PRELIMINARY DOCKET: Examiner Hearing for Thursday, February 2, 2023

Applications for hearing shall be filed at least thirty (30) days in advance of the hearing date. A party who intends to present evidence shall file a pre-hearing statement no later than the close of business on the Thursday prior to the hearing date and serve a copy on the other parties, if any. The hearing examiner will dismiss the application if the applicant does not file and serve a pre-hearing statement as specified above. A party desiring to use projection equipment at the hearing shall contact Florene Davidson, OCD Clerk, no later than seven (7) business days prior to the hearing.

The producing area for the wells are expected to be orthodox. The completed intervals for the Alpha Wolf 36 Federal Com 302H, Alpha Wolf 36 Federal Com 502H, Alpha Wolf 36 Federal Com 602H wells are expected to be less than 330 feet from the adjoining tracts, thereby allowing for the inclusion of the proximity tracts within the proposed spacing unit. Also to be considered will be the cost of drilling and completing said wells, the allocation of these costs as well as the actual operating costs and charges for supervision, designation of Avant Operating, LLC as operator of the wells, and a 200% charge for risk involved in drilling said wells. Said area is located approximately 10.8 miles south of Maljamar, New Mexico.
2. 23264 Application of Devon Energy Production Company, L.P. for Approval of an Overlapping Horizontal Well Spacing Unit and Compulsory Pooling, Lea County, New Mexico. Applicant in the above-styled cause seeks an order (a) approving a standard 320-acre, more or less, overlapping horizontal well spacing unit in the Bone Spring formation comprised of the E/2 E/2 of Sections 6 and 7, Township 26 South, Range 34 East, NMPM, Lea County, New Mexico, and (b) pooling all uncommitted mineral interests in this overlapping horizontal well spacing unit. Said unit will be initially dedicated to the proposed Jawhawk 6–7 Fed Fee Com #33H well, to be horizontally drilled from a surface location in the SE/4 SE/4 (Unit P) of Section 31, Township 25 South, Range 34 East, to a bottom hole location in the SE/4 SE/4 (Unit P) of Section 7, Township 26 South, Range 34 East. This 320-acre horizontal well spacing unit will overlap the following existing horizontal well spacing unit covering portions of the subject acreage:

Applicant seeks an order pooling all mineral interests within the Bone Spring Quail Ridge Pool (Pool Code 50460) underlying W/2 of Sections 16, and the NW/4 of Section 21, Township 19 South, Range 34 East, NMPM Lea County, New Mexico, on the following wells listed below. 5. 22813 Application of Earthstone Operating, LLC for Compulsory Pooling, Lea County, New Mexico. Applicant applies for an order pooling all uncommitted mineral interests in the Bone Spring formation underlying a 640-acre, more or less, standard horizontal spacing unit comprised of the W/2 of Sections 26 and 35, Township 18 South, Range 33 East, Lea County, New Mexico (“Unit”). The well will have a target interval within the 1st Bone Spring formation, drilled horizontally with a Total Vertical Depth of ~15,000' to a Measured Depth of approximately 5,400'. This well will target the 1st Bone Spring zone with dedicated acreage consisting of the E2 of Section 23.
B.    Thunderball 23 Fed 1BS Com 2H
To be drilled from a proposed surface hole location in the NW4NE4 of Section 26-19S-34E and a proposed bottom hole location in the NE4NE4 of Section 23-19S-34E. The well will have a target interval within the 1st Bone Spring formation, drilled horizontally with a Total Vertical Depth of ~15,000' to a Measured Depth of approximately 5,400'. This well will target the 1st Bone Spring zone with dedicated acreage consisting of the E2 of Section 23.
C.    Thunderball 23 Fed 2BS Com 5H
To be drilled from a proposed surface hole location in the NW4NE4 of Section 23-19S-34E and a proposed bottom hole location in the NW4NE4 of Section 23-19S-34E. The well will have a target interval within the 2nd Bone Spring formation, drilled horizontally with a Total Vertical Depth of ~15,750' to a Measured Depth of approximately 5,400'. This well will target the 2nd Bone Spring zone with dedicated acreage consisting of the E2E2 of Section 23.
