PRELIMINARY DOCKET: Examiner Hearing for January 9, 2025

For hearings by affidavit: presenting parties are required to submit a pre-hearing statement no later than the Thursday before the hearing. The pre-hearing statement shall include: 1) a list of disputed facts and issues; 2) identification of witnesses and their qualifications; and 3) all exhibits and written testimony a party intends to enter into evidence at the hearing and a full narrative for each.

For contested matters: pre-hearing statements shall be filed no later than 9:00 a.m., 4 business days prior to the hearing and in addition to the requirements of 19.15.4.13.B(1) NMAC, shall include: all evidentiary exhibits, documents, affidavits, and full-written testimony of any witness a party offers at the hearing. Exhibits must be sequentially marked on every page.

Failure to timely file a complete pre-hearing statement may cause the Hearing Examiner to continue the hearing and/or impose sanctions up to and including the exclusion of late-filed evidence. Evidentiary objections must be filed no later than 48 hours before the hearing. Rulings on the objections will be addressed as a preliminary matter when the case is called.

Applicant seeks an order from the Division approving a non-standard spacing unit and pooling all uncommitted interests within a 1280-acre, more or less, Bone Spring horizontal spacing unit comprised of Sections 14 and 23, Township 19 South, Range 33 East, N.M.P.M., Lea County, New Mexico. The wells will be drilled at orthodox locations. The pool and pool code for Sections 14 and 23 is the Gem; Bone Spring, East Pool (Code 27230), which is an oil pool. Also to be considered will be the cost of drilling and completing said wells, the allocation of these costs as well as the actual operating costs and charges for supervision, designation of Avant Operating, LLC as operator of the wells, and a 200% charge for risk involved in drilling said wells. Said area is located approximately 23 miles west of Hobbs, New Mexico.
6. 24987 Application of Catamount Energy Partners, LLC, for Approval of a Non-Standard Horizontal Well Spacing Unit and Compulsory Pooling, San Juan and Rio Arriba Counties, New Mexico. Applicant in the above-styled cause seeks an order (a) creating a 1440-acre, more or less, non-standard horizontal well spacing unit in the Mancos formation [Basin Mancos (Gas) Pool (97232)] underlying the N2 and the N2S2 of Sections 13, 14 and 15, Township 32 North, Range 6 West, NMPM, San Juan and Rio Arriba Counties, New Mexico, and (b) pooling the uncommitted mineral owners in this proposed non-standard horizontal well spacing unit. Applicant seeks to initially dedicate the above-referenced spacing unit to the following proposed wells:
?    NLS 32-6-15 3H and NLS 32-6-15 4H wells to be drilled from a surface location in the NE4 of Section 16, with first take points in the SW4NW4 (Unit E) of Section 15 and last take points in the SE4NE4 (Unit H) of Section 13; and
?    NLS 32-6-15 5H well to be drilled from a surface location in the NE4 of Section 16, with a first take point in the NW4SW4 (Unit L) of Section 15 and a last take point in the NE4SE4 (Unit I) of Section 13.
Also, to be considered will be the necessity of the non-standard spacing unit, the cost of drilling and completing the proposed wells, the allocation of the cost thereof, the actual operating costs and charges for supervision, the designation of applicant as operator, and the imposition of 200% charge for risk involved in drilling and completing the wells. Said area is located approximately 19 miles northeast of the town of Navajo Dam, New Mexico.
