PRELIMINARY DOCKET: Examiner Hearing for Thursday, April 21, 2022

Applications for hearing shall be filed at least thirty (30) days in advance of the hearing date. A party who intends to present evidence shall file a pre-hearing statement no later than the close of business on the Thursday prior to the hearing date and serve a copy on the other parties, if any. The hearing examiner will dismiss the application if the applicant does not file and serve a pre-hearing statement as specified above. Said unit will be initially dedicated to the proposed Red Bud 25-36-32 State Com 096H (API 30-025-49591) to be horizontally drilled from a surface location in the SE/4 SE/4 (Unit P) of Section 32 to a bottom hole location in the NW/4 NE/4 (Unit B) of Section 29. Also, to be considered will be the cost of drilling and completing the well and the allocation of the cost thereof, actual operating costs and charges for supervision, designation of Applicant as operator of the well, and a 200% charge for risk involved in drilling said well. Said area is located approximately 7 miles southwest of Jal, New Mexico.
2. 22679 Application of Ameredev Operating, LLC for compulsory pooling, Lea County, New Mexico. 3. 22680 Application of Ameredev Operating, LLC for compulsory pooling, Lea County, New Mexico. Applicant in the above-styled cause seeks an order pooling all uncommitted interest in the Wolfcamp formation [Jal; Wolfcamp, West (33813)] underlying a 640-acre, more or less, standard horizontal well spacing unit comprised of the comprised of the E/2 E/2 of Sections 29 and 32 and the W/2 W/2 of Sections 28 and 33, Township 25 South, Range 36 East, NMPM, Lea County, New Mexico. Said unit will be initially dedicated to the proposed Red Bud 25-36-32 State Com 107H (API 30-025-49593) and the Red Bud 25-36-32 State Com 118H (API pending) to be horizontally drilled from a surface location in the SE/4 SE/4 (Unit P) of Section 32 to a bottom hole location in the NE/4 NE/4 (Unit A) of Section 29. The completed interval of the Red Bud 25-36-32 State Com 118H will be within 330 feet of the offsetting quarter-quarter sections or equivalent tracts to allow inclusion of these tracts in a standard horizontal spacing unit for oil wells.
Also, to be considered will be the cost of drilling and completing the wells and the allocation of the cost thereof, actual operating costs and charges for supervision, designation of Applicant as operator of the wells, and a 200% charge for risk involved in drilling said wells. Said area is located approximately 7 miles southwest of Jal, New Mexico.
4. 22075 Application of Catena Resources Operating, LLC for Compulsory Pooling, Lea County, New Mexico. Applicant applies for an order pooling all uncommitted mineral interests in the Bone Spring formation in a 320-acre, more or less, standard horizontal spacing unit (“Unit”) comprised of the E/2W/2 of Sections 8 and 17, Township 19 South, Range 35 East, Lea County, New Mexico. The Unit will be dedicated to the Rambo E2W2 08-17 B1 1H well (“Well”) which will be horizontally drilled from a surface location in the NE/4NW/4 (Unit C) of Section 8 to a bottom hole location in the SE/4SW/4 (Unit N) of Section 17. Also to be considered will be the cost of drilling and completing the wells and the allocation of the cost, the designation of Applicant as the operator of the wells, and a 200% charge for the risk involved in drilling and completing the wells. The wells are located approximately 20 miles west of Hobbs, New Mexico.
5. 22373 Application of COG Operating LLC for Compulsory Pooling, Lea County, New Mexico. Applicant seeks an order pooling all uncommitted mineral interests in the Bone Spring formation underlying a 400-acre, more or less, standard horizontal spacing unit (“Unit”) comprised of Lot 4, the SW/4NW/4 and the W/2SW/4 of Section 4 in Township 25 South, Range 35 East; the W/2W/2 of Section 9 in Township 25 South, Range 35 East; and the W/2SW/4 of Section 33 in Township 24 South, Range 35 East, Lea County, New Mexico. The Unit will be dedicated to the Fez Fed Com 401H well (“Well”) to be horizontally drilled from a surface location in the NE/4NW/4(Unit C) of Section 16 to a bottom hole location in the NW/4SW/4 (Unit L) of Section 33. The completed interval of the Well will be orthodox. Also to be considered will be the cost of drilling and completing the Well and the allocation of the costs, the designation of Applicant as the operator of the Well, and a 200% charge for the risk involved in drilling and completing the Well. The Well is located approximately 10.5 miles west of Jal, New Mexico.
