PRELIMINARY DOCKET: Examiner Hearing for Thursday, August 5, 2021

Applications for hearing shall be filed at least thirty (30) days in advance of the hearing date. A party who intends to present evidence shall file a pre-hearing statement no later than the close of business on the Thursday prior to the hearing date and serve a copy on the other parties, if any. The hearing examiner will dismiss the application if the applicant does not file and serve a pre-hearing statement as specified above. COG Operating LLC seeks to dedicate the above-referenced horizontal spacing unit to the following proposed wells:
•    The Dolores Fed Com 701H well to be horizontally drilled from a surface hole location in the SE/4SE/4 (Unit P) of Section 2 to a bottom hole location in the NE/4NE/4 (Unit A) of Section 35,
•    The Dolores Fed Com 702H well to be horizontally drilled from a surface hole location in the SW/4SE/4 (Unit O) of Section 2 to a bottom hole location in the NW/4NE/4 (Unit B) of Section 35, and
•    The Dolores Fed Com 703H well to be horizontally drilled from a surface hole location in the SW/4SE/4 (Unit O) of Section 2 to a bottom hole location in the NW/4NE/4 (Unit B) of Section 35.
Also, to be considered will be the allocation of the cost thereof, the actual operating costs and charges for supervision, the designation of COG Operating LLC as operator of the wells, and the imposition of 200% charge for risk involved in drilling and completing said wells. 2. 21269 Application of COG Operating LLC for Compulsory Pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order from the Division pooling all uncommitted interest owners in the Wolfcamp formation, Purple Sage-Wolfcamp Gas Pool (Pool code 98220), underlying a standard 640-acre, more or less, horizontal spacing unit comprised of the W/2 of Section 2, Township 26 South, Range 28 East, and the W/2 of Section 35, Township 25 South, Range 28 East, NMPM, Eddy County, New Mexico. COG Operating LLC seeks to dedicate the above-referenced horizontal spacing unit to the following proposed wells:
•    The Dolores Fed Com 704H well to be horizontally drilled from a surface hole location in the SE/4SW/4 (Unit N) of Section 2 to a bottom hole location in the NE/4NW/4 (Unit C) of Section 35,

COG Operating LLC seeks to dedicate the above-referenced horizontal spacing unit to the following proposed wells:
•    The Huevos Rancheros State Com 701H well to be horizontally drilled from a surface hole location in the SE/4SE/4 (Unit P) of Section 7 to a bottom hole location in the NE/4NE/4 (Unit A) of Section 6,
•    The Huevos Rancheros State Com 702H well to be horizontally drilled from a surface hole location in the SE/4SE/4 (Unit P) of Section 7 to a bottom hole location in the NW/4NE/4 (Unit B) of Section 6, and
•    The Huevos Rancheros State Com 703H well to be horizontally drilled from a surface hole location in the SW/4SE/4 (Unit O) of Section 7 to a bottom hole location in the NW/4NE/4 (Unit B) of Section 6.
Also, to be considered will be the allocation of the cost thereof, the actual operating costs and charges for supervision, the designation of COG Operating LLC as operator of the wells, and the imposition of 200% charge for risk involved in drilling and completing said wells. Said area is located approximately 9.9 miles southeast of Malaga, New Mexico.
4. 21937 Application of Spur Energy Partners, LLC for Compulsory Pooling, Eddy County, New Mexico. Applicant seeks an order pooling all uncommitted mineral interests in the Yeso formation underlying a 320-acre, more or less, standard horizontal spacing unit comprised of the S/2 of Section 36, Township 17 South, Range 27 East, Eddy County, New Mexico (“Unit”). The Unit will be dedicated to following wells:
•    Waukee C 36 State Com 2H, Waukee C 36 State Com 11H, and Waukee C 36 State Com 51H, which will be horizontally drilled from a surface location in the NW/4SW/4 (Unit L) of Section 31 to a bottom hole location in the NW/4SW/4 (Unit L) of Section 36; and
•    Waukee D 36 State Com 1H, Waukee D 36 State Com 10H, and Waukee D 36 State Com 50H, which will be horizontally drilled from a surface location in the SW/4SW/4 (Unit M) of Section 31 to a bottom hole location in the SW/4SW/4 (Unit M) of Section 36 (collectively the “Wells”).
The completed interval of the Waukee C 36 State Com 2H is unorthodox. The completed intervals of the remaining Wells are orthodox. The completed interval for the Waukee D 36 State Com 1H will be within 330’ of the line separating the N/2S/2 and S/2S/2 of Section 36 to allow inclusion of this acreage into a standard 320-acre horizontal spacing unit.
