PRELIMINARY DOCKET: Special Examiner's Hearing set for December 9, 2025

For hearings by affidavit: presenting parties are required to submit a pre-hearing statement no later than the Thursday before the hearing. The pre-hearing statement shall include: 1) a list of disputed facts and issues; 2) identification of witnesses and their qualifications; and 3) all exhibits and written testimony a party intends to enter into evidence at the hearing and a full narrative for each.

For contested matters: pre-hearing statements shall be filed no later than 9:00 a.m., 4 business days prior to the hearing and in addition to the requirements of 19.15.4.13.B(1) NMAC, shall include: all evidentiary exhibits, documents, affidavits, and full-written testimony of any witness a party offers at the hearing. Exhibits must be sequentially marked on every page.

Failure to timely file a complete pre-hearing statement may cause the Hearing Examiner to continue the hearing and/or impose sanctions up to and including the exclusion of late-filed evidence. Evidentiary objections must be filed no later than 48 hours before the hearing. Rulings on the objections will be addressed as a preliminary matter when the case is called.

NOTICE: The hearing examiner may call the following cases in any order at their discretion.

1. 25535 Application of Spur Energy Partners LLC for Compulsory Pooling, Eddy County, New Mexico. Applicant seeks an order pooling all uncommitted interests in the San Andres formation underlying a 327.43-acre, more or less, standard horizontal spacing unit comprised of the S/2 of Section 31, Township 17 South, Range 28 East, Eddy County, New Mexico (“Unit”). The Unit will be dedicated to the following wells (“Wells”) Marley State Com 31 CD 110H, which will be drilled from a surface hole location in the NW/4 SW/4 (Unit L) of Section 32 to a bottom hole location in the NW/4 SW/4 (Unit L) of Section 31; Marley State Com 31 CD 111H, which will be drilled from a surface hole location in the NW/4 SW/4 (Unit L) of Section 32 to a bottom hole location in the NW/4 SW/4 (Unit L) of Section 31; and Marley State Com 31 CD 112H, which will be drilled from a surface hole location in the NW/4 SW/4 (Unit L) of Section 32 to a bottom hole location in the SW/4 SW/4 (Unit M) of Section 31. The completed intervals of the Wells will be orthodox. The completed interval of the Marley State Com 31 CD 111H well will be located within 330’ of the quarter-quarter section line separating the N/2 S/2 and the S/2 S/2 of Section 31 to allow for the creation of a 327.43-acre standard horizontal spacing unit. Also to be considered will be the cost of drilling and completing the Wells, the allocation of the costs, the designation of Applicant as operator of the Wells and the Unit, and a 200% charge for the risk involved in drilling and completing the Wells. The Wells are located approximately 11.5 miles southeast of Artesia, New Mexico.


