PRELIMINARY DOCKET: Examiner Hearing for Thursday, July 6, 2023

Applications for hearing shall be filed at least thirty (30) days in advance of the hearing date. A party who intends to present evidence shall file a pre-hearing statement no later than the close of business on the Thursday prior to the hearing date and serve a copy on the other parties, if any. The hearing examiner will dismiss the application if the applicant does not file and serve a pre-hearing statement as specified above. 4. 22971 Application of FAE II Operating, LLC for Approval of an Enhanced Oil Recovery Project and to Qualify the Project for the Recovered Oil Tax Rate, Lea County, New Mexico. Applicant applies for an order approving an enhanced oil recovery project (secondary and tertiary recovery) in the South Jal Unit Area by the injection of water and gas into the Yates-Seven Rivers-Queen formation in wells located on approximately 19,369.77 acres of federal, state, and fee lands located in Lea County that include all or parts of: Township 25 South, Range 36 East – Sections 13, 24-26, 36; Township 25 South, Range 37 East – Sections 15, 16, 18, 19, 21-23, 26-28, 30-35; Township 26 South, Range 37 East – Sections 3-10, 15-23, 29, 32. Applicant proposes to: convert four producing wells to injection wells, drill 11 new injection wells, and reactivate one injection well in the Queen Formation; convert five producing wells to injection wells and drill three new injection wells in the Yates Formation; and convert three producing wells to injection wells in the Moberly Rhodes, Yates-Seven Rivers Formation. Applicant seeks authorization to include additional injection wells within the project administratively. Applicant also requests that the enhanced oil recovery project be qualified for the recovered oil tax rate, pursuant to the Enhanced Oil Recovery Act, NMSA 1978, Sections 7-29A-1 to -5, and New Mexico Oil Conservation Division regulations. The project area is centered approximately 2.25 miles South of Jal, New Mexico.
5. 22988 Application of Matador Production Company for compulsory pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order pooling all uncommitted interests in the Bone Spring formation underlying a standard 320-acre, more or less, horizontal well spacing unit comprised of the S/2 S/2 of Sections 11 and 12, Township 24 South, Range 27 East, NMPM, Eddy County, New Mexico. Said unit will be initially dedicated to the proposed David Edelstein State Com #114H well and David Edelstein State Com #124H well, to be horizontally drilled from a surface location in the SE/4 SE/4 (Unit P) of Section 12 to a bottom hole location in the SW/4 SW/4 (Unit M) of Section 11. 6. 23572 Application of Riley Permian Operating Company LLC for approval of a salt water disposal well in Eddy County, New Mexico. Applicant seeks an order for a salt water disposal well for its Angel Ranch SWD#1, (Pool Code 96099) to be drilled at a location 1,320' FSL and 1,320' FEL, Unit A, Section 12, Township 19 South, Range 27 East, N.M.P.M., Eddy County, New Mexico for injection into the Cisco formations at depths between 8,586' through 9,210' open hole. The well will be located approximately 18 miles north of Carlsbad, New Mexico.
7. 23573 Application of Riley Permian Operating Company LLC for approval of a salt water disposal well in Eddy County, New Mexico. Applicant seeks an order for a salt water disposal well for its Angel Ranch SWD#2, (Pool Code 96099) to be drilled at a location 588' FNL and 2,157' FEL, Unit B, Section 11, Township 19 South, Range 27 East, N.M.P.M., Eddy County, New Mexico for injection into the Cisco formations at depths between 8,450' through 8,975' open hole. The well will be located approximately 18 miles north of Carlsbad, New Mexico.
8. 23578 Application of Steward Energy II, LLC for Compulsory Pooling, Lea County, New Mexico. Applicant seeks an order pooling all uncommitted interests in the San Andres formation underlying a 265.00-acre, more or less, standard horizontal spacing unit comprised of the E/2 of irregular Section 11, Township 13 South, Range 38 East, Lea County, New Mexico (“Unit”). The Unit will be dedicated to the Gale Federal 2H well (“Well”), to be drilled from a surface hole location in the SW/4 SE/4 (Unit O) of Section 2, Township 13 South, Range 38 East, to a bottom hole location in the SW/4 SE/4 (Unit O) of Section 11, Township 13 South, Range 38 East. The completed interval of the Well will be orthodox. The completed interval of the Well will be located within 330’ of the quarter-quarter section line separating the W/2 E/2 and E/2 E/2 of Section 11 to allow for the creation of a 265.00-acre standard horizontal spacing unit. Also to be considered will be the cost of drilling and completing the Well and the allocation of the cost, the designation of Applicant as the operator of the Well, and a 200% charge for the risk involved in drilling and completing the Well. The Well is located approximately 14.8 miles SE of Tatum, New Mexico.
