PRELIMINARY DOCKET: Examiner Hearing for Thursday, May 6, 2021

Applications for hearing shall be filed at least thirty (30) days in advance of the hearing date. A party who intends to present evidence shall file a pre-hearing statement no later than the close of business on the Thursday prior to the hearing date and serve a copy on the other parties, if any. The hearing examiner will dismiss the application if the applicant does not file and serve a pre-hearing statement as specified above. 2. 21800 Application of Chisholm Energy Operating, LLC for compulsory pooling, Lea County, New Mexico. Applicant in the above-styled cause seeks an order pooling all uncommitted interest owners in the Bone Spring formation underlying a standard 320.03-acre, more or less, horizontal spacing unit comprised of the E/2 W/2 of Section 34, Township 19 South, Range 33 East, and the E/2 W/2 of Section 3, Township 20 South, Range 33 East, NMPM, Lea County, New Mexico. 3. 21835 Application of Mewbourne Oil Company to Pool Additional Interest Owners Under the Terms of Order No. R-21293, Lea County, New Mexico. Applicant seeks to pool additional interest owners under the terms of Oil Conservation Division Order No. R-21293, which created a 240-acre, more or less, standard horizontal spacing unit comprised of the E/2 E/2 of Section 26 and the E/2 SE/4 of Section 23, Township 21 South, Range 34 East in Lea County, New Mexico (“the Unit”) and designated Mewbourne as the operator of the Unit. Order No. R-21293 further pooled the uncommitted interests in the Bone Spring formation (Grama Ridge; Bone Spring NE Pool, Code 28435) and dedicated the Unit to the Inland 26/23 B2PI State Com #1H well, to be horizontally drilled from a surface location in Unit P in Section 26 to a bottom hole location in Unit I in Section 23, Township 21 South, Range 34 East. The well is located approximately 12.5 miles west of Eunice, New Mexico.
4. 21837 Application of Apache Corporation for compulsory pooling, Eddy County, New Mexico. Applicant seeks an order from the Division: (1) to the extent necessary, approving the creation of a 320-acre, more or less, Bone Spring standard horizontal spacing unit; and, (2) pooling all uncommitted mineral interests within a Bone Spring standard horizontal spacing unit underlying the N/2 N/2 of Sections 25 and 26, Township 19 South, Range 27 East, NMPM, Eddy County, New Mexico. This standard spacing unit will be dedicated to the Camacho 25-26 State Com 201H and Camacho 25-26 State Com 301H wells, to be horizontally drilled. The producing intervals for these wells will be orthodox. 8. 21841 Application of Steward Energy II, LLC for compulsory pooling, Lea County, New Mexico. Applicant applies for an order pooling all uncommitted mineral interests in the San Andres formation in a 480-acre, more or less, standard (proximity tract) horizontal spacing unit comprised of the SW/4 of Section 11 and the W/2 of Section 14, Township 13 South, Range 38 East in Lea County, New Mexico. The horizontal spacing unit will be dedicated to the Gustavo Fee #5H well, which will be horizontally drilled from a surface location in the NW/4NW/4 (Unit F) of Section 23 to a bottom hole location in NW/4SW/4 (Unit J) of Section 11, Township 13 South, Range 38 East. The completed interval of the well will be orthodox. Also to be considered will be the cost of drilling and completing the well and the allocation of the cost, the designation of Steward Energy II, LLC as the operator of the well, and a 200% charge for the risk involved in drilling and completing the well. The well location is approximately fourteen (14) miles east of McDonald, New Mexico.
9. 21843 (Re-Open) Application of Chevron U.S.A. Inc. to Amend Order No. R-20859, Lea County, New Mexico. Applicant in the above-styled cause seeks an order amending Order No. R-20859, issued on September 13, 2019, to retroactively extend the deadline for completing the initial wells for one year to February 1, 2022. Order No. R-20859 pooled all mineral interests in the Bone Spring formation in a horizontal spacing unit comprised of the E/2 of Section 9 and E/2 of Section 16, Township 22 South, Range 33 East, NMPM, Lea County, New Mexico, and requires that operator commence completion operations on at least one of the wells within one year after commencement of drilling operations unless the operator obtains an extension from the Division Director for good cause shown. The three initial wells, the DL 9 16 Loch Ness Fed Com 16H well, the DL 9 16 Loch Ness Fed Com 17H well and the DL 9 16 Loch Ness Fed Com 18H well, were commenced on February 1, 6 and 8, 2020, respectively, and successfully drilled to planned total depth. The unit is located approximately 21 miles northwest of Jal, New Mexico.
