PRELIMINARY DOCKET: Special Examiner's Hearing set for September 16, 2025

For hearings by affidavit: presenting parties are required to submit a pre-hearing statement no later than the Thursday before the hearing. The pre-hearing statement shall include: 1) a list of disputed facts and issues; 2) identification of witnesses and their qualifications; and 3) all exhibits and written testimony a party intends to enter into evidence at the hearing and a full narrative for each.

For contested matters: pre-hearing statements shall be filed no later than 9:00 a.m., 4 business days prior to the hearing and in addition to the requirements of 19.15.4.13.B(1) NMAC, shall include: all evidentiary exhibits, documents, affidavits, and full-written testimony of any witness a party offers at the hearing. Exhibits must be sequentially marked on every page.

Failure to timely file a complete pre-hearing statement may cause the Hearing Examiner to continue the hearing and/or impose sanctions up to and including the exclusion of late-filed evidence. Evidentiary objections must be filed no later than 48 hours before the hearing. Rulings on the objections will be addressed as a preliminary matter when the case is called.

1. 25480 Application of Frontier Field Services, LLC for Authorization to Inject, Eddy County, New Mexico. Frontier Field Services, LLC (“Frontier”) (OGRID No. 221115) seeks authorization to inject treated acid gas (“TAG”) from Frontier’s Kings Landing Gas Plant (“Plant”) into the proposed Kings Landing AGI No. 1 well and Kings Landing AGI No. 2 well (“Wells”), which will be located in Section 15, Township 19 South, Range 31 East, Eddy County, New Mexico. The Wells will be drilled as vertical wells: Kings Landing AGI No. 1 will have a surface location approximately 2,176’ from the north line (FNL) and 384’ from the west line (FWL) of Section 15; Kings Landing AGI No. 2 will have a surface location approximately 1,876’ FNL and 735’ FWL of Section 15. The Wells will inject TAG into the Siluro-Devonian formations, including the Thirtyone, Wristen, and Fusselman groups, plus the Montoya Formation, at depths of approximately 13,215’ to 14,415’ in the Kings Landing AGI No. 1 well, and 13,240’ to 14,440’ in the Kings Landing AGI No. 2 well. The Wells are designed to each inject up to 20 million cubic feet per day (MMcf/D) of TAG. Frontier is requesting a combined allowable maximum daily injection rate of 20 MMcf/D to be shared between the two wells. The Wells’ maximum surface injection pressure will not exceed 3,991 pounds per square inch gauge. The Wells are located approximately 12.5 miles southeast of Loco Hills, New Mexico.
2. 25250 Application of MRC Permian Company for Compulsory Pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order pooling a standard 960-acre, more or less, horizontal well spacing unit in the Wolfcamp formation underlying the N2 of Sections 27, 28 and 29, Township 22 South Range 28 East, NMPM, Eddy County, New Mexico. Said unit will be initially dedicated to the following proposed wells to be drilled from a surface location in the NW4 of Section 26:
•    Dick and Donna 2729 Fed Com 201H, with a first take point in the NE4NE4 (Unit A) of Section 27 and a last take point in the NW4NW4 (Unit D) of Section 29, and
•    Dick and Donna 2729 Fed Com 202H, with a first take point in the SE4NE4 (Unit H) of Section 27 and a last take point in the SW4NW4 (Unit E) of Section 29.
Also to be considered will be the cost of drilling and completing the wells and the allocation of the cost thereof, actual operating costs and charges for supervision, designation of Matador Production Company as operator of the wells, and a 200% charge for risk involved in drilling the wells. The subject area is located approximately 5 miles north of Loving, New Mexico.