9. 23602 Application of COG Operating LLC for Compulsory Pooling and Approval of Non-Standard, Overlapping Spacing Unit, Eddy County, New Mexico. Applicant applies for an order: (1) establishing a 1,920.38-acre, more or less, non-standard, overlapping horizontal spacing unit comprised of Sections 19, 30, and 31, Township 25 South, Range 29 East, Eddy County, New Mexico (“Unit”); and (2) pooling all uncommitted interests in the Bone Spring formation underlying the Unit from approximately 8,026’ TVD to the base of the Bone Spring formation. The Unit will be dedicated to the following wells (“Wells”): Wild Thing Fed Com 501H and Wild Thing Fed Com 502H wells, which will be drilled from surface hole locations in the SW/4 SE/4 (Unit O) of Section 31 to bottom hole locations in the NW/4 NE/4 (Unit B) of Section 19; Wild Thing Fed Com 503H well, which will be drilled from a surface hole location in the SE/4 SW/4 (Unit N) of Section 31 to a bottom hole location in the NE/4 NW/4 (Unit C) of Section 19; and Wild Thing Fed Com 504H well, which will be drilled from a surface hole location in the SE/4 SW/4 (Unit N) of Section 31 to a bottom hole location in the NW/4 NW/4 (Unit D) of Section 19. The completed intervals of the wells will be orthodox. Due to a depth severance in the Bone Spring formation within the Unit, Applicant seeks to pool interests from approximately 8,026’ TVD to the base of the Bone Spring formation. The Unit will partially overlap with the spacing units for the following wells: Showstopper 19 Federal #003H (API No. 30-015-37682), Showstopper 19 Federal Com #004H (API No. 30-015-37374), Showstopper 19 Federal Com #005H (API No. 30-015-37373), and Showstopper 19 Federal #006H (API No. 39-015-37480) wells; Thriller BWL Federal #001H well (API No. 30-015-43909); and the Cooper 31 Federal #001H (API No. 30-015-36282), Cooper 31 Federal #003H (API No. 30-015-37749), and Cooper 31 Federal #004H (API No. 30-015-33943) wells. 11. 23604 Application of XTO Energy Inc. for Compulsory Pooling, Lea County, New Mexico. Applicant in the above-styled cause seeks an order pooling all uncommitted interests in the stratigraphic equivalent of the top of the Bone Spring formation to base of the Second Bone Spring interval underlying a standard 633.36-acre horizontal spacing unit comprised of the W/2 equivalent of irregular Sections 30 and 31, Township 19 South, Range 35 East, NMPM, Lea County, New Mexico. Said horizontal spacing unit will be initially dedicated to the following proposed wells:
•    Perla Verde 31 State Com 201H, Perla Verde 31 State Com 401H, and Perla Verde 31 State Com 403H wells to be horizontally drilled with first take points in the SW4SW4 equivalent (Lot 4) of irregular Section 31 and last take points in the NW4NW4 equivalent (Lot 1) of irregular Section 30;
•    Perla Verde 31 State Com 203H and Perla Verde 31 State Com 402H wells to be horizontally drilled with first take points in the SE4SW4 (Unit N) of irregular Section 31 and last take points in the NE4NW4 (Unit C) of irregular Section 30; and
The completed interval for the Perla Verde 31 State Com 403H is expected to remain within 330 feet of the offsetting quarter-quarter sections or equivalent tracts to allow inclusion of these tracts in a horizontal well standard spacing unit pursuant to NMAC 19.15.16.15.B. Also to be considered will be the cost of drilling and completing the wells and the allocation of the cost thereof, the actual operating costs and charges for supervision, the designation of applicant as operator of the wells and the imposition of a 200% charge for risk involved in drilling said well. This area is located approximately 17 miles west of Hobbs, New Mexico.
12. 23605 Application of MRC Permian Company for Approval of an Overlapping Horizontal Well Spacing Unit and Compulsory Pooling, Lea County, New Mexico. Applicant in the above-styled cause seeks an order (a) approving a standard 400-acre, more or less, overlapping horizontal well spacing unit in the Bone Spring formation comprised of the W/2 SE/4 of Section 6 and the W/2 E/2 of Sections 7 and 18, Township 21 South, Range 33 East, NMPM, Lea County, New Mexico, and (b) pooling all uncommitted mineral interests in this overlapping horizontal well spacing unit. Said unit will be initially dedicated to the proposed Horseshoe Fed Com #113H, Horseshoe Fed Com #123H, and Horseshoe Fed Com #137H wells, all to be horizontally drilled from a surface location in the NW/4 NE/4 (Unit B) of Section 19 to a bottom hole location in the NW/4 SE/4 (Unit J) of Section 6. This 400-acre horizontal well spacing unit will overlap the following existing horizontal well spacing units covering portions of the subject acreage:
•    240-acre, more or less, horizontal well spacing unit comprised of the W/2 SE/4 of Section 6 and the W/2 E/2 of Section 7, Township 21 South, Range 33 East, dedicated to the Adams State Com #3H (API: 30-025-40308); and
•    160-acre, more or less, horizontal well spacing unit comprised of the W/2 E/2 of Section 18, Township 21 South, Range 33 East, dedicated to the Horseshoe Fed Com #601H (API: 30-025-47056).
Also, to be considered will be the cost of drilling and completing the wells and the allocation of the cost thereof, actual operating costs and charges for supervision, designation of Matador Production Company as operator of the wells, and a 200% charge for risk involved in drilling said wells. Said area is located approximately 36 miles east of Carlsbad, New Mexico.

Applicant in the above-styled cause seeks an order authorizing it to drill and operate an injection well for purposes of disposing produced salt water to be named the Doc Gooden SWD #1 Well (API No. pending), which will be located 1,596 feet from the south line and 1,334 feet from the east line (Unit J) in Section 3, Township 21 South, Range 36 East, NMPM, Lea County, New Mexico. Injection will be into the San Andres formation [SWD; San Andres (Pool Code 96121)] between approximately 4,200 feet and 4,900 feet below the ground through a perforated completion. The unitized interval extends from the top of the Yates Formation to the base of the Queen Formation. Among the matters to be considered at hearing, pursuant to the New Mexico Statutory Unitization Act, NMSA 1978, §§ 70-7-1 et seq., will be: the necessity of unit operations; the determination of horizontal and vertical limits of the unit area; the determination of the fair, reasonable, and equitable allocation of production and costs of production, including capital investments, to each of the tracts in the unit area; the determination of credits and charges to be made among the working interest owners in the unit area for their investment in wells and equipment; and such other matters as may be necessary and appropriate. Applicant also requests that the Rhodes Unit, approved by Division Order No. 772, be terminated pursuant to the Bureau of Land Management’s agreement to dissolve the Rhodes Unit and incorporate the area into the South Jal Unit.
