PRELIMINARY DOCKET: Examiner Hearing for June 5, 2025

For hearings by affidavit: presenting parties are required to submit a pre-hearing statement no later than the Thursday before the hearing. The pre-hearing statement shall include: 1) a list of disputed facts and issues; 2) identification of witnesses and their qualifications; and 3) all exhibits and written testimony a party intends to enter into evidence at the hearing and a full narrative for each.

For contested matters: pre-hearing statements shall be filed no later than 9:00 a.m., 4 business days prior to the hearing and in addition to the requirements of 19.15.4.13.B(1) NMAC, shall include: all evidentiary exhibits, documents, affidavits, and full-written testimony of any witness a party offers at the hearing. Exhibits must be sequentially marked on every page.

Failure to timely file a complete pre-hearing statement may cause the Hearing Examiner to continue the hearing and/or impose sanctions up to and including the exclusion of late-filed evidence. Evidentiary objections must be filed no later than 48 hours before the hearing. Rulings on the objections will be addressed as a preliminary matter when the case is called.

Applicant seeks an order pooling all uncommitted interests in the Bone Spring formation underlying a 1,920-acre, more or less, non-standard horizontal spacing unit comprised of all of Sections 27, 28 and 29, Township 23 South, Range 30 East, Eddy County, New Mexico (“Unit”). The Unit will be dedicated to the following wells (“Wells”): Iron Throne Federal Com #501H, which will be drilled from a surface hole location in the SW/4 NW/4 (Unit E) of Section 26 to a bottom hole location in the NW/4 NW/4 (Unit D) of Section 29; Iron Throne Federal Com #502H and Iron Throne Federal Com #503H, which will be drilled from surface hole locations in the SW/4 NW/4 (Unit E) of Section 26 to bottom hole locations in the SW/4 NW/4 (Unit E) of Section 29; Iron Throne Federal Com #504H, which will be drilled from a surface hole location in the NW/4 SW/4 (Unit L) of Section 26 to a bottom hole location in the NW/4 SW/4 (Unit L) of Section 29; and Iron Throne Federal Com #505H, which will be drilled from a surface hole location in the NW/4 SW/4 (Unit L) of Section 26 to a bottom hole location in the SW/4 SW/4 (Unit M) of Section 29. The completed intervals of the Wells will be orthodox. Also to be considered will be the cost of drilling and completing the Wells, the allocation of the costs, the designation of Applicant as operator of the Wells and the Unit, a 200% charge for the risk involved in drilling and completing the Wells, and approval of the non-standard spacing unit. The Wells are located approximately 10 miles northeast of Malaga, New Mexico.
2. 25315 AMENDED Application of Tap Rock Operating, LLC for Approving a Standard Horizontal Spacing Unit and Compulsory Pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order from the Division: (1) approving a 1,280-acre, more or less, standard horizontal spacing and proration unit composed of the W/2 of Sections 17 and 20, Township 26 South, Range 26 East, N.M.P.M., and the E/2 of Sections 18 and 19, Township 26 South, Range 26 East, N.M.P.M., and (2) pooling all uncommitted mineral interests in the Purple Sage-Wolfcamp Pool, designated as a gas pool, underlying said unit. The proposed wells to be dedicated to the horizontal spacing unit are the: Coors Fed Com 211H (API No. Pending), which is a gas well that will be horizontally drilled from a surface location in the SE/4 SW/4 (Unit N) of Section 20, Township 26 South, Range 26 East, to a bottom hole location in the Purple Sage-Wolfcamp Gas Pool in the NW/4 NW/4 (Unit D) of Section 17, Township 26 South, Range 26 East; the Coors Fed Com 212H (API No. Pending), which is a gas well that will be horizontally drilled from a surface location in the SE/4 SW/4 (Unit N) of Section 20, Township 26 South, Range 26 East, to a bottom hole location in the Purple Sage-Wolfcamp Gas Pool in the NE/4 NW/4 (Unit C) of Section 17, Township 26 South, Range 26 East; the Coors Fed Com 213H (API No. Pending), which is a gas well that will be horizontally drilled from a surface location in the SW/4 SW/4 (Unit M) of Section 20, Township 26 South, Range 26 East, to a bottom hole location in the Purple Sage-Wolfcamp Gas Pool in the NW/4 NE/4 (Unit B) of Section 18, Township 26 South, Range 26 East, and; the Coors Fed Com 214H (API No. Pending), which is a gas well that will be horizontally drilled from a surface location in the SW/4 SW/4 (Unit M) of Section 20, Township 26 South, Range 26 East, to a bottom hole location in the Purple Sage-Wolfcamp Gas Pool in the NE/4 NE/4 (Unit A) of Section 18, Township 26 South, Range 26 East. The wells are orthodox in location, and the take points and laterals comply with Statewide Rules for setbacks. The wells and lands are located approximately 11.16 miles southeast of Whites City, New Mexico.
