PRELIMINARY DOCKET: Examiner Hearing for July 10, 2025

For hearings by affidavit: presenting parties are required to submit a pre-hearing statement no later than the Thursday before the hearing. The pre-hearing statement shall include: 1) a list of disputed facts and issues; 2) identification of witnesses and their qualifications; and 3) all exhibits and written testimony a party intends to enter into evidence at the hearing and a full narrative for each.

For contested matters: pre-hearing statements shall be filed no later than 9:00 a.m., 4 business days prior to the hearing and in addition to the requirements of 19.15.4.13.B(1) NMAC, shall include: all evidentiary exhibits, documents, affidavits, and full-written testimony of any witness a party offers at the hearing. Exhibits must be sequentially marked on every page.

Failure to timely file a complete pre-hearing statement may cause the Hearing Examiner to continue the hearing and/or impose sanctions up to and including the exclusion of late-filed evidence. Evidentiary objections must be filed no later than 48 hours before the hearing. Rulings on the objections will be addressed as a preliminary matter when the case is called.

Applicant applies for an order pooling all uncommitted interests in the Wolfcamp formation underlying a 1,121.12-acre, more or less, non-standard horizonal spacing unit comprised of all of Section 33 and the NW/4 and S/2 of Section 34, Township 21 South, Range 26 East, Eddy County, New Mexico (“Unit”). The Unit will be dedicated to the following wells (“Wells”): Buffalo Nickel 33/34 Fed Com #711H, which will be drilled from a surface hole location in the SE/4 NE/4 (Unit H) of Section 32 to a bottom hole location in the NE/4 NW/4 (Unit C) of Section 34; Buffalo Nickel 33/34 Fed Com #713H, which will be drilled from a surface hole location in the SE/4 NE/4 (Unit H) of Section 32 to a bottom hole location in the SE/4 NW/4 (Unit F) of Section 34; Buffalo Nickel 33/34 Fed Com #716H; which will be drilled from a surface hole location in the NE/4 SE/4 (Unit I) of Section 32 to a bottom hole location in the NE/4 SE/4 (Unit I) of Section 34; and Buffalo Nickel 33/34 Fed Com #718H, which will be drilled from a surface hole location in the NE/4 SE/4 (Unit I) of Section 32 to a bottom hole location in the SE/4 SE/4 (Unit P) of Section 34. The completed intervals of the Wells will be orthodox. Applicant is seeking approval of the non-standard spacing unit through the Division’s administrative process. Also to be considered will be the cost of drilling and completing the Wells and the allocation of the costs, the designation of Applicant as the operator of the Wells, and a 200% charge for the risk involved in drilling and completing the Wells. The Wells are located less than one mile from northwest Carlsbad, New Mexico.
2. 25235 Application of Mewbourne Oil Company for Compulsory Pooling, Eddy County, New Mexico. Applicant applies for an order pooling all uncommitted interests in the Bone Spring formation underlying a 1,121.12-acre, more or less, non-standard horizonal spacing unit comprised of all of Section 33 and the NW/4 and S/2 of Section 34, Township 21 South, Range 26 East, Eddy County, New Mexico (“Unit”). The Unit will be dedicated to the following wells (“Wells”): Buffalo Nickel 33/34 Fed Com #525H, which will be drilled from a surface hole location in the NE/4 SE/4 (Unit I) of Section 32 to a bottom hole location in the NE/4 SE/4 (Unit I) of Section 34; and Buffalo Nickel 33/34 Fed Com #527H, which will be drilled from a surface hole location in the NE/4 SE/4 (Unit I) of Section 32 to a bottom hole location in the SE/4 SE/4 (Unit P) of Section 34. 3. 25349 Application of COG Operating LLC for Compulsory Pooling, Lea County, New Mexico. Applicant in the above-styled cause seeks an order pooling all uncommitted interest owners in a portion of the Bone Spring formation, from the top of the Third Bone Spring to the base of the Bone Spring formation, underlying a standard 480-acre, more or less, horizontal well spacing unit comprised of the SE/4 of Section 3 and the E/2 of Section 10, Township 25 South, Range 35 East, NMPM, Lea County, New Mexico. Applicant seeks to initially dedicate the above-referenced horizontal spacing unit to the Montera Federal Com #603H well, to be horizontally drilled from a surface location in the N/2 NE/4 of Section 15, with a first take point in the S/2 SE/4 of Section 10 and last take point in the N/2 SE/4 of Section 3. The completed interval of the well is expected to remain within 330 feet of the adjoining quarter-quarter section (or equivalent) tracts to allow inclusion of these proximity tracts within the proposed horizontal spacing unit under 19.15.16.15.B(1)(b) NMAC. Said area is located approximately 9 miles northwest of Jal, New Mexico.
