Below is a preliminary list of cases scheduled to be heard at this OCC hearing. 1. 25006 Application of Franklin Mountain Energy 3, LLC for compulsory pooling and, to the extent necessary, approval of an overlapping spacing unit, Lea County, New Mexico. Applicant seeks an order from the Division pooling all uncommitted mineral interests within a 320-acre, more or less, Bone Spring horizontal spacing unit comprising the E/2 W/2 of Sections 20 and 29, Township 18 South, Range 35 East, N.M.P.M., Lea County, New Mexico. Franklin also seeks, to the extent necessary, approval of an overlapping spacing unit. This spacing unit will be dedicated to the Ball State Com 302H and Ball State Com 602H wells to be horizontally drilled from a surface hole location in the NE/4 NW/4 (Unit C) of Section 32 to a bottom hole location in the NE/4 NW/4 (Unit C) of Section 20. The producing area for the wells is expected to be orthodox. The proposed horizontal spacing unit will overlap with a 160-acre horizontal spacing unit comprised of the E/2 W/2 of Section 20 dedicated to COG Operating LLC’s Condor State #002H well (API 30-025-41025). Also to be considered will be the cost of drilling and completing said wells, the allocation of these costs as well as the actual operating costs and charges for supervision, designation of Franklin Mountain Energy 3, LLC as operator of the wells, and a 200% charge for risk involved in drilling said wells. Said area is located approximately 17
miles West of Hobbs, New Mexico.
2. 25007 Application of Franklin Mountain Energy 3, LLC for compulsory pooling, Lea County, New Mexico. Applicant seeks an order from the Division pooling all uncommitted mineral interests within a 320-acre, more or less, Wolfcamp horizontal spacing unit comprising the E/2 W/2 of Sections 20 and 29, Township 18 South, Range 35 East, N.M.P.M., Lea County, New Mexico. This spacing unit will be dedicated to the Ball State Com 702H and Ball State Com 802H wells to be horizontally drilled from a surface hole location in the NE/4 NW/4 (Unit C) of Section 32 to a bottom hole location in the NE/4 NW/4 (Unit C) of Section 20. The producing area for the wells is expected to be orthodox. Also to be considered will be the cost of drilling and completing said wells, the allocation of these costs as well as the actual operating costs and charges for supervision, designation of Franklin Mountain Energy 3, LLC as operator of the wells, and a 200% charge for risk involved in drilling said wells. Said area is located approximately 17 miles west of Hobbs, New Mexico.
3. 25008 Application of Franklin Mountain Energy 3, LLC for compulsory pooling and, to the extent necessary, approval of an overlapping spacing unit, Lea County, New Mexico. Applicant seeks an order from the Division pooling all uncommitted mineral interests within a 320-acre, more or less, Bone Spring horizontal spacing unit comprising the W/2 W/2 of Sections 20 and 29, Township 18 South, Range 35 East, N.M.P.M., Lea County, New Mexico. Franklin also seeks, to the extent necessary, approval of an overlapping spacing unit. This spacing unit will be dedicated to the Ball State Com 301H and Ball State Com 601H wells to be horizontally drilled from a surface hole location in the NW/4 NW/4 (Unit D) of Section 32 to a bottom hole location in the NW/4 NW/4 (Unit D) of Section 20. The producing area for the wells is expected to be orthodox. The proposed horizontal spacing unit will overlap with the following existing Bone Spring spacing units:
A 160-acre horizontal spacing unit comprised of the W/2 W/2 of Section 20 dedicated to COG Operating LLC’s Condor State #001H well (API 30-025-40814);
A 160-acre horizontal spacing unit comprised of the W/2 W/2 of Section 29 dedicated to Marathon Oil Permian LLC’s Nighthawk State Com #001H well (API 30-025-41519).
Also to be considered will be the cost of drilling and completing said wells, the allocation of these costs as well as the actual operating costs and charges for supervision, designation of Franklin Mountain Energy 3, LLC as operator of the wells, and a 200% charge for risk involved in drilling said wells. Said area is located approximately 17 miles West of Hobbs, New Mexico.
4. 25009 Application of Franklin Mountain Energy 3, LLC for compulsory pooling, Lea County, New Mexico. unit and compulsory pooling, Lea County, New Mexico. Applicant seeks an order from the
Division (1) approving a non-standard 640-acre spacing unit, and (2) pooling all uncommitted
mineral interests within a 640-acre, more or less, Bone Spring horizontal spacing unit comprised
of Section 13, Township 20 South, Range 33 East, N.M.P.M, Lea County, New Mexico. This
spacing unit will be dedicated to the Margie 13 Fed Com 201H, Margie 13 Fed Com 202H,
Margie 13 Fed Com 203H, Margie 13 Fed Com 204H, Margie 13 Fed Com 205H, Margie 13
Fed Com 206H, Margie 13 Fed Com 301H, Margie 13 Fed Com 302H, Margie 13 Fed Com
303H, Margie 13 Fed Com 304H, Margie 13 Fed Com 305H, Margie 13 Fed Com 501H,
Margie 13 Fed Com 502H, Margie 13 Fed Com 503H, Margie 13 Fed Com 504H, Margie 13

locations. Also to be considered will be the cost of drilling and completing said wells, the allocation
of these costs as well as the actual operating costs and charges for supervision, designation of
Avant Operating, LLC as operator of the wells, and a 200% charge for risk involved in drilling
said wells. Said area is located approximately 20 miles west-southwest of Monument, New
Mexico.
6. 24878 Application of Avant Operating, LLC for approval of a non-standard
unit and compulsory pooling, Lea County, New Mexico. Applicant seeks an order from the
Division (1) approving a non-standard 640-acre spacing unit, and (2) pooling all uncommitted
mineral interests within a 640-acre, more or less, Wolfcamp horizontal spacing unit comprised of
Section 13, Township 20 South, Range 33 East, N.M.P.M, Lea County, New Mexico. This spacing
unit will be dedicated to the Margie 13 Fed Com 751H, Margie 13 Fed Com 752H, Margie 13
Fed Com 753H, Margie 13 Fed Com 754H, and the Margie 13 Fed Com 755H wells to be
horizontally drilled. The wells will be drilled at orthodox locations. Also to be considered will be
the cost of drilling and completing said wells, the allocation of these costs as well as the actual
operating costs and charges for supervision, designation of Avant Operating, LLC as operator of
the wells, and a 200% charge for risk involved in drilling said wells. Said area is located
approximately 20 miles west-southwest of Monument, New Mexico.
