PRELIMINARY DOCKET: Special OCD Examiner's Hearing set for March 10, 2026

For hearings by affidavit: presenting parties are required to submit a pre-hearing statement no later than the Thursday before the hearing. The pre-hearing statement shall include: 1) a list of disputed facts and issues; 2) identification of witnesses and their qualifications; and 3) all exhibits and written testimony a party intends to enter into evidence at the hearing and a full narrative for each.

For contested matters: pre-hearing statements shall be filed no later than 9:00 a.m., 4 business days prior to the hearing and in addition to the requirements of 19.15.4.13.B(1) NMAC, shall include: all evidentiary exhibits, documents, affidavits, and full-written testimony of any witness a party offers at the hearing. Exhibits must be sequentially marked on every page.

Failure to timely file a complete pre-hearing statement may cause the Hearing Examiner to continue the hearing and/or impose sanctions up to and including the exclusion of late-filed evidence. Evidentiary objections must be filed no later than 48 hours before the hearing. Rulings on the objections will be addressed as a preliminary matter when the case is called.

2. 25610 Application of Powderhorn Operating, LLC for Compulsory Pooling, Eddy County, New Mexico. Applicant seeks an order pooling all uncommitted interest within the Wolfcamp formation, designated as a gas pool (Purple Sage Wolfcamp [Gas] Pool Code 98220), underlying a 959.60-acre, more or less, standard horizontal well spacing unit comprised of the E/2 of Section 3 and all of Section 2, located in Township 24 South, Range 26 East, NMPM, Eddy County, New Mexico (the “Unit”). The Unit will be dedicated to the following wells: Super Hornet State Com 401H, a gas well that will be horizontally drilled from a surface hole location 2550’ FEL & 1,380’ FNL of Section 3, to a bottom hole location 100’ FEL & 990’ FNL of Section 2, Township 24 South, Range 26 East; Super Hornet State Com 402H, a gas well that will be horizontally drilled from a surface hole location 2550’ FEL & 1,410’ FNL of Section 3, to a bottom hole location 100’ FEL & 2,330’ FNL of Section 2, Township 24 South, Range 26 East; Super Hornet State Com 403H, a gas well that will be horizontally drilled from a surface hole location 2535’ FEL & 1,380’ FSL of Section 3, to a bottom hole location 100’ FEL & 1,650’ FSL of Section 2, Township 24 South, Range 26 East; Super Hornet State Com 404H, a gas well that will be horizontally drilled from a surface hole location 2535’ FEL & 1,350’ FSL of Section 3, to a bottom hole location 100’ FEL & 330’ FSL of Section 2, Township 24 South, Range 26 East. The wells will be horizontally drilled and located within the Purple Sage Wolfcamp Gas Pool (Code 98220). This pool is subject to special pool rules that establish 330-foot setback requirements, and the Wells will have non-standard first and last take points. The completed interval of the Wells will remain within 330 feet of the adjoining half-section tracts, allowing inclusion of these proximity tracts within the proposed Unit under NMAC 19.15.16.15(B)(4). Also, to be considered will be the cost of drilling and completing the Wells and the allocation of the cost, the designation of Applicant as the operator of the Wells and Unit, and a 200% charge for the risk involved in drilling and completing the Wells against any working interest owner who does not voluntarily participate. Applicant seeks an order pooling all uncommitted interest within the Bone Spring formation, underlying a 240-acre, more or less, standard horizontal well spacing unit comprised of the N/2 SE/4 of Section 3 and N/2 S/2 of Section 2, located in Township 24 South, Range 26 East, NMPM, Eddy County, New Mexico (the “Unit”). 5. 25936 Application of Mewbourne Oil Company for Compulsory Pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order pooling all uncommitted mineral owners in a standard 320-acre, more or less, well spacing unit in the Bone Spring formation underlying the S/2 S/2 of irregular Sections 3 and 4, Township 22 South, Range 26 East, NMPM, Eddy County, New Mexico. This spacing unit will be initially dedicated to the proposed Guyana Buffalo 4/3 Federal Com 408H and Guyana Buffalo 4/3 Federal Com 527H wells, both to be drilled from surface locations in the SW/4 SW/4 (Unit M) of irregular Section 4, to bottomhole locations in the SE/4 SE/4 (Unit P) of irregular Section 3. Also to be considered will be the cost of drilling and completing the wells and the allocation of the costs thereof, the operating costs and charges for supervision, the designation of applicant as operator of the proposed spacing unit, and a 200% charge for risk involved in drilling said wells. 6. 