4. 25350 Application of COG Operating LLC for Compulsory Pooling, Lea County, New Mexico. Applicant in the above-styled cause seeks an order pooling all uncommitted interest owners in the Wolfcamp formation underlying a standard 240-acre, more or less, horizontal well spacing unit comprised of the W/2 SE/2 of Section 3 and the W/2 E/2 of Section 10, Township 25 South, Range 35 East, NMPM, Lea County, New Mexico. Applicant seeks to initially dedicate the above-referenced horizontal spacing unit to the Montera Federal Com #701H well, to be horizontally drilled from a surface location in the N/2 NE/4 of Section 15, with a first take point in the SW/4 SE/4 (Unit O) of Section 10 and last take point in the NW/4 SE/4 (Unit J) of Section 3. Said area is located approximately 9 miles northwest of Jal, New Mexico.
5. 25358 Application of Riley Permian Operating, LLC for Approving a Standard Horizontal Spacing Unit and Compulsory Pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order from the Division: (1) approving a 481.47-acre, more or less, standard horizontal spacing and proration unit composed of the N/2 of Section 12, Township 18 South, Range 26 East, N.M.P.M., and the NW/4 of Section 7, Township 18 South, Range 27 South, N.M.P.M.; and (2) pooling all uncommitted mineral interests in the Yeso Pool, designated as an oil pool, underlying said unit. The proposed wells to be dedicated to the horizontal spacing unit are the: Marty Fee 11-7 1H (API No. Pending), which is an oil well that will be horizontally drilled from a surface location in the NE/4 NE/4 (Unit A) of Section 11, Township 18 South, Range 26 East, to a bottom hole location in the Yeso Pool in the NE/4 NW/4 (Unit C) of Section 7, Township 18 South, Range 27 East; the Marty Fee 11-7 2H (API No. Pending), which is an oil well that will be horizontally drilled from a surface location in the NE/4 NE/4 (Unit A) of Section 11, Township 18 South, Range 26 East, to a bottom hole location in the Yeso Pool in the NE/4 NW/4 (Unit C) of Section 7, Township 18 South, Range 27 East; the Marty Fee 11-7 3H (API No. Pending), which is an oil well that will be horizontally drilled from a surface location in the SE/4 NE/4 (Unit H) of Section 11, Township 18 South, Range 26 East, to a bottom hole location in the Yeso Pool in the SE/4 NW/4 (Unit F) of Section 7, Township 18 South, Range 27 East, and; the Marty Fee 11-7 4H (API No. Pending), which is an oil well that will be horizontally drilled from a surface location in the SE/4 NE/4 (Unit H) of Section 11, Township 18 South, Range 26 East, to a bottom hole location in the Yeso Pool in the SE/4 NW/4 (Unit F) of Section 7, Township 18 South, Range 27 East. The wells are orthodox in location, and the take points and laterals comply with Statewide Rules for setbacks. The wells and lands are located approximately 3.41 miles southeast of Atoka, New Mexico.
