PRELIMINARY DOCKET: Examiner Hearing for Thursday, April 6, 2023

For hearings by affidavit: presenting parties are required to submit a pre-hearing statement no later than the Thursday before the hearing. The pre-hearing statement shall include: 1) a list of disputed facts and issues; 2) identification of witnesses and their qualifications; and 3) all exhibits and written testimony a party intends to enter into evidence at the hearing and a full narrative for each.

For contested matters: pre-hearing statements shall be filed no later than 9:00 a.m., 4 business days prior to the hearing and in addition to the requirements of 19.15.4.13.B(1) NMAC, shall include: all evidentiary exhibits, documents, affidavits, and full-written testimony of any witness a party offers at the hearing. Exhibits must be sequentially marked on every page.

Failure to timely file a complete pre-hearing statement may cause the Hearing Examiner to continue the hearing and/or impose sanctions up to and including the exclusion of late-filed evidence. Evidentiary objections must be filed no later than 48 hours before the hearing. Rulings on the objections will be addressed as a preliminary matter when the case is called.

1. 23393 Application of Armstrong Energy Corporation for Special Pool Rules and Regulations for the Reeves; Devonian Pool, Lea County, New Mexico. Armstrong Energy Corporation (“Applicant”) seeks an order instituting special rules and regulations for the Reeves; Devonian Pool (Code 51940) (the “Pool”). Applicant is the operator of the Rocky Raccoon #1 (API No. 30-025-49594), located in a vertical well unit comprised of the NW/4 SE/4 of Section 24, Township 18 South, Range 35 East, Lea County, New Mexico (“Well”). The initial well completed in the Pool had a top perforation of 12,120 feet subsurface. Therefore, the Pool has a depth bracket allowable of 410 barrels of oil per day for a standard 40-acre oil spacing and proration unit. See Rule 19.15.20.12(A) NMAC. The Well was completed on July 14, 2022. The Well is capable of producing above the Pool’s oil allowable. Applicant requests that special rules and regulations for the Pool be established for the Pool, providing for: (a) A special depth bracket allowable of 800 barrels of oil per day for a standard 40- acre oil well unit; (b) All other rules to be in conformance with statewide rules; and (c) The special rules and regulations for the Pool be made effective retroactive to the date of first production from the Well. The Well is located approximately 16.4 miles west of Hobbs, New Mexico.
2. 23379 Application of Cimarex Energy Co. to Amend Order No. R-22198 for a One-Year Extension of the Well Commencement Deadline, Eddy County, New Mexico. Applicant in the above-styled cause seeks to re-open Case No. 22751 and amend Division Order No. R-22198 in order to obtain, based on good cause shown, a one-year extension of the well commencement deadline, such that the drilling deadline would be extended to July 25, 2024. Order No. R-22198 pooled uncommitted interest owners and granted Applicant operating rights for four wells: the Riverbend 11-14 Federal Com 7H, 15H, 16H, and 17H Wells, proposed to be drilled into the Wolfcamp formation and dedicated to the unit underlying the W/2 of Sections 11 and 14, Township 25 South, Range 28 East, NMPM, Eddy County, New Mexico. The wells and lands are located approximately 9 miles south of Loving, NM.
3. 23318 Application of COG Operating LLC for Compulsory Pooling, Lea County, New Mexico. Applicant in the above-styled cause seeks an order pooling all uncommitted interest owners in the Bone Spring formation underlying a standard 639.23-acre, more or less, horizontal spacing unit comprised of Lots 1 & 2, S2NE, SE (E2 equivalent) of irregular Section 2 and E2 of Section 11, Township 23 South, Range 32 East, NMPM, Lea County, New Mexico. Said unit will be initially dedicated to the following proposed wells:
•    Redtail Federal Com 501H and Redtail Federal Com 502H to be horizontally drilled from a surface location in the NE4NE4 (Lot 1) of Section 2 to bottomhole locations in the SE4SE4 (Unit P) of Section 11.
•    Redtail Federal Com 503H to be horizontally drilled from a surface location in the NE4NE4 (Lot 1) of Section 2 to a bottomhole location in the SW4SE4 (Unit O) of Section 11.
•    Redtail Federal Com 602H and Redtail Federal Com 604H to be horizontally drilled from a surface location in the NW4NE4 (Lot 2) of Section 2 to bottomhole locations, respectfully, in the SE4SE4 (Unit P) of Section 11 and SW4SE4 (Unit O) of Section 11.
The completed interval of the proposed Redtail Federal Com 502H well is expected to remain within 330 feet of the offsetting quarter-quarter sections or equivalent tracts to include them within this proposed spacing unit. Also, to be considered will be the cost of drilling and completing the wells, the allocation of the cost thereof, the actual operating costs and charges for supervision, the designation of applicant as operator, and the imposition of 200% charge for risk involved in drilling and completing each well. 4. 23319 Application of COG Operating LLC for Compulsory Pooling and Approval of Overlapping Spacing Unit, Lea County, New Mexico. Applicant in the above-styled cause seeks (a) an order pooling all uncommitted interest owners in the Bone Spring formation underlying a standard 639.29-acre, more or less, horizontal spacing unit comprised of Lots 3 & 4, S2NW, SW (W2 equivalent) of irregular Section 2 and W2 of Section 11, Township 23 South, Range 32 East, NMPM, Lea County, New Mexico, and (b) approving, as necessary, this overlapping spacing unit. Said unit will be initially dedicated to following proposed wells:
•    Redtail Federal Com 504H and Redtail Federal Com 505H wells, to be horizontally drilled from a surface location in the NW4NW4 (Lot 4) of Section 2 to bottomhole locations, respectively, in the SE4SW4 (Unit N) and the SW4SW4 (Unit M) of Section 11.
•    Redtail State Com 506H well, to be horizontally drilled from a surface location in the NW4NW4 (Lot 4) of Section 2 to a bottomhole location in the SW4SW4 (Unit M) of Section 2.
•    Redtail Federal Com 606H and Redtail Federal Com 608H wells, to be horizontally drilled from a surface location in the NE4NW4 (Lot 3) of Section 2 to bottomhole locations, respectively, in the SE4SW4 (Unit N) and the SW4SW4 (Unit M) of Section 11.
The completed interval of the proposed Redtail Federal Com 505H well is expected to remain within 330 feet of the offsetting quarter-quarter sections or equivalent tracts to include them within this proposed spacing unit. This proposed horizontal well spacing unit will overlap the following existing spacing units in the W2 of Section 11:
•    A 160-acre spacing unit comprised of the W2W2 of Section 11 that is currently dedicated to the Urraca 11 SB Federal Com 4H (30-025-41968) currently producing from the Bone Spring formation.
•    A 160-acre spacing unit comprised of the E2W2 of Section 11 that is currently dedicated to the Urraca 23 32 11 Federal Com 24H (30-025-42226) currently producing from the Bone Spring formation.
Also, to be considered will be the cost of drilling and completing the wells, the allocation of the cost thereof, the actual operating costs and charges for supervision, the designation of applicant as operator, and the imposition of 200% charge for risk involved in drilling and completing each well. Said area is located approximately 25 miles east of Malaga, New Mexico.