7. 24989 Application of Spur Energy Partners LLC for Compulsory Pooling, Eddy County, New Mexico. Applicant seeks an order pooling all uncommitted interests in from the top of the Yeso formation to 5,000’ MD, underlying a 160-acre, more or less, standard horizontal spacing unit comprised of the N/2 S/2 of Section 7, Township 17 South, Range 30 East, Eddy County, New Mexico (“Unit”). Applicant seeks to dedicate the Unit to the Merak 7 Federal 10H and Merak 7 Federal 51H wells (“Wells”), to be drilled from surface hole locations in the NW/4 SW/4 (Unit L) of Section 8 to bottom hole locations in the NW/4 SW/4 (Unit L) of Section 7. The completed intervals of the wells will be orthodox. Applicant seeks to pool only those uncommitted interests in the Yeso formation from a stratigraphic equivalent of 4,225’ MD to 5,000’ MD as observed on the Anderson-Federal 1 well Schlumberger Sidewall Neutron Porosity Log (API No. 30-015-20565). Also to be considered will be the cost of drilling and completing the wells and the allocation of the costs, the designation of Applicant as the operator of the Wells, and a 200% charge for the risk involved in drilling and completing the Wells. The Wells are located approximately 3 miles northwest of Loco Hills, New Mexico.
8. 24993 Application of Mewbourne Oil Company for Compulsory Pooling and Approval of Non-Standard Spacing Unit, Eddy County, New Mexico. Mewbourne Oil Company (“Applicant”) applies for an order pooling all uncommitted interests in the Bone Spring formation underlying a 1,269.92 acre, more or less, non-standard horizonal spacing unit comprised of Sections 19 and 20, Township 21 South, Range 27 East, Eddy County, New Mexico (“Unit”). 9. 25002 Application of BTA Oil Producers, LLC for Compulsory Pooling and Approval of Non-Standard Spacing Unit, Lea County, New Mexico. BTA Oil Producers, LLC (“Applicant”) applies for an order pooling all uncommitted interests in the Pennsylvanian Shale formation underlying a 640 acre, more or less, non-standard horizontal spacing unit comprised of the W/2 SW/4 of Section 12, W/2 W/2 of Section 13, W/2 NW/4 of Section 24, E/2 SE/4 of Section 11, E/2 E/2 of Section 14, and the E/2 NE/4 of Section 23, Township 17 South, Range 35 East, Lea County, New Mexico (“Unit”). The Unit will be dedicated to the following wells (“Wells”): Box Elder 22115 24-13-12 State Com #3H, which will be drilled from a surface hole location in the SW/4 NW/4 (Unit E) of Section 24 to a bottom hole location in the NW/4 SW/4 (Unit L) of Section 12; and Box Elder 22115 23-14-11 State Com #4H, which will be drilled from a surface hole location in the SW/4 NW/4 (Unit E) of Section 24 to a bottom hole location in the NE/4 SE/4 (Unit I) of Section 11. The completed intervals of the Wells will be orthodox. The Wells are located approximately 7 miles southwest of Lovington, New Mexico.
10. 25003 Application of Steward Energy II, LLC for Compulsory Pooling, Lea County, New Mexico. Steward Energy II, LLC (“Applicant”) seeks an order pooling all uncommitted interests in the San Andres formation underlying a 479.62-acre, more or less, standard horizontal spacing unit comprised of the W/2 of Section 2 and the NW/4 of Section 11, Township 13 South, Range 38 East, Lea County, New Mexico (“Unit”). The Unit will be dedicated to the Vince Federal 5H well, to be drilled from a surface hole location in the SW/4 SW/4 (Unit M) of Section 35, Township 12 South, Range 38 East, to a bottom hole location in the SW/4 NW/4 (Unit E) of Section 11, Township 13 South, Range 38 East. The completed interval of the Well will be orthodox. The completed interval of the Well will be located within 330’ of the quarter-quarter section line separating the W/2 W/2 and E/2 W/2 of Section 2 and the W/2 NW/4 and E/2 NW/4 of Section 11 to allow for the creation of a 479.62-acre standard horizontal spacing unit. Also to be considered will be the cost of drilling and completing the Well and the allocation of the costs, the designation of Applicant as operator of the Well, and a 200% charge for the risk involved in drilling and completing the Well. The Well is located approximately 14.5 miles SE of Tatum, New Mexico.
