (Unit A) of Section 35,
•    The Dolores Fed Com 702H well to be horizontally drilled from a surface hole location in the SW/4SE/4 (Unit O) of Section 2 to a bottom hole location in the NW/4NE/4 (Unit B) of Section 35, and
•    The Dolores Fed Com 703H well to be horizontally drilled from a surface hole location in the SW/4SE/4 (Unit O) of Section 2 to a bottom hole location in the NW/4NE/4 (Unit B) of Section 35.
Also, to be considered will be the allocation of the cost thereof, the actual operating costs and charges for supervision, the designation of COG Operating LLC as operator of the wells, and the imposition of 200% charge for risk involved in drilling and completing said wells. The 332H Well is the proximity well, and proximity tracts will be utilized for the unit. The wells are orthodox in location and the take points and laterals comply with Statewide Rules for setbacks; also to be considered will be the cost of drilling and completing the wells and the allocation of the costs thereof; actual operating costs and charges for supervision; the designation of the Applicant as Operator of the wells and unit; and a 200% charge for the risk involved in drilling and completing the wells. Applicant in the above-styled cause seeks an order rescinding approval of Administrative Order NSL-8185 for the Bonzo Federal Com 1924 CDX #006H well (the “Bonzo NSL”) issued to Longfellow Energy, L.P. (“Longfellow”) on June 23, 2021. The first take point will be located approximately 155 feet FSL and 100 feet FEL of said Section 19, and the last take point will be located approximately 142 feet FSL and 2535 feet FEL of Section 24, all in Township 17 South, Range 28 East, NMPM, Eddy County, New Mexico. The completed lateral will be located approximately 142 feet from the south boundary of the proposed horizontal spacing unit, which constitutes an unorthodox location because it is closer than the 330-foot setback allowed for oil wells. Spur is an affected party in adjacent Sections 25 and 30 and objects to the non-standard location because the proposed location of the completed lateral, 142 feet from the south boundary of the spacing unit, will impair Spur’s correlative rights in Sections 25 and 30. Said area is located approximately 12 miles east of Artesia, New Mexico.
