PRELIMINARY DOCKET: Examiner Hearing for Thursday, March 4, 2021

Applications for hearing shall be filed at least thirty (30) days in advance of the hearing date. A party who intends to present evidence shall file a pre-hearing statement no later than the close of business on the Thursday prior to the hearing date and serve a copy on the other parties, if any. The hearing examiner will dismiss the application if the applicant does not file and serve a pre-hearing statement as specified above. A party desiring to use projection equipment at the hearing shall contact Florene Davidson, OCD Clerk, no later than seven (7) business days prior to the hearing.

The above-referenced unit will be dedicated to the following proposed initial wells: (1) the Colonel R. The completed interval of the well will comply with the setback requirements of the Special Rules for the Purple Sage Wolfcamp Pool. Said area is located approximately 8 miles south of Carlsbad, New Mexico.
2. 21651 Application of Longfellow Energy, LP for Compulsory Pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order from the Division pooling all uncommitted interests in the Yeso formation (Empire; Glorieta-Yeso [96210]) in a standard 480-acre, more or less, horizontal spacing and proration unit (“HSU”) comprised of the NE/4 of Section 14 and the N/2 of Section 13, all within Township 17 South, Range 28 East, NMPM, in Eddy County, New Mexico. Applicant proposes to drill the following wells: (1) Hendrix State Com 1314 ABX 001H well, to be horizontally drilled from an approximate surface hole location 361’ FNL and 2400’ FEL of Section 14, T17S-R28E, to an approximate bottom hole location 347’ FNL and 20’ FEL of Section 13, T17S-R28E; (2) Hendrix State Com 1314 ABX 002H well, to be horizontally drilled from an approximate surface hole location 386’ FNL and 2400’ FEL of Section 14, T17S-R28E, to an approximate bottom hole location 800’ FNL and 20’ FEL of Section 13, T17S-R28E; (3) Hendrix State Com 1314 ABX 003H well, to be horizontally drilled from an approximate surface hole location 1703’ FNL and 2428’ FEL of Section 14, T17S-R28E, to an approximate bottom hole location 1254’ FNL and 20’ FEL of Section 13, T17S-R28E; (4) Hendrix State Com 1314 ABX 004H well, to be horizontally drilled from an approximate surface hole location 1728’ FNL and 2428’ FEL of Section 14, T17S-R28E, to an approximate bottom hole location 1708’ FNL and 20’ FEL of Section 13, T17S-R28E; and (5) Hendrix State Com 1314 ABX 005H well, to be horizontally drilled from an approximate surface hole location 1753’ FNL and 2428’ FEL of Section 14, T17S-R28E, to an approximate bottom hole location 2161’ FNL and 20’ FEL of Section 13, T17S-R28E. The completed intervals and first and last take points for these wells will meet statewide setback requirements for horizontal wells. The wells and lands are located approximately 9 miles west of Loco Hills, New Mexico.
3. 21653 Application of Spur Energy Partners, LLC for Compulsory Pooling, Eddy County, New Mexico. Applicant seeks an order pooling all uncommitted mineral interests in the Yeso formation in a 320-acre, more or less, standard (proximity tract) horizontal spacing unit comprised of the S/2 of Section 12, Township 17 South, Range 29 East in Eddy County, New Mexico. The completed intervals of the wells will be orthodox. Also to be considered will be the cost of drilling and completing the wells and the allocation of the cost, the designation of Spur Energy Partners, LLC as the operator of the wells, and a 200% charge for the risk involved in drilling and completing the wells. The wells are located approximately 3 miles northwest of Loco Hills, New Mexico.
4. 21654 Application of COG Operating LLC for compulsory pooling, Lea County, New Mexico. Applicant in the above-styled cause seeks an order pooling all uncommitted interests in the Bone Spring formation, WC-025 G-07 S243517D; MIDDLE BONE SPRING [98294], underlying a standard 320-acre, more or less, horizontal spacing unit comprised of the W/2W/2 of Sections 28 and 33, Township 24 South, Range 35 East, NMPM, Lea County, New Mexico. 15. 21666 Application of Chevron Production Company to Amend Order No. R-21229, Eddy County, New Mexico. Applicant in the above-styled cause seeks to amend Order No. R-21229 to allow for a year extension of the time for completing the CB CAL 25 36 State Com 08 #303H Well. The Unit in this case is comprised of the E/2 W/2 of Sections 25 and 36, Township 23 South, Range 28 East, NMPM, Eddy County, New Mexico. Order No. R-21229 pooled the uncommitted interests in the Bone Spring formation and dedicated the Unit to: (1) the CB CAL 25 36 State Com 08 #301H Well, and (2) the CB CAL 25 36 State Com 08 #303H Well. Said area is located approximately 3 miles southeast of Loving, New Mexico.
16. 21667 Application of COG Operating LLC for compulsory pooling, Eddy County, New Mexico. Applicant in the above-styled causes seeks an order pooling all uncommitted interests in the Wolfcamp formation, Purple Sage Wolfcamp Gas Pool (98220), underlying a standard 640-acre, more or less, horizontal spacing unit comprised of E/2 of Sections 7 and 18, Township 26 South, Range 28 East, NMPM, Eddy County, New Mexico. COG Operating LLC seeks to dedicate the above-referenced horizontal spacing unit to the following proposed wells:

Applicant in the above-styled causes seeks an order pooling all uncommitted interests in the Wolfcamp formation, Purple Sage Wolfcamp Gas Pool (98220), underlying a standard 958.16-acre, more or less, horizontal spacing unit comprised of Lots 1, 2, 3, 4, and the E/2W/2 of Sections 6, 7, and 18, Township 26 South, Range 28 East, NMPM, Eddy County, New Mexico. COG Operating LLC seeks to dedicate the above-referenced horizontal spacing unit to the following proposed wells:
• The Mercury State Com 704H well to be horizontally drilled from a surface hole location in the SE/4SW/4 (Unit N) of Section 18 to a bottom hole location in the NE/4NW/4 (Unit C) of Section 6,
• The Mercury State Com 705H well to be horizontally drilled from a surface hole location in the SE/4SW/4 (Unit N) of Section 18 to a bottom hole location in the NW/4NW/4 (Lot 1) of Section 6, and
• The Mercury State Com 706H well to be horizontally drilled from a surface hole location in the SE/4SW/4 (Unit N) of Section 18 to a bottom hole location in the NW/4NW/4 (Lot 1) of Section 6.

18. 21670 Application of EOG Resources, Inc. for compulsory pooling, Lea County, New Mexico. Applicant in the above-styled cause seeks an order pooling all uncommitted interest owners in the Bone Spring formation underlying a standard 320-acre, more or less, horizontal spacing unit comprised of the W/2 of Section 21, Township 24 South, Range 34 East, NMPM, Lea County, New Mexico. Applicant seeks to dedicate the above-referenced horizontal spacing unit to the to the following proposed wells:
•    The Galleon 21 Fed #301H well and the Galleon 21 Fed #302H well to be drilled from a common surface hole location in SW/4 SW/4 (Unit M) of said Section 21 to bottom hole locations in the NW/4 NW/4 (Unit D) of said Section 21; and
•    The Galleon 21 Fed #303H well, to be drilled from a surface hole location in SW/4 SW/4 (Unit M) of said Section 21 to bottom hole locations in the NE/4 NW/4 (Unit C) of said Section 21.
The completed interval for the proposed Galleon 21 Fed #302H well will remain within 330 feet of the quarter-quarter line separating the W/2 W/2 from the E/2 W/2 of Section 21 to allow inclusion of this acreage into a standard 320-acre horizontal well spacing unit. Also, to be considered will be the cost of drilling and completing the wells, the allocation of the cost thereof, the actual operating costs and charges for supervision, the designation of applicant as operator, and the imposition of 200% charge for risk involved in drilling and completing each well. Said area is located approximately 17 miles southeast of Galleon, New Mexico.
19. 21671 Application of Devon Energy Production Company, L.P. for compulsory pooling, Lea County, New Mexico. Applicant in the above-styled cause seeks an order pooling all uncommitted interest owners in the Wolfcamp formation underlying a 800-acre, more or less, horizontal spacing unit comprised of the E/2 of Sections 3 and 10, and the NE/4 of Section 15, Township 26 South, Range 34 East, NMPM, Lea County, New Mexico. Applicant seeks to dedicate the above-referenced horizontal spacing unit to the following proposed initial wells:
(1) The Blondie 15-3 Fed Com #6H well; and (2) the Blondie 15-3 Fed Com #7H well, which will be horizontally drilled from a common surface hole location in the SW/4 NE/4 (Unit G) of Section 15 to bottom hole locations in the NW/4 NE/4 (Unit B) of Section 3; and

