PRELIMINARY DOCKET: Examiner Hearing for Thursday, January 5, 2023

Applications for hearing shall be filed at least thirty (30) days in advance of the hearing date. A party who intends to present evidence shall file a pre-hearing statement no later than the close of business on the Thursday prior to the hearing date and serve a copy on the other parties, if any. The hearing examiner will dismiss the application if the applicant does not file and serve a pre-hearing statement as specified above. Applicant seeks authorization to include additional injection wells within the project administratively. The unitized interval extends from the top of the Yates Formation to the base of the Queen Formation. Among the matters to be considered at hearing, pursuant to the New Mexico Statutory Unitization Act, NMSA 1978, §§ 70-7-1 et seq., will be: the necessity of unit operations; the determination of horizontal and vertical limits of the unit area; the determination of the fair, reasonable, and equitable allocation of production and costs of production, including capital investments, to each of the tracts in the unit area; the determination of credits and charges to be made among the working interest owners in the unit area for their investment in wells and equipment; and such other matters as may be necessary and appropriate. The unit area is centered approximately 2.25 miles South of Jal, New Mexico.
3. 22701 Application of Legacy Reserves Operating LP for a Horizontal Spacing Unit and Compulsory Pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order from the Division: (1) creating a standard 480-acre, more or less, spacing and proration unit comprised of the E½ of Section 33, Township 18 South, Range 31 East, N.M.P.M., and NE¼ of Section 4, Township 19 South, Range 31 East, N.M.P.M., Eddy County, New Mexico, and (2) pooling all uncommitted mineral interests in the Bone Spring formation, designated as an oil pool, underlying said unit. The proposed wells to be dedicated to the horizontal spacing unit are the: (1) Jet Federal Com 401H Well, to be horizontally drilled from an approximate surface location in the NE¼NE¼ of Section 33, T18S-R31E, to a bottom hole location in the SW¼NE¼ of Section 4, Township 19 South, Range 31 East, N.M.P.M.; (2) Jet Federal Com 402H Well, to be horizontally drilled from an approximate surface location in the NE¼NE¼ of Section 33, T18S-R31E, to a bottom hole location in the SE¼NE¼ of Section 4, Township 19 South, Range 31 East, N.M.P.M.; (3) Jet Federal Com 501H Well, to be horizontally drilled from an approximate surface location in the NE¼NE¼ of Section 33, T18S-R31E, to a bottom hole location in the SW¼NE¼ of Section 4, Township 19 South, Range 31 East, N.M.P.M.; (4) Jet Federal Com 502H Well, to be horizontally drilled from an approximate surface location in the NE¼NE¼ of Section 33, T18S-R31E, to a bottom hole location in the SE¼NE¼ of Section 4, Township 19 South, Range 31 East, N.M.P.M.; (5) Jet Federal Com 601H Well, to be horizontally drilled from an approximate surface location in the NE¼NE¼ of Section 33, T18S-R31E, to a bottom hole location in the SW¼NE¼ of Section 4, Township 19 South, Range 31 East, N.M.P.M.; and (6) Jet Federal Com 602H Well, to be horizontally drilled from an approximate surface location in the NE¼NE¼ of Section 33, T18S-R31E, to a bottom hole location in the SE¼NE¼ of Section 4, Township 19 South, Range 31 East, N.M.P.M. The wells are orthodox in location and the take points and laterals comply with Statewide Rules for setbacks; also to be considered will be the cost of drilling and completing the wells and the allocation of the costs thereof; actual operating costs and charges for supervision; the designation of the Applicant as Operator of the wells and unit; and a 200% charge for the risk involved in drilling and completing the wells. The wells and lands are located approximately 28 miles northeast of Carlsbad, New Mexico.
