PRELIMINARY DOCKET: Examiner Hearing for Thursday, August 17, 2023

Applications for hearing shall be filed at least thirty (30) days in advance of the hearing date. A party who intends to present evidence shall file a pre-hearing statement no later than the close of business on the Thursday prior to the hearing date and serve a copy on the other parties, if any. The hearing examiner will dismiss the application if the applicant does not file and serve a pre-hearing statement as specified above. A party desiring to use projection equipment at the hearing shall contact Florene Davidson, OCD Clerk, no later than seven (7) business days prior to the hearing.

Applicant seeks an order pooling additional uncommitted interests under the terms of Division Order No. R-21609. Order No R-21609 (“Order”) pooled uncommitted interests in the Bone Spring formation underlying a standard horizontal spacing unit comprised of the W/2 W/2 of Sections 2 and 11, Township 20 South, Range 35 East, Lea County, New Mexico (“Unit”). Order R-21609 further dedicated the Unit to the Zeus 2-11 Fed Com #1H well (“Well”) and designated Applicant as operator of the Unit and Well. Order No. R-21609-C was entered on April 13, 2023, and granted an extension to drill the Well until February 23, 2024. Since the Order was entered, Applicant has identified additional interests in the Unit that should be pooled under the terms of the Order. The Well is located approximately 16 miles Southwest of Hobbs, New Mexico.
2. 23177 Application of Mewbourne Oil Company for Compulsory Pooling, Lea County, New Mexico. Applicant applies for an order pooling all uncommitted interests in the Bone Spring formation underlying a 240-acre, more or less, standard horizontal spacing unit comprised of the W/2 NE/4 of Section 21 and the W/2 E/2 of Section 16, Township 19 South, Range 33 East, Lea County, New Mexico (“Unit”). The Unit will be dedicated to the Bushwood 21/16 B2GB Fed Com #1H well (“Well”), to be drilled from a surface hole location in the NW/4 SE/4 (Unit J) of Section 21 to a bottom hole location in the NW/4 NE/4 (Unit B) of Section 16. Also to be considered will be the cost of drilling and completing the Well and the allocation of the costs, the designation of Applicant as the operator of the Well, and a 200% charge for the risk involved in drilling and completing the Well. The Well is located approximately 27 miles southwest of Lovington, New Mexico.
3. 23179 Application of Mewbourne Oil Company for Compulsory Pooling, Lea County, New Mexico. Applicant applies for an order pooling all uncommitted interests in the Bone Spring formation underlying a 240-acre, more or less, standard horizontal spacing unit comprised of the W/2 NW/4 of Section 21 and the W/2 W/2 of Section 16, Township 19 South, Range 33 East, Lea County, New Mexico (“Unit”). The Unit will be dedicated to the Bushwood 21/16 B2ED Fed Com #1H well (“Well”), to be drilled from a surface hole location in the NW/4 SE/4 (Unit J) of Section 21 to a bottom hole location in the NW/4 NW/4 (Unit D) of Section 16. 4. 23345 Application of Mewbourne Oil Company for Compulsory Pooling and Approval of Non-Standard Spacing Unit, Lea County, New Mexico. Applicant applies for an order: (1) establishing a 960-acre, more or less, non-standard horizontal spacing unit comprised of Section 16 and the N/2 of Section 21, Township 19 South, Range 33 East, Lea County (“Unit”); and (2) pooling all uncommitted interests in the Bone Spring formation underlying the Unit. Pride Energy Company seeks an order pooling all uncommitted mineral interest owners in the Bone Spring formation (Tonto; Bone Spring [59475]) in a horizontal spacing unit underlying the W/2 E/2 of Section 16 and the W/2 NE/4 of Section 21, all in Township 19 South, Range 33 East, NMPM, Lea County, New Mexico. The unit will be dedicated to the Tonto 16-21 State Federal Com. Well No. 201H, a horizontal well with a first take point in the NW/4 NE/4 of Section 16 and a last take point in the SW/4 NE/4 of Section 21, all in Township 19 South, Range 33 East. Also to be considered will be the cost of drilling, completing, and equipping the well and the allocation of the cost thereof, as well as actual operating costs and charges for supervision, designation of applicant as operator of the well, and a 200% charge for the risk involved in drilling, completing, and equipping the well. The unit is located approximately 9 miles northeast of Halfway, New Mexico.