11. 25004 Application of BTA Oil Producers, LLC for Compulsory Pooling, Lea County, New Mexico. Applicant seeks an order pooling all uncommitted interests in the Pennsylvanian Shale formation underlying a 319.42-acre, more or less, standard horizontal spacing unit comprised of the E/2 W/2 of Section 33, Township 16 South, Range 36 East, and Lot 3, SE/4 NW/4, and E/2 SW/4 (E/2 W/2 equivalent) of irregular Section 4, Township 17 South, Range 36 East, Lea County, New Mexico (“Unit”). Applicant seeks to dedicate the Unit to the Capitan 22301 33-4 State Com #23H well (“Well”), which will produce from a first take point in the NE/4 NW/4 (Unit C) of Section 33, Township 16 South, to a last take point in the SE/4 SW/4 (Unit N) of Section 4, Township 17 South. The completed interval of the Well will be orthodox. Also to be considered will be the cost of drilling and completing the Well and the allocation of the costs, the designation of Applicant as operator of the Well, and a 200% charge for the risk involved in drilling and completing the Well. The Well is located approximately 2 miles south of Lovington, New Mexico.
12. 25005 Application of COG Operating LLC for Compulsory Pooling and Approval of Non-Standard, Overlapping Spacing Unit, Lea County, New Mexico. COG Operating LLC (“Applicant”) seeks an order: (1) establishing a 1,268.12-acre, more or less, non-standard, overlapping horizontal spacing unit comprised of all of irregular Sections 6 and 7, Township 24 South, Range 33 East, Lea County, New Mexico (“Unit”); and (2) pooling uncommitted interests in the Bone Spring formation within the Unit, save and except the Avalon interval defined as the depths lying between the stratigraphic equivalent of 9,175’ and 10,090’ TVD. Applicant seeks to dedicate the Unit to the following proposed wells (“Wells”): Macho Nacho State Com 601H, which will be drilled from a surface hole location in the SW/4 SE/4 (Unit O) of Section 7 to a bottom hole location in Lot 1 (NE/4 NE/4 equivalent) of Section 6; Macho Nacho State Com 603H, which will be drilled from a surface hole location in the SW/4 SE/4 (Unit O) of Section 7 to a bottom hole location in Lot 2 (NW/4 NE/4 equivalent) of Section 6; Macho Nacho State Com 605H, which will be drilled from a surface hole location in the SE/4 SW/4 (Unit N) of Section 7 to a bottom hole location in Lot 3 (NE/4 NW/4 equivalent) of Section 6; and Macho Nacho State Com 607H, which will be drilled from a surface hole location in the SE/4 SW/4 (Unit N) of Section 7 to a bottom hole location in Lot 4 (NW/4 NW/4 equivalent) of Section 6. Also to be considered will be the cost of drilling and completing the Wells and the allocation of the costs, the designation of Applicant as operator of the Wells, and a 200% charge for the risk involved in drilling and completing the Wells. The Wells are located approximately 25 miles northwest of Jal, New Mexico.
13. 25010 CASE NO. ________: Application of Civitas Permian Operating, LLC to Extend the Deadline to Commence Drilling Operations Under Order No. R-22603-A, Lea County, New Mexico. Applicant seeks an order from the Division to extend the time to commence drilling operations under Order No. R-22603-A. On March 30, 2023, the OCD issued Order No. R-22603 in Case No. 22933, which: a. pooled all uncommitted interests within the Bone Spring formation underlying a 640-acre, more or less, standard horizontal spacing unit (“Unit”) comprised of the E/2 of Sections 11 and 14, Township 20 South, Range 32 East, NMPM, Lea County, New Mexico; b. dedicated the Unit to the Double Stamp Fed Com #113H, #123H, #126H, #133H, #153H, #114H, #116H, #124H, #128H, #134H, #136H, #154H and #174H wells (“Wells”); and c. designated Civitas as operator of the Unit and Wells. On January 31, 2024, the OCD issued Order No. R-22603-A (the “Order”) in Case No. 24007 extending the deadline to commence drilling operations for the Wells until March 31, 2025. As identified in the application in Case No. 24007, the extension request was due to delays in obtaining federal permits for the Wells which are located within the potash area. Good cause exists to extend the deadline to commence drilling operations for the Wells since the drilling permits on file with the Bureau of Land Management are still pending approval. Said area is located approximately 35 miles southwest of Hobbs, New Mexico.
