PRELIMINARY DOCKET: Examiner Hearing for Thursday, December 1, 2022

Applications for hearing shall be filed at least thirty (30) days in advance of the hearing date. A party who intends to present evidence shall file a pre-hearing statement no later than the close of business on the Thursday prior to the hearing date and serve a copy on the other parties, if any. The hearing examiner will dismiss the application if the applicant does not file and serve a pre-hearing statement as specified above. 2. 21490 Application of Apache Corporation for compulsory pooling, Eddy County, New Mexico. 4. 21393 Application of Ascent Energy, LLC, for Compulsory Pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order from the Division: (1) establishing a 320-acre, more or less, horizontal spacing and proration unit comprised of the E/2W/2 of Sections 28 and 33, Township 20 South, Range 30 East, NMPM, Eddy County, New Mexico, and (2) pooling all mineral interests in the Bone Spring formation (WC-015 G-04 S203032P; BONE SPRING [Pool Code 98008]) underlying the unit. Said horizontal spacing unit is to be dedicated to three proposed wells, the Anvil Fed Com 502H Well, to be horizontally drilled from a surface location in NE/4 NE/4 (Lot 1) of Section 4, Township 21 South, 29 East, NMPM, to a bottom hole location in the NE/4 NW/4 (Unit C) of Section 28; the Anvil Fed Com 503H Well, to be horizontally drilled from a surface location in NE/4 NE/4 (Lot 1) of Section 4, Township 21 South, 29 East, NMPM, to a bottom hole location in the NE/4 NW/4 (Unit C) of Section 28; and the Anvil Fed Com 602H Well, to be horizontally drilled from a surface location in NE/4 NE/4 (Lot 1) of Section 4, Township 21 South, 29 East, NMPM, to a bottom hole location in the NE/4 NW/4 (Unit C) of Section 28. 6. 22871 Application of Chevron Production Company for compulsory pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order pooling all uncommitted interests in the Bone Spring formation, underlying a standard 320-acre horizontal spacing unit comprised of the E/2 W/2 of Sections 17 and 20, Township 25 South, Range 27 East, NMPM, Eddy County, New Mexico. The above-referenced unit will be initially dedicated to the proposed Wildcatter 17 20 Fed Com 47 2H well to be horizontally drilled from a surface hole location in the SW/4 SE/4 (Unit O) of Section 20 to a bottom hole location in the NE/4 NW/4 (Unit C) of Section 17. Also, to be considered will be the cost of drilling and completing the well, the allocation of the cost thereof, the operating costs and charges for supervision, the designation of applicant as operator, and a 200% charge for risk involved in drilling and completing the well. 7. 22872 Application of Chevron Production Company for compulsory pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order pooling all uncommitted interests in the Bone Spring formation, underlying a standard 640-acre horizontal spacing unit comprised of the E/2 of Sections 17 and 20, Township 25 South, Range 27 East, NMPM, Eddy County, New Mexico. The above-referenced unit will be initially dedicated to the proposed Wildcatter 17 20 Fed Com 47 3H and the Wildcatter 17 20 Fed Com 47 4H wells to be horizontally drilled from a surface hole location in the SW/4 SE/4 (Unit O) of Section 20 to bottom hole locations in the NW/4 NE/4 (Unit B) and the NE/4 NE/4 (Unit A), respectively, of Section 17. The completed interval for the Wildcatter 17 20 Fed Com 47 4H well is projected to be less than 330’ from the adjoining quarter-quarter section (or equivalent) tracts to allow inclusion of these proximity tracts within the proposed horizontal well spacing unit. 8. 23174 Application of Chevron U.S.A. Inc. for Authorization to Expand and Make Permanent its Closed Loop Gas Capture Injection Authority Initially Approved as a Pilot Project Under Order No. R-21336, Lea County, New Mexico. Applicant in the above-styled cause seeks an order authorizing it to expand and make permanent its Salado Draw closed loop gas capture injection in the Avalon shale interval within the Bone Spring formation that was previously approved as a pilot project in Case No. 21020 under Order No. R-21336 (the “pilot project”). Having completed the pilot project, Chevron now seeks authorization to enlarge the closed loop gas capture injection project area and for authorization to conduct periodic injection for an indefinite period of time. Applicant proposes to expand the closed loop gas capture injection project to create a 1,280-acre, more or less, project area comprising all of Sections 18 and 19 within Township 26 South, Range 33 East, NMPM, Lea County, New Mexico. Chevron seeks authority to use the following producing wells within the proposed expanded project area to occasionally inject produced gas into:

Chevron seeks authority to use these producing wells to occasionally inject produced gas into the Avalon shale interval within the Bone Spring formation [WC-025 G-06 S263319P; Bone Spring (Pool Code 97955)] at total vertical depths of between approximately 9,090 feet to 9,258 feet along the horizontal portion of each wellbore at surface injection pressures of no more than 1,250 psi. The proposed average injection rate for each well is 1.5 MMscfd with a maximum injection rate of 2.0 MMscfd during injection. The source of the produced gas will be the Bone Spring and Wolfcamp formations. The subject acreage is located approximately 25 miles southwest of Jal, New Mexico.