25937 Application of Mewbourne Oil Company for Compulsory Pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order pooling all uncommitted mineral owners in a standard 640-acre, more or less, well spacing unit in the Woflcamp formation underlying the S/2 of irregular Sections 3 and 4, Township 22 South, Range 26 East, NMPM, Eddy County, New Mexico. This spacing unit will be initially dedicated to the proposed Guyana Buffalo 4/3 Federal Com 716H and Guyana Buffalo 4/3 Federal Com 825H wells, both to be drilled from surface locations in the SW/4 SW/4 (Unit M) of irregular Section 4, to bottomhole locations in the NE/4 SE/4 (Unit I) of irregular Section 3; and Guyana Buffalo 4/3 Federal Com 718H and Guyana Buffalo 4/3 Federal Com 827H wells, both to be drilled from surface locations in the SW/4 SW/4 (Unit M) of irregular Section 4, to bottomhole locations in the SE/4 SE/4 (Unit P) of irregular Section 3. Applicant seeks an order pooling all uncommitted interests in the Yeso formation underlying a 120-acre, more or less, standard horizontal spacing unit comprised of the N/2 SE/4 and the NE/4 SW/4 of Section 17, Township 17 South, Range 31 East, Eddy County, New Mexico (“Unit”). Applicant seeks to dedicate the Unit to the Garrison 17 Fed 20H, Garrison 17 Fed 70H, and Garrison 17 Fed 90H wells (“Wells”), to be drilled from surface hole locations in the NW/4 SW/4 (Unit L) of Section 16 to bottom hole locations in the NE/4 SW/4 (Unit K) of Section 17. Also to be considered will be the cost of drilling and completing the Wells and the allocation of the costs, the designation of Applicant as the operator of the Wells, and a 200% charge for the risk involved in drilling and completing the Wells. 8. 25771 Application of Permian Resources Operating, LLC for Compulsory Pooling, Eddy County, New Mexico. Applicant seeks an order pooling all uncommitted interests in the Bone Spring formation underlying a 399.38-acre, more or less, standard horizontal spacing unit comprised of the S/2 SW/4 of Section 4 and the S/2 S/2 of Sections 5 and 6, Township 22 South, Range 26 East, Eddy County, New Mexico (“Unit”). Applicant applies for an order pooling all uncommitted interests in the Wolfcamp formation underlying a 1,920-acre, more or less, standard horizontal spacing unit comprised of Sections 35 and 36, Township 24 South, Range 25 East, and Section 31, Township 24 South, Range 26 East, Eddy County, New Mexico (“Unit”). The completed interval of the Shale Ale Fed Com 402H well will be located within 330’ of the half-section line separating the N/2 and S/2 of Sections 35 and 36 of Township 24 South, Range 35 East, and the N/2 and S/2 of Section 31, Township 24 South, Range 26 East, to allow for the creation of a 1,920-acre standard, horizontal spacing unit. Also to be considered will be the cost of drilling and completing the Wells and the allocation of the costs, the designation of Applicant as the operator of the Wells, and a 200% charge for the risk involved in drilling and completing the Wells. The Wells are located approximately ½ mile east of Whites City, Eddy County, New Mexico.
11. 25873 Application of Avant Operating II, LLC for compulsory pooling, Eddy County, New Mexico. Applicant seeks an order from the Division pooling all uncommitted interests within a standard 480-acre, more or less, Bone Spring horizontal spacing unit comprised of the S/2 of Section 2 and the SE/4 of Section 3, Township 24 South, Range 26 East, N.M.P.M., Eddy County, New Mexico. This spacing unit will be dedicated to the following wells: the Casino Queen 2 3 State Com #501H well with a proposed surface hole location in the SE/4 SE/4 (Unit P) of Section 2, and a proposed last take point in the SW/4 SE/4 (Unit O) of Section 3; the Casino Queen 2 3 State Com #502H well, with a proposed surface hole location in the NE/4 SE/4 (Unit I) of Section 2, and a proposed last take point in the SW/4 SE/4 (Unit O) of Section 3; and the Casino Queen 2 3 State Com #503H well, with proposed surface hole locations in the NE/4 SE/4 (Unit I) of Section 2, and proposed last take points in the NW/4 SE/4 (Unit J) of Section 3. The wells will be drilled at orthodox locations. The completed interval for the Casino Queen 2 3 State Com #502H well are expected to be less than 330 feet from the adjoining tracts thereby allowing for the inclusion of the proximity tracts within the proposed spacing unit under Rule 19.15.16.15(B)(1)(b) NMAC. Also to be considered will be the cost of drilling and completing said wells, the allocation of these costs as well as the actual operating costs and charges for supervision, designation of Avant Operating II, LLC as operator of the wells, and a 200% charge for risk involved in drilling said wells. Said area is located approximately 15 miles southwest of Carlsbad, New Mexico.