Also to be considered will be the cost of drilling and completing the wells and the allocation of the cost, the designation of Spur Energy Partners, LLC as the operator of the wells, and a 200% charge for the risk involved in drilling and completing the wells. The wells are located approximately four (4) miles southeast of Riverside, New Mexico.
5. 22029 Application of Chevron U.S.A., Inc., for Compulsory Pooling, Lea County, New Mexico. Applicant in the above-styled cause seeks an order pooling all uncommitted interests in the Bone Spring formation (Lower Avalon: Red Tank; Bone Spring East and TBS: WC-025 G-06 S213326D; Bone Spring) underlying a standard 640-acre, more or less, horizontal spacing unit comprised of the E/2 of Section 9 and the E/2 of Section 16, Township 22 South, Range 33 East, NMPM, Lea County, New Mexico. Applicant seeks to dedicate the above-referenced horizontal spacing unit to the following three proposed initial wells: the DL 9 16 Loch Ness Fed Com 16H well and the DL 9 16 Loch Ness Fed Com 17H well, both horizontally drilled from surface hole locations in the SW/4SE/4 (Unit O) of Section 4 to bottom hole locations in the SE/4SW/4 (Unit O) of Section 16; and the DL 9 16 Loch Ness Fed Com 18H well horizontally drilled from a surface hole location in the SE/4SE/4 (Unit P) of Section 4 to a bottom hole location in the SE/4SE/4 (Unit P) of Section 16. Said area is located approximately 24 miles East of Loving, New Mexico.
6. 22030 Application of EOG Resources, Inc. for compulsory pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order pooling all uncommitted interest owners in the Bone Spring formation underlying a standard 160-acre, more or less, horizontal spacing unit comprised of the S/2 N/2 of Section 16, Township 19 South, Range 25 East, NMPM, Eddy County, New Mexico. Applicant seeks to dedicate the above-referenced horizontal spacing unit to the initial Boyd X State Com #15H well (API No. 30-015-42223) that has been drilled from a surface location in the SE/4 NE/4 (Unit H) of Section 16 to a bottom hole location in the SW/4 NW/4 (Unit E) of Section 16. The completed interval for the well will comply with statewide setbacks for oil wells. Also, to be considered will be the cost of drilling and completing the well, the allocation of the cost thereof, the actual operating costs and charges for supervision, the designation of applicant as operator, and the imposition of 200% charge for risk involved in drilling and completing the well. 7. 22031 Application of EOG Resources, Inc. for compulsory pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order pooling all uncommitted interest owners in the Wolfcamp formation underlying a standard 320-acre, more or less, spacing unit comprised of the W/2 of Section 25, Township 19 South, Range 24 East, NMPM, Eddy County, New Mexico. Applicant seeks to dedicate the above-referenced spacing unit to the initial March AMT Federal Com #1 well (API No. 30-015-27506) that has been drilled from a surface location in the SE/4 SW/4 (Unit N) of Section 25. The completed interval for the well will comply with statewide setbacks for gas wells. Also, to be considered will be the cost of drilling and completing the well, the allocation of the cost thereof, the actual operating costs and charges for supervision, the designation of applicant as operator, and the imposition of 200% charge for risk involved in drilling and completing the well. Said area is located approximately 6 miles west of Lakewood, New Mexico.
8. 22032 Application of Catena Resources Operating, LLC to Amend Order No. R-21436, Lea County, New Mexico. Applicant in the above-styled cause seeks a year extension of time for drilling the well under Order No. R-21436. The Unit is comprised of the Bone Spring formation underlying a standard 640-acre, more or less, horizontal spacing unit in the W/2 of Sections 22 and 27, Township 18 South, Range 35 East, Lea County, New Mexico. Order No. R-21436 dedicated the Unit to the initial Ladder 183527 #1H well to be drilled from a surface location in the SW/4 SW/4 (Unit M) of Section 27 to a bottom hole location in the NW/4 NW/4 (Unit D) of Section 22. Said area is located approximately 20 miles west of Hobbs, New Mexico.
