PRELIMINARY DOCKET: OCD Special Hearing for February 4, 2025

For hearings by affidavit: presenting parties are required to submit a pre-hearing statement no later than the Thursday before the hearing. The pre-hearing statement shall include: 1) a list of disputed facts and issues; 2) identification of witnesses and their qualifications; and 3) all exhibits and written testimony a party intends to enter into evidence at the hearing and a full narrative for each.

For contested matters: pre-hearing statements shall be filed no later than 9:00 a.m., 4 business days prior to the hearing and in addition to the requirements of 19.15.4.13.B(1) NMAC, shall include: all evidentiary exhibits, documents, affidavits, and full-written testimony of any witness a party offers at the hearing. Exhibits must be sequentially marked on every page.

Failure to timely file a complete pre-hearing statement may cause the Hearing Examiner to continue the hearing and/or impose sanctions up to and including the exclusion of late-filed evidence. Evidentiary objections must be filed no later than 48 hours before the hearing. Rulings on the objections will be addressed as a preliminary matter when the case is called.

1. 24826 Application of Alpha Energy Partners, LLC to Pool Additional Interests Under Order No. R-23005, Eddy County, New Mexico. Alpha Energy Partners, LLC (“Applicant”) seeks to pool additional uncommitted interests under the terms of Order No. R-23005. Order No. R-23005 pooled uncommitted interests in the Wolfcamp formation underlying a 634-acre, more or less, standard horizontal spacing unit comprised of the N/2 of Sections 19 and 20, Township 22 South, Range 27 East, Eddy County, New Mexico (“Unit”); dedicated the Unit to The Dude 19/20 Fee 201H and The Dude 19/20 Fee 202H wells; and designated Applicant as operator of the unit and wells (“Wells”). Since the order was entered, Applicant has identified additional uncommitted interests in the Unit that should be pooled under the terms of Order No. R-23005. The Wells are located approximately 1.6 miles southwest of Carlsbad, New Mexico.
2. 24827 Application of Alpha Energy Partners, LLC to Pool Additional Interests Under Order No. R-23006, Eddy County, New Mexico. Alpha Energy Partners, LLC (“Applicant”) seeks to pool additional uncommitted interests under the terms of Order No. R-23006. Order No. R-23006 pooled uncommitted interests in the Wolfcamp formation underlying a 634-acre, more or less, standard horizontal spacing unit comprised of the S/2 of Sections 19 and 20, Township 22 South, Range 27 East, Eddy County, New Mexico (“Unit”); dedicated the Unit to The Dude 19/20 Fee 203H and The Dude 19/20 Fee 204H wells; and designated Applicant as operator of the unit and wells (“Wells”). Since the order was entered, Applicant has identified additional uncommitted interests in the Unit that should be pooled under the terms of Order No. R-23006. The Wells are located approximately 1.6 miles southwest of Carlsbad, New Mexico.
3. 24807 Application of Flat Creek Resources, LLC for Compulsory Pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order from the Division pooling all uncommitted mineral interests in the Bone Spring formation in a standard 280-acre, more or less, horizontal spacing and proration unit (“HSU”), comprised of the N/2 NW/4 of Section 13 and N/2 N/2 of Section 14, Township 19 South, Range 27 East, in Eddy County, New Mexico. Applicant proposes to drill the following well in the HSU: Cardigan State Com 131H well, to be horizontally drilled from a surface hole location approximately 530’ FNL and 1,420’ FWL of Section 13, T19S-R27E to a bottomhole location approximately 455’ FNL and 100’ FWL of Section 14, T19S-R27E. The completed interval and first and last take points will meet statewide setback requirements for horizontal oil wells. Also to be considered will be the cost of drilling and completing the well and the allocation of the costs, the designation of Applicant as Operator of the well, and a 200% charge for the risk involved in drilling and completing the well. The well and land are approximately 14 miles Southwest of Loco Hills, New Mexico.
4. 24808 Application of Flat Creek Resources, LLC for Compulsory Pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order from the Division pooling all uncommitted mineral interests in the Bone Spring formation in a standard 280-acre, more or less, horizontal spacing and proration unit (“HSU”), comprised of the S/2 NW/4 of Section 13, S/2 N/2 of Section 14, and the S/2 NE/4 of Section 15, Township 19 South, Range 27 East, in Eddy County, New Mexico. Applicant proposes to drill the following well in the HSU: Cardigan State Com 132H well, to be horizontally drilled from a surface hole location approximately 2,083’ FSL and 1,766’ FWL of Section 13, T19S-R27E to a bottom hole location approximately 1,730’ FNL and 2,547’ FEL of Section 15, T19S-R27E. The completed interval and first and last take points will meet statewide setback requirements for horizontal oil wells. Also to be considered will be the cost of drilling and completing the well and the allocation of the costs, the designation of Applicant as Operator of the well, and a 200% charge for the risk involved in drilling and completing the well. The well and land are approximately 14 miles Southwest of Loco Hills, New Mexico.
5. 24809 Application of Flat Creek Resources, LLC for Compulsory Pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order from the Division pooling all uncommitted mineral interests in the Bone Spring formation in a standard 280-acre, more or less, horizontal spacing and proration unit (“HSU”), comprised of the N/2 SW/4 of Section 13, the N/2 S/2 of Section 14, and the N/2 SE/4 of Section 15, Township 19 South, Range 27 East, in Eddy County, New Mexico. Applicant proposes to drill the following well in the HSU: Cardigan State Com 132H well, to be horizontally drilled from a surface hole location approximately 2,053’ FSL and 1,766’ FWL of Section 13, T19S-R27E to a bottom hole location approximately 1,883’ FSL and 2,545’ FEL of Section 15, T19S-R27E. The completed interval and first and last take points will meet statewide setback requirements for horizontal oil wells. Also to be considered will be the cost of drilling and completing the well and the allocation of the costs, the designation of Applicant as Operator of the well, and a 200% charge for the risk involved in drilling and completing the well. The well and land are approximately 14 miles Southwest of Loco Hills, New Mexico.

Applicant proposes to drill the following well in the HSU: Cardigan State Com 132H well, to be horizontally drilled from a surface hole location 2,023’ FSL and 1,765’ FWL of Section 13, T19S-R27E to a bottom hole location approximately 383’ FSL and 2,543’ FEL of Section 15, T19S-R27E. The completed interval and first and last take points will meet statewide setback requirements for horizontal oil wells. Also to be considered will be the cost of drilling and completing the well and the allocation of the costs, the designation of Applicant as Operator of the well, and a 200% charge for the risk involved in drilling and completing the well. The well and land are approximately 14 miles Southwest of Loco Hills, New Mexico.