6. 23328 Application of Pride Energy Company for compulsory pooling, Lea County, New Mexico. Pride Energy Company seeks an order pooling all uncommitted mineral interest owners in the Bone Spring formation (Tonto; Bone Spring [59475]) in a horizontal spacing unit underlying the E/2 E/2 of Section 16 and the E/2 NE/4 of Section 21, all in Township 19 South, Range 33 East, NMPM. The unit will be dedicated to the Tonto 16-21 State Federal Com. Well No. 202H, a horizontal well with a first take point in the NE/4 NE/4 of Section 16, Township 19 South, Range 33 East and a last take point in the SE/4 NE/4 of Section 21, all in Township 19 South, Range 33 East. Also to be considered will be the cost of drilling, completing, and equipping the well and the allocation of the cost thereof, as well as actual operating costs and charges for supervision, designation of applicant as well as operator of the well, and a 200% charge for the risk involved in drilling, completing, and equipping the well. The unit is located approximately 9 miles northeast of Halfway, New Mexico.
7. 23318 Application of COG Operating LLC for Compulsory Pooling, Lea County, New Mexico. Applicant in the above-styled cause seeks an order pooling all uncommitted interest owners in the Bone Spring formation underlying a standard 639.23-acre, more or less, horizontal spacing unit comprised of Lots 1 & 2, S2NE, SE (E2 equivalent) of irregular Section 2 and E2 of Section 11, Township 23 South, Range 32 East, NMPM, Lea County, New Mexico. Said unit will be initially dedicated to the following proposed wells:
•    Redtail Federal Com 501H and Redtail Federal Com 502H to be horizontally drilled from a surface location in the NE4NE4 (Lot 1) of Section 2 to bottomhole locations in the SE4SE4 (Unit P) of Section 11.
•    Redtail Federal Com 503H to be horizontally drilled from a surface location in the NE4NE4 (Lot 1) of Section 2 to a bottomhole location in the SW4SE4 (Unit O) of Section 11.
•    Redtail Federal Com 602H and Redtail Federal Com 604H to be horizontally drilled from a surface location in the NW4NE4 (Lot 2) of Section 2 to bottomhole locations, respectfully, in the SE4SE4 (Unit P) of Section 11 and SW4SE4 (Unit O) of Section 11.
The completed interval of the proposed Redtail Federal Com 502H well is expected to remain within 330 feet of the offsetting quarter-quarter sections or equivalent tracts to include them within this proposed spacing unit. Also, to be considered will be the cost of drilling and completing the wells, the allocation of the cost thereof, the actual operating costs and charges for supervision, the designation of applicant as operator, and the imposition of 200% charge for risk involved in drilling and completing each well. Said area is located approximately 25 miles east of Malaga, New Mexico.
8. 23319 Application of COG Operating LLC for Compulsory Pooling and Approval of Overlapping Spacing Unit, Lea County, New Mexico. Applicant in the above-styled cause seeks (a) an order pooling all uncommitted interest owners in the Bone Spring formation underlying a standard 639.29-acre, more or less, horizontal spacing unit comprised of Lots 3 & 4, S2NW, SW (W2 equivalent) of irregular Section 2 and W2 of Section 11, Township 23 South, Range 32 East, NMPM, Lea County, New Mexico, and (b) approving, as necessary, this overlapping spacing unit. Said unit will be initially dedicated to following proposed wells:
•    Redtail Federal Com 504H and Redtail Federal Com 505H wells, to be horizontally drilled from a surface location in the NW4NW4 (Lot 4) of Section 2 to bottomhole locations, respectively, in the SE4SW4 (Unit N) and the SW4SW4 (Unit M) of Section 11.
•    Redtail State Com 506H well, to be horizontally drilled from a surface location in the NW4NW4 (Lot 4) of Section 2 to a bottomhole location in the SW4SW4 (Unit M) of Section 2.
•    Redtail Federal Com 606H and Redtail Federal Com 608H wells, to be horizontally drilled from a surface location in the NE4NW4 (Lot 3) of Section 2 to bottomhole locations, respectively, in the SE4SW4 (Unit N) and the SW4SW4 (Unit M) of Section 11.
