PRELIMINARY DOCKET: Examiner Hearing for October 31, 2024

Applications for hearing shall be filed at least thirty (30) days in advance of the hearing date. A party who intends to present evidence shall file a pre-hearing statement no later than the close of business on the Thursday prior to the hearing date and serve a copy on the other parties, if any. The hearing examiner will dismiss the application if the applicant does not file and serve a pre-hearing statement as specified above. A party desiring to use projection equipment at the hearing shall contact Florene Davidson, OCD Clerk, no later than seven (7) business days prior to the hearing.

The unit will be dedicated to (a) the Bond 33-34 Fed. Com. Well Nos. 104H, 105H, 207H, and 209H, with surface locations in the SW/4SW/4 of Section 33 and last take points in the NE/4SE/4 of Section 34, and (b) the Bond 33-34 Fed. Com. Well Nos. 106H and 211H, with surface locations in the SW/4SW/4 of Section 33 and last take points in the SE/4SE/4 of Section 34. Also to be considered will be the cost of drilling, completing, testing, and equipping the wells and the allocation of the cost thereof, as well as actual operating costs and charges for supervision, designation of applicant as operator of the wells, and a 200% charge for the risk involved in drilling, completing, testing, and equipping the wells. The unit is located approximately 10-1/2 miles south of Maljamar, New Mexico.
2. 24678 Application of Avant Operating, LLC for approval of a non-standard unit, compulsory pooling, and, to the extent necessary, approval of an overlapping spacing unit, Lea County, New Mexico. Applicant seeks an order from the Division (a) approving a non-standard 480-acre spacing unit; (b) pooling all uncommitted interests within a 480-acre, more or less, Bone Spring horizontal spacing unit comprised of the N/2 of Section 32 and the NW/4 of Section 33, Township 18 South, Range 32 East, N.M.P.M., Lea County, New Mexico; and (c) to the extent necessary, approving an overlapping spacing unit. This spacing unit will be dedicated to the Lobo Loco 34 Fed Com 303H, Lobo Loco 34 Fed Com 503H, and Lobo Loco 34 Fed Com 603H wells with proposed surface hole locations in the NE/NW (Unit C) of Section 34, Township 18 South, Range 32 East, and proposed last take points in the SW/NW (Unit E) of Section 32, Township 18 South, Range 32 East; and the Lobo Loco 34 Fed Com 301H, Lobo Loco 34 Fed Com 302H, Lobo Loco 34 Fed Com 501H, Lobo Loco 34 Fed Com 502H, Lobo Loco 34 Fed Com 601H,and Lobo Loco 34 Fed Com 602H wells with proposed surface hole locations in the NE/NW (Unit C) of Section 34, Township 18 South, Range 32 East, and proposed last take points in the NW/NW (Unit D) of Section 32, Township 18 South, Range 32 East. The wells will be drilled at orthodox locations. This proposed spacing unit will overlap the following existing spacing units operated by Raybaw Operating, LLC:
•    A 40-acre spacing unit comprised of the NE4NE4 of Section 32 dedicated to the Hulkster No. 4 (30-025-39571);
•    A 40-acre spacing unit comprised of the NW4NE4 of Section 32 dedicated to the Hulkster No. 3 (30-025-39570);
•    A 40-acre spacing unit comprised of the NE4NW4 of Section 32 dedicated to the N. Lusk 32 State No. 1 (30-025-35747);
•    A 40-acre spacing unit comprised of the NW4NW4 of Section 32 dedicated to the Hulkster No. 1 (30-025-38446);
•    A 40-acre spacing unit comprised of the SW4NW4 of Section 32 dedicated to the Hulkster No. 2 (30-025-38844);
•    A 40-acre spacing unit comprised of the SE4NW4 of Section 32 dedicated to the Watkins 32 State No. 1 (30-025-31735);