9. 23088 Application of Cimarex Energy Co. for compulsory pooling, approval of overlapping well units, and to allow two operators in a well unit, Eddy County, New Mexico. The well will have a target interval within the Bone Spring Quail Ridge Pool, drilled horizontally with a Total Vertical Depth of approximately 10,680 to a Measured Depth of approximately 19,125’. To be drilled from a proposed surface location for this well in the NE/4SW/4 of Section 21-19S-34E and a proposed bottom hole location in the NW/4NW/4 of Section 16-19S-R34E. The well will have a target interval within the Bone Spring Quail Ridge Pool, drilled horizontally with a Total Vertical Depth of approximately 9,530’ to a Measured Depth of approximately 17,975’. Mewbourne Oil Company seeks an order pooling all mineral interests in the Wolfcamp formation underlying a horizontal spacing unit comprised of the S/2 of Section 32 and the S/2 of Section 33, Township 23 South, Range 27 East, N.M.P.M., Eddy County, New Mexico The unit will be dedicated to
(a)    The Viper 32/33 W0LI State. Com. Well No. 1H, with a first take point in the NW/4SW/4 of Section 32 and a last take point in the NE/4SE/4 of Section 33;
(b)    The Viper 32/33 W0MP State Com. Well No. 1H, with a first take point in the SW/4SW/4 of Section 32 and a last take point in the SE/4SE/4 of Section 33; and
(c)    The Viper 32/33 W2MP State Com. Well No. 1H, with a first take point in the SW/4SW/4 of Section 32 and a last take point in the SE/4SE/4 of Section 33.

100. 23207 Application of Steward Energy II, LLC for Compulsory Pooling, Lea County, New Mexico. Applicant seeks an order pooling all uncommitted interests in the San Andres Formation underlying a 276.17-acre, more or less, standard horizontal spacing unit comprised of the W/2 SE/4, SW/4 NE/4, and Lots 1, 2, 5, 6, and 7 (E/2 equivalent) of irregular Section 2, Township 13 South, Range 38 East, Lea County, New Mexico (“Unit”). The Unit will be dedicated to the Wexler Fee 2H well (“Well”), which will be drilled from a surface hole location in the SE/4 NE/4 (Unit H) of Section 3, Township 13 South, Range 38 East, to a bottom hole location in the SE/4 SE/4 (Unit P) of Section 10, Township 13 South, Range 38 East. The completed interval of the Well will be orthodox. The completed interval of the Well will be located within 330’ of the quarter-quarter section line separating the W/2 SE/4 and E/2 SE/4 of Section 3 and the quarter-quarter section line separating the E/2 E/2 and W/2 E/2 of Section 10 to allow for the creation of a 480-acre standard horizontal spacing unit. Novo Oil & Gas Northern Delaware, LLC seeks an order from the Division pooling all uncommitted interests within a Bone Spring horizontal spacing unit underlying the W/2 of Sections 9 and 16, and the N/2 NW/4 of Section 21, Township 19 South, Range 30 East, N.M.P.M., Eddy County, New Mexico. The spacing unit will be dedicated to the Tickety Boo Fed Com 2109 121H, Tickety Boo Fed Com 2109 122H, Tickety Boo Fed Com 2109 123H, Tickety Boo Fed Com 2109 131H, Tickety Boo Fed Com 2109 132H, and Tickety Boo Fed Com 2109 133H wells, to be horizontally drilled. The wells will be drilled at orthodox locations. 106. 