PRELIMINARY DOCKET: Examiner Hearing for May 8, 2025

For hearings by affidavit: presenting parties are required to submit a pre-hearing statement no later than the Thursday before the hearing. The pre-hearing statement shall include: 1) a list of disputed facts and issues; 2) identification of witnesses and their qualifications; and 3) all exhibits and written testimony a party intends to enter into evidence at the hearing and a full narrative for each.

For contested matters: pre-hearing statements shall be filed no later than 9:00 a.m., 4 business days prior to the hearing and in addition to the requirements of 19.15.4.13.B(1) NMAC, shall include: all evidentiary exhibits, documents, affidavits, and full-written testimony of any witness a party offers at the hearing. Exhibits must be sequentially marked on every page.

Failure to timely file a complete pre-hearing statement may cause the Hearing Examiner to continue the hearing and/or impose sanctions up to and including the exclusion of late-filed evidence. Evidentiary objections must be filed no later than 48 hours before the hearing. Rulings on the objections will be addressed as a preliminary matter when the case is called.

2. 24865 Application of MRC Permian Company for Compulsory Pooling, Lea County, New Mexico. Applicant in the above-styled cause seeks an order pooling all uncommitted interests in a standard 640-acre, more or less, horizontal well spacing unit in the Wolfcamp formation comprised of the E2 of Sections 11 and 14, Township 17 South, Range 37 East, NMPM, Lea County, New Mexico. Said unit will be initially dedicated to the proposed Monika 203H well, to be horizontally drilled from a surface location in the SE4 of Section 14, with a first take point in the SE4SE4 (Unit P) of Section 14 and a last take point in the NE4NE4 (Unit A) of Section 11. The location of the proposed well is expected to remain within 330 feet of the offsetting quarter-quarter sections or equivalent tracts to allow inclusion of this acreage in the proposed horizontal well spacing unit. Also, to be considered will be the cost of drilling and completing the well and the allocation of the cost thereof, actual operating costs and charges for supervision, designation of Matador Production Company as operator of the proposed spacing unit, and a 200% charge for risk involved in drilling the proposed well. 3. 25050 Application of Permian Resources Operating, LLC for Compulsory Pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order from the Oil Conservation Division pooling all uncommitted mineral interests in the Bone Spring formation in a 400-acre, more or less, horizontal spacing and proration unit (“HSU”) comprised of the N/2 SW/4 of Section 4 and the N/2 S/2 of Sections 5 and 6, in Eddy County, New Mexico. Applicant proposes to drill the following 2.5-mile wells in the HSU: Dreamcatcher 4 Fed Com 113H well, to be horizontally drilled from an approximate surface hole location within the SW/4 of Section 4, T22S-R26E, to an approximate bottom hole location 1650’ FSL and 100’ FWL of Section 6, T22S-R26E; Dreamcatcher 4 Fed Com 123H well, to be horizontally drilled from an approximate surface hole location within the SW/4 of Section 4, T22S-R26E, to an approximate bottom hole location 2311’ FSL and 100’ FWL of Section 6, T22S-R26E; and Dreamcatcher 4 Fed Com 133H well, to be horizontally drilled from an approximate surface hole location within the SW/4 of Section 4, T22S-R26E, to an approximate bottom hole location 2311’ FSL and 100’ FWL of Section 6, T22S-R26E. 6. 25091 Application of Cimarex Energy Co. for approval of a non-standard spacing unit, compulsory pooling, and, to the extent necessary, approval of an overlapping spacing unit Eddy County, New Mexico. Applicant seeks an order from the Division approving a non-standard spacing unit and pooling all uncommitted interests within a 1280-acre, more or less, Wolfcamp horizontal spacing unit comprised of Sections 28 and 29, Township 23 South, Range 29 East, NMPM, Eddy County, New Mexico, in the Purple Sage Wolfcamp Gas Pool (Code 98220). This spacing unit will be dedicated to the following wells: Laguna Grande Fed Com 29-28 #9H and the Laguna Grande Fed Com 29-28 #10H wells with proposed first take points in the NW/4 NW/4 (Unit D) of Section 29 and proposed bottom hole locations in the NE/4 NE/4 (Unit A) of Section 28; Laguna Grande Fed Com 29-28 #11H and the Laguna Grande Fed Com 29-28 #12H wells with proposed first take points in the SW/4 NW/4 (Unit E) of Section 29 and proposed bottom hole locations in the SE/4 NE/4 (Unit H) of Section 28; Laguna Grande Fed Com 29-28 #13H and the Laguna Grande Fed Com 29-28 #14H wells with proposed first take points in the NW/4 SW/4 (Unit L) of Section 29 and proposed bottom hole locations in the NE/4 SE/4 (Unit I) of Section 28; and Laguna Grande Fed Com 29-28 #15H and the Laguna Grande Fed Com 29-28 #16H wells with proposed first take points in the SW/4 SW/4 (Unit M) of Section 29 and proposed bottom hole locations in the SE/4 SE/4 (Unit P) of Section 28. Also to be considered will be the cost of drilling, completing, and equipping said wells, the allocation of these costs as well as the actual operating costs and charges for supervision while drilling and after completion, designation of Cimarex Energy Co. as operator of the wells, and a 200% charge for risk involved in drilling said wells. Said area is located approximately 5 miles southeast of Loving, New Mexico.
