PRELIMINARY DOCKET: Examiner Hearing for Thursday, December 2, 2021

Applications for hearing shall be filed at least thirty (30) days in advance of the hearing date. A party who intends to present evidence shall file a pre-hearing statement no later than the close of business on the Thursday prior to the hearing date and serve a copy on the other parties, if any. The hearing examiner will dismiss the application if the applicant does not file and serve a pre-hearing statement as specified above. A party desiring to use projection equipment at the hearing shall contact Florene Davidson, OCD Clerk, no later than seven (7) business days prior to the hearing.

NOTICE: The hearing examiner may call the following cases in any order in his or her discretion.

1. 21565 Application of Caza Petroleum, LLC for compulsory pooling, Lea County, New Mexico. Caza Petroleum, LLC seeks an order pooling all mineral interests in the Bone Spring formation (limited to depths from the top of the Bone Spring formation to the base of the First Bone Spring) underlying a (proximity tract) horizontal spacing unit comprised of the E/2 of Section 27 and the E/2 of Section 34, Township 21 South, Range 34 East, NMPM, Lea County, New Mexico. The unit will be dedicated to the following wells:
(a)    The Caza Gramma 27-34 State Well No. 6H, to be drilled to a depth sufficient to test the Avalon Bone Spring; and
(b)    The Caza Gramma 27-34 State Well No. 7H, to be drilled to a depth sufficient to test the First Bone Spring.
The above two wells will have first take points in the NW/4NE/4 of Section 27 and last take points in the SW/4SE/4 of Section34.
(c)    The Caza Gramma 27-34 State Well No. 9H, to be drilled to a depth sufficient to test the First Bone Spring; and
(d)    The Caza Gramma 27-34 State Well No. 10H, to be drilled to a depth sufficient to test the Avalon Bone Spring.
The above two wells will have first take points in the NE/4NE/4 of Section 27 and last take points in the SE/4SE/4 of Section34.
(e)    The Caza Gramma 27-34 State Well No. 8H, to be drilled to a depth sufficient to test the Avalon Bone Spring.
The well has first and last take points approximately 1320 feet from the East lines of Sections 27 and 34.
Also to be considered will be the cost of drilling and completing the wells and the allocation of the cost thereof, as well as actual operating costs and charges for supervision, designation of Caza Operating, LLC as operator of the well, and a 200% charge for risk involved in drilling, completing, and equipping the wells. The unit is located approximately 12 miles west-southwest of Oil Center, New Mexico.
2. 22048 Application of Caza Petroleum, LLC and Caza Operating, LLC for approval of an overlapping spacing unit in the Bone Spring formation and to allow two operators in a certain well unit, Lea County, New Mexico. Caza Petroleum, LLC and Caza Operating, LLC seek approval of an overlapping spacing unit in the Bone Spring formation (limited to depths from the top of the Bone Spring formation to the base of the First Bone Spring) in a (proximity tract) horizontal spacing unit comprised of the E/2 of Section 27 and the E/2 of Section 34, Township 21 South, Range 34 East, NMPM, Lea County, New Mexico, for purposes of drilling its proposed Caza Gramma 27-34 State Wells. Caza Operating, LLC also requests that it be approved as operator of Bone Spring wells, limited to the above stated depths, in the E/2 of Section 34. The well unit is located approximately 12 miles west-southwest of Oil Center, New Mexico.

Applicant in the above-styled cause seeks an order pooling all uncommitted interest owners in the Bone Spring formation underlying a standard 320-acre, more or less, horizontal spacing unit comprised of the N/2 N/2 of Sections 16 and 17, Township 19 South, Range 28 East, NMPM, Eddy County, New Mexico. It will have a TVD of approximately 7,450 feet and TMD of approximately 17, 500 feet, and will target the 2nd Bonespring Sand.

This proposed well is a horizontal well with a legal surface location in Units I/P of Section 16, T19S, R28E, and an intended legal bottom hole location in Unit M of Section 17, T19S, R28E, Eddy County, New Mexico. It will have a TVD of approximately 7,450 feet and TMD of approximately 17, 500 feet, and will target the 2nd Bonespring Sand.

This proposed well is a horizontal well with a legal surface location in Units I/P of Section 16, T19S, R28E, and an intended legal bottom hole location in Unit L of Section 17, T19S, R28E, Eddy County, New Mexico. It will have a TVD of approximately 8,600 feet and TMD of approximately 18,600 feet, and will target the 3rd Bonespring Sand.

