PRELIMINARY DOCKET: Examiner Hearing for October 9, 2025

For hearings by affidavit: presenting parties are required to submit a pre-hearing statement no later than the Thursday before the hearing. The pre-hearing statement shall include: 1) a list of disputed facts and issues; 2) identification of witnesses and their qualifications; and 3) all exhibits and written testimony a party intends to enter into evidence at the hearing and a full narrative for each.

For contested matters: pre-hearing statements shall be filed no later than 9:00 a.m., 4 business days prior to the hearing and in addition to the requirements of 19.15.4.13.B(1) NMAC, shall include: all evidentiary exhibits, documents, affidavits, and full-written testimony of any witness a party offers at the hearing. Failure to timely file a complete pre-hearing statement may cause the Hearing Examiner to continue the hearing and/or impose sanctions up to and including the exclusion of late-filed evidence. 5. 25519 Application of OXY USA Inc. to Amend and Expand the Proposed Closed Loop Gas Capture Injection Pilot Project Area and Add Additional Injection Wells, Eddy and Lea Counties, New Mexico. Applicant in the above-styled cause seeks an order amending the request under Case No. 23633 to (1) expand the closed loop gas capture injection project area; and (2) authorize seventeen additional injection wells for intermittent, temporary produced gas injection within the Bone Spring formation within the requested amended project area. OXY seeks authority to utilize these producing wells to occasionally inject produced gas into the Bone Spring formation at total vertical depths of between approximately 9,081 feet to 10,303 feet along the horizontal portion of each wellbore at surface injection pressures of no more than 1,300 psi. at an average injection rate of 3 MMSCF per day and a maximum injection rate of 4 MMSCF per day. The source of the produced gas will be from the Bone Spring and Wolfcamp formations. The subject acreage is located approximately 41 miles southwest of Lovington, New Mexico.