The completed interval of the proposed Redtail Federal Com 505H well is expected to remain within 330 feet of the offsetting quarter-quarter sections or equivalent tracts to include them within this proposed spacing unit. This proposed horizontal well spacing unit will overlap the following existing spacing units in the W2 of Section 11:
•    A 160-acre spacing unit comprised of the W2W2 of Section 11 that is currently dedicated to the Urraca 11 SB Federal Com 4H (30-025-41968) currently producing from the Bone Spring formation.
•    A 160-acre spacing unit comprised of the E2W2 of Section 11 that is currently dedicated to the Urraca 23 32 11 Federal Com 24H (30-025-42226) currently producing from the Bone Spring formation.
Also, to be considered will be the cost of drilling and completing the wells, the allocation of the cost thereof, the actual operating costs and charges for supervision, the designation of applicant as operator, and the imposition of 200% charge for risk involved in drilling and completing each well. Said area is located approximately 25 miles east of Malaga, New Mexico.
9. 23320 Application of COG Operating LLC for Compulsory Pooling, Lea County, New Mexico. Applicant in the above-styled cause seeks an order pooling all uncommitted interest owners in the Wolfcamp formation underlying a standard 639.23-acre, more or less, horizontal spacing unit comprised of Lots 1 & 2, S2NE, SE (E2 equivalent) of irregular Section 2 and E2 of Section 11, Township 23 South, Range 32 East, NMPM, Lea County, New Mexico. This spacing unit will be dedicated to the Swallowtail 14-11 TB Federal 9H well to be horizontally drilled. The producing area for the well will be orthodox. The completed interval for the Swallowtail 14-11 TB Federal 9H well will be less than 330’ from the adjoining tracts to allow inclusion of proximity tracts within the proposed standard horizontal spacing unit. Also to be considered will be the cost of drilling, completing, and equipping said well, the allocation of these costs as well as the actual operating costs and charges for supervision while drilling and after completion, designation of Marathon Oil Permian LLC as operator of the well, and a 200% charge for risk involved in drilling said well. 17. 23605 Application of MRC Permian Company for Approval of an Overlapping Horizontal Well Spacing Unit and Compulsory Pooling, Lea County, New Mexico. Applicant in the above-styled cause seeks an order (a) approving a standard 400-acre, more or less, overlapping horizontal well spacing unit in the Bone Spring formation comprised of the W/2 SE/4 of Section 6 and the W/2 E/2 of Sections 7 and 18, Township 21 South, Range 33 East, NMPM, Lea County, New Mexico, and (b) pooling all uncommitted mineral interests in this overlapping horizontal well spacing unit. Said unit will be initially dedicated to the proposed Horseshoe Fed Com #113H, Horseshoe Fed Com #123H, and Horseshoe Fed Com #137H wells, all to be horizontally drilled from a surface location in the NW/4 NE/4 (Unit B) of Section 19 to a bottom hole location in the NW/4 SE/4 (Unit J) of Section 6. This 400-acre horizontal well spacing unit will overlap the following existing horizontal well spacing units covering portions of the subject acreage:
•    240-acre, more or less, horizontal well spacing unit comprised of the W/2 SE/4 of Section 6 and the W/2 E/2 of Section 7, Township 21 South, Range 33 East, dedicated to the Adams State Com #3H (API: 30-025-40308); and
•    160-acre, more or less, horizontal well spacing unit comprised of the W/2 E/2 of Section 18, Township 21 South, Range 33 East, dedicated to the Horseshoe Fed Com #601H (API: 30-025-47056).
Also, to be considered will be the cost of drilling and completing the wells and the allocation of the cost thereof, actual operating costs and charges for supervision, designation of Matador Production Company as operator of the wells, and a 200% charge for risk involved in drilling said wells. Said area is located approximately 36 miles east of Carlsbad, New Mexico.