9. 22033 Application of Kaiser-Francis Oil Company for compulsory pooling, Eddy County, New Mexico. Kaiser-Francis Oil Company seeks an order pooling all mineral interest owners in the Delaware formation underlying a horizontal spacing unit comprised of the E/2NE/4 of Section 25 and the E/2E/2 of Section 24, Township 23 South, Range 28 East, NMPM. The unit will be dedicated to the Wright Fed. 2524 LBC Well No. 2H, with a first take point in the SE/4NE/4 of Section 25 and a final take point in the NE/4NE/4 of Section 24. Also to be considered will be the cost of drilling, completing, and equipping the well and the allocation of the cost thereof, as well as actual operating costs and charges for supervision, designation of applicant as operator of the well, and a 200% charge for the risk involved in drilling, completing, and equipping the well. The unit is located approximately 3-1/2 miles southeast of Malaga, New Mexico.
10. 22034 Application of Mewbourne Oil Company to amend Order No. R-21411, Eddy County, New Mexico. Mewbourne Oil Company seeks an order amending Order No. R-21411, issued on July 29, 2020, to extend the well commencement deadline one year, to July 29, 2022. Order No. R-21411 pooled all mineral interests in the Wolfcamp formation in a horizontal spacing unit comprised of the N/2 of Section 20 and the N/2 of Section 19, Township 22 South, Range 28 East, NMPM, for the purpose of drilling (a) the Little Giants 20/19 W0AD Fed. Com. Well No. 1H, (b) the Little Giants 20/19 W0HE Fed. Com. Well No. 2H, and (c) the Little Giants 20/19 W0HE Fed. Com. Well No. 3H. It requires the commencement of drilling within one year of the date of the order unless the operator obtains an extension by amendment of the order for good cause shown. The unit is located approximately 7 miles east-southeast of Carlsbad, New Mexico.
11. 22035 Application of Mewbourne Oil Company for compulsory pooling, Lea County, New Mexico. Mewbourne Oil Company seeks an order pooling all mineral interest owners in the Bone Spring formation underlying a horizontal spacing unit comprised of the W/2W/2 of Section 26 and the W/2SW/4 of Section 23, Township 21 South, Range 34 East, NMPM. The unit will be dedicated to (a) the Inland 26/23 B2ML State Com. Well No. 1H, with a first take point in the SW/4SW/4 of 26 and a last take point in the NW/4SW/4 of Section 23, and (b) the Inland 26/23 B3ML State Com. Applicant in the above-styled cause seeks an order pooling all uncommitted interest owners in the Wolfcamp formation underlying a standard 640-acre, more or less, horizontal spacing unit comprised of the W/2 of Section 11 and the NW/4 of Section 14, Township 25 South, Range 33 East, NMPM, Lea County, New Mexico. The completed interval for the proposed Antero 14 Fed Com #721H well will remain within 330 feet of the quarter-quarter line separating the E/2 E/2 from the W/2 E/2 of Section 11 and the E/2 NE/4 from the W/2 NE/4 of Section 14 to allow inclusion of this acreage into a standard 640-acre horizontal well spacing unit. Applicant seeks to dedicate the above-referenced horizontal spacing unit to the to the following proposed wells:
•    The Durango 2 State #705H well, to be drilled from a surface hole location in SE/4 SE/4 (Unit P) of said Section 2 to a bottom hole location in the NW/4 NE/4 (Unit B) of said Section 2;
•    The Durango 2 State #707H well, to be drilled from a surface hole location in SE/4 SE/4 (Unit P) of said Section 2 to a bottom hole location in the NE/4 NE/4 (Unit A) of said Section 2;
•    The Durango 2 State #706H well, to be drilled from a surface hole location in NW/4 NE/4 (Unit B) of said Section 2 to a bottom hole location in the SW/4 SE/4 (Unit O) of said Section 2; and
•    The Durango 2 State #708H well, to be drilled from a surface hole location in NW/4 NE/4 (Unit B) of said Section 2 to a bottom hole location in the SE/4 SE/4 (Unit P) of said Section 2.
The completed interval for the proposed Durango 2 State #706H well will remain within 330 feet of the quarter-quarter line separating the E/2 E/2 from the W/2 E/2 of Section 2 to allow inclusion of this acreage into a standard 320-acre horizontal well spacing unit. Also, to be considered will be the cost of drilling and completing the wells, the allocation of the cost thereof, the actual operating costs and charges for supervision, the designation of applicant as operator, and the imposition of 200% charge for risk involved in drilling and completing each well. Said area is located approximately 15 miles west of Jal, New Mexico.