7. 25259 Application of Cimarex Energy Co. for approval of a non-standard spacing unit, compulsory pooling, and, to the extent necessary, approval of an overlapping spacing unit Eddy County, New Mexico. Applicant seeks an order from the Division approving a non-standard spacing unit and pooling all uncommitted interests within a 1280-acre, more or less, Bone Spring horizontal spacing unit comprised of Sections 28 and 29, Township 23 South, Range 29 East, NMPM, Eddy County, New Mexico in the Laguna Salado; Bone Spring Pool (Code 96721) and/or the Laguna Salado; Bone Spring, South Pool (Code 96857). •    A 120-acre spacing unit comprised of the N/2NW/4 and the NW/4NE/4 of Section 28, dedicated to OXY USA, Inc.’s Cypress 28 Federal #3H well (API 30-015-38287);
•    A 120-acre spacing unit comprised of the S/2NW/4 and the SW/4NE/4 of Section 28, dedicated to OXY USA, Inc.’s Cypress 28 Federal #4H well (API 30-015-39330);
•    A 120-acre spacing unit comprised of the N/2SW/4 and the NW/4SE/4 of Section 28, dedicated to OXY USA, Inc.’s Cypress 28 Federal #2H well (API 30-015-37331); and
•    A 120-acre spacing unit comprised of the S/2SW/4 and the SW/4SE/4 of Section 28, dedicated to OXY USA, Inc.’s Cypress 28 Federal #1H well (API 30-015-37249).
Also to be considered will be the cost of drilling, completing, and equipping said wells, the allocation of these costs as well as the actual operating costs and charges for supervision while drilling and after completion, designation of Cimarex Energy Co. as operator of the wells, and a 200% charge for risk involved in drilling said wells. Said area is located approximately 5 miles southeast of Loving, New Mexico.
8. 25182 Application of Coterra Energy Operating Co. (formerly known as Cimarex Energy Co.) for Compulsory Pooling, Eddy County, New Mexico. Applicant seeks an order pooling all uncommitted interest within an interval of the Bone Spring Formation from the top of the Bone Spring formation to the correlative stratigraphic equivalent of 7,680 feet measured depth as shown in the dual laterolog of the Wigeon 23 Federal Com 2 (API# 30-015-33684) underlying a 640.00-acre, more or less, standard horizontal spacing unit comprised of the E/2 of Section 23 and the E/2 of Section 26, located in Township 25 South, Range 26 East, NMPM, Eddy County, New Mexico (“Unit”). The Unit will be dedicated to the following wells: Wigeon 23-26 Fed Com 3H, which is an oil well that will be horizontally drilled from a surface hole location in the E/2 of Section 23, Township 25 South, Range 26 East, to a bottom hole location in the E/2 of Section 26, Township 25 South, Range 26 East. Wigeon 23-26 Fed Com 5H, which is an oil well that will be horizontally drilled from a surface hole location in the E/2 of Section 23, Township 25 South, Range 26 East, to a bottom hole location in the E/2 of Section 26, Township 25 South, Range 26 East. The 3H and 5H Wells are referred to collectively herein as the “Wells.” The completed interval of the Wells will be orthodox. Also, to be considered will be the cost of drilling and completing the Wells and the allocation of the cost, the designation of Applicant as the operator of the Wells, and a 200% charge for the risk involved in drilling and completing the Wells. The Wells are located approximately 24 miles Southwest of Carlsbad, New Mexico.
