PRELIMINARY DOCKET: Examiner Hearing for December 18, 2025

For hearings by affidavit: presenting parties are required to submit a pre-hearing statement no later than the Thursday before the hearing. The pre-hearing statement shall include: 1) a list of disputed facts and issues; 2) identification of witnesses and their qualifications; and 3) all exhibits and written testimony a party intends to enter into evidence at the hearing and a full narrative for each.

For contested matters: pre-hearing statements shall be filed no later than 9:00 a.m., 4 business days prior to the hearing and in addition to the requirements of 19.15.4.13.B(1) NMAC, shall include: all evidentiary exhibits, documents, affidavits, and full-written testimony of any witness a party offers at the hearing. Exhibits must be sequentially marked on every page.

Failure to timely file a complete pre-hearing statement may cause the Hearing Examiner to continue the hearing and/or impose sanctions up to and including the exclusion of late-filed evidence. Evidentiary objections must be filed no later than 48 hours before the hearing. Rulings on the objections will be addressed as a preliminary matter when the case is called.

Applicant applies for an order pooling all uncommitted interests in the Wolfcamp formation underlying a 1,920-acre, more or less, standard horizontal spacing unit comprised of Sections 35 and 36, Township 24 South, Range 25 East, and Section 31, Township 24 South, Range 26 East, Eddy County, New Mexico (“Unit”). The Unit will be dedicated to Shale Ale Fed Com 401H and Shale Ale Fed Com 501H, which will produce from first take points located in the NW/4 NW/4 (Unit D) of Section 35 to last take points located in the NE/4 NE/4 (Unit A) of Section 31; Shale Ale Fed Com 402H and Shale Ale Fed Com 502H, which will produce from first take points located in the SW/4 NW/4 (Unit E) of Section 35 to last take points located in the SE/4 NE/4 (Unit H) of Section 31; Shale Ale Fed Com 403H and Shale Ale Fed Com 503H, which will produce from first take points located in the NW/4 SW/4 (Unit L) of Section 35 to last take points located in the NE/4 SE/4 (Unit I) of Section 31; and Shale Ale Fed Com 404H and Shale Ale Fed Com 504H, which will produce from first take points located in the SW/4 SW/4 (Unit M) of Section 35 to last take points located in the SE/4 SE/4 (Unit P) of Section 31. The completed intervals of the Wells will be orthodox. The completed interval of the Shale Ale Fed Com 402H well will be located within 330’ of the half-section line separating the N/2 and S/2 of Sections 35 and 36 of Township 24 South, Range 35 East, and the N/2 and S/2 of Section 31, Township 24 South, Range 26 East, to allow for the creation of a 1,920-acre standard, horizontal spacing unit. Also to be considered will be the cost of drilling and completing the Wells and the allocation of the costs, the designation of Applicant as the operator of the Wells, and a 200% charge for the risk involved in drilling and completing the Wells. The Wells are located approximately ½ mile east of Whites City, Eddy County, New Mexico.
2. 25727 Application of Spur Energy Partners LLC for Compulsory Pooling, Eddy County, New Mexico. Applicant seeks an order pooling all uncommitted interests in the Yeso formation underlying a 120-acre, more or less, standard horizontal spacing unit comprised of the N/2 SE/4 and the NE/4 SW/4 of Section 17, Township 17 South, Range 31 East, Eddy County, New Mexico (“Unit”). Applicant seeks to dedicate the Unit to the Garrison 17 Fed 20H, Garrison 17 Fed 70H, and Garrison 17 Fed 90H wells (“Wells”), to be drilled from surface hole locations in the NW/4 SW/4 (Unit L) of Section 16 to bottom hole locations in the NE/4 SW/4 (Unit K) of Section 17. Also to be considered will be the cost of drilling and completing the Wells and the allocation of the costs, the designation of Applicant as the operator of the Wells, and a 200% charge for the risk involved in drilling and completing the Wells. The Wells are located approximately 6.87 miles west and 1.67 miles south of Maljamar, New Mexico.