6. 25532 Application of Spur Energy Partners LLC for Compulsory Pooling, Eddy County, New Mexico. Applicant seeks an order pooling all uncommitted interests from the top of the Yeso Formation to approximately 5,000’ TVD underlying a 320-acre, more or less, standard horizontal spacing unit comprised of the S/2 of Section 3, Township 19 South, Range 25 East, Eddy County, New Mexico (“Unit”). The Unit will be dedicated to the following wells (“Wells”): Friesian 3 Federal Com 1H, Friesian 3 Federal Com 11H, and Friesian 3 Federal Com 71H, which will be drilled from surface hole locations in the NW/4 SW/4 (Unit L) of Section 2 to bottom hole locations in the NW/4 SW/4 (Unit L) of Section 3; and Friesian 3 Federal Com 10H and Friesian 3 Federal Com 70H, which will be drilled from surface hole locations in the SW/4 SW/4 (Unit M) of Section 2 to bottom hole locations in the SW/4 SW/4 (Unit M) of Section 3. The completed intervals of the Wells will be orthodox. A depth severance exists within the Unit. Therefore, Applicant only seeks to pool those uncommitted interests from the top of the Yeso formation to 5,000’ TVD. Also to be considered will be the cost of drilling and completing the Wells, the allocation of the costs, the designation of Applicant as operator of the Wells and the Unit, and a 200% charge for the risk involved in drilling and completing the Wells. The Wells are located approximately 11.5 miles southwest of Artesia, New Mexico.
7. 25539 Application of Permian Resources Operating, LLC for Compulsory Pooling and Approval of a Non-Standard Horizontal Spacing Unit, Eddy County, New Mexico. Applicant seeks an order pooling all uncommitted interests in the Bone Spring formation underlying a 640-acre, more or less, non-standard horizontal spacing unit comprised of Section 26, Township 22 South, Range 28 East, Eddy County, New Mexico (“Unit”). The Unit will be dedicated to the following u-turn wells (“Wells”): Crocubot Federal 26 212H and Crocubot Federal 26 231H, which will produce from a first take point located in the SW/4 SW/4 (Unit M) to a last take point located in the SE/4 SW/4 (Unit N); and Crocubot Federal 26 304H and Crocubot Federal 26 414H, which will produce from a first take point located in the SE/4 SE/4 (Unit P) to a last take point located in the SW/4 SE/4 (Unit O). The completed intervals of the Wells will be orthodox. Applicant seeks approval of a non-standard spacing unit. 9. 25578 Application of COG Operating LLC for Approval of an Overlapping Horizontal Well Spacing Unit and Compulsory Pooling, Lea County, New Mexico. Applicant in the above-styled cause seeks an order (1) approving a 640-acre, more or less, overlapping horizontal well spacing unit
in the Bone Spring formation underlying the E/2 of Sections 8 and 17, Township 26 South, Range 33 East, NMPM, Lea County, New Mexico, and
(2) pooling all uncommitted interests in this acreage. Applicant seeks to initially dedicate the above-referenced horizontal spacing unit to the
proposed Tigercat Federal Com 501H and Tigercat Federal Com 601H wells, both to be drilled from surface locations in the N/2 NE/4 of Section 8, first take points in the NW/4 NE/4 (Unit B) of Section 8 and last take points in the SW/4 SE/4 (Unit O) of Section 17; and Tigercat Federal Com 502H, Tigercat Federal Com 503H and Tigercat Federal Com 602H wells, all to be drilled from surface locations in the N/2 NE/4 of Section 8, first take points in the NE/4 NE/4 (Unit A) of Section 8 and last take points in the SE/4 SE/4 (Unit P) of Section 17. This proposed horizontal well spacing unit will overlap the following spacing units in the Bone Spring
formation:
• An existing 320-acre spacing unit in the Bone Spring formation
underlying the E/2 E/2 of Sections 8 and 17, T26S-R33E, currently
dedicated to COG Operating LLC’s Tigercat Federal Com 1H (API
No. 30-025-44302); and
• An existing 320-acre spacing unit in the Bone Spring formation underlying the W/2 E/2 of Sections 8 and 17, T26S-R33E, currently dedicated to COG Operating LLC’s Tigercat Federal Com 2H (API No. 30-025-44303).
The completed interval of the Tigercat Federal Com 502H is expected within 330 feet of the adjoining quarter-quarter section (or equivalent) tracts to allow inclusion of these proximity tracts within the proposed horizontal spacing unit under 19.15.16.15.B(1)(b) NMAC. Also to be considered will be the cost of drilling and completing the wells and the allocation of the cost thereof, actual operating costs and charges for supervision, designation of Applicant as operator of the well, and a 200% charge for risk involved in drilling the well. The subject area is located approximately 4 miles north of the Texas and New Mexico border.
10. 25579 Amended Application of MRC Toro, LLC for Compulsory Pooling, Lea County, New Mexico. Applicant applies for an order pooling all uncommitted interests in the Avalon formation and the Third Bone Spring interval of the Bone Spring formation underlying a 482.04-acre, more or less, standard, overlapping horizontal spacing unit comprised of the E/2 E/2 of irregular Section 5 and the E/2 E/2 of Sections 8 and 17, Township 22 South, Range 35 East, Lea County, New Mexico (“Unit”). The Unit will be dedicated to Casa Bonita 5 State Com 604H and Casa Bonita 5 State Com 104H wells (“Wells”), which will produce from first take points in the NE/4 NE/4 (Lot 1) of Section 5 to last take points in the SE/4 SE/4 (Unit P) of Section 17. The completed intervals of the Wells will be orthodox. Multiple depth severances exist within the Unit. Accordingly, Applicant seeks to pool uncommitted interests from the top of the Avalon formation, at a stratigraphic equivalent of approximately 8,724’ TVD, to the base of the Avalon, at a stratigraphic equivalent of 9,366’ TVD, and from the top of the Third Bone Spring interval, at a stratigraphic equivalent of approximately 10,344’ TVD, to the base of the Third Bone Spring interval, at a stratigraphic equivalent of approximately 10,956’ TVD, as observed on the San Simon 32-A State Com #1 well log (API No. 30-025-27306). The Unit will partially overlap with the following spacing units: the Casa Bonita 8 State Com #124H (API No. 30-025-52487) well, which produces from the WC-025 G-07 S223505N Pool (Code 98136); the Butter Stotch 8 State Com #124H (API No. 30-025-52485) well, which produces from the WC-025 G-07 S223505N Pool (Code 98136); and Casa Bonita 5 State Com #304H (API No. 30-025-54263) well, which produces from the WC-025 G-07 S223505N Pool (Code 98136). Also to be considered will be the cost of drilling and completing the Wells and the allocation of the costs, the designation of Applicant as operator of the Wells, and a 200% charge for the risk involved in drilling and completing the Wells. The Wells are located approximately 13.1 miles southwest of Eunice, New Mexico.
