PRELIMINARY DOCKET: OCD Special Examiner's Hearing set for February 10, 2026

For hearings by affidavit: presenting parties are required to submit a pre-hearing statement no later than the Thursday before the hearing. The pre-hearing statement shall include: 1) a list of disputed facts and issues; 2) identification of witnesses and their qualifications; and 3) all exhibits and written testimony a party intends to enter into evidence at the hearing and a full narrative for each.

For contested matters: pre-hearing statements shall be filed no later than 9:00 a.m., 4 business days prior to the hearing and in addition to the requirements of 19.15.4.13.B(1) NMAC, shall include: all evidentiary exhibits, documents, affidavits, and full-written testimony of any witness a party offers at the hearing. Exhibits must be sequentially marked on every page.

Failure to timely file a complete pre-hearing statement may cause the Hearing Examiner to continue the hearing and/or impose sanctions up to and including the exclusion of late-filed evidence. Evidentiary objections must be filed no later than 48 hours before the hearing. Rulings on the objections will be addressed as a preliminary matter when the case is called.

1. 25602 Application of Waterloo Resources LLC for Approval of a 1,276.76-acre Overlapping Non-Standard Horizontal Well Spacing Unit and Compulsory Pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order (a) approving a 1,276.76-acre, more or less, overlapping non-standard horizontal well spacing unit in the Bone Spring formation underlying Lots 1-4 (W/2 W/2 equivalent), E/2 W/2, and the E/2 of irregular Section 19, and all of Section 20, Township 19 South, Range 30 East, N.M.P.M., Eddy County, New Mexico, and (b) pooling all uncommitted interest owners in this acreage. This spacing unit will be initially dedicated to the following proposed wells: (1) Wave Race Fed Com 111H well, to be drilled from a surface location approximately in the SW/4 NW/4 (Unit E) and SE/4 NW/4 (Unit F) of Section 21, to a bottom hole location in Lot 1 (NW/4 NW/4 equivalent) of Section 19; (2) Wave Race Fed Com 112H well, to be drilled from a surface location approximately in the SW/4 NW/4 (Unit E) and SE/4 NW/4 (Unit F) of Section 21, to a bottom hole location in Lot 2 (SW/4 NW/4 equivalent) of Section 19; (3) Wave Race Fed Com 113H well, to be drilled from a surface location approximately in the SW/4 NW/4 (Unit E) and SE/4 NW/4 (Unit F) of Section 21, to a bottom hole location in Lot 3 (NW/4 SW/4 equivalent) of Section 19; (4) Wave Race Fed Com 114H well, to be drilled from a surface location approximately in the SW/4 NW/4 (Unit E) and SE/4 NW/4 (Unit F) of Section 21, to a bottom hole location in Lot 4 (SW/4 SW/4 equivalent) of Section 19; (5) Wave Race Fed Com 121H well, to be drilled from a surface location approximately in the SW/4 NW/4 (Unit E) and SE/4 NW/4 (Unit F) of Section 21, to a bottom hole location in Lot 1 (NW/4 NW/4 equivalent) of Section 19; (6) Wave Race Fed Com 122H well, to be drilled from a surface location approximately in the SW/4 NW/4 (Unit E) and SE/4 NW/4 (Unit F) of Section 21, to a bottom hole location in Lot 2 (SW/4 NW/4 equivalent) of Section 19; (7) Wave Race Fed Com 123H well, to be drilled from a surface location approximately in the SW/4 NW/4 (Unit E) and SE/4 NW/4 (Unit F) of Section 21, to a bottom hole location in Lot 3 (NW/4 SW/4 equivalent) of Section 19; and (8) Wave Race Fed Com 124H well, to be drilled from a surface location approximately in the SW/4 NW/4 (Unit E) and SE/4 NW/4 (Unit F) of Section 21, to a bottom hole location in Lot 4 (SW/4 SW/4 equivalent) of Section 19. The proposed spacing unit also overlaps the following existing spacing units in the Bone Spring formation: (1) a 195.94-acre horizontal well spacing unit comprised of Lot 1 (39.17 acres), Lot 2 (39.18 acres), Lot 3 (39.20 acres), and Lot 4 (39.21 acres) of Section 19, and Lot 4 (39.18 acres) of Section 18, Township 19 South, Range 30 East, N.M.P.M., Eddy County, New Mexico, operated by Marathon Oil Permian LLC and dedicated to the Parkway 19 18 Federal Com 1H (30-015-42545); (2) a 160.00-acre horizontal well spacing unit comprised of the W/2 E/2 of Section 19, Township 19 South, Range 30 East, N.M.P.M., Eddy County, New Mexico, operated by EOG Resources Inc. and dedicated to the Antweil ANU Federal 3H (30-015-40523). Also to be considered will be the cost of drilling and completing the wells and the allocation of the costs thereof, the operating costs and charges for supervision, the designation of applicant as operator of the proposed spacing unit, and a 200% charge for risk involved in drilling said wells. Said area is located approximately 18 miles northeast of Carlsbad, New Mexico.