The completed interval of the Blondie 15-3 Fed Com #11H well will remain within 330 feet of the quarter-quarter line separating the W/2 E/2 from the E/2 E/2 of Sections 3 and 10, and the W/2 NE/4 from the E/2 NE/4 of Section 15 to allow inclusion of these proximity tracts into a standard horizontal spacing unit. Also to be considered will be the cost of drilling and completing the well, the allocation of the costs thereof, the actual operating costs and charges for supervision, the designation of the Applicant as operator, and the imposition of a 200% charge for risk involved in drilling and completing the well. Applicant in the above-styled cause seeks to amend Order R-21562 to allow for a standard 800-acre, more or less, horizontal spacing unit comprised of the W/2 of Sections 3 and 10, and the NW/4 of Section 15, Township 26 South, Range 34 East, NMPM, Lea County, New Mexico. Applicant in the above-styled cause seeks an order from the Division for the limited purpose of pooling additional interest owners under the terms of Division Order No. R-21476 (“Order”). The Division entered the Order in Case No. 21424 on September 25, 2020, which created a 1280-acre, more or less, standard horizontal spacing unit comprised of all of Sections 17 and 20, Township 24 South, Range 28 East, Eddy County, New Mexico (“Unit”), and designated COG as the operator of the Unit. The Order further pooled all uncommitted interests within the Purple Sage Wolfcamp Gas Pool (Pool Code: 98220) underlying the Unit and dedicated the Unit to the Tomahawk WC Unit #709H, 710H, 711H, 712H, and 713H wells. COG has identified additional mineral interest owners in the Unit that have not been pooled under the terms of the Order. Flat Creek proposes the Thirteen Seconds 23 Fed-Fee 701H Well, to be horizontally drilled from a surface location in NW/4 NW/4 (Unit D) of Section 23 to a bottom hole location in the NE/4 NE/4 (Unit A) of Section 23; the Thirteen Seconds 23 Fed-Fee 702H Well, to be horizontally drilled from a surface location in NW/4 NW/4 (Unit D) of Section 23 to a bottom hole location in the SE/4 NE/4 (Unit H) of Section 23; and the Thirteen Seconds 23 Fed-Fee 703H Well, to be horizontally drilled from a surface location in the NW/4 SW/4 (Unit L) of Section 23 to a bottom hole location in the NE/4 SE/4 (Unit I) of Section 23. The completed intervals for the proposed wells will be nonstandard in relation to the setback requirements imposed by the Special Rules for the Purple Sage Gas Pool. Flat Creek will apply administratively for approval of the nonstandard location. Also to be considered will be the cost of drilling and completing the wells and the allocation of the costs thereof; actual operating costs and charges for supervision; the designation of the Applicant as Operator of the wells; and a 200% charge for the risk involved in drilling and completing the wells.