D.    Thunderball 23 Fed 2BS Com 6H
To be drilled from a proposed surface hole location in the NW4NE4 of Section 23-19S-34E and a proposed bottom hole location in the NE4NE4 of Section 23-19S-34E. The well will have a target interval within the 2nd Bone Spring formation, drilled horizontally with a Total Vertical Depth of ~15,750' to a Measured Depth of approximately 5,400'. This well will target the 2nd Bone Spring zone with dedicated acreage consisting of the E2E2 of Section 23.
E.    Thunderball 23 Fed 3BS Com 3H
To be drilled from a proposed surface hole location in the NW4NE4 of Section 23-19S-34E and a proposed bottom hole location in the NE4NE4 of Section 23-19S-34E. The well will have a target interval within the 3rd Bone Spring formation, drilled horizontally with a Total Vertical Depth of ~16,500' to a Measured Depth of approximately 5,400'. This well will target the 3rd Bone Spring zone with dedicated acreage consisting of the E2E2 of Section 23.
F.    Thunderball 23 Fed 3BS Com 4H
To be drilled from a proposed surface hole location in the NW4NE4 of Section 23-19S-34E and a proposed bottom hole location in the NE4NE4 of Section 23-19S-34E. The well will have a target interval within the 3rd Bone Spring formation, drilled horizontally with a Total Vertical Depth of ~16,500' to a Measured Depth of approximately 5,400'. This well will target the 3rd Bone Spring zone with dedicated acreage consisting of the E2E2 of Section 23.
7. 23221 (Amend) Application of Franklin Mountain Energy LLC to Amend Order No. R-21995, Lea County, New Mexico. Applicant seeks an order from the Division for the limited purpose of amending Order No. R-21995 to allow for a one-year extension of time to commence drilling the initial well under Order No. R-21995. Applicant in the above-styled cause seeks an order pooling all uncommitted interest owners in the Bone Spring formation underlying a standard 320-acre, more or less, horizontal spacing unit comprised of the W/2 W/2 of Sections 16 and 21, Township 19 South, Range 34 East, NMPM, Lea County, New Mexico. The above-referenced unit will be dedicated to the proposed initial Cimarron 1621 Fed Com #131H well, to be horizontally drilled from a surface location in the NW/4 NW/4 (Unit D) of Section 16 to a bottom hole location in SW/4 SW/4 (Unit M) of Section 21. Applicant in the above-styled cause seeks an order pooling all uncommitted interest owners in the Wolfcamp formation underlying a standard 480-acre, more or less, horizontal spacing unit comprised of the E/2 W/2 of Sections 16, 21 and 28, Township 19 South, Range 34 East, NMPM, Lea County, New Mexico. The above-referenced unit will be dedicated to the proposed initial Cimarron 1628 Fed Com #206H well, to be horizontally drilled from a surface location in the NE/4 NW/4 (Unit C) of Section 16 to a bottom hole location in SE/4 SW/4 (Unit N) of Section 28. 15. 22584 Application of Matador Production Company for Compulsory Pooling, Lea County, New Mexico. Applicant in the above-styled cause seeks an order pooling all uncommitted interest owners in the Bone Spring formation underlying a standard 320-acre, more or less, horizontal well spacing unit comprised of the W/2 W/2 of Sections 26 and 35, Township 18 South, Range 33 East (NMPM), Lea County New Mexico. The above-referenced unit will be initially dedicated to the proposed English Buffalo 35 26 Fed Com 111H and English Buffalo 35 26 Fed Com 121H wells to be drilled from a surface location in the SW/4 SW/4 of Section 35 to a proposed bottom hole location in the NW/4 NW/4 of Section 26. Also, to be considered will be the cost of drilling and completing the wells and the allocation of the cost thereof, operating costs and charges for supervision, the designation of applicant as operator, and a 200% charge for risk involved in drilling and completing the wells. Said area is located approximately 12 miles Southeast of Maljamar, New Mexico.