6. 22374 Application of COG Operating LLC for Compulsory Pooling, Lea County, New Mexico. Applicant seeks an order pooling all uncommitted mineral interests in the Bone Spring formation underlying a 400-acre, more or less, standard horizontal spacing unit (“Unit”) comprised of Lot 3, the SE/4NW/4 and the E/2SW/4 of Section 4 in Township 25 South, Range 35 East; the E/2W/2 of Section 9 in Township 25 South, Range 35 East; and the E/2SW/4 of Section 33 in Township 24 South, Range 35 East, Lea County, New Mexico. The Unit will be dedicated to the Fez Fed Com 402H well (“Well”) to be horizontally drilled from a surface location in the NE/4NW/4 (Unit C) of Section 16 to a bottom hole location in the NE/4SW/4 (Unit K) of Section 33. The completed interval of the Well will be orthodox. 7. 21072 Application of Colgate Corporation for compulsory pooling, Eddy County, New Mexico. Applicant seeks an order from the Division: (1) to the extent necessary, approving the creation of a 320-acre, more or less, Bone Spring horizontal spacing unit; and, (2) pooling all uncommitted mineral interests within a Bone Spring horizontal spacing unit underlying the N/2 N/2 of Section 25, Township 19 South, Range 29 East, NMPM, Eddy County, New Mexico and the N/2 N/2 of Section 30, Township 19 South, Range 30 East, NMPM, Eddy County, New Mexico. This spacing unit will be dedicated to the Red Bandana 25 State Com 121H and Red Bandana 25 State Com 131H wells, to be horizontally drilled. The producing area for these wells will be orthodox. Also to be considered will be the cost of drilling, completing and equipping said wells, the allocation of these costs as well as the actual operating costs and charges for supervision, designation of Colgate as operator of the wells, and a 200% charge for risk involved in drilling said wells. 11. 22568 Application of Colgate Operating, LLC to Pool Additional Interest and Record Title Owners Under Order No. R-21438, Eddy County, New Mexico. Applicant seeks an order pooling additional mineral interest and record title owners under the terms of Division Order No. R-21438. On August 24, 2020, the Division entered Order No. R-21438 (“Order”) in Case No. 21078, which pooled all uncommitted interests in the Winchester; Bone Spring Pool (Pool Code 65010) within the Bone Spring formation in a 320-acre, more or less, standard horizontal spacing unit comprised of the N/2 S/2 of Section 27 and the N/2 S/2 of Section 28, Township 19 South, Range 28 East, Eddy County, New Mexico (“Unit”). The Order further dedicated the Unit to the Big Burro 27 State Com 123H and Big Burro 27 State Com 133H wells (“Wells”) and designated Applicant as operator of the Unit and Wells. Since entry of the Order, Applicant has identified additional mineral interest and record title owners in the Unit that have not been pooled under the terms of the Order. Applicant has undertaken diligent, good-faith efforts to obtain voluntary agreements from the additional mineral interest and record title owners but has been unable to do so. The Wells are located approximately 19 miles southeast of Artesia, New Mexico.
12. 22569 Application of Colgate Operating, LLC to Pool Additional Interest and Record Title Owners Under Order No. R-21439, Eddy County, New Mexico. Applicant seeks an order pooling additional mineral interest and record title owners under the terms of Division Order No. R-21439. On August 24, 2020, the Division entered Order No. R-21439 (“Order”) in Case No. 21079, which pooled all uncommitted interests in the Winchester; Bone Spring Pool (Pool Code 65010) within the Bone Spring formation in a 320-acre, more or less, standard horizontal spacing unit comprised of the S/2 S/2 of Section 27 and the S/2 S/2 of Section 28, Township 19 South, Range 28 East, Eddy County, New Mexico (“Unit”). The Order further dedicated the Unit to the Big Burro 27 State Com 124H and Big Burro 27 State Com 134H wells (“Wells”) and designated Applicant as operator of the Unit and Wells. Since entry of the Order, Applicant has identified additional mineral interest and record title owners in the Unit that have not been pooled under the terms of the Order. Applicant has undertaken diligent, good-faith efforts to obtain voluntary agreements from the additional mineral interest and record title owners but has been unable to do so. The Wells are located approximately 19 miles southeast of Artesia, New Mexico.