14. 25012 CASE NO. ________: Application of Civitas Permian Operating, LLC to Extend the Deadline to Commence Drilling Operations Under Order No. R-22604-A, Lea County, New Mexico. Applicant seeks an order from the Division to extend the time to commence drilling operations under Order No. R-22604-A. On March 30, 2023, the OCD issued Order No. R-22604 in Case No. 22934, which: pooled all uncommitted interests within the Bone Spring formation underlying a 640-acre, more or less, standard horizontal spacing unit (“Unit”) comprised of the W/2 of Sections 11 and 14, Township 20 South, Range 32 East, NMPM, Lea County, New Mexico; dedicated the Unit to the Double Stamp Fed Com #111H, #112H, #115H, #121H, #122H, #125H, #127H, #131H, #132H, #135H, #151H, #152H, #171H and #172H wells (“Wells”); and designated Civitas as operator of the Unit and Wells. On January 31, 2024, the OCD issued Order No. R-22604-A (the “Order”) in Case No. 24008 extending the deadline to commence drilling operations for the Wells until March 31, 2025. As identified in the application in Case No. 24008, the extension request was due to delays in obtaining federal permits for the Wells, which are located within the potash area. Good cause exists to extend the deadline to commence drilling operations for the Wells since the drilling permits on file with the Bureau of Land Management are still pending approval. Said area is located approximately 35 miles southwest of Hobbs, New Mexico.
15. 25022 Application of 3R Operating LLC to Pool Additional Interests Under Order No. R-22846, Eddy County, New Mexico. 3R Operating LLC, as successor in interest to Flat Creek Resources, LLC, (“Applicant”) seeks to pool additional interests under Order No. R 22846 (“Order”). The Order: (1) pooled uncommitted interests in the Wolfcamp formation underlying a 640-acre, more or less, non-standard horizontal spacing unit comprised of the W/2 of Sections 7 and 18, Township 23 South, Range 26 East, Eddy County, New Mexico (“Unit”); dedicated the Unit to the Rena 7 Fed Com 702H well (“Well”); and designated Applicant as operator of the Unit and Well. Since the Order was entered, Applicant has identified additional uncommitted interests in the Unit that should be pooled under the terms of the Order. The Well is located approximately 4 miles southwest of Carlsbad, New Mexico.
16. 25023 Application of 3R Operating LLC to Pool Additional Interests Under Order No. R-22847, Eddy County, New Mexico. 3R Operating LLC, as successor in interest to Flat Creek Resources, LLC, (“Applicant”) seeks to pool additional interests under Order No. R 22847 (“Order”). The Order: (1) pooled uncommitted interests in the Wolfcamp formation underlying a 640-acre, more or less, standard horizontal spacing unit comprised of the E/2 of Sections 7 and 18, Township 23 South, Range 26 East, Eddy County, New Mexico (“Unit”); dedicated the Unit to the Rena 7 Fed Com 704H well (“Well”); and designated Applicant as operator of the Unit and Well. Since the Order was entered, Applicant has identified additional uncommitted interests in the Unit that should be pooled under the terms of the Order. o    320-acres spacing unit comprised of the NW/4, E/2 NW/4, and Lots 1-2 (N/2 equivalent) of irregular Section 30 dedicated to the Rock Ridge Federal BSS 7H (API: 30-015-45731) well currently operated by 3R Operating, LLC;
o    160-acre spacing unit comprised of the N/2 SE/4, NE/4 SW/4 and Lot 3 (N/2 S/2 equivalent) of irregular Section 30 dedicated to the Malaga 30 LI Fed Com 1H (API: 30-015-42193) well currently operated by Mewbourne Oil Company; and