16. 23042 Application of Mewbourne Oil Company to Revoke or Modify the Injection Authority Granted Under Order No. R-10139 for the State MA Com No. 1 Operated by Endeavor Energy Resources, LP, Eddy County, New Mexico. Applicant seeks an order revoking or modifying the injection authority granted by Order R-10139, issued in June of 1994 in Case No. 10968, for the State MA Com No. 1 (30-015-23709), located 1980 feet from the North line and 660 feet from the East line (Unit H) in Section 3, Township 25 South, Range 28 East, N.M.P.N., Eddy County, New Mexico. The approved injection zone is from “approximately 7,287 feet to approximately 7,740 feet” and includes the First Bone Spring Sand interval of the Bone Spring formation, an interval which has proven to be productive or potentially productive of hydrocarbons since the advent of horizontal drilling. Said area is located approximately 4.5 miles south of Malaga, New Mexico.
17. 23199 Application of OXY USA Inc. to Amend Order R-21020 to Add Additional Pooled Parties, Eddy County, New Mexico. Applicant seeks an order from the Division Order R-21020 to add additional parties to the terms of the pooling order. Order R-21020 pooled uncommitted mineral interests in the Bone Spring formation [Pierce Crossing; Bone Spring Pool (50371)] underlying a standard 640-acre horizontal spacing unit comprised of the W/2 of Section 8 and Section 17, Township 24 South, Range 29 East, NMPM, Eddy County, New Mexico. This standard horizonal well spacing unit is currently dedicated to the Oxbow CC 17 8 Federal Com Well No. 33H (API No. 30-015-45085), a horizontal well drilled from a surface location in the SW/4 SW/4 (Unit M) of Section 17 to a bottomhole location in the NE/4 NW/4 (Unit C) of Section 8. This area is located approximately 3.5 miles east of Malaga, New Mexico.
18. 23200 Application of OXY USA Inc. to Amend Order R-21021 to Add Additional Pooled Parties, Eddy County, New Mexico. Applicant seeks an order from the Division Order R-21021 to add additional parties to the terms of the pooling order. Order R-21021 pooled uncommitted mineral interests in the Wolfcamp formation [Pierce Crossing; Bone Spring Pool (50371)] underlying a standard 640-acre horizontal spacing unit comprised of the W/2 of Section 8 and Section 17, Township 24 South, Range 29 East, NMPM, Eddy County, New Mexico. This standard horizonal well spacing unit is dedicated to the following initial wells:
•    Oxbow CC 17 8 Federal Com Well No. 31H (API No. 30-015-45083), a horizontal well drilled from a surface location in the SW/4 SW/4 (Unit M) of Section 17 to a bottomhole location in the NW/4 NW/4 (Unit D) of Section 8;
•    Oxbow CC 17 8 Federal Com Well No. 32H (API No. 30-015-45084), a horizontal well drilled from a surface location in the SW/4 SW/4 (Unit M) of Section 17 to a bottomhole location in the NW/4 NW/4 (Unit D) of Section 8; and
•    Oxbow CC 17 8 Federal Com Well No. 37H (API No. 30-015-46400), a horizontal well drilled from a surface location in the SE/4 SW/4 (Unit N) of Section 17 to a bottomhole location in the NE/4 NW/4 (Unit C) of Section 8.
This area is located approximately 3.5 miles east of Malaga, New Mexico.
