PRELIMINARY DOCKET: Examiner Hearing for Thursday, September 21, 2023

Applications for hearing shall be filed at least thirty (30) days in advance of the hearing date. A party who intends to present evidence shall file a pre-hearing statement no later than the close of business on the Thursday prior to the hearing date and serve a copy on the other parties, if any. The hearing examiner will dismiss the application if the applicant does not file and serve a pre-hearing statement as specified above. 8. 21393 Application of Ascent Energy, LLC, for Compulsory Pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order from the Division: (1) establishing a 320-acre, more or less, horizontal spacing and proration unit comprised of the E/2W/2 of Sections 28 and 33, Township 20 South, Range 30 East, NMPM, Eddy County, New Mexico, and (2) pooling all mineral interests in the Bone Spring formation (WC-015 G-04 S203032P; BONE SPRING [Pool Code 98008]) underlying the unit. Said horizontal spacing unit is to be dedicated to three proposed wells, the Anvil Fed Com 502H Well, to be horizontally drilled from a surface location in NE/4 NE/4 (Lot 1) of Section 4, Township 21 South, 29 East, NMPM, to a bottom hole location in the NE/4 NW/4 (Unit C) of Section 28; the Anvil Fed Com 503H Well, to be horizontally drilled from a surface location in NE/4 NE/4 (Lot 1) of Section 4, Township 21 South, 29 East, NMPM, to a bottom hole location in the NE/4 NW/4 (Unit C) of Section 28; and the Anvil Fed Com 602H Well, to be horizontally drilled from a surface location in NE/4 NE/4 (Lot 1) of Section 4, Township 21 South, 29 East, NMPM, to a bottom hole location in the NE/4 NW/4 (Unit C) of Section 28. The 503H and 602H Wells will have standard, orthodox locations. Ascent will apply administratively for approval of a nonstandard location for the 502H Well. Also to be considered will be the cost of drilling and completing the wells and the allocation of the costs thereof; actual operating costs and charges for supervision; the designation of the Applicant as Operator of the wells and unit; and a 200% charge for the risk involved in drilling and completing the wells. 9. 21394 Application of Ascent Energy, LLC, for Compulsory Pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order from the Division: (1) establishing a 320-acre, more or less, horizontal spacing and proration unit comprised of the E/2W/2 of Sections 28 and 33, Township 20 South, Range 30 East, NMPM, Eddy County, New Mexico, and (2) pooling all mineral interests in the Wolfcamp formation (WC-015 G-07 S203032G; WOLFCAMP [Pool Code 97963]) underlying the unit. Said horizontal spacing unit is to be dedicated to the proposed Anvil Fed Com 703H Well, to be horizontally drilled from a surface location in NE/4 NE/4 (Lot 1) of Section 4, Township 21 South, 29 East, NMPM, to a bottom hole location in the NE/4 NW/4 (Unit C) of Section 28. The completed interval of the 703H Well will meet requirements for an orthodox, standard location. Also to be considered will be the cost of drilling and completing the wells and the allocation of the costs thereof; actual operating costs and charges for supervision; the designation of the Applicant as Operator of the wells and unit; and a 200% charge for the risk involved in drilling and completing the wells. The wells and unit are located approximately 16 1/2 miles northeast of Carlsbad, New Mexico.
10. 22947 Application of EOG Resources, Inc. for compulsory pooling, Lea County, New Mexico. Applicant in the above-styled cause seeks an order pooling all uncommitted interest owners in the Bone Spring formation underlying a standard 640-acre, more or less, horizontal spacing unit comprised of the E/2 of Sections 23 and 26, Township 24 South, Range 34 East, NMPM, Lea County, New Mexico. Applicant seeks to dedicate the above-referenced horizontal spacing unit to the following proposed wells:
•    Grackle 23 Fed Com 101H, Grackle 23 Fed Com 301H and the Grackle 23 Fed Com 302H to be drilled from the NW/4 NE/4 (Unit B) of Section 23 to a bottomhole location in the SW/4 SE/4 (Unit O) of Section 26.
•    Grackle 23 Fed Com 102H, Grackle 23 Fed Com 103H, Grackle 23 Fed Com 303H, Grackle 23 Fed Com 304H, and the Grackle 23 Fed Com 305H to be drilled from the NE/4 NE/4 (Unit A) of Section 23 to a bottomhole location in the SE/4 SE/4 (Unit P) of Section 26.
