PRELIMINARY DOCKET: Examiner Hearing for Thursday, October 5, 2023

Applications for hearing shall be filed at least thirty (30) days in advance of the hearing date. A party who intends to present evidence shall file a pre-hearing statement no later than the close of business on the Thursday prior to the hearing date and serve a copy on the other parties, if any. The hearing examiner will dismiss the application if the applicant does not file and serve a pre-hearing statement as specified above. The unitized interval extends from the top of the Yates Formation to the base of the Queen Formation. Among the matters to be considered at hearing, pursuant to the New Mexico Statutory Unitization Act, NMSA 1978, §§ 70-7-1 et seq., will be: the necessity of unit operations; the determination of horizontal and vertical limits of the unit area; the determination of the fair, reasonable, and equitable allocation of production and costs of production, including capital investments, to each of the tracts in the unit area; the determination of credits and charges to be made among the working interest owners in the unit area for their investment in wells and equipment; and such other matters as may be necessary and appropriate. The completed interval and first and last take points will meet the setback requirements set forth in the statewide rules for horizontal oil wells. 125. 23818 Application of Permian Resources Operating, LLC for Compulsory Pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order from the Oil Conservation Division pooling all uncommitted mineral interests in the Wolfcamp formation (GATUNA CANYON; WOLFCAMP [27191]) in a standard 640-acre, more or less, horizontal spacing and proration unit (“HSU”) comprised of the 640-acre, more or less, horizontal spacing and proration unit (“HSU”) comprised of the S/2 of Sections 35 and 36, T19S-R29E, in Eddy County, New Mexico. 129. 23828 Application of Spur Energy Partners LLC to Amend Order No. R-22385 to Update the Initial Wells, Extend the Drilling Deadline, and Pool Additional Parties, Eddy County, New Mexico. Applicant in the above-styled cause seeks to amend Order No. R-22385 (“Order”) to (1) update the initial wells approved under the order, (2) allow for an extension of time for drilling the proposed initial well under the Order, and (3) to pool additional parties under the terms of the Order. Since entry of the Order, Applicant has updated the wells and locations of its proposed initial wells in the Unit to the following:
•    The Aid 14-13 State 10H well and the Aid 14-13 State 20H and Aid 14-13 State 60H well, to be drilled from a common surface location in the NW/4 NE/4 (Unit B) of Section 14, to bottom hole locations in the NE/4 NE/4 (Unit A) of Section 13; and
•    The Aid 14-13 State 21H well and the Aid 14-13 State 61H well, to be drilled from a common surface location in the NW/4 NE/4 (Unit B) of Section 14, to bottom hole locations in the NE/4 NE/4 (Unit H) of Section 13.
Said area is located approximately 13 miles south of Artesia, New Mexico.
130. 23809 Application of Legacy Reserves Operating LP to Amend Order No. R-22394, Lea County, New Mexico. Applicant in the above-styled cause seeks an order amending Order No. R-22394, issued on November 17, 2022, to extend the well commencement deadline one year, to November 17, 2024. Order No. R-22394 pooled all mineral interests in the Bone Spring formation in a 320-acre horizontal spacing unit comprised of the E½E½ of Section 15 and E½E½ of Section 22, Township 19 South, Range 33 East, N.M.P.M, Lea County, New Mexico, and requires the commencement of drilling within one year of the date of the order unless the operator obtains an extension by amendment of the order for good cause shown. The well and lands are located approximately 3 miles southwest of Lovington, New Mexico.