3. 25254 Application of MRC Permian Company for Compulsory Pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order pooling a standard 960-acre, more or less, horizontal well spacing unit in the Wolfcamp formation underlying the S2 of Sections 27, 28 and 29, Township 22 South Range 28 East, NMPM, Eddy County, New Mexico. Said unit will be initially dedicated to the following proposed wells to be drilled from a surface location in the SW4 of Section 26:
•    Warrior 2729 Fed Com 203H, with a first take point in the NE4SE4 (Unit I) of Section 27 and a last take point in the NW4SW4 (Unit L) of Section 29, and
•    Warrior 2729 Fed Com 204H, with a first take point in the SE4SE4 (Unit P) of Section 27 and a last take point in the SW4SW4 (Unit M) of Section 29.
Also to be considered will be the cost of drilling and completing the wells and the allocation of the cost thereof, actual operating costs and charges for supervision, designation of Matador Production Company as operator of the wells, and a 200% charge for risk involved in drilling the wells. Colgate Production, LLC (“Colgate” or “Applicant”) seeks an order extending the deadline to commence drilling the well authorized by Order No. R-23361 (“Order”) until September 19, 2026. Applicant in the above-styled cause seeks an order from the Oil Conservation Division approving a standard ~320-acre horizontal spacing and proration unit (“HSU”), with proximity tracts, comprised of the S/2 of Section 31, Township 16 South, Range 31 East in Eddy County, New Mexico and pooling all mineral interests in the Yeso formation (Cedar Lake; Glorieta-Yeso [96831]) underlying the HSU. Applicant proposes to drill the following 1.0-mile wells in the HSU: Petty Federal Com 31CD 001H well, to be horizontally drilled from a surface hole location (“SHL”) ~441’ FWL and 1,717’ FSL of Section 32-16S-31E and a bottomhole location (“BHL”) ~20’ FWL & 2,628’ FSL of Section 31-16S-31E (“001H”); Petty Federal Com 31CD 002H well, to be horizontally drilled from a SHL ~441’ FWL and 1,697’ FSL of Section 32-16S-31E and a BHL ~20’ FWL & 2,319’ FSL of Section 31-16S-31E; Petty Federal Com 31CD 003H well, to be horizontally drilled from a surface hole location approximately 441’ FWL and 1,677’ FSL of Section 32-16S-31E and a bottomhole location approximately 20’ FWL & 2,159’ FSL of Section 31-16S-31E; Petty Federal Com 31CD 004H well, to be horizontally drilled from a SHL ~441’ FWL and 1,657’ FSL of Section 32-16S-31E and a BHL ~20’ FWL & 1,785’ FSL of Section 31-16S-31E; Petty Federal Com 31CD 005H well, to be horizontally drilled from a SHL ~441’ FWL and 1,637’ FSL of Section 32-16S-31E and a BHL ~20’ FWL & 1,410’ FSL of Section 31-16S-31E; Petty Federal Com 31CD 006H well, to be horizontally drilled from a SHL ~1,085’ FWL and 676’ FSL of Section 32-16S-31E and a BHL ~20’ FWL & 1,250’ FSL of Section 31-16S-31E; Petty Federal Com 31CD 007H well, to be horizontally drilled from a SHL ~1,086’ FWL and 656’ FSL of Section 32-16S-31E and a bottomhole location approximately 20’ FWL & 875’ FSL of Section 31-16S-31E; Petty Federal Com 31CD 008H well, to be horizontally drilled from a SHL ~1,086’ FWL and 636’ FSL of Section 32-16S-31E and a BHL ~20’ FWL & 500’ FSL of Section 31-16S-31E; and Petty Federal Com 31CD 009H well, to be horizontally drilled from a SHL ~1,087’ FWL and 616’ FSL of Section 32-16S-31E and a BHL ~20’ FWL & 340’ FSL of Section 31-16S-31E. The completed interval of the 001H is in a non-standard location (“NSL”). Applicant will seek administrative approval of the NSL. With the proximity tracts, the completed intervals of the other wells will meet standard setback requirements. The first and last take points of all wells will meet the setback requirements set forth in the statewide rules for horizontal oil wells. Additional considerations will be the cost of drilling and completing the well and allocation of such costs, the designation of Applicant as operator of the HSU and wells to be drilled thereon, and a 200% charge for the risk involved in drilling and completing the well. The well and lands are located approximately 6 miles Northeast of Loco Hills, New Mexico.
17. 25573 Application of Mewbourne Oil Company for compulsory pooling, Eddy County, New Mexico: Mewbourne Oil Company (“Applicant”) has filed an application with the Oil Conservation Division for an order pooling all uncommitted mineral interest owners in the Bone Spring formation underlying a horizontal spacing unit comprised of the S/2S/2 of Section 9 and the S/2S/2 of Section 8, Township 22 South, Range 27 East, NMPM, Eddy County, New Mexico (the “Unit). Applicant proposes to drill the following wells in the Unit to test the Bone Spring formation: The Sandlot 9/8 Well Nos. 527H and 557H, with first take points in the SE/4SE/4 of Section 9 and last take points in the SW/4SW/4 of Section 8. Also to be considered will be the cost of drilling, completing, testing, and equipping the wells, and the allocation of the cost thereof among the wells’ working interest owners, designation of Applicant as operator of the wells and the Unit, approval of actual operating charges and costs charged for supervision, together with a provision adjusting the rates pursuant to the COPAS accounting procedure, and setting a 200% charge for the risk involved in drilling, completing, testing, and equipping the wells in the event a working interest owner elects not to participate in the wells. The Unit is located approximately 3-1/2 miles northwest of Otis, New Mexico.
18. 25574 Application of Mewbourne Oil Company for compulsory pooling, Lea County, New Mexico: Mewbourne Oil Company (“Applicant”) has filed an application with the Oil Conservation Division for an order pooling all uncommitted mineral interest owners in the Bone Spring formation underlying a horizontal spacing unit comprised the W/2E/2 of Section 17, the W/2E/2 of Section 8, and Lot 15 and the W/2SE/4 of Section 5, Township 21 South, Range 32 East, NMPM, Lea County, New Mexico (the “Unit). In support of this application, Applicant proposes to drill the following wells in the Unit to depths sufficient to test the Bone Spring formation:

(a)    The Cousin Eddy Fed. Unit Com. Well No. 9H, with a first take point in the SW/4SE/4 of Section 17 and a last take point in Lot 15 of Section 5;
(b)    The Cousin Eddy Fed. Unit Com. Well No. 11H, with a first take point in the SW/4SE/4 of Section 17 and a last take point in Lot 15 of Section 5; and
(c)    The Cousin Eddy Fed. Unit Com. Well No. 13H, with a first take point in the SW/4SE/4 of Section 17 and a last take point in Lot 15 of Section 5.

Also to be considered will be the cost of drilling, completing, testing, and equipping the wells, and the allocation of the cost thereof among the wells’ working interest owners, designation of Applicant as operator of the wells and the Unit, approval of actual operating charges and costs charged for supervision, together with a provision adjusting the rates pursuant to the COPAS accounting procedure, and setting a 200% charge for the risk involved in drilling, completing, testing, and equipping the wells in the event a working interest owner elects not to participate in the wells. The Unit is located approximately 4 miles south-southeast of Halfway, New Mexico.
19. 25575 Application of Mewbourne Oil Company for compulsory pooling, Lea County, New Mexico: Mewbourne Oil Company (“Applicant”) has filed an application with the Oil Conservation Division for an order pooling all uncommitted mineral interest owners in the Bone Spring formation underlying a horizontal spacing unit comprised the E/2E/2 of Section 17, the E/2E/2 of Section 8, and Lot 16 and the E/2SE/4 of Section 5, Township 21 South, Range 32 East, NMPM, Lea County, New Mexico (the “Unit). In support of this application, Applicant proposes to drill the following wells in the Unit to depths sufficient to test the Bone Spring formation:

(a)    The Cousin Eddy Fed. Unit Com. Well No. 10H, with a first take point in the SE/4SE/4 of Section 17 and a last take point in Lot 16 of Section 5;
(b)    The Cousin Eddy Fed. Unit Com. Well No. 12H, with a first take point in the SE/4SE/4 of Section 17 and a last take point in Lot 16 of Section 5; and
(c)    The Cousin Eddy Fed. Unit Com. Well No. 15H, with a first take point in the SE/4SE/4 of Section 17 and a last take point in Lot 16 of Section 5.