10. 21844 (Re-Open) Application of Chevron U.S.A. Inc. to Amend Order No. R-21409, Lea County, New Mexico. Applicant in the above-styled cause seeks an order amending Order No. R-21409, issued on July 29, 2020, to extend the deadline to commence drilling the initial wells for two years to July 29, 2023. Order No. R-21409 pooled all mineral interests in the Bone Spring formation in a horizontal spacing unit comprised of the E/2 of Section 3 and E/2 of Section 10, Township 22 South, Range 33 East, NMPM, Lea County, New Mexico, and requires that operator commence drilling operations within one year after the date of the order unless the operator obtains an extension by amending the order for good cause shown. The initial wells to be drilled within the unit are: (1) the DL 10 3 Morag Fed Com 210H well; (2) the DL 10 3 Morag Fed Com 211H well; (3) the DL 10 3 Morag Fed Com 212H well; and (4) the DL 10 3 Morag Fed Com 506H well. The unit is located approximately 21 miles northwest of Jal, New Mexico.
11. 21845 (Re-Open) Application of Chevron U.S.A. Inc. to Amend Order No. R-21418, Lea County, New Mexico. Applicant in the above-styled cause seeks an order amending Order No. R-21418, issued on August 7, 2020, to extend the deadline to commence drilling the initial wells for one year to August 7, 2022. Order No. R-21418 pooled all mineral interests in the Bone Spring formation in a horizontal spacing unit comprised of the W/2 of Section 3 and W/2 of Section 10, Township 22 South, Range 33 East, NMPM, Lea County, New Mexico, and requires that operator commence drilling operations within one year after the date of the order unless the operator obtains an extension by amending the order for good cause shown. 14. 21848 Application of Spur Energy Partners, LLC for compulsory pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order pooling all uncommitted interests in the Yeso formation, underlying a standard 320-acre horizontal spacing unit comprised of the N/2 of Section 32, Township 17 South, Range 28 East, NMPM, Eddy County, New Mexico. Applicant proposes to dedicate the above-referenced spacing unit to the following wells:
•    The Blalock #1H well, the Blalock #11H well, the Blalock #51H well, the Blalock #71H well, the Blalock #91H well each of which will be horizontally drilled from a common surface location in the NE/4 NE/4 (Unit A) of Section 31, to bottom hole locations in the NE/4 NE/4 (Unit A) of Section 32; and

The completed intervals of the Blalock #30H well and the Blalock #91H well will remain within 330 feet of the quarter-quarter line separating the N/2 N/2 from the S/2 N/2 of Section 32 to allow inclusion of these proximity tracts into a standard horizontal spacing unit. Also, to be considered will be the cost of drilling and completing said wells and the allocation of the cost thereof, actual operating costs, charges for supervision, designation of applicant as operator of the wells, and a 200% charge for risk involved in drilling said wells. Applicant in the above-styled cause seeks to pool additional interests under the terms of Order No. R-21096. The Unit is comprised of the W/2 and E/2 of Section 12, Township 22 South, Range 26 East, and the W/2 and E/2 of Section 7, Township 22 South, Range 27 East, NMPM, Eddy County, New Mexico. Order No. R-21096 (and the pending Order from Case No. 21577) pooled the uncommitted interests in the Wolfcamp formation (Purple Sage; Wolfcamp Pool (Pool Code 98220)) and dedicated the Unit to the following Proposed Wells: (1) the Caveman #402H well (API No. 30-015-47629), and (2) the Caveman #442H well (formerly the Caveman 7 12 WCD #003H, sundry pending) (API No. 30-015-47689). Portions of said area are located within the city limits of Carlsbad, New Mexico.