6. 25407 Application of WPX Energy Permian, LLC, for Compulsory Pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order from the Division pooling all uncommitted mineral interests in the Bone Spring formation, designated as an oil pool, underlying a standard 609.5-acre, more or less, spacing unit comprised of the W/2 of Sections 33 and 28, and the SW/4 of Section 21, all in Township 26 South, Range 30 East, NMPM, Eddy County, New Mexico. The proposed wells to be dedicated to the horizontal spacing unit are the Clawhammer 33-28-21 Fed Com 322H Well, an oil well, to be horizontally drilled from a surface location in Lot 3 of Section 33 to a bottom hole location in the NW/4 SW/4 (Unit L) of Section 21; the Clawhammer 33-28-21 Fed Com 323H Well, an oil well, to be horizontally drilled from a surface location in Lot 3 of Section 33 to a bottom hole location in the NE/4 SW/4 (Unit K) of Section 21; the Clawhammer 33-28-21 Fed Com 330H Well, an oil well, to be horizontally drilled from a surface location in Lot 2 of Section 33 to a bottom hole location in the NE/4 SW/4 (Unit K) of Section 21; the Clawhammer 33-28-21 Fed Com 333H Well, an oil well, to be horizontally drilled from a surface location in Lot 3 of Section 33 to a bottom hole location in the NW/4 SW/4 (Unit L) of Section 21; and the Clawhammer 33-28-21 Fed Com 334H Well, an oil well, to be horizontally drilled from a surface location in Lot 2 of Section 33 to a bottom hole location in the NW/4 SW/4 (Unit L) of Section 21. The Clawhammer 33-28-21 Fed Com 334H Well is a proximity well and proximity tracts will be utilized. All the proposed wells have orthodox locations and meet setback requirements under statewide rules. Also to be considered will be the cost of drilling and completing the wells and the allocation of the costs thereof; actual operating costs and charges for supervision; the designation of the Applicant as Operator of the wells and unit; and a 200% charge for the risk involved in drilling and completing the wells. The wells and lands are located adjacent to the southern state line and approximately 17 miles southeast of Malaga, New Mexico.
7. 25409 Application of MRC Permian Company for Approval of a 983.65-acre Non-Standard Horizontal Well Spacing Unit Compulsory Pooling, Lea County, New Mexico. Applicant in the above-styled cause seeks an order (1) approving a 983.65-acre, more or less, non-standard horizontal well spacing unit in the Pennsylvanian formation underlying the W/2 of Sections 26 and 35, Township 15 South, Range 36 East, and Lots 3-6 and 11-14 (NW/4 equivalent) of Section 5, Township 16 South, Range 37 East, NMPM, Lea County, New Mexico; and (2) pooling all uncommitted mineral owners in this acreage. Said non-standard unit will be initially dedicated to the proposed Steve Ruschell State Com #241H well, with a surface location in the SW/4 SW/4 (Unit M) of Section 23, T15S-R36E, a first take point in the NW/4 NW/4 (Unit D) of Section 26, T15S-R36E, and a last take point in Lot 13 of Section 5, T16S-R37E, as well as the Steve Ruschell State Com #242H well, with a surface location in the SW/4 SW/4 (Unit M) of Section 23, T15S-R36E a first take point in the NE/4 NW/4 (Unit C) of Section 26, T15S-R36E, and a last take point in Lot 14 of Section 5, T16S-R37E. Also to be considered will be the cost of drilling and completing the wells and the allocation of the cost thereof, actual operating costs and charges for supervision, designation of Matador Production Company as operator of the wells, and a 200% charge for risk involved in drilling the wells. The subject area is located approximately 4.5 miles northeast of Lovington, New Mexico.
8. 25410 Application of FAE II Operating, LLC for Dismissal of Order No. R-24123, Lea County, New Mexico. Applicant in the above-styled cause is the designated operator of the Arnott Ramsey Waterflood Project, consisting of 640 acres of state trust land all located in Section 32, Township 25 South, Range 37 East, NMPM, Lea County, New Mexico. Pursuant to Ordering Paragraph 23 of OCD Order No. R-21423, FAE seeks OCD dismissal of Order No. R-21423. Said area is located approximately 4 miles south from Jal, New Mexico.