Applicant in the above-styled cause seeks an order from the Division: (1) creating a standard 480-acre, more or less, horizontal spacing and proration unit comprised of the W/2 E/2 of Sections 8, 17, and 20, Township 25 South, Range 27 East, NMPM, Eddy County, New Mexico, and (2) pooling all mineral interests in the Bone Spring formation underlying the unit. 14. 22295 Application of Cimarex Energy Co. for a Horizontal Spacing and Proration Unit and Compulsory Pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order from the Division: (1) creating a standard 320-acre, more or less, horizontal spacing and proration unit comprised of the W/2 W/2 of Sections 29 and 32, Township 25 South, Range 27 East, NMPM, Eddy County, New Mexico, and (2) pooling all mineral interests in the Bone Spring formation, designated as an oil pool, underlying the unit. The proposed well to be dedicated to the horizontal spacing unit is the Southern Hills 32-29 State Fed Com 1H Well, an oil well, to be horizontally drilled from a surface location in the SE/4 SW/4 (Unit N) of Section 32 to a bottom hole location in the NW/4 NW/4 (Unit D) of Section 29. The well will be orthodox, and the take points and completed interval will comply with the setback requirements under the statewide Rules; also to be considered will be the cost of drilling and completing the well and the allocation of the costs thereof; actual operating costs and charges for supervision; the designation of the Applicant as Operator of the well and unit; and a 200% charge for the risk involved in drilling and completing the well. The well and lands are located approximately 3 miles south of Carlsbad, New Mexico, and 1 mile north of the state line.
15. 22297 Application of Cimarex Energy Co. for a Horizontal Spacing and Proration Unit and Compulsory Pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order from the Division: (1) creating a standard 640-acre, more or less, horizontal spacing and proration unit comprised of the W/2 of Sections 29 and 32, Township 25 South, Range 27 East, NMPM, Eddy County, New Mexico, and (2) pooling all mineral interests in the Wolfcamp formation, designated as a gas pool, underlying the unit. The proposed wells to be dedicated to the horizontal spacing unit are the Southern Hills 32-29 State Fed Com 3H Well to be horizontally drilled from a surface location in the SE/4 SW/4 (Unit N) of Section 32 to a bottom hole location in the NE/4 NW/4 (Unit C) of Section 29; and the Southern Hills 32-29 State Fed Com 4H Well to be horizontally drilled from a surface location in the SE/4 SW/4 (Unit N) of Section 32 to a bottom hole location in the NE/4 NW/4 (Unit C) of Section 29. The wells will be unorthodox in location, and the 100’ setback of the take points do not comply with the special field rules for the Purple Sage, Wolfcamp, pursuant to Order No. R-14262; Cimarex will be applying administratively to the NMOCD for approval of the non-standard locations; also to be considered is the approval, to the extent necessary, of an overlapping spacing unit involving the Cottonwood Hills 32 State Com (API No. 30-015-39967) in the W/2 of Section 32; the cost of drilling and completing the wells and the allocation of the costs thereof; actual operating costs and charges for supervision; the designation of the Applicant as Operator of the wells and unit; and a 200% charge for the risk involved in drilling and completing the wells. Order No. R-21853 pooled all uncommitted mineral interests in the Bone Spring formation underlying a 360-acre, more or less, standard horizontal spacing unit comprised of the SW/4NE/4 and W/2SE/4 of Section 13, W/2E/2 of Section 24, and W/2NE/4 of Section 25, Township 21 South, Range 32 East in Lea County, New Mexico and dedicated the unit to the Margarita Federal Com #15H, #5H, #6H, and #11H wells. The Orders designated Applicant as the operator of the units. Subsequent to the entry of the Orders, Applicant revised the proposed locations of the wells approved under the Orders and intends to include the Margarita Federal Com 13 #19H and #20H wells in its development plan. Accordingly, Applicant intends to dedicate the Unit to the following wells (“Wells”):
•    Margarita Federal Com 13 #5H, #6H, #11H, #15H and #19H wells to be horizontally drilled from a surface location in the SW/4NE/4 (Unit G) of Section 13 to a bottom hole location in the SW/4NE/4 (Unit G) of Section 25;

COG Operating, LLC (“COG”) seeks an order amending Order No. R-21473-A to extend the deadline to commence drilling operations to one year from the date an amended order is issued. The Division issued Order No. R-21473-A (“Order”) in Case No. 21622 on January 19, 2021, which approved a 640-acre, more or less, standard horizontal spacing unit (“Unit”) comprised of the W/2 of Sections 26 and 35, Township 23 South, Range 32 East, Lea County, New Mexico, and designated COG as the operator of the Unit. The Order further pooled all uncommitted interests within the Triste Draw, Bone Spring Pool (96603) underlying the Unit and dedicated the Unit to the Bedlington Federal Com #201H, 202H, 301H, 302H, 303H, 501H, 502H, and 503H wells (“Wells”). Applicant seeks an order: (1) removing Flare Oil Inc. as operator of record of the State IL Com #001 well; and (2) designating R&S as operator of record. R&S is a registered operator in good standing with the Oil Conservation Division (“Division”). R&S is record title owner of State Lease L0-4609-0001 (“Lease”) covering lands in Section 3 in Township 19 South, Range 24 East, which was terminated on May 21, 2019. Flare Oil Inc. As record title owner of the Lease, R&S intends to properly plug and abandon the Well. The Well is located approximately 14.4 miles southwest of Artesia, New Mexico.