23213 Application of Headington Royalty Inc. for Unilateral Change in Operator for the Sunray State #2 Well or, in the Alternative, for an Order Requiring the Current Operator to Plug and Abandon the Well. Applicant Headington Royalty, Inc. seeks an order from the Division for unilateral change in operator from Northern Pacific Oil and Gas, Inc., OGRID No. 330352 (“Northern Pacific”), to Applicant, OGRID No. 330830, for the Sunray State #2 well, API# 30-005-21036, located in the SE/4 NW/4 of Section 16, Township 8 South, Range 31 East, for the purpose of plugging the well due to expiration of the underlying lease. 108. 23215 Application of Spur Energy Partners LLC to Pool Additional Interests Under Order No. R-22273, Eddy County, New Mexico. Applicant seeks an order pooling additional uncommitted interests under the terms of Division Order No. R-22273. Order No R-22273 (“Order”) pooled all uncommitted interest from the top of the Yeso formation to a depth of approximately 4,100’ (Artesia; Glorieta-Yeso Pool, Code 96830) underlying a 320-acre, more or less, overlapping spacing unit comprised of the N/2 of Section 32, Township 17 South, Range 28 East, NMPM, Eddy County, New Mexico (“Unit”). The Order further dedicated the Unit to the Blalock 32 State Com #1H, Blalock 32 State Com #10H, and Blalock 32 State Com #11H wells (“Wells”) and designated Applicant as operator of the Unit and the Wells. Since entry of the Order, Applicant has identified additional interests in the Unit that should be pooled under the terms of the Order. The Wells are located approximately 13 miles south of Artesia, New Mexico.
109. 23216 Application of Spur Energy Partners LLC to Pool Additional Interests Under Order No. R-22274, Eddy County, New Mexico. Applicant seeks an order pooling additional uncommitted interests under the terms of Division Order No. R-22274. Order No R-22274 (“Order”) pooled all uncommitted interest in the Yeso formation from a depth of approximately 4,130’ to the base of the Yeso formation (Artesia; Glorieta-Yeso Pool, Code 96830) underlying a 320-acre, more or less, overlapping spacing unit comprised of the N/2 of Section 32, Township 17 South, Range 28 East, NMPM, Eddy County, New Mexico (“Unit”). The Order further dedicated the Unit to the Blalock 32 State Com #50H; Blalock 32 State Com #70H; and Blalock 32 State Com #90H wells (“Wells”) and designated Applicant as operator of the Unit and the Wells. Since entry of the Order, Applicant has identified additional interests in the Unit that should be pooled under the terms of the Order. The Wells are located approximately 13 miles south of Artesia, New Mexico.
110. 23217 Application of Matador Production Company to Amend Order No. R-21546-A, Lea County, New Mexico. Applicant in the above-styled cause seeks a year extension of time for drilling the well under Order No. R-21546-A. The Unit is comprised of the W/2 W/2 of Sections 4 and 9, Township 20 South, Range 33 East, NMPM, Lea County, New Mexico. Order No. R-21546 pooled the uncommitted interests in the Bone Spring formation and dedicated the Unit to the proposed:
•    Silver Fed Com #501H (API No. 30-025-48804) and Silver Fed Com #601H (API No. 30-025-48805) wells to be horizontally drilled from a surface location in the SW/4 SW/4 (Unit M) of Section 9, to a bottom hole location in the NW/4 NW/4 (Unit D) of Section 4; and
•    Silver Fed Com #502H (API No. 30-025-48924) well to be horizontally drilled from a surface location in the SE/4 SW/4 (Unit N) of Section 9, to a bottom hole location in the NW/4 NW/4 (Unit D) of Section 4.
Said area is located 31 miles southwest of Hobbs, New Mexico.