Also to be considered will be the cost of drilling and completing said wells, the allocation of these costs as well as the actual operating costs and charges for supervision, designation of Avant Operating, LLC as operator of the wells, and a 200% charge for risk involved in drilling said wells. Said area is located approximately 10 miles south of Maljamar, New Mexico.
3. 24886 Application of PBEX, LLC for Approval of an Overlapping Horizontal Well Spacing Unit and Compulsory Pooling, Lea County, New Mexico. Applicant in the above-styled cause seeks an order (a) approving a 800-acre, more or less, overlapping horizontal well spacing unit in the Bone Spring formation underlying the NE4 of Section 32, N2 of Section 33, and the N2 of Section 34, Township 18 South, Range 32 East, NMPM, Lea County, New Mexico, and (b) pooling the uncommitted mineral owners in this proposed spacing unit. Said unit will be initially dedicated to the following proposed wells:
•    The Bond 32-34 Fed Com 101H, Bond 32-34 Fed Com 102H, Bond 32-34 Fed Com 201H and Bond 32-34 Fed Com 203H to be drilled from a surface location in the NW4 of Section 32, with first take points in the NW4NE4 (Unit B) of Section 32 and last take points in the NE4NE4 (Unit A) of Section 34; and
•    The Bond 32-34 Fed Com 103H and Bond 32-34 Fed Com 205H to be drilled from the SE4 of Section 32, with first take points in the SW4NE4 (Unit G) of Section 32 and last take points in the SE4NE4 (Unit H) of Section 34.
The completed intervals of the Bond 32-34 Fed Com 102H and 203H wells are expected to remain within 330 feet of the offsetting quarter-quarter sections or equivalent tracts to allow inclusion of that acreage into a standard horizontal well spacing unit. This proposed horizontal well spacing unit will overlap the following existing spacing units in the Bone Spring formation:
•    A 40-acre vertical well spacing unit comprised of the SE4NW4 (Unit F) of Section 34 dedicated to the McKay West Fed 001 (API No. 30-025-24931), operated by RAYBAW Operating LLC in the Querecho Plains; Upper Bone Spring Pool [50600];
•    A 40-acre vertical well spacing unit comprised of the NW4NE4 (Unit B) of Section 32 dedicated to the Hulkster 003 (API No. 30-025-39570) operated by RAYBAW Operating LLC in the Lusk; Bone Spring, North Pool [41450];
•    A 40-acre vertical well spacing unit comprised of the NE4NE4 (Unit A) of Section 32 dedicated to the Hulkster 004 (API No. 30-025-39571) operated by RAYBAW Operating LLC in the Lusk; Bone Spring, North Pool [41450];
•    A 40-acre vertical well spacing unit comprised of the SE4NE4 (Unit H) of Section 32 dedicated to the Hulkster 005 (API No. 30-025-39572) operated by RAYBAW Operating LLC in the Lusk; Bone Spring, North Pool [41450]; and

Resources, Inc. as operator of the proposed spacing unit, and a 200% charge for risk involved in drilling said wells. The subject area is located approximately 10 miles south of Maljamar, New Mexico.
4. 24231 Application of Marathon Oil Permian LLC for Compulsory Pooling, and, to the Extent Necessary, Approval of an Overlapping Spacing Unit, Eddy County, New Mexico. Applicant seeks an order from the Division pooling all uncommitted mineral interests within a standard 960-acre, more or less, Bone Spring horizontal spacing unit underlying the S/2 of Sections 8 and 7, Township 23 South, Range 28 East, and the S/2 of Section 12, Township 23 South, Range 27 East, NMPM, Eddy County, New Mexico. This spacing unit will be dedicated to the Silver Snake Federal Com 301H and Silver Snake Federal Com 501H wells to be horizontally with first take points in the SE/4 SE/4 (Unit P) of Section 8 and last take points in the SW/4 SW/4 (Unit M) of Section 12; and the Silver Snake Federal Com 302H and Silver Snake Federal Com 502H wells to be horizontally drilled with first take points in the NE/4 SE/4 (Unit I) of Section 8 and last take points in the NW/4 SW/4 (Unit L) of Section 12. The producing area for the wells is expected to be orthodox. The completed intervals for the Silver Snake Federal Com 302H and Silver Snake Federal Com 501H wells are expected to be less than 330 feet from the adjoining tracts thereby allowing for the inclusion of the proximity tracts within the proposed spacing unit. Applicant also seeks, to the extent necessary, approval of an overlapping spacing unit. This proposed horizontal spacing unit will overlap with a 160-acre horizontal spacing unit comprised of the N/2 S/2 of Section 8, Township 23 South, Range 28 East, dedicated to OXY USA WTP Limited Partnership’s Villa A Fee Com #002H well (API 30-015-42284). Also to be considered will be the cost of drilling and completing said wells, the allocation of these costs as well as the actual operating costs and charges for supervision, designation of Marathon as operator of the wells, and a 200% charge for risk involved in drilling said wells. Said area is located approximately 9 miles southwest of Carlsbad, New Mexico.

•    Shiner Rock Fed Com 204H, which will be drilled from a surface hole location 1617 Feet from the South Line of Section 31 and 959 Feet from the East Line of Section 31 (Unit I) to a bottom hole located 5 Feet from the West Line in Section 35 and 660 Feet from the North Line in Section 35 (Unit M).
•    Shiner Rock Fed Com 211H, which will be drilled from a surface hole location 1162 Feet from the North Line of Section 31 and 1041 Feet from the East Line of Section 31 (Unit A) to a bottom hole located 5 Feet from the West Line in Section 35 and 381 Feet from the North Line in Section 35 (Unit D).
•    Shiner Rock Fed Com 213H, which will be drilled from a surface hole location 1617 Feet from the South Line of Section 31 and 989 Feet from the East Line of Section 31 (Unit I) to a bottom hole located 5 Feet from the West Line in Section 35 and 2360 Feet from the North Line in Section 35 (Unit L).

The subject area is located approximately 3 miles east of Whites City, New Mexico.