2. 25756 Application of Longfellow Operating Partners, LLC for Compulsory Pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order from the Oil Conservation Division approving a standard 327.43-acre, more or less, horizontal spacing and proration unit (“HSU”), with proximity tracts, comprised of the South Half of Section 31, Township 17 South, Range 28 East in Eddy County, New Mexico and pooling all mineral interests in the San Andres formation underlying the HSU. Applicant proposes to drill the following 1.0-mile wells in the HSU: Marley State Com 31CD SA 001H, well, to be horizontally drilled from a surface hole location approximately 1,325' FEL & 2,320' FSL of Section 36-17S-27E; with a Bottom Hole Location of 20' FEL & 2,269' FSL of Section 31-17S-28E; Marley State Com 31CD SA 002H well, to be horizontally drilled from a surface hole location approximately 1,325' FEL & 2,300' FSL of Section 36-17S-27E; with a Bottom Hole Location of 20' FEL & 1,590' FSL of Section 31-17S-28E; Marley State Com 31CD SA 003H well, to be horizontally drilled from a surface hole location approximately 535' FEL & 766' FSL of Section 36-17S-27E; with a Bottom Hole Location of 20' FEL & 983' FSL of Section 31-17S-28E; and Marley State Com 31CD SA 004H well, to be horizontally drilled from a surface hole location approximately 525' FEL & 756' FSL of Section 36-17S-27E; with a Bottom Hole Location of 20' FEL & 340' FSL of Section 31-17S-28E. The Marley State Com 31CD SA 002H well is a proximity well. With the proximity tracts, the completed intervals will meet standard setback requirements. The first and last take points will meet the setback requirements set forth in the statewide rules for horizontal oil wells. Additional considerations will be the cost of drilling and completing the well and allocation of such costs, the designation of Applicant as operator of the HSU and wells to be drilled thereon, and a 200% charge for the risk involved in drilling and completing the well. The well and lands are located approximately 9 miles East of Artesia, New Mexico.
3. 25663 Amended Application of Mewbourne Oil Company for Approval of an Overlapping Horizontal Well Spacing Unit and Compulsory Pooling, Lea and Eddy County, New Mexico. Applicant in the above-styled cause seeks an order (1) approving an overlapping, 962.45 acre, more or less, non-standard horizontal well spacing unit in the Bone Spring formation underlying the NE/4 of Section 35, and N/2 of Section 36, Township 18 South, Range 31 East, NMPM, Eddy County, New Mexico, and Lots 1-2, E/2 NW/4, and NE/4 (N/2 equivalent) of irregular Section 31, and NW/4 of Section 32, Township 18 South, Range 32 East, NMPM, Lea County, New Mexico, and (2) pooling all uncommitted mineral interests in this acreage. This spacing unit will be initially dedicated to the proposed Lead Belly 35/32 Federal Com 521H and Lead Belly 35/32 Federal Com 622H wells, both with surface locations in the NW/4 NE/4 (Unit B) of Section 35, to bottomhole locations in the NE/4 NW/4 (Unit C) of Section 32; and the Lead Belly 35/32 Federal Com 523H and Lead Belly 35/32 Federal Com 624H wells, both with surface locations in the NW/4 NE/4 (Unit B) of Section 35, to bottomhole locations in the SE/4 NW/4 (Unit F) of Section 32. The proposed horizontal well spacing unit will overlap the following existing Bone Spring spacing units: • 160-acre horizontal well spacing unit comprised of the W/2 W/2 of Section 36, T18S-R31E, dedicated to COG Operating LLC’s Nervous Horz Com 4H (API: 30-015- 37146); • 160-acre horizontal well spacing unit comprised of the W/2 E/2 of Section 36, T18S-R31E, dedicated to COG Operating LLC’s Nervous Horz Com 3H (API: 30-015-37145); • 160-acre horizontal well spacing unit comprised of the E/2 E/2 of Section 36, T18S-R31E, dedicated to COG Operating LLC’s Nervous Horz Com 2H (API: 30-015-37143); • 121.18-acre horizontal well spacing unit comprised of Lot 1, the NE/4 NW/4, and the NW/4 NE/4 of irregular Section 31, T18S-R32E, dedicated to COG Operating LLC’s SDL Federal Com 1H (API: 30-025-39537); • 40-acre vertical well spacing unit comprised of the SW/4 NE/4 (Unit G) of irregular Section 31, T18S-R32E, dedicated to COG Operating LLC’s LPC 31 Federal 2 (API: 30-025-38157); • 41.27-acre vertical well spacing unit comprised of Lot 2 (SW/4 NW/4 equivalent) of irregular Section 31, T18S R32E, dedicated to COG Operating LLC’s LPC 31 Federal 4 (API: 30-025-38109); • 40-acre vertical well spacing unit comprised of the SE/4 NW/4 (Unit F) of irregular Section 31, T18S-R32E, 6 dedicated to COG Operating LLC’s LPC 31 Federal 3 (API: 30-025-37859); • 40-acre vertical well spacing unit comprised of the NE/4 NE/4 (Unit A) of irregular Section 31, T18S-R32E, dedicated to COG Operating LLC’s EGL Federal 1 (API: 30-025-35690); • 40-acre vertical well spacing unit comprised of the NW/4 NW/4 (Unit D) of Section 32, T18S-R32E, dedicated to RAYBAW Operating LLC’s Hulkster 1 (API: 30-025- 38446); • 40-acre vertical well spacing unit comprised of the NE/4 NW/4 (Unit C) of Section 32, T18S-R32E, dedicated to RAYBAW Operating LLC’s N Lusk 32 State 1 (API: 30- 025-35747); • 40-acre vertical well spacing unit comprised of the SW/4 NW/4 (Unit E) of Section 32, T18S-R32E, dedicated to RAYBAW Operating LLC’s Hulkster 2 (API: 30-025- 38844); and • 40-acre vertical well spacing unit comprised of the SE/4 NW/4 (Unit F) of Section 32, T18S-R32E, dedicated to RAYBAW Operating LLC’s Watkins 32 State 1 (API: 30- 025-31735). Also to be considered will be the cost of drilling and completing the wells and the allocation of the costs thereof, the operating costs and charges for supervision, the designation of applicant as operator of the proposed spacing unit, and a 200% charge for risk involved in drilling said wells. Said area is located approximately 30 miles northeast of Carlsbad, New Mexico.
4. 25584 Application of Matador Production Company to Amend Order R-22860 to Add Additional Pooled Parties, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order amending pooling Order R-22860 to add additional interest owners to the pooling order. Division Order R-22860 was issued in Case No. 23672 and pooled uncommitted interest owners in the Bone Spring formation (Culebra Bluff; Bone Spring, South [15011]) underlying the N/2 N/2 of Section 1 and the N/2 NE/4 of Section 2, Township 24 South, Range 28 East, NMPM, Eddy County, New Mexico. This standard 240-acre overlapping horizontal well spacing unit is currently dedicated to the drilled and producing C Sweeney State Com 111H (API No. 30-015-54331), C Sweeney State Com 121H (API No. 30-015-54333), and C Sweeney State Com 131H (API No. 30-015-54332). The subject area is located approximately 2 miles northeast of Malaga, New Mexico.