4. 23173 Application of Mewbourne Oil Company for compulsory pooling, Eddy County, New Mexico. Mewbourne Oil Company seeks an order pooling all mineral interests in the Wolfcamp formation underlying a horizontal spacing unit comprised of the S/2 of Section 31, Township 23 South, Range 27 East, N.M.P.M. and the S/2 of Section 36, Township 23 South, Range 26 East, N.M.P.M., Eddy County, New Mexico. The unit will be dedicated to (a) the Charlie 31/36 W2IL State. Com. Well No. 1H, with a first take point in the NE/4SE/4 of Section 31 and a last take point in the NW/4SW/4 of Section 36, and (b) the Charlie 31/36 W2PM State Com. Well No. 1H, with a first take point in the SE/4SE/4 of Section 31 and a last take point in the SW/4SW/4 of Section 36. 5. 23176 Application of Mewbourne Oil Company for Compulsory Pooling, Lea County, New Mexico. Applicant applies for an order pooling all uncommitted interests in the Bone Spring formation underlying a 240-acre, more or less, standard horizontal spacing unit comprised of the E/2 NE/4 of Section 21 and the E/2 E/2 of Section 16, Township 19 South, Range 33 East, Lea County, New Mexico (“Unit”). The Unit will be dedicated to the Bushwood 21/16 B2HA Fed Com #1H well (“Well”), to be drilled from a surface hole location in the NW/4 SE/4 (Unit J) of Section 21 to a bottom hole location in the NE/4 NE/4 (Unit A) of Section 16. Also to be considered will be the cost of drilling and completing the Well and the allocation of the costs, the designation of Applicant as the operator of the Well, and a 200% charge for the risk involved in drilling and completing the Well. The Well is located approximately 27 miles southwest of Lovington, New Mexico.
6. 23178 Application of Mewbourne Oil Company for Compulsory Pooling, Lea County, New Mexico. Applicant applies for an order pooling all uncommitted interests in the Bone Spring formation underlying a 240-acre, more or less, standard horizontal spacing unit comprised of the E/2 NW/4 of Section 21 and the E/2 W/2 of Section 16, Township 19 South, Range 33 East, Lea County, New Mexico (“Unit”). The Unit will be dedicated to the Bushwood 21/16 B2FC Fed Com #1H well (“Well”), to be drilled from a surface hole location in the NW/4 SE/4 (Unit J) of Section 21 to a bottom hole location in the NE/4 NW/4 (Unit C) of Section 16. Also to be considered will be the cost of drilling and completing the Well and the allocation of the costs, the designation of Applicant as the operator of the Well, and a 200% charge for the risk involved in drilling and completing the Well. The Well is located approximately 27 miles southwest of Lovington, New Mexico.
7. 23210 Application of Novo Oil & Gas Northern Delaware, LLC for compulsory pooling, Eddy County, New Mexico. Novo Oil & Gas Northern Delaware, LLC seeks an order from the Division pooling all uncommitted interests within a Bone Spring horizontal spacing unit underlying the W/2 of Sections 9 and 16, and the N/2 NW/4 of Section 21, Township 19 South, Range 30 East, N.M.P.M., Eddy County, New Mexico. The spacing unit will be dedicated to the Tickety Boo Fed Com 2109 121H, Tickety Boo Fed Com 2109 122H, Tickety Boo Fed Com 2109 123H, Tickety Boo Fed Com 2109 131H, Tickety Boo Fed Com 2109 132H, and Tickety Boo Fed Com 2109 133H wells, to be horizontally drilled. The wells will be drilled at orthodox locations. The completed interval for the Tickety Boo Fed Com 2109 122H and the Tickety Boo Fed Com 2109 132H wells will be less than 330’ from the adjoining tracts to allow inclusion of proximity tracts within the proposed standard horizontal spacing unit. Also to be considered will be the cost of drilling and completing said wells, the allocation of these costs as well as the actual operating costs and charges for supervision, designation of Novo as operator of the wells, and a 200% charge for risk involved in drilling said well. Said area is located approximately 22 miles northwest of Carlsbad, New Mexico.
8. 23199 Application of OXY USA Inc. to Amend Order R-21020 to Add Additional Pooled Parties, Eddy County, New Mexico. Applicant seeks an order from the Division Order R-21020 to add additional parties to the terms of the pooling order. Order R-21020 pooled uncommitted mineral interests in the Bone Spring formation [Pierce Crossing; Bone Spring Pool (50371)] underlying a standard 640-acre horizontal spacing unit comprised of the W/2 of Section 8 and Section 17, Township 24 South, Range 29 East, NMPM, Eddy County, New Mexico. This standard horizonal well spacing unit is currently dedicated to the Oxbow CC 17 8 Federal Com Well No. 33H (API No. 30-015-45085), a horizontal well drilled from a surface location in the SW/4 SW/4 (Unit M) of Section 17 to a bottomhole location in the NE/4 NW/4 (Unit C) of Section 8. This area is located approximately 3.5 miles east of Malaga, New Mexico.