17. 22041 Application of Mewbourne Oil Company for an order approving a change of operator and allowing two operators in the Morrow formation in the same well unit, Eddy County, New Mexico. Mewbourne Oil Company applies for an order (a) approving a change of operator for one well, and (b) allowing two operators in the same well unit in the same formation. Applicant is the operator of record for the following wells, all of which have the S/2 of Section 9, Township 22 South, Range 27 East, N.M.P.M., Eddy County dedicated to them in the Morrow formation:
(i)    The Calvani Com. Well No. 1 (API No. 30-015-20784), located in the NE/4SW/4 of Section 9;
(ii)    The Pecos River “9” Well No. 1 (API No. 30-015-33534), located in the NE/4SE/4 of Section 9; and
(iii)    The Pecos River “9” Well No. 2 (API No. 30-015-335912), located in the SW/4SW/4 of Section 9.
The Calvani well was drilled by Union Oil Company of California from December 1972 – March 1973. Royalty Resources, LLC subsequently became operator of the well. In 2004 Applicant desired to drill a Morrow well in the S/2 of Section 9. Due to Division restrictions on two operators in the same formation in the same well unit, applicant agreed to become operator of record of the Calvani well. Royalty Resources, LLC continued to be the physical operator of the well. Applicant subsequently drilled the Pecos River wells. All three wells continue to produce from the Morrow formation. The Calvani well now has environmental issues, for which applicant, as operator of record, is legally responsible, even though it did not cause the issues. Royalty Resources, LLC has refused to become operator of record of the Calvani well. As a result, applicant requests that the Division change the operator of record of the well to Royalty Resources, LLC. If the Division grants this relief, there will be two operators in the Morrow formation in the S/2 of Section 9, and applicant requests approval of same. The well unit is located 2-1/2 miles east-southeast of Carlsbad, New Mexico.
18. 22042 Application of Caza Petroleum, LLC for compulsory pooling, Lea County, New Mexico. Caza Petroleum, LLC seeks an order pooling all mineral interest owners in the Bone Spring formation underlying a horizontal spacing unit comprised of the E/2E/2 of Section 17 and the E/2SE/4 of Section 8, Township 20 South, Range 35 East, NMPM, Lea County, New Mexico. The unit will be dedicated to the Desert Rose 17-8 Fed. Com. Well Nos. 8H and 10H, with first take points in the SE/4SE/4 of Section 17 and last take points in the NE/4SE/4 of Section 8. Also to be considered will be the cost of drilling, completing, and equipping the wells and the allocation of the cost thereof, as well as actual operating costs and charges for supervision, designation of Caza Operating, LLC as operator of the wells, and a 200% charge for risk involved in drilling, completing, and equipping the wells. The unit is located approximately 13-1/2 miles northwest of Oil Center, New Mexico.
19. 22043 Application of Caza Petroleum, LLC for compulsory pooling, Lea County, New Mexico. Caza Petroleum, LLC seeks an order pooling all mineral interest owners in the Wolfcamp formation underlying a horizontal spacing unit comprised of the E/2E/2 of Section 17 and the E/2SE/4 of Section 8, Township 20 South, Range 35 East, NMPM, Lea County, New Mexico. The completed interval of the Caprock Yeso Area CYA E State Com #106H well will remain within 330 feet of the quarter-quarter line separating the N/2 N/2 from the S/2 N/2 of Section 13 and the N/2 NW/4 from the S/2 NW/4 of Section 18 to allow inclusion of these proximity tracts into a standard horizontal spacing unit. Also, to be considered will be the cost of drilling and completing said wells and the allocation of the cost thereof, actual operating costs, charges for supervision, designation of applicant as operator of the wells, and a 200% charge for risk involved in drilling said wells. Said area is located approximately 5 miles east of Maljamar, New Mexico.
79. 22028 Application of ConocoPhillips Company for compulsory pooling, Lea County, New Mexico. Applicant in the above-styled cause seeks an order pooling all uncommitted interests in the Yeso formation, underlying a standard 160-acre horizontal spacing unit comprised of the S/2 N/2 of Section 7, Township 17 South, Range 33 East NMPM, Lea County, New Mexico. Applicant proposes to dedicate the above-referenced spacing unit to the initial wells: (1) the Caprock Yeso Area CYA W State Com #123H well, and (2) the Caprock Yeso Area CYA W State Com #205H well, to be horizontally drilled from a surface location in the SE/4 NE/4 (Unit H) of Section 7, to a bottom hole location in the SW/4 NW/4 (Unit E) of Section 7. The completed interval for these wells will comply with statewide setbacks for oil wells. Also, to be considered will be the cost of drilling and completing said wells and the allocation of the cost thereof, actual operating costs, charges for supervision, designation of applicant as operator of the wells, and a 200% charge for risk involved in drilling said wells.
