PRELIMINARY DOCKET: Examiner Hearing for Thursday, March 16, 2023

For hearings by affidavit: presenting parties are required to submit a pre-hearing statement no later than the Thursday before the hearing. The pre-hearing statement shall include: 1) a list of disputed facts and issues; 2) identification of witnesses and their qualifications; and 3) all exhibits and written testimony a party intends to enter into evidence at the hearing and a full narrative for each.

For contested matters: pre-hearing statements shall be filed no later than 9:00 a.m., 4 business days prior to the hearing and in addition to the requirements of 19.15.4.13.B(1) NMAC, shall include: all evidentiary exhibits, documents, affidavits, and full-written testimony of any witness a party offers at the hearing. Exhibits must be sequentially marked on every page.

Failure to timely file a complete pre-hearing statement may cause the Hearing Examiner to continue the hearing and/or impose sanctions up to and including the exclusion of late-filed evidence. Evidentiary objections must be filed no later than 48 hours before the hearing. Rulings on the objections will be addressed as a preliminary matter when the case is called.

Said unit will be initially dedicated to the proposed Romeo Federal Com #311H well, to be horizontally drilled from a surface location in the SW/4 NW/4 (Unit E) of Section 27, to a bottom hole location in the NW/4 NW/4 (Unit D) of Section 22. This 240-acre horizontal spacing unit will overlap the following existing horizontal well spacing units covering portions of the subject acreage:

Said area is located approximately 24 miles southwest of Eunice, New Mexico.
2. 23379 Application of Cimarex Energy Co. to Amend Order No. R-22198 for a One-Year Extension of the Well Commencement Deadline, Eddy County, New Mexico. Applicant in the above-styled cause seeks to re-open Case No. 22751 and amend Division Order No. R-22198 in order to obtain, based on good cause shown, a one-year extension of the well commencement deadline, such that the drilling deadline would be extended to July 25, 2024. Order No. R-22198 pooled uncommitted interest owners and granted Applicant operating rights for four wells: the Riverbend 11-14 Federal Com 7H, 15H, 16H, and 17H Wells, proposed to be drilled into the Wolfcamp formation and dedicated to the unit underlying the W/2 of Sections 11 and 14, Township 25 South, Range 28 East, NMPM, Eddy County, New Mexico. The wells and lands are located approximately 9 miles south of Loving, NM.
3. 23344 Application of COG Operating LLC for Compulsory Pooling, Eddy County, New Mexico. COG Operating LLC (“Applicant”) seeks an order pooling all uncommitted interests in the Wolfcamp formation underlying a 1,535.8-acre, more or less, standard horizontal spacing unit comprised of Sections 23 and 26, and the N/2 N/2 and Lots 1, 2, 3, and 4 (“all”) of irregular Section 35, Township 26 South, Range 28 East, Eddy County, New Mexico (“Unit”). The completed intervals of the Wells will be orthodox. The completed interval of the Keg Shell Fed Com 906H well will be located within 330’ of the line separating the E/2 and W/2 of Sections 23, 26, and 35 to allow for the creation of a 1,535.8-acre standard horizontal spacing unit. Also to be considered will be the cost of drilling and completing the wells and the allocation of the costs, the designation of Applicant as the operator of the Wells, and a 200% charge for the risk involved in drilling and completing the Wells. The Wells are located approximately 13.6 miles south of Malaga, New Mexico.
4. 23384 Application of ConocoPhillips Company to Remove Cambrian Management, Ltd as Operator of Record of the Chem State #2, Chem State #5, and Chem State #6 Wells, Lea County, New Mexico. Applicant seeks an order: (1) removing Cambrian Management, Ltd. (“Cambrian”) as operator of record of the Chem State #2, Chem State #5, and Chem State #6 wells (“Wells”); and (2) designating ConocoPhillips Company (“ConocoPhillips”) as the operator of record. ConocoPhillips is record title owner of State Lease #B0-9680 (“Lease”) covering lands in Lots 1, 2, 3, 4, S/2 NE/4, SW/4 NW/4, SW/4, SE/4 of Township 15 South, Range 32 East, N.M.P.M. Cambrian (OGRID No. 198688) is the operator of record of Wells located on the Lease at the following locations: Chem State #2 (API # 30-025-00336) – 2240’ from the north line (Unit H) and 658’ from the east line (Unit H) of Section 3, Township 15 South, Range 32 East, Lea County; Chem State #5 (API # 30-025-23273) – 1980’ from the south line (Unit K) and 1980’ from the west line (Unit K) of Section 3, Township 15 South, Range 32 East, Lea County; and Chem State #6 (API # 30-025-27977) – 2229’ from the north line (Unit E) and 660’ from the west line (Unit E) of Section 3, Township 15 South, Range 32 East, Lea County. The Wells were completed in the Tulk; Wolfcamp Pool (Pool No. 60420). As operator of record, Cambrian is obligated to properly plug and abandon the Wells but is unavailable. As record title owner of the Lease, ConocoPhillips intends to properly plug and abandon the Wells. The Wells are located approximately 20 miles northeast of Lovington, New Mexico.
5. 21967 Application of Devon Energy Production Company, L.P. for compulsory pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order pooling all uncommitted interest owners in the Bone Spring formation underlying a standard 640-acre, more or less, horizontal spacing unit comprised of the N/2 of Sections 23 and 24, Township 20 South, Range 29 East, NMPM, Eddy County, New Mexico. Applicant seeks to dedicate the above-referenced horizontal spacing unit to the proposed initial Tiger Paw 24-23 Fed Com #331H well, to be horizontally drilled from a surface hole location in the NE/4 NE/4 (Unit A) of Section 24 to a bottom hole location in the NW/4 NW/4 (Unit D) of Section 23. 17. 22947 Application of EOG Resources, Inc. for compulsory pooling, Lea County, New Mexico. Applicant in the above-styled cause seeks an order pooling all uncommitted interest owners in the Bone Spring formation underlying a standard 640-acre, more or less, horizontal spacing unit comprised of the E/2 of Sections 23 and 26, Township 24 South, Range 34 East, NMPM, Lea County, New Mexico. Applicant seeks to dedicate the above-referenced horizontal spacing unit to the following proposed wells:
•    Grackle 23 Fed Com 101H, Grackle 23 Fed Com 301H and the Grackle 23 Fed Com 302H to be drilled from the NW/4 NE/4 (Unit B) of Section 23 to a bottomhole location in the SW/4 SE/4 (Unit O) of Section 26.
•    Grackle 23 Fed Com 102H, Grackle 23 Fed Com 103H, Grackle 23 Fed Com 303H, Grackle 23 Fed Com 304H, and the Grackle 23 Fed Com 305H to be drilled from the NE/4 NE/4 (Unit A) of Section 23 to a bottomhole location in the SE/4 SE/4 (Unit P) of Section 26.
The completed interval of the Grackle 23 Fed Com 101H and the Grackle 23 Fed Com 303H are expected to remain within 330 feet of the adjoining quarter-quarter section (or equivalent) tracts to allow inclusion of these proximity tracts within the proposed horizontal spacing unit under NMAC 19.15.16.15.B(1)(b).    Also, to be considered will be the cost of drilling and completing the wells, the allocation of the cost thereof, the actual operating costs and charges for supervision, the designation of applicant as operator, and the imposition of 200% charge for risk involved in drilling and completing each well. Said area is located approximately 15 miles northwest of Jal, New Mexico.
18. 23158 Application of Franklin Mountain Energy, LLC for compulsory pooling, Lea County, New Mexico. Applicant seeks an order from the Division pooling all uncommitted interests within a standard 160-acre, more or less, Leonard/Avalon horizontal spacing unit underlying the W/2W/2 of Section 35, Township 25 South, Range 35 East, N.M.P.M., Lea County, New Mexico. This spacing unit will be dedicated to the Forge Fed Com 101H well, to be horizontally drilled. The producing area for the well is expected to be orthodox. Also to be considered will be the cost of drilling and completing said well, the allocation of these costs as well as the actual operating costs and charges for supervision, designation of Franklin Mountain Energy, LLC as operator of the well, and a 200% charge for risk involved in drilling said well. Said area is located approximately 24-25 miles northwest of Jal, New Mexico.

Tap Rock Operating, LLC (“TRO”) applies for an order pooling all uncommitted interests within the Bone Spring formation underlying a 640-acre, more or less, standard horizontal spacing unit (“Unit”) comprised of the E/2 of Sections 10 and 15, Township 20 South, Range 33 East, NMPM, Lea County, New Mexico. The Unit will be dedicated to the following proposed initial wells (“Wells”):
•    PATG Federal Com #123H, #126H, #143H, #153H #173H and #163H wells to be horizontally drilled from a surface hole location in the SW/4SE/4 of Section 15 to a bottom hole location in the NW/4NE/4 of Section 10, and
•    PATG Federal Com #124H, #166H, #144H, #154H, #164H and #174H wells to be horizontally drilled from a surface hole location in the SW/4SE/4 of Section 15 to a bottom hole location in the NE/4NE/4 of Section 10.
The completed interval for the PATG Federal Com #166H will be within 330’ of the quarter-quarter line separating the W/2E/2 from the E/2E/2 of Sections 10 and 15 to allow the inclusion of this acreage into a standard horizontal spacing unit. Also, to be considered will be the cost of drilling and completing the Wells and the allocation of the cost, the designation of Tap Rock Operating, LLC as operator of the Unit and Wells, and a 200% charge for risk involved in drilling and completing the Wells. The Unit is located approximately 33 miles southwest of Hobbs, New Mexico.