9. 23200 Application of OXY USA Inc. to Amend Order R-21021 to Add Additional Pooled Parties, Eddy County, New Mexico. Applicant seeks an order from the Division Order R-21021 to add additional parties to the terms of the pooling order. Order R-21021 pooled uncommitted mineral interests in the Wolfcamp formation [Pierce Crossing; Bone Spring Pool (50371)] underlying a standard 640-acre horizontal spacing unit comprised of the W/2 of Section 8 and Section 17, Township 24 South, Range 29 East, NMPM, Eddy County, New Mexico. This standard horizonal well spacing unit is dedicated to the following initial wells:
•    Oxbow CC 17 8 Federal Com Well No. 31H (API No. 30-015-45083), a horizontal well drilled from a surface location in the SW/4 SW/4 (Unit M) of Section 17 to a bottomhole location in the NW/4 NW/4 (Unit D) of Section 8;
•    Oxbow CC 17 8 Federal Com Well No. 32H (API No. 30-015-45084), a horizontal well drilled from a surface location in the SW/4 SW/4 (Unit M) of Section 17 to a bottomhole location in the NW/4 NW/4 (Unit D) of Section 8; and
•    Oxbow CC 17 8 Federal Com Well No. 37H (API No. 30-015-46400), a horizontal well drilled from a surface location in the SE/4 SW/4 (Unit N) of Section 17 to a bottomhole location in the NE/4 NW/4 (Unit C) of Section 8.
This area is located approximately 3.5 miles east of Malaga, New Mexico.
10. 23201 Application of Oxy USA Inc. for Compulsory Pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order pooling all uncommitted interests in the Bone Spring formation underlying a standard 639.88-acre, more or less, horizontal well spacing unit comprised of the E/2 of Sections 6 and 7 all within Township 24 South, Range 29 East (NMPM), Eddy County New Mexico. Applicant seeks to initially dedicate the above-referenced horizontal spacing unit to the following proposed wells which have been drilled thereon:
•    Width CC 6 7 Federal Com Well No. 14H (API No. 30-015-45573), which has been drilled from a surface location in the NE/4 NE/4 (Unit A) of Section 6 to a bottom hole location in the SE/4 SE/4 (Unit P) of Section 7;
•    Length CC 6 7 Federal Com Well No. 24H (API No. 30-015-45552), which has been drilled from a surface location in the NE/4 NW/4 (Unit C) of Section 6 to a bottom hole location in the SW/4 SE/4 (Unit O) of Section 7;
•    Length CC 6 7 Federal Com Well No. 25H (API No. 30-015-45566), which has been drilled from a surface location in the NE/4 NE/4 (Unit A) of Section 6 to a bottom hole location in the SW/4 SE/4 (Unit O) of Section 7; and

The completed interval of the Length CC 6 7 Federal Com Well No. 25H well is within 330 feet of the offsetting quarter-quarter sections or equivalent tracts to include them in a standard horizontal well spacing unit. Also, to be considered will be the cost of drilling and completing the well and the allocation of the costs thereof, operating costs and charges for supervision, the designation of applicant as operator, and a 200% charge for risk involved in drilling and completing the well. Said area is approximately 3 miles northeast of Malaga, New Mexico.
11. 23202 Application of Oxy USA Inc. for Compulsory Pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order pooling all uncommitted interests in the Wolfcamp formation underlying a standard 639.88-acre, more or less, horizontal well spacing unit comprised of the E/2 of Sections 6 and 7 all within Township 24 South, Range 29 East (NMPM), Eddy County New Mexico. Applicant seeks to initially dedicate the above-referenced horizontal spacing unit to the following proposed wells which have been drilled thereon:
•    Height CC 6 7 Federal Com Well No. 34H (API No. 30-015-45562), which has been drilled from a surface location in the NE/4 NW/4 (Unit C) of Section 6 to a bottom hole location in the SW/4 SE/4 (Unit O) of Section 7;
•    Height CC 6 7 Federal Com Well No. 35H (API No. 30-015-45563), which has been drilled from a surface location in the NE/4 NE/4 (Unit A) of Section 6 to a bottom hole location in the SW/4 SE/4 (Unit O) of Section 7; and
•    Height CC 6 7 Federal Com Well No. 36H (API No. 30-015-45564), which has been drilled from a surface location in the NE/4 NE/4 (Unit A) of Section 6 to a bottom hole location in the SE/4 SE/4 (Unit P) of Section 7.