Applicant in the above-styled cause seeks an order from the Division pooling all uncommitted mineral interests in the Yeso formation ([96210] EMPIRE, GLORIETA-YESO) in a standard 147.04-acre, more or less, horizontal spacing and proration unit (“HSU”) comprised of the S/2 S/2 of irregular Section 18, Township 17 South, Range 29 East in Eddy County, New Mexico. The first and last take points will meet the setback requirements set forth in the statewide rules for horizontal oil wells. Longfellow will be seeking administrative approval of a non-standard location for the Ozzy 18D 1H and 4H wells. The order pooled all uncommitted mineral interest owners in the Bone Spring formation underlying a horizontal spacing unit comprised of the E/2E/2 of Section 36 and E/2E/2 of Section 25, Township 23 South, Range 28 East, NMPM. The unit will be dedicated to the Ray State Com. 36 & 25-23S-28E Well No. 124H, with a first take point in the SE/4SE/4 of Section 36 and a final take point in the NE/4NE/4 of Section 25. The order required the well to be commenced by December 31, 2020. Applicant previously obtained an extension of the deadline to December 31, 2021. Due to market conditions and public health reasons commencement of the well was delayed, and applicant requests a second extension of the deadline to June 30, 2022. 77. 22357 Application of Manzano LLC for Approval of a Pressure Maintenance Project and Authorization to Inject, Lea County, New Mexico. Applicant seeks an order: (1) approving a pressure maintenance project for the injection of produced gas through the Vince BGH #1 well into the San Andres formation in a project area (“Project Area”) comprised of SE/4 of Section 30, Township 9 South, Range 35 East, NMPM, Eddy County, New Mexico; and (2) authorizing Manzano to convert the Vince BGH #1 well from a producing well to an injector. Applicant operates the following described wells within or near the Project Area:
•    the Sodbuster 21 Fee #4H (API 30-025-43704) with a surface hole location at 200 FSL, 1650 FWL of Section 21 and a bottom hole location at 330 FNL, 1650 FWL of Section 21;
•    the Rag Mama 30-19 Fee #1 (API 30-025-44067) with a surface hole location at 25 FSL, 528 FEL of Section 30 and a bottom hole location at 2303 FSL, 394 FEL of Section 19; and
•    The Vince BGH No. 1H (API No. 30-025-37104) located at 1980 FSL, 1750 FEL (Unit J) of Section 30.
The wells are currently producing from the Jenkins San Andres Pool (Pool No. 33950). Applicant proposes to convert its Vince BGH No. 1H well from a producer into an injection well for pressure maintenance operations. Applicant plans to inject produced gas from the Sodbuster 21 Fee #4 and Rag Mama 30-19 Fee #1 into the San Andres formation through a closed system using the Vince BGH No. 1H. Applicant does not anticipate compatibility issues. The injection interval of the Vince BGH No. 1H is 4840 feet to 4850 feet. Injection will provide pressure maintenance support for the Rag Mama 30 19 Fee #1 well and will also reduce flaring. The expected average injection rate of produced gas into the Vince BGH No. 1H is 150 MCFGPD. The expected maximum injection rate is 1,000 MCFGPD to provide Manzano the option to inject more gas as the GOR increases or if Manzano drills additional wells in the Jenkins San Andres Pool. The expected average injection pressure of produced gas into the Vince BGH No. 1H is 500 psi and the proposed maximum injection pressure is 950 psi. Applicant’s proposed pressure maintenance project can be conducted in a safe and responsible manner without causing waste, impairing correlative rights or endangering fresh water, public health or the environment. The wells are located approximately 3 miles west of Crossroads, New Mexico.

The above-referenced unit will be dedicated to the following proposed initial (1) Tom Matthews 10& 11 Com #113H well, and the (2) Tom Matthews 10& 11 Com #123H well, both of which are to be drilled from a surface location in the NE/4 SE/4 (Unit I) of Section 9, to a bottom hole location in the NE/4 SE/4 (Unit I) of said Section 11. The completed interval of the wells will comply with statewide setbacks for oil wells. Also to be considered will be the cost of drilling and completing the wells, the allocation of the cost thereof, as well as actual operating costs and charges for supervision, the designation of applicant as operator, and a 200% charge for risk involved in drilling and completing the wells.