9. 25255 Application of Flat Creek Resources, LLC for Compulsory Pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order from the Division pooling all uncommitted mineral interests in the Bone Spring formation (WILLOW LAKE; BONE SPRING, WEST [96415]) in a non-standard 640-acre, more or less, horizontal spacing and proration unit (“HSU”) comprised of the N/2 of Sections 22 and 23, Township 24 South, Range 26 East, in Eddy County, New Mexico, or in the alternative, a non-standard 560-acre, more or less, HSU, comprised of the N/2 N/2 of Section 22 and the N/2 NW/4 of Section 23, and the S/2 N/2 of Sections 22 and 23, Township 24 South, Range 26 East, in Eddy County, New Mexico. Applicant proposes to drill the following wells in the HSU: Jurnegan Fed Com BS2 #1H well, to be horizontally drilled from a surface hole location approximately 948’ FNL and 713’ FWL of Section 22, T24S-R26E to a bottom hole location approximately 421’ FNL and 100’ FEL of Section 23, T24S-R26E or, in the alternative, from a surface hole location approximately 948’ FNL and 713’ FWL of Section 22, T24S-R26E to a bottom hole location approximately 421’ FNL and 2,607’ FWL of Section 22, T24S-R26E to a bottom hole location approximately 440’ FNL and 2,540’ FWL of Section 23, T24S-R26E; and Jurnegan Fed Com BS2 #2H well, to be horizontally drilled from a surface hole location approximately 978’ FNL and 713’ FWL of Section 22, T24S-26E to a bottom hole location approximately 1,870’ FNL and 15’ FEL of Section 23, T24S-R26E. The completed intervals and first and last take points will meet statewide setback requirements for horizontal oil wells. Also to be considered will be the cost of drilling and completing the well and the allocation of the costs, the designation of Applicant as Operator of the well, and a 200% charge for the risk involved in drilling and completing the well. The wells and land are approximately 5 miles North East of Whites City, New Mexico.
10. 25256 Application of Flat Creek Resources, LLC for Compulsory Pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order from the Division pooling all uncommitted mineral interests in the Bone Spring formation down to 8,062’ (being 300’ above the top of the Wolfcamp Formation, or 8,362’) (WILLOW LAKE; BONE SPRING, WEST [96415]) in a non-standard 640-acre, more or less, horizontal spacing and proration unit (“HSU”) comprised of the S/2 of Sections 22 and 23, Township 24 South, Range 26 East, in Eddy County, New Mexico. Applicant proposes to drill the following wells in the HSU: Jurnegan Fed Com BS2 #3H well, to be horizontally drilled from a surface hole location approximately 1,106’ FSL and 733’ FWL of Section 22, T24S-R26E to a bottom hole location approximately 1,900’ FSL and 15’ FEL of Section 23, T24S-R26E; and Jurnegan Fed Com BS2 #4H well, to be horizontally drilled from a surface hole location approximately 1,087’ FSL and 757’ FWL of Section 22, T24S-R26E to a bottom hole location approximately 440’ FSL and 15’ FEL of Section 23, T24S-R26E. The completed intervals and first and last take points will meet statewide setback requirements for horizontal oil wells. Also to be considered will be the cost of drilling and completing the well and the allocation of the costs, the designation of Applicant as Operator of the well, and a 200% charge for the risk involved in drilling and completing the well. 11. 25258 Application of Devon Energy Production Company, L.P. for Compulsory Pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order from the Division pooling all uncommitted mineral interests in the Wolfcamp formation, designated as a gas pool, underlying a standard 639.26-acre, more or less, spacing unit comprised of Lots 1, 2, 3, and 4 and the S/2 N/2 of Sections 3 and 4, all in Township 22 South, Range 27 East, NMPM, Eddy County, New Mexico. The proposed wells to be dedicated to the horizontal spacing unit are the War Club 3-4 Fed Com 621H Well, a gas well, to be horizontally drilled from a surface location in Lot 1 (NE/4 NE/4) of Section 3 to a bottom hole location in Lot 4 (NW/4 NW/4) of Section 4; the War Club 3-4 Fed Com 622H Well, a gas well, to be horizontally drilled from a surface location in Lot 1 (NE/4 NE/4) of Section 3 to a bottom hole location in the SW/4 NW/4 (Unit E) of Section 4; the War Club 3-4 Fed Com 821H Well, a gas well, to be horizontally drilled from a surface location in Lot 1 (NE/4 NE/4) of Section 3 to a bottom hole location in the Lot 4 (NW/4 NW/4) of Section 4, and the War Club 3-4 Fed Com 822H Well, a gas well, to be horizontally drilled from a surface location