3. 25753 Application of Powderhorn Operating, LLC for Compulsory Pooling, Eddy County, New Mexico. Applicant seeks an order pooling all uncommitted interest within the Bone Spring formation, underlying a 240-acre, more or less, standard horizontal well spacing unit comprised of the N/2 SE/4 of Section 3 and N/2 S/2 of Section 2, located in Township 24 South, Range 26 East, NMPM, Eddy County, New Mexico (the “Unit”). The Unit will be dedicated to the following well: Super Hornet State Com 203H, an oil well that will be horizontally drilled from a surface hole location 2,545’ FEL & 1,380’ FSL of Section 3, to a bottom hole location 100’ FEL & 1,980’ FSL of Section 2, Township 24 South, Range 26 East. The completed interval of the Well will be orthodox. Also, to be considered will be the cost of drilling and completing the Well and the allocation of the cost, the designation of Applicant as the operator of the Well and Unit, and a 200% charge for the risk involved in drilling and completing the Well against any working interest owner who does not voluntarily participate. The Well is located approximately 8.9 miles south of Carlsbad, New Mexico.
4. 25754 Application of Powderhorn Operating, LLC for Compulsory Pooling, Eddy County, New Mexico. Applicant seeks an order pooling all uncommitted interest within the Bone Spring formation, underlying a 240-acre, more or less, standard horizontal well spacing unit comprised of the S/2 SE/4 of Section 3 and S/2 S/2 of Section 2, located in Township 24 South, Range 26 East, NMPM, Eddy County, New Mexico (the “Unit”). The Unit will be dedicated to the following well: Super Hornet State Com 204H, an oil well that will be horizontally drilled from a surface hole location 2,595’ FEL & 1,380’ FSL of Section 3, to a bottom hole location 100’ FEL & 660’ FSL of Section 2, Township 24 South, Range 26 East. The completed interval of the Well will be orthodox. Also, to be considered will be the cost of drilling and completing the Well and the allocation of the cost, the designation of Applicant as the operator of the Well and Unit, and a 200% charge for the risk involved in drilling and completing the Well against any working interest owner who does not voluntarily participate. The Well is located approximately 8.9 miles south of Carlsbad, New Mexico.
5. 25787 Application of Mewbourne Oil Company for Compulsory Pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order pooling all uncommitted mineral owners in a non-standard 1,600-acre, more or less, well spacing unit in the Bone Spring formation underlying All of Sections 27 and 28, and the E/2 of Section 29, Township 22 South, Range 26 East, NMPM, Eddy County, New Mexico. This spacing unit will be initially dedicated to the proposed McKittrick Draw 27/28 Federal Com 521H well, to be drilled from a surface location in the NE/4 SE/4 (Unit I) of Section 27, to a bottomhole location in the NW/4 NE/4 (Unit B) of Section 29; McKittrick Draw 27/28 Federal Com 523H well, to be drilled from a surface location in the NE/4 SE/4 (Unit I) of Section 27, to a bottomhole location in the SW/4 NE/4 (Unit G) of Section 29; and McKittrick Draw 27/28 Federal Com 526H well, to be drilled from a surface location in the NE/4 SE/4 (Unit I) of Section 27, to a bottomhole location in the NW/4 SE/4 (Unit J) of Section 29. Also to be considered will be the cost of drilling and completing the wells and the allocation of the costs thereof, the operating costs and charges for supervision, the designation of applicant as operator of the proposed spacing unit, and a 200% charge for risk involved in drilling said wells. 6. 25788 Application of Mewbourne Oil Company for Compulsory Pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order pooling all uncommitted mineral owners in a standard 800-acre, more or less, well spacing unit in the Wolfcamp formation underlying the N/2 of Sections 27 and 28, and the NE/4 of Section 29, Township 22 South, Range 26 East, NMPM, Eddy County, New Mexico. 