Applicant seeks an order pooling record title owners under the terms of Division Order No. R-21440. On August 24, 2020, the Division entered Order No. R-21440 (“Order”) in Case No. 21239, which pooled all uncommitted interests in the Winchester; Bone Spring Pool (Pool Code 65010) within the Bone Spring formation in a 320-acre, more or less, standard horizontal spacing unit comprised of the N/2 of Sections 27 and Section 28, Township 19 South, Range 28 East, Eddy County, New Mexico (“Unit”). The Order further dedicated the Unit to the Weaver 27 State Com 121H, 122H, 131H, and 132H wells (“Wells”) and designated Applicant as operator of the Unit and Wells. Since entry of the Order, Applicant has identified record title owners in the Unit that have not been pooled under the terms of the Order. Applicant has undertaken diligent, good-faith efforts to obtain voluntary agreements from the record title owners but has been unable to do so. The Wells are located approximately 19 miles southeast of Artesia, New Mexico.
14. 22669 Application of Colgate Operating, LLC for Compulsory Pooling, Eddy County, New Mexico. Applicant applies for an order (1) approving a 320-acre, more or less, overlapping spacing unit in the Bone Spring formation, and (2) pooling all uncommitted interests in the Third Bone Spring interval of the Bone Spring formation from a depth of approximately 7,763’ to the base of the Bone Spring formation at a depth of approximately 8,822’ underlying the N/2N/2 of Sections 35 and 36, Township 19 South, Range 28 East, Eddy County, New Mexico (“Unit”). The Unit will be dedicated to the Uluru 35 Fed State Com 131H well, which will be horizontally drilled from a surface hole location in the SE/4NE/4 (Unit H) of Section 34 to a bottom hole location in the NE/4NE/4 (Unit A) of Section 36. The Unit will partially overlap with the spacing unit for the Winchester 36 AD State 1H well (API No. 30-015-41354) which is dedicated to the N/2N/2 of Section 36 in the Second Bone Spring interval of the Bone Spring formation. Accordingly, Applicant seeks to pool all uncommitted interests in the Third Bone Spring interval of the Bone Spring formation from a depth of approximately 7,763’ MD to the base of the Bone Spring formation at a stratigraphic equivalent of approximately 8,822’ MD as observed on the Dero Federal #3 well log (API 3001530399). Also to be considered will be the cost of drilling and completing the Well and the allocation of the costs, the designation of Applicant as the operator of the Well, and a 200% charge for the risk involved in drilling and completing the Well. Applicant applies for an order (1) approving a 320-acre, more or less, overlapping spacing unit in the Bone Spring formation, and (2) pooling all uncommitted interests in the Third Bone Spring interval of the Bone Spring formation from a depth of approximately 7,763’ to the base of the Bone Spring formation at a depth of approximately 8,822’ underlying the S/2N/2 of Sections 35 and 36, Township 19 South, Range 28 East, Eddy County, New Mexico (“Unit”). The Unit will be dedicated to the Uluru 35 Fed State Com 132H well, which will be horizontally drilled from a surface hole location in the SE/4NE/4 (Unit H) of Section 34 to a bottom hole location in the SE/4NE/4 (Unit H) of Section 36. The Unit will partially overlap with the spacing unit for the Winchester 36 HE State 1H well (API No. 30-015-41747) which is dedicated to the S/2N/2 of Section 36 in the Second Bone Spring interval of the Bone Spring formation. Accordingly, Applicant seeks to pool all uncommitted interests in the Third Bone Spring interval of the Bone Spring formation from a depth of approximately 7,763’ MD to the base of the Bone Spring formation at a stratigraphic equivalent of approximately 8,822’ MD as observed on the Dero Federal #3 well log (API 3001530399).