19. 23201 Application of Oxy USA Inc. for Compulsory Pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order pooling all uncommitted interests in the Bone Spring formation underlying a standard 639.88-acre, more or less, horizontal well spacing unit comprised of the E/2 of Sections 6 and 7 all within Township 24 South, Range 29 East (NMPM), Eddy County New Mexico. Applicant seeks to initially dedicate the above-referenced horizontal spacing unit to the following proposed wells which have been drilled thereon:
•    Width CC 6 7 Federal Com Well No. 14H (API No. 30-015-45573), which has been drilled from a surface location in the NE/4 NE/4 (Unit A) of Section 6 to a bottom hole location in the SE/4 SE/4 (Unit P) of Section 7;
•    Length CC 6 7 Federal Com Well No. 24H (API No. 30-015-45552), which has been drilled from a surface location in the NE/4 NW/4 (Unit C) of Section 6 to a bottom hole location in the SW/4 SE/4 (Unit O) of Section 7;
•    Length CC 6 7 Federal Com Well No. 25H (API No. 30-015-45566), which has been drilled from a surface location in the NE/4 NE/4 (Unit A) of Section 6 to a bottom hole location in the SW/4 SE/4 (Unit O) of Section 7; and

The proposed wells to be dedicated to the horizontal spacing unit are the: (1) Jet Federal Com 401H Well, to be horizontally drilled from an approximate surface location in the NE¼NE¼ of Section 33, T18S-R31E, to a bottom hole location in the SW¼NE¼ of Section 4, Township 19 South, Range 31 East, N.M.P.M.; (2) Jet Federal Com 402H Well, to be horizontally drilled from an approximate surface location in the NE¼NE¼ of Section 33, T18S-R31E, to a bottom hole location in the SE¼NE¼ of Section 4, Township 19 South, Range 31 East, N.M.P.M.; (3) Jet Federal Com 501H Well, to be horizontally drilled from an approximate surface location in the NE¼NE¼ of Section 33, T18S-R31E, to a bottom hole location in the SW¼NE¼ of Section 4, Township 19 South, Range 31 East, N.M.P.M.; (4) Jet Federal Com 502H Well, to be horizontally drilled from an approximate surface location in the NE¼NE¼ of Section 33, T18S-R31E, to a bottom hole location in the SE¼NE¼ of Section 4, Township 19 South, Range 31 East, N.M.P.M.; (5) Jet Federal Com 601H Well, to be horizontally drilled from an approximate surface location in the NE¼NE¼ of Section 33, T18S-R31E, to a bottom hole location in the SW¼NE¼ of Section 4, Township 19 South, Range 31 East, N.M.P.M.; and (6) Jet Federal Com 602H Well, to be horizontally drilled from an approximate surface location in the NE¼NE¼ of Section 33, T18S-R31E, to a bottom hole location in the SE¼NE¼ of Section 4, Township 19 South, Range 31 East, N.M.P.M. The wells are orthodox in location and the take points and laterals comply with Statewide Rules for setbacks; also to be considered will be the cost of drilling and completing the wells and the allocation of the costs thereof; actual operating costs and charges for supervision; the designation of the Applicant as Operator of the wells and unit; and a 200% charge for the risk involved in drilling and completing the wells. The wells and lands are located approximately 28 miles northeast of Carlsbad, New Mexico.

Pride Energy Company seeks an order pooling all uncommitted mineral interest owners in the Bone Spring formation underlying a 157.83 acre horizontal spacing unit comprised of Lots 3, 6, 11, and 14 of Section 2, Township 21 South, Range 34 East, N.M.P.M., Lea County, New Mexico. The unit will be dedicated to the Grama Ridge State Com. Well Nos. 101H and 201H, to be drilled to depths sufficient to test the Bone Spring formation. The wells have first take points in Lot 14 and last take points in Lot 3 of Section 2. Also to be considered will be the cost of drilling, completing, and equipping the wells and the allocation of the cost thereof, as well as actual operating costs and charges for supervision, designation of applicant as operator of the wells, and a 200% charge for the risk involved in drilling, completing, and equipping the wells. The unit is located approximately 17-1/2 miles east-southeast of Halfway, New Mexico.
