PRELIMINARY DOCKET: Special Examiner's Hearing set for May 27, 2025

For hearings by affidavit: presenting parties are required to submit a pre-hearing statement no later than the Thursday before the hearing. The pre-hearing statement shall include: 1) a list of disputed facts and issues; 2) identification of witnesses and their qualifications; and 3) all exhibits and written testimony a party intends to enter into evidence at the hearing and a full narrative for each.

For contested matters: pre-hearing statements shall be filed no later than 9:00 a.m., 4 business days prior to the hearing and in addition to the requirements of 19.15.4.13.B(1) NMAC, shall include: all evidentiary exhibits, documents, affidavits, and full-written testimony of any witness a party offers at the hearing. Exhibits must be sequentially marked on every page.

Failure to timely file a complete pre-hearing statement may cause the Hearing Examiner to continue the hearing and/or impose sanctions up to and including the exclusion of late-filed evidence. Evidentiary objections must be filed no later than 48 hours before the hearing. Rulings on the objections will be addressed as a preliminary matter when the case is called.

NOTICE: The hearing examiner may call the following cases in any order at their discretion.

1. 25273 Application of Burnett Oil Company, Inc. for approval of a non-standard spacing unit and compulsory pooling, Eddy County, New Mexico: Burnett Oil Company, Inc. has filed an application with the New Mexico Oil Conservation Division requesting approval of a non-standard spacing unit in the Atoka Glorieta-Yeso Pool (Pool Code 3250) comprised of all of Section 24, Township 18 South, Range 26 East, NMPM, Eddy County, New Mexico (the “Unit), and pooling all uncommitted mineral interest owners in the Glorieta-Yeso formation underlying the Unit. Applicant proposes to drill the following wells in the Unit:

(a)    The Horned Frog Well No. 11H, with a first take point in the NE/4NE/4 and a final take point in the NW/4NW/4 of Section 24;
(b)    The Horned Frog Well No. 32H, with a first take point in the NE/4NE/4 and a final take point in the BW/4NW/4 of Section 24;
(c)    The Horned Frog Well No. 13H, with a first take point in the SE/4NE/4 and a final take point in the SW/4NW/4 of Section 24;
(d)    The Horned Frog Well No. 34H, with a first take point in the SE/4NE/4 and a final take point in the SW/4NW/4 of Section 24;
(e)    The Horned Frog Well No. 15H, with a first take point in the NE/4NE/4 and a final take point in the NW/4NW/4 of Section 24;
(f)    The Horned Frog Well No. 36H, with a first take point in the NE/4SE/4 and a final take point in the NW/4SW/4 of Section 24;
(g)    The Horned Frog Well No. 17H, with a first take point in the NE/4SE/4 and a final take point in the NW/4SW/4 of Section 24;
(h)    The Horned Frog Well No. 38H, with a first take point in the SE/4SE/4 and a final take point in the SW/4SW/4 of Section 24; and
(i)    The Horned Frog Well No. 19H, with a first take point in the SE/4SE/4 and a final take point in the SW/4SW/4 of Section 24.

Also to be considered will be the cost of drilling, completing, testing, and equipping the wells, and the allocation of the cost thereof among the wells’ working interest owners, designation of Applicant as operator of the wells and the Unit, approval actual operating charges and costs charged for supervision, together with a provision adjusting the rates pursuant to the COPAS accounting procedure, and setting a 200% charge for the risk involved in drilling, completing, testing, and equipping the wells in the event a working interest owner elects not to participate in the wells. The Unit is located approximately 4 miles southeast of Atoka, New Mexico.
2. 25283 Application of Permian Resources Operating, LLC for Compulsory Pooling, Eddy County, New Mexico. Applicant seeks an order pooling all uncommitted interests in the Bone Spring formation underlying 320-acre, more or less, standard horizontal spacing unit comprised of Lot 3, NE/2 SW/4, N/2 SE/4 (N/2 S/2 equivalent) of irregular Section 7, and the N/2 S/2 of Section 8, Township 20 South, Range 27 East, Eddy County, New Mexico (“Unit”). The Unit will be dedicated to the Fiero 7 Fed Com 133H well (“Well”), which will be drilled from a surface hole location in the SW/4 SW/4 (Unit M) of Section 9 to a bottom hole location in the NW/4 SW/4 (Unit L) of Section 7. The completed interval of the Well will be orthodox. Also to be considered will be the cost of drilling and completing the Well, the allocation of the costs, the designation of Applicant as operator of the Unit and the Well, and a 200% charge for the risk involved in drilling and completing the Well. The Well is located approximately 11.3 miles northwest of Carlsbad, New Mexico.

Also to be considered will be the cost of drilling and completing the Well, the allocation of the costs, the designation of Applicant as operator of the Unit and the Well, and a 200% charge for the risk involved in drilling and completing the Well. The Well is located approximately 11.3 miles northwest of Carlsbad, New Mexico.