9. 25411 Application of BTA Oil Producers, LLC for Compulsory Pooling, Lea County, New Mexico. Applicant seeks an order pooling all uncommitted interests in the Second Bone Spring interval of the Bone Spring formation underlying a 400-acre, more or less, standard horizontal spacing unit comprised of the W/2 NW/4 of Section 25 and the W/2 W/2 of Sections 24 and 13, Township 20 South, Range 35 East, Lea County, New Mexico (“Unit”). The Unit will be dedicated to the Sage Brush 22302 25-24-13 State Com #3H well (“Well”), to be drilled from a surface hole location in the SW/4 NW/4 (Unit E) of Section 25 to a bottom hole location in the NW/4 NW/4 (Unit D) of Section 13. The completed interval of the Well will be orthodox. A depth severance exists within the Unit. Therefore, BTA seeks to pool only those uncommitted interests from the top of the Second Bone Spring interval, at a stratigraphic equivalent of approximately 9,538’ TVD, to the top of the Third Bone Spring interval, at a stratigraphic equivalent of approximately 10,402’ TVD, as found in the RSC Resources LP – Heller Co Trust Com “A” 1 well (API No. 30-025-28193). Also to be considered will be the cost of drilling and completing the Well and the allocation of the cost, the designation of Applicant as operator of the Well, and a 200% charge for the risk involved in drilling and completing the Well. The Well is located approximately 15.5 miles northwest of Eunice, New Mexico.
10. 25412 Application of BTA Oil Producers, LLC for Compulsory Pooling, Lea County, New Mexico. Applicant seeks an order pooling all uncommitted interests in the Second Bone Spring interval of the Bone Spring formation underlying a 400-acre, more or less, standard horizontal spacing unit comprised of the E/2 NW/4 of Section 25 and the E/2 W/2 of Sections 24 and 13, Township 20 South, Range 35 East, Lea County, New Mexico (“Unit”). The Unit will be dedicated to the Sage Brush 22302 25-24-13 State Com #4H well (“Well”), to be drilled from a surface hole location in the SW/4 NW/4 (Unit E) of Section 25 to a bottom hole location in the NE/4 NW/4 (Unit C) of Section 13. 11. 25414 Application of Mewbourne Oil Company for Compulsory Pooling, Eddy County, New Mexico. Applicant applies for an order pooling all uncommitted interests in the Bone Spring formation underlying a 640.24-acre, more or less, standard horizonal spacing unit comprised of the N/2 of Sections 28 and 29, Township 22 South, Range 27 East, Eddy County, New Mexico (“Unit”). The Unit will be dedicated to the following wells (“Wells”): City Slickers 28/29 Fee #523H, which will be drilled from a surface hole location in the NW/4 NW/4 (Unit D) of Section 27 to a bottom hole location in the SW/4 NW/4 (Unit E) of Section 29; City Slickers 28/29 #551H, which will be drilled from a surface hole location in the NW/4 NW/4 (Unit D) of Section 27 to a bottom hole location in the NW/4 NW/4 (Unit D) of Section 29; and City Slickers 28/29 #554H, which will be drilled from a surface hole location in the NW/4 NW/4 (Unit D) of Section 27 to a bottom hole location in the SW/4 NW/4 (Unit E) of Section 29. The completed intervals of the Wells will be orthodox. The completed interval of the City Slickers 28/29 #523H well will be located within 330’ of the quarter-quarter section line separating the N/2 N/2 and S/2 N/2 of Sections 28 and 29 to allow for the creation of a standard, 640.24-acre, more or less, standard horizontal spacing unit. Also to be considered will be the cost of drilling and completing the Wells and the allocation of the costs, the designation of Applicant as operator of the Unit and Wells, and a 200% charge for the risk involved in drilling and completing the Wells. The Wells are located approximately one mile northwest of Carlsbad, New Mexico.
12. 25415 Application of Permian Resources Operating, LLC to Amend Order No. R-23221 to Allow Additional Time to Commence Drilling, Eddy County, New Mexico. Applicant in the above-styled cause seeks a one-year extension of time for drilling the well under Order No. R-23221 and to designate Permian Resources Operating, LLC as operator of the Unit and the initial well. The Unit is comprised of the N/2 of Section 7, Township 22 South, Range 27 East, and the N/2 of Section 12, Township 22 South, Range 26 East, NMPM, Eddy County, New Mexico. Order No. R-23221 pooled the uncommitted interests in the Bone Spring formation and dedicated the Unit to the proposed initial Hannah 131H well. Portions of said area are located within the city limits of Carlsbad, New Mexico.