3. 25325 Application of Permian Resources Operating, LLC for Compulsory Pooling, Lea County, New Mexico. Applicant applies for an order pooling all uncommitted interests in the Third Bone Spring interval of the Bone Spring formation underlying a 480-acre, more or less, standard horizontal spacing unit comprised of the S/2 N/2 of Section 15 and the N/2 of Section 16, Township 20 South, Range 28 East, Eddy County, New Mexico (“Unit”). The Unit will be dedicated to the Fosters 16-15 Fed Com 132H J-Turn well (“Well”), which will be drilled from a surface hole location in the SE/4 NE/4 (Unit H) of Section 15 to a bottom hole location in the NE/4 NE/4 (Unit A) of Section 16. The completed interval of the Well will be orthodox. A depth severance exists in the Bone Spring formation within the Unit. Accordingly, Applicant seeks to pool uncommitted interests from the base of the Second Bone Spring interval, at a stratigraphic equivalent of approximately 7,493’ TVD, to the base of the Third Bone Spring interval, at a stratigraphic equivalent of approximately 8,752’ TVD, as observed on the State CV #1 well log (API No. 30-015-21927). Also to be considered will be the cost of drilling and completing the Well and the allocation of the costs, the designation of Applicant as operator of the Well, and a 200% charge for risk involved in drilling and completing the well. The Well is located approximately 10 miles northeast of Carlsbad, New Mexico.
4. 25329 Application of EOG Resources, Inc. for Compulsory Pooling, Lea County, New Mexico. Applicant seeks an order pooling a standard 799.73-acre, more or less, horizontal spacing well unit in the Delaware Mountain Group formation comprised of the W/2 of Sections 1, 12, and the NW/4 of Section 13, all in Township 25 South, Range 33 East, NMPM, Lea County, New Mexico. This spacing unit will be initially dedicated to the
•    Lacey Swiss 1 Fed Com 1H Well, to be horizontally drilled from a surface location in NE/4 NE/4 (Lot 1) of Section 2, with a first take point in the NW/4 NW/4 (Lot 4) of Section 1 and a last take point in the SW/4 NW/4 (Unit E) of Section 13; and
•    Lacey Swiss 1 Fed Com 2H Well, to be horizontally drilled from a surface location in NW/4 NE/4 (Lot 2) of Section 1, with a first take point in the NE/4 NW/4 (Lot 3) of Section 1 and a last take point in the SE/4 NW/4 (Unit F) of Section 4.
EOG understands this acreage is dedicated to a Wildcat Pool (WC-025 G-05 S253301L4; DELAWARE [Pool Code 98396]). Also, to be considered will be the cost of drilling and completing the wells and the allocation of the costs thereof, operating costs and charges for supervision, the designation of applicant as operator, and a 200% charge for risk involved in drilling and completing the wells. Said area is approximately 20 miles west of Jal, New Mexico.
5. 25330 Application of EOG Resources, Inc. for Compulsory Pooling, Lea County, New Mexico. Applicant seeks an order pooling a standard 799.73-acre, more or less, horizontal well spacing unit in the Upper Bone Spring formation (Red Hills; Upper Bone Spring Shale, Pool Code 97900) comprised of the W/2 of Sections 1, 12, and the NW/4 of Section 13, all in Township 25 South, Range 33 East, NMPM, Lea County, New Mexico. This spacing unit will be initially dedicated to the
•    Lacey Swiss 1 Fed Com 111H Well, to be horizontally drilled from a surface location in NE/4 NE/4 (Lot 1) of Section 2, with a first take point in the NW/4 NW/4 (Lot 4) of Section 1 and a last take point in the SW/4 NW/4 (Unit E) of Section 13;
•    Lacey Swiss 1 Fed Com 112H Well, to be horizontally drilled from a surface location in NW/4 NE/4 (Lot 2) of Section 1, with a first take point in the NE/4 NW/4 (Lot 3) of Section 1 and a last take point in the SE/4 NW/4 (Unit F) of Section 4; and
•    Lacey Swiss 1 Fed Com 113H Well, to be horizontally drilled from a surface location in NW/4 NE/4 (Lot 2) of Section 2, with a first take point in the NE/4 NW/4 (Lot 3) of Section 1 and a last take point in the SE/4 NW/4 (Unit F) of Section 13.

6. 25331 Application of EOG Resources, Inc. for Compulsory Pooling, Lea County, New Mexico. Applicant seeks an order pooling all uncommitted mineral owners in a standard 640-acre, more or less, horizontal spacing well unit in the Lower Bone Spring formation (Red Hills; Lower Bone Spring Shale Pool [Pool Code 51020]) comprised of the W/2 of Sections 13 and 24, Township 25 South, Range 33 East, NMPM, Lea County, New Mexico. 7. 25333 Application of Marathon Oil Permian, LLC to Amend Order No. R-23223 to Extend the Drilling Deadline and Add Additional Pooled Parties, Eddy County, New Mexico. Applicant in the above-styled cause seeks a year extension of time for drilling the wells under Order No. R-23223 and to add additional mineral interest owners to the pooling order. Order No. R-23223 in Case No. 24150 pooled uncommitted mineral interest owners in the Bone Spring formation (Cass Draw; Bone Spring [10380]) underlying the S/2 of Sections 28 and 29, Township 22 South, Range 27 East, NMPM, Eddy County, New Mexico. This standard 640-acre horizontal well spacing unit is currently dedicated to the proposed initial Magellan BS Fee #501H (API No. 30-015-PENDING), to be horizontally drilled from a surface location in the NW/4 SW/4 (Unit L) of Section 29, T22S-R27E, to a bottom hole location in the NE/4 SE/4 (Unit I) of Section 28, T22S-R27E, and Magellan BS Fee #502H (API No. 30-015-PENDING), to be horizontally drilled from a surface location in the NW/4 SW/4 (Unit L) of Section 29, T22S-R27E, to a bottom hole location in the SE/4 SE/4 (Unit P) of Section 28, T22S-R27E. Said area is located 3.5 miles southeast of Carlsbad, New Mexico.
8. 25334 Application of Marathon Oil Permian, LLC to Amend Order No. R-23224 to Extend the Drilling Deadline and Add Additional Pooled Parties, Eddy County, New Mexico. Applicant in the above-styled cause seeks a year extension of time for drilling the wells under Order No. R-23224 and to add additional mineral interest owners to the pooling order. Order No. R-23224 in Case No. 24151 pooled uncommitted mineral interest owners in the Wolfcamp formation (Purple Sage; Wolfcamp [98220]) underlying the S/2 of Sections 28 and 29, Township 22 South, Range 27 East, NMPM, Eddy County, New Mexico. This standard 640-acre horizontal well spacing unit is currently dedicated to the proposed initial Magellan WC Fee #701H (API No. 30-015-PENDING), to be horizontally drilled from a surface location in the NW/4 SW/4 (Unit L) of Section 29, T22S-R27E, to a bottom hole location in the NE/4 SE/4 (Unit I) of Section 28, T22S-R27E; Magellan WC Fee #702H (API No. 30-015-PENDING), to be horizontally drilled from a surface location in NW/4 SW/4 (Unit L) of Section 29, T22S-R27E, to a bottom hole location in SE/4 SE/4 (Unit P) of Section 28, T22S-R27E; Magellan WC Fee #801H (API No. 30-015-PENDING), to be horizontally drilled from a surface location in NW/4 SW/4 (Unit L) of Section 29, T22S-R27E, to a bottom hole location in NE/4 SE/4 (Unit I) of Section 28, T22S-R27E; and Magellan WC Fee #802H (API No. 30-015-PENDING), to be horizontally drilled from a surface location in NW/4 SW/4 (Unit L) of Section 29, T22S-R27E, to a bottom hole location in SE/4 SE/4 (Unit P) of Section 28, T22S-R27E. Said area is located approximately 3.5 miles southeast of Carlsbad, New Mexico.
9. 25338 Application of Civitas Permian Operating, LLC for Compulsory Pooling, Lea County, New Mexico. Applicant seeks an order from the Division pooling all uncommitted interests from the top of the Bone Spring formation to the base of the Second Bone Spring interval underlying a standard 480-acre, more or less, horizontal spacing unit comprised of the SE/4 of Section 3 and the E/2 of Section 10, Township 25 South, Range 35 East, Lea County, New Mexico. The proposed horizontal spacing unit will be dedicated to First Tee Fed Com 113H and Tee Fed Com 122H to be horizontally drilled with first take points in the NE/4SE/4 (Unit I) of Section 3 and last take points in the SE/4SE/4 (Unit P) of Section 10; and First Tee Fed Com 111H, First Tee Fed Com 112H and First Tee Fed Com 121H be horizontally drilled with first take points in the NW/4SE/4 (Unit J) of Section 3 and last take points in the SW/4SE/4 (Unit O) of Section 10. The producing area for the wells is expected to be orthodox. The completed intervals for First Tee Fed Com 122H is expected to be less than 330 feet from the adjoining tracts thereby allowing for the inclusion of the proximity tracts within the Unit. Civitas seeks to pool all uncommitted interests from the top of the Bone Spring formation to the base of the Second Bone Spring interval (being the stratigraphic equivalent of 11,164’ TVD as referenced from the Oxy Banana Girl Federal 2 well [API # 30-025-35322]). Also to be considered will be the cost of drilling and completing said wells, the allocation of these costs and the actual operating costs and charges for supervision, designation of Civitas as operator of the wells, and a 200% charge for risk involved in drilling said wells. Said area is located approximately 9 miles west of Jal, New Mexico.
10. 25349 Application of COG Operating LLC for Compulsory Pooling, Lea County, New Mexico. Applicant in the above-styled cause seeks an order pooling all uncommitted interest owners in a portion of the Bone Spring formation, from the top of the Third Bone Spring to the base of the Bone Spring formation, underlying a standard 480-acre, more or less, horizontal well spacing unit comprised of the SE/4 of Section 3 and the E/2 of Section 10, Township 25 South, Range 35 East, NMPM, Lea County, New Mexico. Applicant seeks to initially dedicate the above-referenced horizontal spacing unit to the Montera Federal Com #603H well, to be horizontally drilled from a surface location in the N/2 NE/4 of Section 15, with a first take point in the S/2 SE/4 of Section 10 and last take point in the N/2 SE/4 of Section 3. The completed interval of the well is expected to remain within 330 feet of the adjoining quarter-quarter section (or equivalent) tracts to allow inclusion of these proximity tracts within the proposed horizontal spacing unit under 19.15.16.15.B(1)(b) NMAC. Said area is located approximately 9 miles northwest of Jal, New Mexico.
11. 25350 Application of COG Operating LLC for Compulsory Pooling, Lea County, New Mexico. Applicant in the above-styled cause seeks an order pooling all uncommitted interest owners in the Wolfcamp formation underlying a standard 240-acre, more or less, horizontal well spacing unit comprised of the W/2 SE/2 of Section 3 and the W/2 E/2 of Section 10, Township 25 South, Range 35 East, NMPM, Lea County, New Mexico. Applicant seeks to initially dedicate the above-referenced horizontal spacing unit to the Montera Federal Com #701H well, to be horizontally drilled from a surface location in the N/2 NE/4 of Section 15, with a first take point in the SW/4 SE/4 (Unit O) of Section 10 and last take point in the NW/4 SE/4 (Unit J) of Section 3. 12. 25351 Application of COG Operating LLC for Compulsory Pooling, Lea County, New Mexico. Applicant in the above-styled cause seeks an order pooling all uncommitted interest owners in the Wolfcamp formation underlying a standard 240-acre, more or less, horizontal well spacing unit comprised of the E/2 SE/2 of Section 3 and the E/2 E/2 of Section 10, Township 25 South, Range 35 East, NMPM, Lea County, New Mexico. Applicant seeks to initially dedicate the above-referenced horizontal spacing unit to the Montera Federal Com #702H well, to be horizontally drilled from a surface location in the N/2 NE/4 of Section 15, with a first take point in the SE/4 SE/4 (Unit O) of Section 10 and last take point in the NE/4 SE/4 (Unit I) of Section 3. 13. 25352 Application of Chevron U.S.A., Inc. to Amend Order No. R-20250, Eddy County, New Mexico. Chevron seeks to amend Order No. R-20250 to dismiss from the order approval to surface commingle oil and gas production from the Bone Spring and Wolfcamp formations within its Javelina Unit (“Unit”). The Unit is comprised of approximately 5,119.76 acres of the following Federal and State acreage situated in Eddy County, New Mexico:

14. 25358 Application of Riley Permian Operating, LLC for Approving a Standard Horizontal Spacing Unit and Compulsory Pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order from the Division: (1) approving a 481.47-acre, more or less, standard horizontal spacing and proration unit composed of the N/2 of Section 12, Township 18 South, Range 26 East, N.M.P.M., and the NW/4 of Section 7, Township 18 South, Range 27 South, N.M.P.M.; and (2) pooling all uncommitted mineral interests in the Yeso Pool, designated as an oil pool, underlying said unit. The proposed wells to be dedicated to the horizontal spacing unit are the: Marty Fee 11-7 1H (API No. Pending), which is an oil well that will be horizontally drilled from a surface location in the NE/4 NE/4 (Unit A) of Section 11, Township 18 South, Range 26 East, to a bottom hole location in the Yeso Pool in the NE/4 NW/4 (Unit C) of Section 7, Township 18 South, Range 27 East; the Marty Fee 11-7 2H (API No. Pending), which is an oil well that will be horizontally drilled from a surface location in the NE/4 NE/4 (Unit A) of Section 11, Township 18 South, Range 26 East, to a bottom hole location in the Yeso Pool in the NE/4 NW/4 (Unit C) of Section 7, Township 18 South, Range 27 East; the Marty Fee 11-7 3H (API No. Pending), which is an oil well that will be horizontally drilled from a surface location in the SE/4 NE/4 (Unit H) of Section 11, Township 18 South, Range 26 East, to a bottom hole location in the Yeso Pool in the SE/4 NW/4 (Unit F) of Section 7, Township 18 South, Range 27 East, and; the Marty Fee 11-7 4H (API No. Pending), which is an oil well that will be horizontally drilled from a surface location in the SE/4 NE/4 (Unit H) of Section 11, Township 18 South, Range 26 East, to a bottom hole location in the Yeso Pool in the SE/4 NW/4 (Unit F) of Section 7, Township 18 South, Range 27 East. The wells are orthodox in location, and the take points and laterals comply with Statewide Rules for setbacks. The wells and lands are located approximately 3.41 miles southeast of Atoka, New Mexico.