The completed intervals for the wells comply with setback requirements under the special rules for the Purple Sage Wolfcamp Pool. Also, to be considered will be the cost of drilling and completing the well and the allocation of the costs thereof, operating costs and charges for supervision, the designation of applicant as operator, and a 200% charge for risk involved in drilling and completing the well. Said area is approximately 3 miles northeast of Malaga, New Mexico.
12. 23203 Application of OXY USA Inc. for Compulsory Pooling, Lea County, New Mexico. Applicant in the above-styled cause seeks an order pooling all uncommitted interest owners in the Wolfcamp (oil) formation underlying a standard 640-acre, more or less, horizontal spacing unit comprised of the W/2 of Sections 26 and 35, Township 22 South, Range 32 East, NMPM, Lea County, New Mexico. The above-referenced unit will be dedicated to the proposed initial:
the Llama Mall 26 35 Fed Com #32H and Llama Mall 26 35 Fed Com #311H both to be horizontally drilled from a surface location in the NW/4 NW/4 (Unit D) of Section 26, to a bottom hole location in the SW/4 SW/4 (Unit M) of Section 35;
the Llama Mall 26 35 Fed Com #33H to be horizontally drilled from a surface location in the NW/4 NW/4 (Unit D) of Section 26, to a bottom hole location in the SE/4 SW/4 (Unit N) of Section 35; and
the Llama Mall 26 35 Fed Com #312H to be horizontally drilled from a surface location in the NE/4 NW/4 (Unit C) of Section 26, to a bottom hole location in the SE/4 SW/4 (Unit N) of Section 35.
The completed interval of the Llama Mall 26 35 Fed Com #32H is expected to remain within 330 feet of the adjoining quarter-quarter section (or equivalent) tracts to allow inclusion of these proximity tracts within the proposed horizontal spacing unit under 19.15.16.15.B(1)(b) NMAC. Also, to be considered will be the cost of drilling and completing the wells, the allocation of the cost thereof, the actual operating costs and charges for supervision, the designation of applicant as operator, and a 200% charge for risk involved in drilling and completing the wells. Said area is located approximately 28 miles southwest of Eunice, New Mexico.
13. 23157 Application of Redwood Operating LLC for Compulsory Pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order pooling all uncommitted interest owners in the Yeso formation underlying a standard 160-acre, more or less, horizontal spacing unit comprised of the S/2 N/2 of Section 15, Township 18 South, Range 26 East, NMPM, Eddy County, New Mexico. The above-referenced unit will be dedicated to the proposed initial Elm Fee #1H, Elm Fee #2H, Elm Fee #3H, and Elm Fee #4H well to be horizontally drilled from a surface location in the NW/4 SE/4 (Unit J) of Section 16, to a bottom hole location in the SE/4 NE/4 (Unit H) of Section 15. Also, to be considered will be the cost of drilling and completing the wells, the allocation of the cost thereof, the actual operating costs and charges for supervision, the designation of applicant as operator, and a 200% charge for risk involved in drilling and completing the wells. Said area is located approximately 6 miles southeast of Artesia, New Mexico.
14. 23209 Application of Steward Energy II, LLC for Compulsory Pooling, Lea County, New Mexico. Applicant seeks an order pooling all uncommitted interests in the San Andres Formation underlying a 480-acre, more or less standard horizontal spacing unit comprised of the SE/4 of Section 3 and the E/2 of Section 10, Township 13 South, Range 38 East, Lea County, New Mexico (“Unit”). The Unit will be dedicated to the Wexler Fee 2H well (“Well”), which will be drilled from a surface hole location in the SE/4 NE/4 (Unit H) of Section 3, Township 13 South, Range 38 East, to a bottom hole location in the SE/4 SE/4 (Unit P) of Section 10, Township 13 South, Range 38 East. The completed interval of the Well will be orthodox. The completed interval of the Well will be located within 330’ of the quarter-quarter section line separating the W/2 SE/4 and E/2 SE/4 of Section 3 and the quarter-quarter section line separating the E/2 E/2 and W/2 E/2 of Section 10 to allow for the creation of a 480-acre standard horizontal spacing unit. Also to be considered will be the cost of drilling and completing the Well and the allocation of the cost, the designation of Applicant as the operator of the Well, and a 200% charge for the risk involved in drilling and completing the Well. The Well is located approximately 13.8 miles southeast of Tatum, New Mexico.