18. 23606 Application of MRC Permian Company for Compulsory Pooling, Lea County, New Mexico. Applicant in the above-styled cause seeks an order pooling all uncommitted interests in the Bone Spring formation underlying a standard 400-acre, more or less, horizontal well spacing unit comprised of the E/2 SE/4 of Section 6 and the E/2 E/2 of Sections 7 and 18, Township 21 South, Range 33 East, NMPM, Lea County, New Mexico. Said unit will be initially dedicated to the proposed Horseshoe Fed Com #114H, Horseshoe Fed Com #124H, Horseshoe Fed Com #134H, and Horseshoe Fed Com #138H wells, all to be horizontally drilled from a surface location in the NE/4 NE/4 (Unit A) of Section 19 to a bottom hole location in the NE/4 SE/4 (Unit I) of Section 6. Also, to be considered will be the cost of drilling and completing the wells and the allocation of the cost thereof, actual operating costs and charges for supervision, designation of Matador Production Company as operator of the wells, and a 200% charge for risk involved in drilling the wells. Said area is located approximately 36 miles east of Carlsbad, New Mexico.
19. 23682 Application of Ameredev Operating, LLC for compulsory pooling, Lea County, New Mexico. Applicant in the above-styled cause seeks an order pooling all uncommitted mineral owners in a standard 640-acre, more or less, horizontal well spacing unit in the Wolfcamp formation underlying the E/2 W/2 and W/2 E/2 of Sections 28 and 33, all in Township 25 South, Range 36 East, NMPM, Lea County, New Mexico. Ameredev proposes to dedicate the above-referenced spacing unit to the proposed initial following wells:
•    Tea Olive Fed Com 25 36 33 104H well (API No. 30-025-50739) and Tea Olive Fed Com 25 36 33 124H well (API No. 30-025-50745), to be horizontally drilled from a surface location in the NE/4 NW/4 (Unit C) of Section 4, Township 26 south, Range 36 East, to bottom hole locations in the NE/4 NW/4 (Unit C) of Section 28, Township 25 South, Range 36 East; and
•    Tea Olive Fed Com 25 36 33 105H well (API No. 30-025-50740) and the Tea Olive Fed Com 25 36 33 115H well (API No. 30-025-50742), to be horizontally drilled from surface locations in the NW/4 NE/4 (Lot 2) of Section 4, Township 26 south, Range 36 East, to bottom hole locations in the NW/4 NE/4 (Unit B) of Section 28, Township 25 South, Range 36 East.
The completed interval of the Fed Com 25 36 33 124H well is expected to remain within 330 feet of the offsetting quarter-quarter sections or equivalent tracts to include them in a standard horizontal well spacing unit. Also, to be considered will be the cost of drilling and completing the wells and the allocation of the cost thereof as well as actual operating costs and charges for supervision, designation of Ameredev Operating, LLC as operator of the wells, and a 200% charge for risk involved in drilling said wells. Said area is located approximately 5 miles southwest of Jal, New Mexico.
20. 23693 Application of Mewbourne Oil Company for compulsory pooling and approval of a non-standard spacing and proration unit, Lea County, New Mexico. Mewbourne Oil Company seeks an order pooling all uncommitted mineral interests in the Bone Spring formation underlying a horizontal spacing unit comprised of Lots 1-4 and the S/2N/2 (the N/2) of Section 2 and Lots 1-4 and the S/2N/2 (the N/2) of Section 1, Township 18 South, Range 32 East, N.M.P.M., Lea County, New Mexico. Applicant proposes to drill the following wells to a depth sufficient to test the Bone Spring formation: (a) the Night Watch 2/1 B2DA Fed. Com. Well No. 1H, with a first take point in Lot 4 of Section 2 and a last take point in Lot 1 of Section 1; and (b) the Night Watch 2/1 B2EH Fed. Com. Well No. 1H, a horizontal well with a first take point in the SW/4NW/4 of Section 2 and a last take point in the SE/4NE/4 of Section 1. The producing interval of each well will be orthodox Applicant also requests that the wells be dedicated to a non-standard spacing and proration unit in the Young; Bone Spring, North Pool. Also to be considered will be the cost of drilling, completing, testing, and equipping the wells and the allocation of the cost thereof, as well as actual operating costs and charges for supervision, designation of applicant as operator of the wells, and a 200% charge for the risk involved in drilling, completing, testing and equipping the wells. The well unit is located approximately 5-1/2 miles south-southeast of Maljamar, New Mexico.
21. 23696 Application of Texas Standard Operating NM LLC for compulsory pooling, Lea County, New Mexico.