2. 25768 Application of Permian Resources Operating, LLC for Compulsory Pooling, Eddy County, New Mexico. Applicant seeks an order pooling all uncommitted interests in the Bone Spring formation underlying a 643.38-acre, more or less, standard horizontal spacing unit comprised of the S/2 of Sections 29 and 30, Township 21 South, Range 26 East, Eddy County, New Mexico (“Unit”). The Unit will be dedicated to the GTO Fed Com 134H well (“Well”), which will produce from a first take point in Lot 24 (SE/4 SE/4 equivalent) of Section 29 to a last take point in Lot 4 (SW/4 SW/4) of Section 30. The completed interval of the Well will be orthodox. The completed interval of the GTO Fed Com 134H well will be located within 330’ of the quarter-quarter section line separating the N/2 S/2 and S/2 S/2 of Sections 29 and 30 to allow for the creation of a 643.38-acre standard, horizontal spacing unit. Also to be considered will be the cost of drilling and completing the Well and the allocation of the cost, the designation of Applicant as operator of the Well, and a 200% charge for the risk involved in drilling and completing the Well. The Well is located approximately 1.5 miles northwest of Carlsbad, New Mexico.
3. 25769 Application of Permian Resources Operating, LLC for Compulsory Pooling, Eddy County, New Mexico. Applicant seeks an order pooling all uncommitted interests in the Wolfcamp formation underlying a 1,286.80-acre, more or less, standard horizontal spacing unit comprised of all of Sections 29 and 30, Township 21 South, Range 26 East, Eddy County, New Mexico (“Unit”). The Unit will be dedicated to the GTO Fed Com 212H well (“Well”), which will produce from a first take point in Lot 2 (SW/4 NW/4 equivalent) of Section 30 to a last take point in Lot 8 (SE/4 NE/4 equivalent) of Section 29. The completed interval of the Well will be orthodox. The completed interval of the GTO Fed Com 212H well will be located within 330’ of the half-section line separating the N/2 and S/2 of Sections 29 and 30 to allow for the creation of a 1,286.80-acre standard, horizontal spacing unit. Also to be considered will be the cost of drilling and completing the Well and the allocation of the cost, the designation of Applicant as operator of the Well, and a 200% charge for the risk involved in drilling and completing the Well. The Well is located approximately 1.5 miles northwest of Carlsbad, New Mexico.
4. 25770 Application of Permian Resources Operating, LLC for Compulsory Pooling, Eddy County, New Mexico. Applicant seeks an order pooling all uncommitted interests in the Bone Spring formation underlying a 643.42-acre, more or less, standard horizontal spacing unit comprised of the N/2 of Sections 29 and 30, Township 21 South, Range 26 East, Eddy County, New Mexico (“Unit”). The Unit will be dedicated to the GTO Fed Com 132H well (“Well”), which will produce from a first take point in Lot 2 (SW/4 NW/4 equivalent) of Section 30 to a last take point in Lot 8 (SE/4 NE/4 equivalent) of Section 29. The completed interval of the Well will be orthodox. The completed interval of the GTO Fed Com 132H well will be located within 330’ of the quarter-quarter section line separating the N/2 N/2 and S/2 N/2 of Sections 29 and 30 to allow for the creation of a 643.42-acre standard, horizontal spacing unit. Also to be considered will be the cost of drilling and completing the Well and the allocation of the cost, the designation of Applicant as operator of the Well, and a 200% charge for the risk involved in drilling and completing the Well. The Well is located approximately 1.5 miles northwest of Carlsbad, New Mexico.