15. 25365 Application of Mewbourne Oil Company for Compulsory Pooling, Lea County, New Mexico. Applicant in the above-styled cause seeks an order pooling all uncommitted interest owners in a standard 640-acre, more or less, well spacing unit in the Bone Spring formation underlying the E/2 of Sections 15 and 22, Township 18 South, Range 35 East, NMPM, Lea County, New Mexico. Mewbourne seeks to dedicate the above-referenced spacing unit to the proposed Seafood Tower 22/15 State Com #527H well to be drilled from a surface hole location in the SW/4 SW/4 (Unit M) of Section 23 to a bottom hole location in the NE/4 NE/4 (Unit A) of Section 15. Also to be considered will be the cost of drilling and completing the well, the allocation of the cost thereof, as well as actual operating costs and charges for supervision, designation of Applicant as operator, and a 200% charge for risk involved in drilling and completing the well. Said area is located approximately 16 miles west of Hobbs, New Mexico.

16. 25372 Application of Colgate Production, LLC to Extend Time to Commence Drilling Operations, Eddy County, New Mexico. Colgate Production, LLC (“Applicant”) seeks an order extending the deadline to commence drilling the wells authorized by Order No. R-23220 (“Order”) until May 22, 2026. The Division issued the Order in Case No. 24166 on May 22, 2024. The Order: pooled all uncommitted interests in the Bone Spring formation underlying a 243.28-acre, more or less, standard, horizontal spacing unit comprised of the N/2 S/2 of Section 7, Township 19 South, Range 28 East, and the N/2 SE/4 of Section 12, Township 19 South, Range 27 East, Eddy County, New Mexico (“Unit”), dedicated the Unit to the Alpine 7-12 State 123H and Alpine 7-12 State 133H wells (“Wells”), and designated Permian Resources Operating, LLC (OGRID No. 372165) as operator of the Unit and the Wells. The Order requires Applicant to commence drilling the Wells within one year of the date of the Order. Applicant requests that the Division extend the deadline to commence drilling the Wells until May 22, 2026. The Wells are located approximately 18 miles northeast of Carlsbad, New Mexico.


17. 25373 Application of Colgate Production, LLC to Extend Time to Commence Drilling Operations, Eddy County, New Mexico. Colgate Production, LLC (“Applicant”) seeks an order extending the deadline to commence drilling the wells authorized by Order No. R-23219 (“Order”) until May 22, 2026. The Division issued the Order in Case No. 24165 on May 22, 2024. The proposed wells to be dedicated to the horizontal spacing unit are the Clawhammer 33-28-21 Fed Com 322H Well, an oil well, to be horizontally drilled from a surface location in Lot 3 of Section 33 to a bottom hole location in the NW/4 SW/4 (Unit L) of Section 21; the Clawhammer 33-28-21 Fed Com 323H Well, an oil well, to be horizontally drilled from a surface location in Lot 3 of Section 33 to a bottom hole location in the NE/4 SW/4 (Unit K) of Section 21; the Clawhammer 33-28-21 Fed Com 330H Well, an oil well, to be horizontally drilled from a surface location in Lot 2 of Section 33 to a bottom hole location in the NE/4 SW/4 (Unit K) of Section 21; the Clawhammer 33-28-21 Fed Com 333H Well, an oil well, to be horizontally drilled from a surface location in Lot 3 of Section 33 to a bottom hole location in the NW/4 SW/4 (Unit L) of Section 21; and the Clawhammer 33-28-21 Fed Com 334H Well, an oil well, to be horizontally drilled from a surface location in Lot 2 of Section 33 to a bottom hole location in the NW/4 SW/4 (Unit L) of Section 21. The Clawhammer 33-28-21 Fed Com 334H Well is a proximity well and proximity tracts will be utilized. All the proposed wells have orthodox locations and meet setback requirements under statewide rules. Also to be considered will be the cost of drilling and completing the wells and the allocation of the costs thereof; actual operating costs and charges for supervision; the designation of the Applicant as Operator of the wells and unit; and a 200% charge for the risk involved in drilling and completing the wells. The wells and lands are located adjacent to the southern state line and approximately 17 miles southeast of Malaga, New Mexico.
52. 25408 Application of Coterra Energy Operating Co. for approval of a non-standard spacing unit and compulsory pooling, Eddy County, New Mexico. Applicant seeks an order from the Division approving a non-standard spacing unit and pooling all uncommitted interests within a 1280-acre, more or less, Wolfcamp horizontal spacing unit comprised of Sections 34 and 35, Township 25 South, Range 25 East, NMPM, Eddy County, New Mexico. This spacing unit will be dedicated to the following wells: Scarlet 35-34 Federal Com 1H well with a proposed first take point in the NE/4 NE/4 (Unit A) of Section 35 and proposed last take point in the NW/4 NW/4 (Unit D) of Section 34; Scarlet 35-34 Federal Com 3H well with a proposed first take point in the SE/4 NE/4 (Unit H) of Section 35 and proposed last take point in the SW/4 NW/4 (Unit E) of Section 34; Scarlet 35-34 Federal Com 5H well with a proposed first take point in the NE/4 SE/4 (Unit I) of Section 35 and proposed last take point in the NW/4 SW/4 (Unit L) of Section 34; and Scarlet 35-34 Federal Com 7H well with a proposed first take point in the SE/4 SE/4 (Unit P) of Section 35 and proposed last take point in the SW/4 SW/4 (Unit M) of Section 34. The wells will be located within the Purple Sage Wolfcamp Gas Pool (Code 98220), which is subject to special pool rules that establish 330-foot setback requirements. Coterra will administratively apply for non-standard location approvals for the wells’ first and last take points. Also to be considered will be the cost of drilling, completing, and equipping said wells, the allocation of these costs as well as the actual operating costs and charges for supervision while drilling and after completion, designation of Cimarex Energy Co. as operator of the wells, and a 200% charge for risk involved in drilling said wells. Said area is located approximately 5.7 miles from Whites City, New Mexico.
53. 25409 Application of MRC Permian Company for Approval of a 983.65-acre Non-Standard Horizontal Well Spacing Unit Compulsory Pooling, Lea County, New Mexico. Applicant in the above-styled cause seeks an order (1) approving a 983.65-acre, more or less, non-standard horizontal well spacing unit in the Pennsylvanian formation underlying the W/2 of Sections 26 and 35, Township 15 South, Range 36 East, and Lots 3-6 and 11-14 (NW/4 equivalent) of Section 5, Township 16 South, Range 37 East, NMPM, Lea County, New Mexico; and (2) pooling all uncommitted mineral owners in this acreage. Said non-standard unit will be initially dedicated to the proposed Steve Ruschell State Com #241H well, with a surface location in the SW/4 SW/4 (Unit M) of Section 23, T15S-R36E, a first take point in the NW/4 NW/4 (Unit D) of Section 26, T15S-R36E, and a last take point in Lot 13 of Section 5, T16S-R37E, as well as the Steve Ruschell State Com #242H well, with a surface location in the SW/4 SW/4 (Unit M) of Section 23, T15S-R36E a first take point in the NE/4 NW/4 (Unit C) of Section 26, T15S-R36E, and a last take point in Lot 14 of Section 5, T16S-R37E. The subject area is located approximately 4.5 miles northeast of Lovington, New Mexico.
