PRELIMINARY DOCKET: Examiner Hearing for Thursday, February 15, 2024

Applications for hearing shall be filed at least thirty (30) days in advance of the hearing date. A party who intends to present evidence shall file a pre-hearing statement no later than the close of business on the Thursday prior to the hearing date and serve a copy on the other parties, if any. Applicant in the above-styled cause seeks an order pooling all uncommitted mineral owners in a standard 640-acre horizontal well spacing unit in the Bone Spring formation underlying the W2 of Sections 20 and 29, Township 24 South, Range 36 East, NMPM, Lea County, New Mexico. Said unit will be initially dedicated to the proposed K. Stewart Fed Com 135H well to be horizontally drilled from a surface hole location in the S2SW4 of Section 29, with a first take point located in the SW4SW4 (Unit M) of Section 29 and a last take point in the NW4NW4 (Unit D) Section 20. The completed interval for this well is expected to remain within 330 feet of the quarter-quarter line to allow the inclusion of the offsetting 40-acre tracts in the proposed 640-acre spacing unit. Applicant is a working interest owner in the proposed North Jal Unit. Applicant applies for an order approving an enhanced oil recovery project (secondary and tertiary recovery) in the North Jal Unit Area by the injection of water and gas into the Yates-Seven Rivers-Queen formation in wells located on approximately 7,859.35 acres of the following federal, state, and fee lands located in Lea County, New Mexico. The unitized interval extends from the top of the Yates Formation to a lower limit at the base of the Queen Formation. Among the matters to be considered at hearing, pursuant to the New Mexico Statutory Unitization Act, NMSA 1978, §§ 70-7-1 et seq., will be: the necessity of unit operations; the determination of horizontal and vertical limits of the unit area; the determination of the fair, reasonable, and equitable allocation of production and costs of production, including capital investments, to each of the tracts in the unit area; the determination of credits and charges to be made among the working interest owners in the unit area for their investment in wells and equipment; and such other matters as may be necessary and appropriate.. The unit area is centered approximately 5 miles North of Jal, New Mexico.
9. 24081 Application of Marathon Oil Permian, LLC for Compulsory Pooling, Eddy County, New Mexico. Applicant seeks an order pooling all uncommitted interests in the Willow Lake; Bone Spring Formation underlying a 800-acre, more or less, standard horizontal spacing unit comprised of the SW/4 Section 31, Township 24 South, Range 29 East, and the W/2 Section 6 and W/2 Section 7, located in Township 25 South, Range 29 East, NMPM, Eddy County, New Mexico (“Unit”). 10. 23917 Application of OXY USA Inc. for Approval of an Overlapping 960-Acre Non-Standard Horizontal Well Spacing Unit and Compulsory Pooling, Eddy County, New Mexico. Applicant seeks an order (a) approving an overlapping 960-acre, more or less, non-standard horizontal well spacing unit in the Bone Spring formation underlying Section 35 and the S/2 Section 26, Township 22 South, Range 31 East, NMPM, Eddy County, New Mexico, and (b) pooling all uncommitted mineral owners in this acreage. This spacing unit will be initially dedicated to the following proposed wells:

o    Evil Olive 26 35 Fed Com 4H, to be drilled from a surface location in the NE/4 SE/4 (Unit I) of Section 26 to a bottomhole location in the SE/4 SE/4 (Unit P) of Section 35; and

o    Evil Olive 26 35 Fed Com 71H, to be drilled from a surface location in the NE/4 SW/4 (Unit K) of Section 26 to a bottomhole location in the SW/4 SW/4 (Unit M) of Section 35.

This 960-acre non-standard horizontal well spacing unit will overlap an existing 240-acre standard horizontal well spacing unit comprised of the E/2 SE/4 of Section 26 and the E/2 E/2 of Section 35, Township 22 South, Range 31 East, NMPM, Eddy County, New Mexico, which is operated by COG Operating LLC and dedicated to the Tankless Federal Com #2H well (API: 30-015-44434) within the Livingston Ridge; Bone Spring (Pool Code 39350). Also, to be considered will be the cost of drilling and completing the wells and the allocation of the costs thereof, operating costs and charges for supervision, the designation of applicant as operator, and a 200% charge for risk involved in drilling and completing the wells. Said area is approximately 20 miles northeast of Loving, New Mexico.
11. 23918 Application of OXY USA Inc. for Approval of a 960-Acre Non-Standard Horizontal Well Spacing Unit and Compulsory Pooling, Eddy County, New Mexico. Applicant seeks an order (a) approving an overlapping 960-acre, more or less, non-standard horizontal well spacing unit in the Wolfcamp formation underlying Section 35 and the S/2 Section 26, Township 22 South, Range 31 East, NMPM, Eddy County, New Mexico, and (b) pooling all uncommitted mineral owners in this acreage. This spacing unit will be initially dedicated to the following proposed wells:

o    Evil Olive 26 35 Fed Com 31H and 32H, to be drilled from ac common surface location in the NE/4 SW/4 (Unit K) of Section 26 to bottomhole locations in the SW/4 SW/4 (Unit M) of Section 35;

o    Evil Olive 26 35 Fed Com 33H, 34H, and 35H, to be drilled from a common surface location in the NW/4 SE/4 (Unit J) of Section 26 to bottomhole locations in the SE/4 SW/4 (Unit N) and the SW/4 SE/4 (Unit O) of Section 35; and

Said area is approximately 20 miles northeast of Loving, New Mexico.

12. 23984 Application of Marathon Oil Permian LLC for approval of a non-standard spacing unit and compulsory pooling, Lea County, New Mexico. Applicant seeks an order from the Division approving a non-standard spacing unit and pooling all uncommitted mineral interests within a 960-acre, more or less, Bone Spring horizontal spacing unit underlying the E/2 of Sections 6, 7, Township 20 South, Range 33 East, and the E/2 of Section 31, Township 19 South, Range 33 East, NMPM, Lea County, New Mexico. This spacing unit will be dedicated to the Andretti Fed Com 304H, Andretti Fed Com 504H, Andretti Fed Com 505H, and Andretti Fed Com 506H wells, to be horizontally drilled. The wells will be drilled at orthodox locations. Applicant applies for an order pooling all uncommitted interests in the Bone Spring formation underlying a 320-acre, more or less, standard horizontal spacing unit comprised of the N/2 N/2 of Sections 8 and 9, Township 19 South, Range 28 East, Eddy County, New Mexico (“Unit”). Mewbourne Oil Company seeks an order amending Order No. R-21985 for compulsory pooling to pool all uncommitted mineral interest owners in the Bone Spring formation underlying a 320-acre horizontal spacing unit comprised of the N/2S/2 of Section 11 and the N/2S/2 of Section 12, Township 24 South, Range 28 East, NMPM. The unit will be dedicated to the Journey 11/12 B1LI Fed. Com. Well No. 1H and the Journey 11/12 B2LI Fed. Com. Well No. 1H, with first take points in the NW/4SW/4 of Section 11 and last take points in the NE/4SE/4 of Section 12. Also to be considered will be the cost of drilling, completing, testing, and equipping the wells and the allocation of the cost thereof, as well as actual operating costs and charges for supervision, designation of applicant as operator of the wells, and a 200% charge for the risk involved in drilling, completing, testing, and equipping the wells. The unit is located approximately approximately 1-1/2 miles east-northeast of Malaga, New Mexico.
16. 24109 Application of Franklin Mountain Energy 3, LLC for compulsory pooling and, to the extent necessary, approval of an overlapping spacing unit, Lea County, New Mexico. Applicant seeks an order from the Division pooling all uncommitted mineral interests within a 319.70-acre, more or less, Wolfcamp horizontal spacing unit comprising the W/2 W/2 of Section 33, Township 18 South, Range 35 East, and Lot 4, the SW/4 NW/4 and W/2 SW/4 of Section 4 (W/2 W/2 equivalent), Township 19 South, Range 35 East, N.M.P.M., Lea County, New Mexico. Franklin also seeks, to the extent necessary, approval of an overlapping spacing unit. This spacing unit will be dedicated to the Alpha State Com 701H and Alpha State Com 801H wells, to be horizontally drilled. The producing area for the wells are expected to be orthodox. The proposed horizontal spacing unit will partially overlap the following existing Wolfcamp spacing units:
•    A 80-acre vertical well spacing unit comprised of Unit E in Section 4, dedicated to G and C Operating, LLC’s New Mexico DD State #002 well (API 30-025-27663)
•    A 320-acre horizontal spacing comprised of the SW/SW of Section 4 dedicated to Franklin Mountain’s Cable 19 35 9 State Com #001H well (API 30-025-46140).
Also to be considered will be the cost of drilling and completing said wells, the allocation of these costs as well as the actual operating costs and charges for supervision, designation of Franklin Mountain Energy 3, LLC as operator of the wells, and a 200% charge for risk involved in drilling said wells. Said area is located approximately 16 miles west of Hobbs, New Mexico.
17. 24122 Application of Longfellow Energy, LP for Compulsory Pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order from the Division pooling all uncommitted interests in the Yeso formation (Empire; Glorieta-Yeso [96210]) in a standard 320-acre, more or less, horizontal spacing and proration unit (“HSU”) comprised of the S/2 S/2 of Sections 17 and 18, Township 17 South, Range 29 East, NMPM, in Eddy County, New Mexico. Applicant proposes to drill the following wells: (1) Ozzy Federal Com 1718DX 001H well, to be horizontally drilled from an approximate surface hole location 255’ FSL and 608’ FEL of Section 13, T17S-R28E, to an approximate bottom hole location 880’ FSL and 100’ FEL of Section 17, T17S-R29E; and (2) Ozzy Federal Com 1718DX 002H well, to be horizontally drilled from an approximate surface hole location 235’ FSL and 608’ FEL of Section 13, T17S-R28E, to an approximate bottom hole location 480’ FSL and 100’ FEL of Section 17, T17S-R29E. The completed intervals and first and last take points for all wells will meet the setback requirements set forth in the statewide rules for horizontal oil wells. Also to be considered will be the cost of drilling and completing the wells and the allocation of the costs, the designation of Applicant as Operator of the wells, and a 200% charge for the risk involved in drilling and completing the wells.