22. 21856 Application of EOG Resources, Inc. for compulsory pooling, Lea County, New Mexico. Applicant in the above-styled cause seeks an order pooling all uncommitted interest owners in the Bone Spring formation underlying a standard 640-acre, more or less, horizontal spacing unit comprised of the E/2 of Sections 4 and 9, Township 25 South, Range 34 East, NMPM, Lea County, New Mexico. Applicant seeks to dedicate the above-referenced horizontal spacing unit to the to the following proposed wells:
•    The Holyfield 9 Fed Com #303H well (API No. 30-025-pending) to be drilled from a surface hole location in SW/4 SE/4 (Unit O) of said Section 9 to a bottom hole location in the NE/4 NE/4 (Unit A) of said Section 4; and

The completed interval for the proposed Holyfield 9 Fed Com #304H well will remain within 330 feet of the quarter-quarter line separating the E/2 E/2 from the W/2 E/2 of Sections 4 and 9 to allow inclusion of this acreage into a standard 640-acre horizontal well spacing unit. Also, to be considered will be the cost of drilling and completing the wells, the allocation of the cost thereof, the actual operating costs and charges for supervision, the designation of applicant as operator, and the imposition of 200% charge for risk involved in drilling and completing each well. Applicant in the above-styled cause seeks an order from the Division: (1) establishing a 320-acre, more or less, standard horizontal spacing and proration unit comprised of the N/2 of Section 23, Township 23 South, Range 27 East, NMPM, Eddy County, New Mexico and (2) pooling all mineral interests in the Wolfcamp formation, a gas field, underlying the unit. Said horizontal spacing unit is to be dedicated to two wells. Flat Creek proposes the Thirteen Seconds 23 Fed-Fee 701H Well, to be horizontally drilled from a surface location in NW/4 NW/4 (Unit D) of Section 23 to a bottom hole location in the NE/4 NE/4 (Unit A) of Section 23; and the Thirteen Seconds 23 Fed-Fee 702H Well, to be horizontally drilled from a surface location in NW/4 NW/4 (Unit D) of Section 23 to a bottom hole location in the SE/4 NE/4 (Unit H) of Section 23. The completed intervals for the proposed wells will be nonstandard in relation to the setback requirements imposed by the Special Rules for the Purple Sage Gas Pool. Flat Creek will apply administratively for approval of the nonstandard location. Applicant in the above-styled cause seeks an order pooling all uncommitted interest owners in the Bone Spring formation underlying a standard 320-acre, more or less, horizontal spacing unit comprised of the W/2 of Section 21, Township 24 South, Range 34 East, NMPM, Lea County, New Mexico. Applicant seeks to dedicate the above-referenced horizontal spacing unit to the to the following proposed wells:
•    The Galleon 21 Fed #301H well and the Galleon 21 Fed #302H well to be drilled from a common surface hole location in SW/4 SW/4 (Unit M) of said Section 21 to bottom hole locations in the NW/4 NW/4 (Unit D) of said Section 21; and
•    The Galleon 21 Fed #303H well, to be drilled from a surface hole location in SW/4 SW/4 (Unit M) of said Section 21 to bottom hole locations in the NE/4 NW/4 (Unit C) of said Section 21.
The completed interval for the proposed Galleon 21 Fed #302H well will remain within 330 feet of the quarter-quarter line separating the W/2 W/2 from the E/2 W/2 of Section 21 to allow inclusion of this acreage into a standard 320-acre horizontal well spacing unit. Also, to be considered will be the cost of drilling and completing the wells, the allocation of the cost thereof, the actual operating costs and charges for supervision, the designation of applicant as operator, and the imposition of 200% charge for risk involved in drilling and completing each well. Said area is located approximately 17 miles southeast of Galleon, New Mexico.
70. 21634 Application of Tamaroa Operating, LLC for Approval of a Non-Standard Spacing and Proration Unit and Compulsory Pooling, Chaves County, New Mexico. Applicant seeks an order: (1) approving an 80-acre, more or less, non-standard spacing and proration unit comprised of the NW/4 NW/4 of Section 29 and the NE/4 NE/4 of Section 30, Township 9 South, Range 29 East in Chaves County; and (2) pooling all uncommitted interests in all formations from the surface through the Devonian formation underlying the proposed non-standard spacing unit. Applicant proposes to dedicate the spacing unit to the Heritage Park #1 well, which will be vertically drilled from a surface location 660’ FNL and 10’ FEL in Section 30. The completed interval for the well will comply with the Division’s standard setback requirements. Applicant seeks an order approving a standard 40 acre spacing and proration unit comprised of the NW4/NW4 of Section 29, Township 9 South, Range 29 East dedicated to the Plainview 29 #1 well. The application requests pooling all uncommitted interests in all formations from the surface through the Devonian formation underlying the proposed unit; designating Plains Radio as the operator of the proposed unit; and denying the competing application filed by Tamaroa Operating, LLC currently pending in Case No. 21634 before the Division.
