PRELIMINARY DOCKET: Special Examiner's Hearing set for December 10, 2024

Applications for hearing shall be filed at least thirty (30) days in advance of the hearing date. A party who intends to present evidence shall file a pre-hearing statement no later than the close of business on the Thursday prior to the hearing date and serve a copy on the other parties, if any. The hearing examiner will dismiss the application if the applicant does not file and serve a pre-hearing statement as specified above. A party desiring to use projection equipment at the hearing shall contact Florene Davidson, OCD Clerk, no later than seven (7) business days prior to the hearing.

NOTICE: The hearing examiner may call the following cases in any order in his or her discretion.

1. 24951 Application of Cimarex Energy Co. of Colorado for Compulsory Pooling, Eddy County, New Mexico. Applicant seeks an order pooling all uncommitted interests in the Wolfcamp Formation underlying a 959.88-acre, more or less, standard horizontal spacing unit comprised of the S/2 of Section 31, located in Township 24 South, Range 26 East, NMPM, Eddy County, New Mexico, and the S/2 of Sections 35 & 36, located in Township 24 South, Range 25 East, NMPM, Eddy County, New Mexico (“Unit”). The Unit will be dedicated to the following wells: Know Whatta Mean 31-35 Fed Com 3H, which is an oil well that will be horizontally drilled from a surface hole location in the S/2 of Section 31, Township 24 South, Range 26 East, to a bottom hole location in the S/2 of Section 35, Township 24 South, Range 25 East. Know Whatta Mean 31-35 Fed Com 4H, which is an oil well that will be horizontally drilled from a surface hole location in the S/2 of Section 31, Township 24 South, Range 26 East, to a bottom hole location in the S/2 of Section 35, Township 24 South, Range 25 East. The 3H and 4H Wells are referred to collectively herein as the “Wells.” The completed interval of the Wells will be orthodox. Also, to be considered will be the cost of drilling and completing the Wells and the allocation of the cost, the designation of Applicant as the operator of the Wells, and a 200% charge for the risk involved in drilling and completing the Wells. The Wells are located approximately 17 miles Southwest of Loving, New Mexico.
2. 24952 Application of Cimarex Energy Co. of Colorado for Compulsory Pooling, Eddy County, New Mexico. Applicant seeks an order pooling all uncommitted interests in the Wolfcamp Formation underlying a 959.64-acre, more or less, standard horizontal spacing unit comprised of the N/2 of Section 31, located in Township 24 South, Range 26 East, NMPM, Eddy County, New Mexico, and the N/2 of Sections 35 & 36, located in Township 24 South, Range 25 East, NMPM, Eddy County, New Mexico (“Unit”). The Unit will be dedicated to the following wells: Know Whatta Mean 31-35 Fed Com 1H, which is an oil well that will be horizontally drilled from a surface hole location in the N/2 of Section 31, Township 24 South, Range 26 East, to a bottom hole location in the N/2 of Section 35, Township 24 South, Range 25 East. Know Whatta Mean 31-35 Fed Com 2H, which is an oil well that will be horizontally drilled from a surface hole location in the N/2 of Section 31, Township 24 South, Range 26 East, to a bottom hole location in the N/2 of Section 35, Township 24 South, Range 25 East. The 1H and 2H Wells are referred to collectively herein as the “Wells.” The completed interval of the Wells will be orthodox. Also, to be considered will be the cost of drilling and completing the Wells and the allocation of the cost, the designation of Applicant as the operator of the Wells, and a 200% charge for the risk involved in drilling and completing the Wells. Applicant seeks an order pooling all uncommitted interests in the Bone Spring Formation underlying a 479.91-acre, more or less, standard horizontal spacing unit comprised of the S/2 S/2 of Section 31, located in Township 24 South, Range 26 East, NMPM, Eddy County, New Mexico, and the S/2 S/2 of Sections 35 & 36, located in Township 24 South, Range 25 East, NMPM, Eddy County, New Mexico (“Unit”). The Unit will be dedicated to the following Well: Know Whatta Mean 31-35 Fed Com 5H, which is an oil well that will be horizontally drilled from a surface hole location in the S/2 S/2 of Section 31, Township 24 South, Range 26 East, to a bottom hole location in the S/2 S/2 of Section 35, Township 24 South, Range 25 East. The completed interval of the Well will be orthodox. Also, to be considered will be the cost of drilling and completing the Well and the allocation of the cost, the designation of Applicant as the operator of the Well, and a 200% charge for the risk involved in drilling and completing the Well. The Well is located approximately 17 miles Southwest of Loving, New Mexico.