12. 25874 Application of Avant Operating II, LLC for compulsory pooling, Eddy County, New Mexico. Applicant seeks an order from the Division pooling all uncommitted interests within a standard 480-acre, more or less, Wolfcamp horizontal spacing unit comprised of the S/2 of Section 2 and the SE/4 of Section 3, Township 24 South, Range 26 East, N.M.P.M., Eddy County, New Mexico. This spacing unit will be dedicated to the following wells: the Casino Queen 2 3 State Com #701H well, the Casino Queen 2 3 State Com #751H well, and the Casino Queen 2 3 State Com #752H well with proposed surface hole locations in the SE/4 SE/4 (Unit P) of Section 2, and proposed last take points in the SW/4 SE/4 (Unit O) of Section 3; the Casino Queen 2 3 State Com #702H well, with a proposed surface hole location in the NE/4 SE/4 (Unit I) of Section 2, and a proposed last take point in the SW/4 SE/4 (Unit O) of Section 3; and the Casino Queen 2 3 State Com #703H well, and the Casino Queen 2 3 State Com #753H well, with proposed surface hole locations in the NE/4 SE/4 (Unit I) of Section 2, and proposed last take points in the NW/4 SE/4 (Unit J) of Section 3. The wells will be drilled at orthodox locations. The well spacing complies with the Special Rules for the Purple Sage Wolfcamp Pool. Also to be considered will be the cost of drilling and completing said wells, the allocation of these costs as well as the actual operating costs and charges for supervision, designation of Avant Operating II, LLC as operator of the wells, and a 200% charge for risk involved in drilling said wells. 13. 25980 Application of Coterra Energy Operating Co, for Approving a Standard Horizontal Spacing Unit and Compulsory Pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order from the Division: (1) approving a 639.28-acre, more or less, standard horizontal spacing and proration unit composed of the E/2 of Sections 3 and 10, Township 24 South, Range 26 East, N.M.P.M. Eddy County, New Mexico, and (2) pooling all uncommitted mineral interests in the WC-015 G-04 S232628M; Bone Spring formation designated as an oil pool, underlying said unit. Applicant in the above-styled cause seeks an order pooling all uncommitted interest owner in the Wolfcamp formation underlying a standard 479.57-acre, more or less, horizontal well spacing unit comprised of Lots 1-4 and S/2 N/2 (N/2 equivalent) of irregular Section 2 and Lots 1-2 and S/2 NE/4 (NE/4 equivalent) of irregular Section 3, Township 24 South, Range 26 East, NMPM, Eddy County, New Mexico. The wells and lands are located approximately 2.94 miles southeast of Whites City, New Mexico.
17. 25972 Application of Marathon Oil Permian, LLC for Approval of a Non-Standard Horizontal Well Spacing Unit and Compulsory Pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order (a) approving a non-standard 479.57-acre, more or less, horizontal well spacing unit in the Bone Spring formation underlying Lots 1-4 and S/2 N/2 (N/2 equivalent) of irregular Section 2 and Lots 1-2 and S/2 NE/4 (NE/4 equivalent) of irregular Section 3, Township 24 South, Range 26 East, NMPM, Eddy County, New Mexico, and (b) pooling the uncommitted interest owners in this acreage. Applicant seeks to initially dedicate the above-referenced horizontal spacing unit to the Campana State Com 501H well, to be drilled from a surface location in the SE/4 NE/4 (Unit H) of irregular Section 2, a first take point in Lot 1 (NE/4 NE/4 equivalent) of irregular Section 2, to a last take point in Lot 2 (NW/4 NE/4 equivalent) of irregular Section 3; and Campana State Com 502H well, to be drilled from a surface location in the SE/4 NE/4 (Unit H) of irregular Section 2, a first take point in the SE/4 NE/4 (Unit H) of irregular Section 2, to a last take point in the SW/4 NE/4 (Unit G) of irregular Section 3. Also to be considered will be the cost of drilling and completing the wells and the allocation of the cost thereof, actual operating costs and charges for supervision, designation of Applicant as operator of the wells, and a 200% charge for risk involved in drilling the wells.