The completed interval of the Grackle 23 Fed Com 101H and the Grackle 23 Fed Com 303H are expected to remain within 330 feet of the adjoining quarter-quarter section (or equivalent) tracts to allow inclusion of these proximity tracts within the proposed horizontal spacing unit under NMAC 19.15.16.15.B(1)(b).    Also, to be considered will be the cost of drilling and completing the wells, the allocation of the cost thereof, the actual operating costs and charges for supervision, the designation of applicant as operator, and the imposition of 200% charge for risk involved in drilling and completing each well. Said area is located approximately 15 miles northwest of Jal, New Mexico.
11. 22845 Application of Tap Rock Operating, LLC for compulsory pooling, Lea County, New Mexico. Tap Rock Operating, LLC (“TRO”) applies for an order pooling all uncommitted interests within the Bone Spring formation underlying a 640-acre, more or less, standard horizontal spacing unit (“Unit”) comprised of the E/2 of Sections 23 and 26, Township 24 South, Range 34 East, NMPM, Lea County, New Mexico. The Unit will be dedicated to the following proposed initial wells (“Wells”) which it intends to drill simultaneously:
•    The Fancy Boy Fed Com #113H and Fancy Boy Fed Com #123H, to be horizontally drilled from surface hole locations in the SE/4SE/4 (Unit P) of Section 26 to bottom hole locations in the NW/4NE/4 (Unit B) of Section 23; and
•     The Fancy Boy Fed Com #114H, Fancy Boy Fed Com #124H, and Fancy Boy Fed Com #128H, to be horizontally drilled from surface hole locations in the SE/4SE/4 (Unit P) of Section 26 to bottom hole locations in the NE/4NE/4 (Unit A) of Section 23.
The completed interval for the proposed Fancy Boy Fed Com #124H will be within 330’ of the quarter-quarter line separating the E/2E/2 from the W/2E/2 of Sections 23 and 26 to allow the inclusion of this acreage into a standard horizontal spacing unit. The completed intervals of the Wells will be orthodox. Also, to be considered will be the cost of drilling and completing the Wells and the allocation of the cost, the designation of Tap Rock Operating, LLC as operator of the Unit and Wells, and a 200% charge for risk involved in drilling and completing the Wells. The Unit is located approximately 15 miles northwest of Jal, New Mexico.
12. 23318 Application of COG Operating LLC for Compulsory Pooling, Lea County, New Mexico. Applicant in the above-styled cause seeks an order pooling all uncommitted interest owners in the Bone Spring formation underlying a standard 639.23-acre, more or less, horizontal spacing unit comprised of Lots 1 & 2, S2NE, SE (E2 equivalent) of irregular Section 2 and E2 of Section 11, Township 23 South, Range 32 East, NMPM, Lea County, New Mexico. Said unit will be initially dedicated to the following proposed wells:
•    Redtail Federal Com 501H and Redtail Federal Com 502H to be horizontally drilled from a surface location in the NE4NE4 (Lot 1) of Section 2 to bottomhole locations in the SE4SE4 (Unit P) of Section 11.
•    Redtail Federal Com 503H to be horizontally drilled from a surface location in the NE4NE4 (Lot 1) of Section 2 to a bottomhole location in the SW4SE4 (Unit O) of Section 11.
•    Redtail Federal Com 602H and Redtail Federal Com 604H to be horizontally drilled from a surface location in the NW4NE4 (Lot 2) of Section 2 to bottomhole locations, respectfully, in the SE4SE4 (Unit P) of Section 11 and SW4SE4 (Unit O) of Section 11.
The completed interval of the proposed Redtail Federal Com 502H well is expected to remain within 330 feet of the offsetting quarter-quarter sections or equivalent tracts to include them within this proposed spacing unit. Also, to be considered will be the cost of drilling and completing the wells, the allocation of the cost thereof, the actual operating costs and charges for supervision, the designation of applicant as operator, and the imposition of 200% charge for risk involved in drilling and completing each well. Said area is located approximately 25 miles east of Malaga, New Mexico.
13. 23319 Application of COG Operating LLC for Compulsory Pooling and Approval of Overlapping Spacing Unit, Lea County, New Mexico. Applicant in the above-styled cause seeks (a) an order pooling all uncommitted interest owners in the Bone Spring formation underlying a standard 639.29-acre, more or less, horizontal spacing unit comprised of Lots 3 & 4, S2NW, SW (W2 equivalent) of irregular Section 2 and W2 of Section 11, Township 23 South, Range 32 East, NMPM, Lea County, New Mexico, and (b) approving, as necessary, this overlapping spacing unit. Said unit will be initially dedicated to following proposed wells:
•    Redtail Federal Com 504H and Redtail Federal Com 505H wells, to be horizontally drilled from a surface location in the NW4NW4 (Lot 4) of Section 2 to bottomhole locations, respectively, in the SE4SW4 (Unit N) and the SW4SW4 (Unit M) of Section 11.