4. 24954 Application of Cimarex Energy Co. of Colorado for Compulsory Pooling, Eddy County, New Mexico. Applicant seeks an order pooling all uncommitted interests in the Bone Spring Formation underlying a 479.97-acre, more or less, standard horizontal spacing unit comprised of the N/2 S/2 of Section 31, located in Township 24 South, Range 26 East, NMPM, Eddy County, New Mexico, and the N/2 S/2 of Sections 35 & 36, located in Township 24 South, Range 25 East, NMPM, Eddy County, New Mexico (“Unit”). The Unit will be dedicated to the following Well: Know Whatta Mean 31-35 Fed Com 6H, which is an oil well that will be horizontally drilled from a surface hole location in the N/2 S/2 of Section 31, Township 24 South, Range 26 East, to a bottom hole location in the N/2 S/2 of Section 35, Township 24 South, Range 25 East. The completed interval of the Well will be orthodox. Also, to be considered will be the cost of drilling and completing the Well and the allocation of the cost, the designation of Applicant as the operator of the Well, and a 200% charge for the risk involved in drilling and completing the Well. The Well is located approximately 17 miles Southwest of Loving, New Mexico.
5. 24681 Application of Tap Rock Operating, LLC for Compulsory Pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order pooling a standard 480 acre, more or less, horizontal well spacing unit in the Bone Spring formation comprised of S2/S/2 of Section 35, Township 24 South, Range 25 East, the S2/S2 of Section 36 in Township 24 South, Range 25 East, and the S/2 S/2 of Section 31 in Township 24 South Range 26 East, NMPM, Eddy County, New Mexico. Said unit will be initially dedicated to the proposed Shiner Rock Fed Com 154H well to be horizontally drilled from a surface location in the NE/4SE/4 (Unit I) of Section 31, with first take points in SE/4SE/4 (Unit P) of Section 31 and last take points in the SW/4SW/4 (Unit M) of Section 35. Also, to be considered will be the cost of drilling and completing the well and the allocation of the cost thereof, actual operating costs and charges for supervision, designation of Tap Rock Operating, LLC as operator of the well, and a 200% charge for risk involved in drilling said well. The subject area is located approximately 3 miles east of Whites City, New Mexico.
6. 24680 Application of Tap Rock Operating, LLC for Compulsory Pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order pooling a standard 480 acre, more or less, horizontal well spacing unit in the Bone Spring formation comprised of N2/S/2 of Section 35, Township 24 South, Range 25 East, the N2/S2 of Section 36 in Township 24 South, Range 25 East, and the N/2 S/2 of Section 31 in Township 24 South Range 26 East, NMPM, Eddy County, New Mexico. Said unit will be initially dedicated to the proposed Shiner Rock Fed Com 153H well to be horizontally drilled from a surface location in the NE/4SE/4 (Unit I) of Section 31, with first take points in the NE/4SE/4 (Unit I) of Section 31 and last take points in the NW/4SW/4 (Unit L) of Section 35. Also, to be considered will be the cost of drilling and completing the well and the allocation of the cost thereof, actual operating costs and charges for supervision, designation of Tap Rock Operating, LLC as operator of the well, and a 200% charge for risk involved in drilling said well. The subject area is located approximately 3 miles east of Whites City, New Mexico.
7. 24879 Application of Tap Rock Operating, LLC for Compulsory Pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order pooling a standard 1920 acre, more or less, horizontal well spacing unit in the Wolfcamp formation comprised of all of Section 35, Township 24 South, Range 25 East, all of Section 36 in Township 24 South, Range 25 East, and all of Section 31 in Township 24 South Range 26 East, NMPM, Eddy County, New Mexico. Said unit will be initially dedicated to the proposed Shiner Rock Fed Com 202H, Shiner Rock Fed Com 204H, Shiner Rock Fed Com 211H, and Shiner Rock Fed Com 213H wells to be horizontally drilled as follows:
•    Shiner Rock Fed Com 202H, which will be drilled from a surface hole location 1168 Feet from the North Line of Section 31 and 1012 Feet from the East Line of Section 31 (Unit A) to a bottom hole located 5 Feet from the West Line in Section 35 and 1510 Feet from the North Line in Section 35 (Unit E).
•    Shiner Rock Fed Com 204H, which will be drilled from a surface hole location 1617 Feet from the South Line of Section 31 and 959 Feet from the East Line of Section 31 (Unit I) to a bottom hole located 5 Feet from the West Line in Section 35 and 660 Feet from the South Line in Section 35 (Unit M).
•    Shiner Rock Fed Com 211H, which will be drilled from a surface hole location 1162 Feet from the North Line of Section 31 and 1041 Feet from the East Line of Section 31 (Unit A) to a bottom hole located 5 Feet from the West Line in Section 35 and 381 Feet from the North Line in Section 35 (Unit D).
•    Shiner Rock Fed Com 213H, which will be drilled from a surface hole location 1617 Feet from the South Line of Section 31 and 989 Feet from the East Line of Section 31 (Unit I) to a bottom hole located 5 Feet from the West Line in Section 35 and 2360 Feet from the South Line in Section 35 (Unit L).

Also, to be considered will be the cost of drilling and completing the wells and the allocation of the cost thereof, actual operating costs and charges for supervision, designation of Tap Rock Operating, LLC as operator of the wells, and a 200% charge for risk involved in drilling said wells. The subject area is located approximately 3 miles east of Whites City, New Mexico.