in Lot 1 (NE/4 NE/4) of Section 3 to a bottom hole location in the SW/4 NW/4 (Unit E) of Section 4. The proposed wells are unorthodox in their locations; the take points do not comply with setback requirements in Order No. R-14262 governing the Purple Sage; Wolfcamp pool. Applicant will be applying with the Division for administrative approval of the nonstandard locations. Also to be considered will be the cost of drilling and completing the wells and the allocation of the costs thereof; actual operating costs and charges for supervision; the designation of the Applicant as Operator of the wells and unit; and a 200% charge for the risk involved in drilling and completing the wells. 12. 25307 Application of Devon Energy Production Company, L.P., for Compulsory Pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order from the Division pooling all uncommitted mineral interests in the Wolfcamp formation, designated as a gas pool, underlying a standard 480-acre, more or less, spacing unit comprised of the S/2 of Section 3 and the SW/4 of Section 2, all in Township 22 South, Range 27 East, NMPM, Eddy County, New Mexico. The proposed wells to be dedicated to the horizontal spacing unit are the War Club 2-3 Fed Com 623H Well, a gas well, to be horizontally drilled from a surface location in the NE/4 SW/4 (Unit K) of Section 2 to a bottom hole location in the NW/4 SW/4 (Unit L) of Section 3; the War Club 2-3 Fed Com 624H Well, a gas well, to be horizontally drilled from a surface location surface location in the NE/4 SW/4 (Unit K) of Section 2 to a bottom hole location in the SW/4 SW/4 (Unit M) of Section 3; the War Club 2-3 Fed Com 823H Well, a gas well, to be horizontally drilled from a surface location in the NE/4 SW/4 (Unit K) of Section 2 to a bottom hole location in the NW/4 SW/4 (Unit L) of Section 3; and the War Club 2-3 Fed Com 824H Well, a gas well, to be horizontally drilled from a surface location in the NE/4 SW/4 (Unit K) of Section 2 to a bottom hole location in the SW/4 SW/4 (Unit M) of Section 3. The wells are unorthodox in their locations; the take points do not comply with setback requirements in Order No. R-14262 governing the Purple Sage; Wolfcamp pool. Applicant seeks approval for an overlapping spacing unit with the Chase 2 State #001 Well (API No. 30-015-25698) spacing unit. Applicant will be applying with the Division for administrative approval of the nonstandard locations. Also to be considered will be the cost of drilling and completing the wells and the allocation of the costs thereof; actual operating costs and charges for supervision; the designation of the Applicant as Operator of the wells and unit; and a 200% charge for the risk involved in drilling and completing the wells. The wells and lands are located approximately 3 miles East of Carlsbad, New Mexico.
13. 25271 Application of Spur Energy Partners LLC for Compulsory Pooling, Eddy County, New Mexico. Applicant seeks an order pooling all uncommitted interests in the Yeso formation underlying a 480-acre, more or less, standard horizontal spacing unit comprised of the S/2 of Section 16 and the SW/4 of Section 15, Township 17 South, Range 28 East, Eddy County, New Mexico (“Unit”). Applicant seeks to dedicate the Unit to the following wells (“Wells”): Ghost 16-15 State Com 10H, Ghost 16-15 State Com 20H, and Ghost 16-15 State Com 70H, which will be drilled from surface hole locations in the NE/4 SE/4 (Unit I) of Section 17 to bottom hole locations in the NE/4 SW/4 (Unit K) of Section 15; Ghost 16-15 State Com 21H, which will be drilled from a surface hole location in the SE/4 SE/4 (Unit P) of Section 17 to a bottom hole location in the SE/4 SW/4 (Unit N) of Section 15; and Ghost 16-15 State Com 71H, which will be drilled from a surface hole location in the NE/4 SE/4 (Unit I) of Section 17 to a bottom hole location in the SE/4 SW/4 (Unit N) of Section 15. The completed intervals of the Wells will be orthodox. The completed interval of the Ghost 16-15 State Com 10H well will be located within 330’ of the quarter-quarter section line separating the N/2 S/2 and the S/2 S/2 of Sections 15 and 16 to allow for the creation of a 480-acre, standard horizontal spacing unit. Also to be considered will be the cost of drilling and completing the Wells and the allocation of the costs, the designation of Applicant as the operator of the Wells, and a 200% charge for the risk involved in drilling and completing the Wells. The Ghost 16-15 State Com 10H, 20H, 70H, and 71H wells are located approximately 11.97 miles East and 0.63 miles South of Artesia, New Mexico.