•    Redtail State Com 506H well, to be horizontally drilled from a surface location in the NW4NW4 (Lot 4) of Section 2 to a bottomhole location in the SW4SW4 (Unit M) of Section 2.
•    Redtail Federal Com 606H and Redtail Federal Com 608H wells, to be horizontally drilled from a surface location in the NE4NW4 (Lot 3) of Section 2 to bottomhole locations, respectively, in the SE4SW4 (Unit N) and the SW4SW4 (Unit M) of Section 11.
The completed interval of the proposed Redtail Federal Com 505H well is expected to remain within 330 feet of the offsetting quarter-quarter sections or equivalent tracts to include them within this proposed spacing unit. This proposed horizontal well spacing unit will overlap the following existing spacing units in the W2 of Section 11:
•    A 160-acre spacing unit comprised of the W2W2 of Section 11 that is currently dedicated to the Urraca 11 SB Federal Com 4H (30-025-41968) currently producing from the Bone Spring formation.
•    A 160-acre spacing unit comprised of the E2W2 of Section 11 that is currently dedicated to the Urraca 23 32 11 Federal Com 24H (30-025-42226) currently producing from the Bone Spring formation.
Also, to be considered will be the cost of drilling and completing the wells, the allocation of the cost thereof, the actual operating costs and charges for supervision, the designation of applicant as operator, and the imposition of 200% charge for risk involved in drilling and completing each well. Said area is located approximately 25 miles east of Malaga, New Mexico.
14. 23320 Application of COG Operating LLC for Compulsory Pooling, Lea County, New Mexico. Applicant in the above-styled cause seeks an order pooling all uncommitted interest owners in the Wolfcamp formation underlying a standard 639.23-acre, more or less, horizontal spacing unit comprised of Lots 1 & 2, S2NE, SE (E2 equivalent) of irregular Section 2 and E2 of Section 11, Township 23 South, Range 32 East, NMPM, Lea County, New Mexico. Said unit will be initially dedicated to the proposed Redtail Federal Com 701H and Redtail Federal Com 703H wells, both to be horizontally drilled from a surface location in the NW4NE4 (Lot 2) of Section 2 to bottomhole locations, respectively, in the SE4SE4 (Unit P) and the SW4SE4 (Unit O) of Section 11. Applicant in the above-styled cause seeks an order pooling all uncommitted interests in the Wolfcamp formation underlying a standard 640-acre, more or less, horizontal well spacing unit comprised of the S/2 of Sections 27 and 28, Township 22 South, Range 28 East, NMPM, Eddy County, New Mexico. Said unit will be initially dedicated to the proposed:
•    Warrior 2827 Fed Com #203H well, to be horizontally drilled from a surface location in the SE/4 of Section 29 to a bottom hole location in the NE/4 SE/4 (Unit I) of Section 27; and
•    Warrior 2827 Fed Com #204H well, to be horizontally drilled from a surface location in the SE/4 of Section 29 to a bottom hole location in the SE/4 SE/4 (Unit P) of Section 27.
Also, to be considered will be the cost of drilling and completing the wells and the allocation of the cost thereof, actual operating costs and charges for supervision, designation of Applicant as operator of the wells, and a 200% charge for risk involved in drilling the wells. Said area is located approximately 7 miles southeast of Carlsbad, New Mexico.
66. 23475 Application of Earthstone Operating, LLC for a Horizontal Spacing and Proration Unit and Compulsory Pooling, Lea County, New Mexico. Applicant in the above-styled cause seeks an order from the Division: (1) establishing a standard 320.00-acre, more or less, spacing and proration unit comprised of the E/2 E/2 of Sections 7 and 18, all in Township 21 South, Range 35 East, NMPM, Lea County, New Mexico, and (2) pooling all mineral interests in the Bone Spring formation, designated as an oil pool, underlying the unit. Sections 7 and 18 are irregular with correction lots but there are no such lots in the proposed unit. The proposed wells to be dedicated to the horizontal spacing unit are the Outland 18-7 State Com 114H Well and the Outland 18-7 State Com 214H Well, both oil wells, to be horizontally drilled from a surface location in the SW/4 SE/4 (Unit O) of Section 18 to a bottom hole location in the NE/4 NE/4 (Unit A) of Section 7. The proposed unit is a straddle unit that includes lands in the E/2 E/2 of Section 7 that are within the North Wilson Deep Unit. Applicant will seek approval for this overlap.