13. 25416 Application of Mewbourne Oil Company to compulsory pool additional interest owners under Order No. R-23284, Eddy County, New Mexico: Mewbourne Oil Company requests the Division to enter an order pooling additional uncommitted mineral interest owners under Order No. R-23284. The order pooled uncommitted mineral interest owners in the Bone Spring formation underlying a standard horizontal spacing unit comprised of the N/2N/2 of Section 16 and the N/2NE/4 of Section 17, Township 18 South, Range 29 East, NMPM, Eddy County, New Mexico (the “Unit). The following well is in the Unit: The Mockingbird 16/17 Fed. Com. Well No. 521H, with a first take point in the NE/4NE/4 of Section 16 and a last take point in the NW/4NE/4 of Section 17 (the “Well”). Also to be considered will be the cost of drilling, completing, testing, and equipping the Well, and the allocation of the cost thereof among the Well’s working interest owners, approval actual operating charges and costs charged for supervision, together with a provision adjusting the rates pursuant to the COPAS accounting procedure, and setting a 200% charge for the risk involved in drilling, completing, testing, and equipping the Well in the event a working interest owner elects not to participate in the Well. The Unit is located approximately 9 miles southwest of Loco Hills, New Mexico.
14. 25417 Application of Mewbourne Oil Company to compulsory pool additional interest owners under Order No. R-23287, Eddy County, New Mexico: Mewbourne Oil Company requests the Division to enter an order pooling additional uncommitted mineral interest owners under Order No. R-23287. The order pooled uncommitted mineral interest owners in the Bone Spring formation underlying a standard horizontal spacing unit comprised of the S/2N/2 of Section 16 and the S/2NE/4 of Section 17, Township 18 South, Range 29 East, NMPM, Eddy County, New Mexico (the “Unit). The following well is in the Unit: The Mockingbird 16/17 Fed. Com. Well No. 523H, with a first take point in the SE/4NE/4 of Section 16 and a last take point in the SW/4NE/4 of Section 17 (the “Well”). Also to be considered will be the cost of drilling, completing, testing, and equipping the Well, and the allocation of the cost thereof among the Well’s working interest owners, approval actual operating charges and costs charged for supervision, together with a provision adjusting the rates pursuant to the COPAS accounting procedure, and setting a 200% charge for the risk involved in drilling, completing, testing, and equipping the Well in the event a working interest owner elects not to participate in the Well. The Unit is located approximately 9 miles southwest of Loco Hills, New Mexico.
15. 25418 Application of PBEX Operations, LLC to Pool Additional Interests Under Order No. R-23783, Lea County, New Mexico. Applicant seeks an order pooling additional uncommitted interests under the terms of Division Order No. R-23783 (“Order”). The Order pooled uncommitted interests in the First Bone Spring interval of the Bone Spring formation, at depths lying between the stratigraphic equivalent of 9,115’ and 9,244’ TVD, underlying a 960-acre, more or less, standard horizontal spacing unit comprised of the W/2 of Sections 15, 22, and 27, Township 19 South, Range 33 East, Lea County (“Unit”). The Order dedicated the Unit to the Moonraker 15-27 Fed Com 101H and Moonraker 15-27 Fed Com 102H wells (“Wells”) and designated Applicant as operator of the Unit and the Wells. Applicant has identified additional interests in the Unit that should be pooled under the terms of the Order. The Wells are located approximately 29.8 miles west of Hobbs, New Mexico.
16. 25419 Application of PBEX Operations, LLC to Pool Additional Interests Under Order No. R-23782, Lea County, New Mexico. Applicant seeks an order pooling additional uncommitted interests under the terms of Division Order No. R-23782 (“Order”). The Order pooled uncommitted interests in the Second and Third Bone Spring intervals of the Bone Spring formation, at depths lying between the stratigraphic equivalent of 9,600’ and 10,770’ TVD, underlying a 960-acre, more or less, standard horizontal spacing unit comprised of the W/2 of Sections 15, 22, and 27, Township 19 South, Range 33 East, Lea County (“Unit”). The Order dedicated the Unit to the Moonraker 15-27 Fed Com 201H, Moonraker 15-27 Fed Com 203H, and Moonraker 15-27 Fed Com 205H wells (“Wells”) and designated Applicant as operator of the Unit and the Wells. Applicant has identified additional interests in the Unit that should be pooled under the terms of the Order. The Wells are located approximately 29.8 miles west of Hobbs, New Mexico.