8. 25768 Application of Permian Resources Operating, LLC for Compulsory Pooling, Eddy County, New Mexico. Applicant seeks an order pooling all uncommitted interests in the Bone Spring formation underlying a 643.38-acre, more or less, standard horizontal spacing unit comprised of the S/2 of Sections 29 and 30, Township 21 South, Range 26 East, Eddy County, New Mexico (“Unit”). The Unit will be dedicated to the GTO Fed Com 134H well (“Well”), which will produce from a first take point in Lot 24 (SE/4 SE/4 equivalent) of Section 29 to a last take point in Lot 4 (SW/4 SW/4) of Section 30. The completed interval of the Well will be orthodox. The completed interval of the GTO Fed Com 134H well will be located within 330’ of the quarter-quarter section line separating the N/2 S/2 and S/2 S/2 of Sections 29 and 30 to allow for the creation of a 643.38-acre standard, horizontal spacing unit. Also to be considered will be the cost of drilling and completing the Well and the allocation of the cost, the designation of Applicant as operator of the Well, and a 200% charge for the risk involved in drilling and completing the Well. 9. 25769 Application of Permian Resources Operating, LLC for Compulsory Pooling, Eddy County, New Mexico. 10. 25758 Application of E.G.L. Resources, Inc. to Extend Time to Commence Drilling Operations Under Order No. R-23684, Lea County, New Mexico. E.G.L. Resources, Inc. (“Applicant”) (OGRID No. 192373) seeks an order pooling additional uncommitted interests and extending the deadline to commence drilling the wells authorized by Order No. R-23684 (“Order”) until February 19, 2027. The Division issued the Order in Case No. 24185 on February 19, 2025. The Order: pooled all uncommitted interests in the Bone Spring formation underlying a 640-acre, more or less, standard horizontal spacing unit comprised of the S/2 of Sections 33 and 34, Township 18 South, Range 32 East, Lea County, New Mexico (“Unit”); dedicated the Unit to the Bond 32-34 Fed Com 104H, Bond 32-34 Fed Com 105H, Bond 32-34 Fed Com 106H, Bond 32-34 Fed Com 207H, Bond 32-34 Fed Com 209H, and Bond 32-34 Fed Com 211H wells (“Wells”); and designated Applicant as operator of the Unit and the Wells. The Order requires Applicant to commence drilling the Wells within one year of the date of the Order. Applicant requests that the Division extend the deadline to commence drilling the Wells by one year. The Wells are located approximately 10.5 miles south of Maljamar, New Mexico.
11. 25759 Application of PBEX, LLC to Extend Time to Commence Drilling Operations Under Order No. R-23685, Lea County, New Mexico. PBEX, Inc. (“Applicant”) seeks an order pooling additional uncommitted interests and extending the deadline to commence drilling the wells authorized by Order No. R-23685 (“Order”) until February 19, 2027. The Division issued the Order in Case No. 24886 on February 19, 2025. The Order: pooled all uncommitted interests in the Bone Spring formation underlying a 800-acre, more or less, standard horizontal spacing unit comprised of the NE/4 of Section 32, N/2 of Section 33, and N/2 of Section 34, Township 18 South, Range 32 East, Lea County, New Mexico (“Unit”); dedicated the Unit to the Bond 32-34 Fed Com 101H, Bond 32-34 Fed Com 102H, Bond 32-34 Fed Com 103H, Bond 32-34 Fed Com 201H, Bond 32-34 Fed Com 203H, and Bond 32-34 Fed Com 205H wells (“Wells”); and designated E.G.L. Resources, Inc. (OGRID No. 192373) as operator of the Unit and the Wells. The Order requires Applicant to commence drilling the Wells within one year of the date of the Order. Applicant requests that the Division extend the deadline to commence drilling the Wells by one year. The Wells are located approximately 10 miles south of Maljamar, New Mexico.
