Date Detail
10/30/2025 Ensolum does not need to forego the 2-business day notification requirement to remove additional impacted soil and collect samples from the site to assess the presence or absence of remaining contaminants. The variance request is denied. Please fill out the C-141N on OCD Permitting and allow at least 2-business days’ notice before conduction closure sampling.
10/30/2025 The excavation at the San Juan 29-6 Unit 74B site began on Thursday October 23rd and continued until Monday October 27. We requested rush turnaround times for analytical results in order to make quick decisions on the need to continue excavating impacted material. We believe that a variance is needed in order to remove additional impacted soil and collect samples from the site to assess the presence or absence of remaining contaminant concentrations. The variance will be more protective of fresh water and the environment, as we will be able to remove impacted soil from the site sooner to prevent any potential migration of contaminants. Additionally, this is more protective to public health by removing contaminants that are now exposed to the air and allowing less restrictive access to the open excavation and impacted soil.
10/30/2025 Based on receipt of analytical results, we plan to continue digging impacted soil at the San Juan 29-6 Unit 74B site on Friday. As such, we are requesting a variance from the 2-business day sampling notification requirement outlined in 19.15.29.12(D)(1)(a) to allow soil sampling at the site on Friday October 31, 2025. 08/12/2025 The Remediation Plan is Conditionally Approved. The variance request to only collect confirmation soil samples from the remedial excavation for TPH and BTEX constituents is denied. All samples must be analyzed for all constituents listed in Table I of 19.15.29.12 NMAC. Floor confirmation samples should be delineated/excavated to meet closure criteria standards from Table 1 of the OCD Spill Rule for site assessment/characterization/proven depth to water determination. All sidewall samples should be taken from the sidewall of the excavation. Please make sure that the edge of the release extent is accurately defined. Sidewall/edge samples should be delineated/excavated to 600 mg/kg for chlorides and 100 mg/kg for TPH to define the edge of the release. Please collect confirmation samples, representing no more than 200 ft2. The work will need to be completed in 90 days after the report has been reviewed.

06/27/2025 Shelly Wells email response: As Hilcorp was told after the last extension request that a remediation plan and/or remediation closure report was due to the OCD Permitting Portal no later than July 3, 2025 and the reason provided for requiring more time to complete remediation activities does not demonstrate good cause, the extension request is denied. A remediation plan or remediation closure report is due to the OCD by 7/3/25.
06/27/2025 Extension request received and denied on 6/27/25. Email from Kate Kaufman: "Hilcorp Energy Company is submitting this request for a 60 - day extension to the reporting deadline for the San Juan 29-6 Unit 74B release. Hand auger, excavator pothole and hollow stem auger rig delineation activities have been performed at the Site, and we have completed the spill delineation. Hilcorp has been in discussion with the landowner about possible remediation techniques and has elected to excavate and haul impacted material offsite for disposal. Our ongoing discussions with the landowner and having crews dedicated to other remediation projects have led to delays in starting the excavation. I anticipate we will begin within 1-2 weeks and respectfully request an extension of the reporting deadline from July 3, 2025, to August 29, 2025."

04/04/2025 Hilcorp Energy Company is submitting this request for a 90-day extension to the reporting deadline for the San Juan 29-6 Unit 74B release. Hand auger and excavator pothole delineation activities have been performed at the Site but the lateral and vertical extent of impacts have not yet been fully delineated. A drill rig was utilized to continue delineation efforts on April 1 and we are waiting on sample results to determine next steps towards remediation. We respectfully request an extension of the reporting deadline from April 7, 2025 to July 6, 2025.