17. 25420 Application of E.G.L. Resources, Inc. to Extend Time to Commence Drilling Operations Under Order No. R-23525, Lea County, New Mexico. E.G.L. Resources, Inc (“E.G.L” or “Applicant”) seeks an order extending the deadline to commence drilling the well authorized by Order No. R-23525 (“Order”) until October 23, 2026. The Division issued the Order in Case No. 24720 on October 23, 2024. The Order: pooled all uncommitted interests in the Second Bone Spring interval of the Bone Spring formation, from a depth of approximately 8,700’ to 9,580’ TVD, underlying a 640-acre, more or less, standard horizontal spacing unit comprised of the E/2 of Sections 24 and 25, Township 18 South, Range 32 East, Lea County, New Mexico (“Unit”); dedicated the Unit to the LTK 24-25 Fed Com 201H, LTK 24-25 Fed Com 203H, and LTK 24-25 Fed Com 205H wells (“Wells”); and designated Applicant as operator of the Unit and the Wells. The Order requires Applicant to commence drilling the Wells within one year of the date of the Order. Applicant requests that the Division extend the deadline to commence drilling the Wells by one year. The Wells are located approximately 8 miles south of Maljamar, New Mexico.
18. 25421 Application of E.G.L. Resources, Inc. to Extend Time to Commence Drilling Operations Under Order No. R-23524, Lea County, New Mexico. E.G.L. Resources, Inc (“E.G.L” or “Applicant”) seeks an order extending the deadline to commence drilling the wells authorized by Order No. R-23524 (“Order”) until October 23, 2026. The Division issued the Order in Case No. 24719 on October 23, 2024. The Order: pooled all uncommitted interests in the First Bone Spring interval of the Bone Spring formation from the top of the formation to approximately 8,700’ TVD underlying a 640-acre, more or less, standard horizontal spacing unit comprised of the E/2 of Sections 24 and 25, Township 18 South, Range 32 East, Lea County, New Mexico (“Unit”); dedicated the Unit to the LTK 24-25 Fed Com 101H, LTK 24-25 Fed Com 102H, and LTK 24-25 Fed Com 103H wells (“Wells”); and designated Applicant as operator of the Unit and the Wells. The Order requires Applicant to commence drilling the Wells within one year of the date of the Order. Applicant requests that the Division extend the deadline to commence drilling the Wells by one year. The Wells are located approximately 8 miles south of Maljamar, New Mexico.
19. 25422 Application of FAE II Operating, LLC to Extend the Vertical Limits of the Langlie-Mattix; Seven Rivers-Queen-Grayburg Pool within the North Jal Unit, Lea County, New Mexico. FAE II Operating, LLC (“FAE” or “Applicant”) seeks an order extending the vertical limits of the Langlie-Mattix; Seven Rivers-Queen-Grayburg Pool (Pool Code 37240) to include the Yates and Upper Seven Rivers Formations only within the boundaries of the North Jal Unit. The well is proposed be drilled as a deviated well with a surface location of approximately 1,607 feet from the south line (FSL) and approximately 1,991 feet from the west line (FWL) of Section 17, to a bottom hole location at approximately 2,338 from the north line (FNL) and 188 feet FWL in said Section 17, within Township 19 South, Range 35 East, Lea County, New Mexico. The injection stream will consist of TAG comprised of approximately 70 percent carbon dioxide and 30 percent hydrogen sulfide from oil and gas wells in the area. Lea Midstream seeks approval to inject up to 12 MMSCFD of TAG. The proposed maximum allowable operating pressure requested is approximately 4,593 psig. The injection will target the Siluro-Devonian formations, including the Devonian, Wristen, and Fusselman formations, between depths of approximately 14,615 to 16,029 feet. The subject well will be located approximately 20 miles southwest of Hobbs, N.M.