15. 23218 Application of SPC Resources, LLC to Amend Order No. R-21096, As Amended, Eddy County, New Mexico. Applicant in the above-styled cause seeks to amend Order No. R-21096, as amended, to allow for an extension of time to drill an initial a well under the Order until February 17, 2024. The Unit is comprised of the W/2 and E/2 of Section 12, Township 22 South, Range 26 East, and the W/2 and E/2 of Section 7, Township 22 South, Range 27 East, NMPM, Eddy County, New Mexico. Order No. R-21096 pooled the uncommitted interests in the Wolfcamp formation (Purple Sage; Wolfcamp Pool (Pool Code 98220)). The Unit is dedicated to the Caveman #402H well (API No. 30-015-47629), and (2) the Caveman #442H well (API 30-015-Pending). Portions of said area are located within the city limits of Carlsbad, New Mexico.
16. 23219 Application of Mewbourne Oil Company for Compulsory Pooling, Lea County, New Mexico. Applicant applies for an order pooling all uncommitted interests in the Bone Spring Formation underlying a 240.45-acre, more or less, standard horizontal spacing unit comprised of Lots 1 and 2 (N/2 NE/4 equivalent) of Section 6 and Lots 1 through 4 (N/2 N/2 equivalent) of Section 5, Township 18 South, Range 32 East, Lea County, New Mexico (“Unit”). The Unit will be dedicated to the Winterfell 6/5 B2BA Fed Com #1H well (“Well”), which will be horizontally drilled from a surface hole location in Lot 2 (NW/4 NE/4) of Section 6 to a bottom hole location in Lot 1 (NE/4 NE/4) of Section 5. Also to be considered will be the cost of drilling and completing the Well and the allocation of the costs, the designation of Applicant as the operator of the Well, and a 200% charge for the risk involved in drilling and completing the Well. The Well is located approximately 6 miles southwest of Maljamar, New Mexico.
17. 23220 Application of Steward Energy II, LLC to Pool Additional Interests Under Order No. R-22192, Lea County, New Mexico. Applicant seeks an order pooling additional uncommitted interests under the terms of Division Order No. R-22192. Order No R-22192 (“Order”) pooled all uncommitted interests in the San Andres formation underlying a standard horizontal spacing unit comprised of the W/2 E/2 and Lots 1, 2, 3, and 4 (E/2 equivalent) of irregular Section 14, Township 13 South, Range 38 East, Lea County, New Mexico (“Unit”). The Order further dedicated the Unit to the Fring Fed #2H well (“Well”) and designated Applicant as operator of the Unit and Well. Since entry of the Order, Applicant has identified additional interests in the Unit that should be pooled under the terms of the Order. The Well is located approximately 15 miles southeast of Tatum, New Mexico.
18. 23221 (Amend) Application of Franklin Mountain Energy LLC to Amend Order No. R-21995, Lea County, New Mexico. Applicant seeks an order from the Division for the limited purpose of amending Order No. R-21995 to allow for a one-year extension of time to commence drilling the initial well under Order No. R-21995. Order No. R-21995 pooled uncommitted interest owners in a 640-acre, more or less, Wolfcamp standard horizontal spacing unit comprised of the E/2 of Sections 14 and 23, Township 24 South, Range 35 East, N.M.P.M., Lea County, New Mexico. Said area is located approximately 16 miles northwest of Jal, New Mexico.
19. 23222 (Amend) Application of Franklin Mountain Energy LLC to Amend Order No. R-21996, Lea County, New Mexico. Applicant seeks an order from the Division for the limited purpose of amending Order No. R-21996 to allow for a one-year extension of time to commence drilling the initial well under Order No. R-21996. Order No. R-21996 pooled uncommitted interest owners in a 320-acre, more or less, Bone Spring standard horizontal spacing unit comprised of the E/2W/2 of Sections 14 and 23, Township 24 South, Range 35 East, N.M.P.M., Lea County, New Mexico. Said area is located approximately 16 miles northwest of Jal, New Mexico.