9. 22971 Application of FAE II Operating, LLC for Approval of an Enhanced Oil Recovery Project and to Qualify the Project for the Recovered Oil Tax Rate, Lea County, New Mexico. Applicant applies for an order approving an enhanced oil recovery project (secondary and tertiary recovery) in the South Jal Unit Area by the injection of water and gas into the Yates-Seven Rivers-Queen formation in wells located on approximately 19,369.77 acres of federal, state, and fee lands located in Lea County that include all or parts of: Township 25 South, Range 36 East – Sections 13, 24-26, 36; Township 25 South, Range 37 East – Sections 15, 16, 18, 19, 21-23, 26-28, 30-35; Township 26 South, Range 37 East – Sections 3-10, 15-23, 29, 32. Applicant seeks authorization to include additional injection wells within the project administratively. A portion of the as-drilled interval for this well is unorthodox because a part of the interval is more than 50 feet from its projected location and closer than the standard offsets to the eastern boundary of the spacing unit. The completed intervals of the Wells will be orthodox. The completed interval of the Flaming Snail Fed Com 706H well will be located within 330’ of the quarter-quarter section line separating the E/2 and W/2 of Sections 28 and 33, Township 25 South, Range 27 East, and Section 4, Township 26 South, Range 27 East, to allow for the creation of a 1,920-acre standard horizontal spacing unit. Also to be considered will be the cost of drilling and completing the wells and the allocation of the costs, the designation of Applicant as the operator of the Wells, and a 200% charge for the risk involved in drilling and completing the Wells. 100. 23308 Application of Mewbourne Oil Company for Approval of a 1,280-acre Non-Standard Horizontal Well Spacing Unit and Compulsory Pooling, Lea County, New Mexico. Applicant in the above-styled cause seeks an order (a) approving a 1,280-acre, more or less, non-standard horizontal well spacing unit in the Bone Spring formation underlying Sections 9 and 4, Township 19 South, Range 34 East, NMPM, Lea County, New Mexico and (b) pooling all uncommitted interests in this acreage. This spacing unit will be initially dedicated to the following proposed wells:
