PRELIMINARY DOCKET: Examiner Hearing for October 23, 2025 [VIRTUAL]

For hearings by affidavit: presenting parties are required to submit a pre-hearing statement no later than the Thursday before the hearing. The pre-hearing statement shall include: 1) a list of disputed facts and issues; 2) identification of witnesses and their qualifications; and 3) all exhibits and written testimony a party intends to enter into evidence at the hearing and a full narrative for each.

For contested matters: pre-hearing statements shall be filed no later than 9:00 a.m., 4 business days prior to the hearing and in addition to the requirements of 19.15.4.13.B(1) NMAC, shall include: all evidentiary exhibits, documents, affidavits, and full-written testimony of any witness a party offers at the hearing. Exhibits must be sequentially marked on every page.

Failure to timely file a complete pre-hearing statement may cause the Hearing Examiner to continue the hearing and/or impose sanctions up to and including the exclusion of late-filed evidence. Evidentiary objections must be filed no later than 48 hours before the hearing. Rulings on the objections will be addressed as a preliminary matter when the case is called.

Select Water seeks authorization to inject produced water into the Bell Canyon and Cherry Canyon formations (SWD; Bell Canyon-Cherry Canyon; Code 96802), at a depth of approximately 5,175 feet to 7,500 feet. Select Water proposes to inject an average of 15,000 barrels of water per day up to a maximum of 20,000 barrels of water per day, and requests that the Division approve a maximum surface injection pressure of 1,035 psi. 2. 25546 Application of Select Water Solutions, LLC for Approval of a Saltwater Disposal Well, Lea County, New Mexico. Select Water Solutions, LLC (“Select Water”) (OGRID No. 289068) applies for an order approving its proposed Roadrunner Fed 26 SWD #1, to be drilled at a location 2,054’ from the north line and 2,126’ from the east line (Unit G) of Section 26, Township 26 South, Range 35 East, Lea County, New Mexico, for the purpose of produced water disposal. Select Water seeks authorization to inject produced water into the Bell Canyon and Cherry Canyon formations (SWD; Bell Canyon-Cherry Canyon; Code 96802), at a depth of approximately 5,400 feet to 7,425 feet. Select Water proposes to inject an average of 15,000 barrels of water per day up to a maximum of 20,000 barrels of water per day, and requests that the Division approve a maximum surface injection pressure of 1,080 psi. Select Water Solutions, LLC (“Select Water”) (OGRID No. 289068) applies for an order approving its proposed Javelina Fed 4 SWD #1, to be drilled at a location 408’ from the south line and 831’ from the east line (Unit P) of Section 4, Township 26 South, Range 35 East, Lea County, New Mexico, for the purpose of produced water disposal. Select Water seeks authorization to inject produced water into the Bell Canyon and Cherry Canyon formations (SWD; Bell Canyon-Cherry Canyon; Code 96802), at a depth of approximately 5,360 feet to 7,550 feet. Select Water proposes to inject an average of 15,000 barrels of water per day up to a maximum of 20,000 barrels of water per day, and requests that the Division approve a maximum surface injection pressure of 1,072 psi. 4. 25548 Application of Select Water Solutions, LLC for Approval of a Saltwater Disposal Well, Lea County, New Mexico. Select Water Solutions, LLC (“Select Water”) (OGRID No. 289068) applies for an order approving its proposed Jackrabbit Fed SWD #1, to be drilled at a location 556’ from the south line and 1,968’ from the east line (Unit O) of Section 28, Township 26 South, Range 35 East, Lea County, New Mexico, for the purpose of produced water disposal. Select Water seeks authorization to inject produced water into the Bell Canyon and Cherry Canyon formations (SWD; Bell Canyon-Cherry Canyon; Code 96802), at a depth of approximately 5,305 feet to 7,750 feet. Select Water proposes to inject an average of 15,000 barrels of water per day up to a maximum of 20,000 barrels of water per day, and requests that the Division approve a maximum surface injection pressure of 1,061 psi. 5. 25549 Application of Select Water Solutions, LLC for Approval of a Saltwater Disposal Well, Lea County, New Mexico. Select Water Solutions, LLC (“Select Water”) (OGRID No. 289068) applies for an order approving its proposed Antelope Fed 28 SWD #1, to be drilled at a location 629’ from the south line and 2,543’ from the west line (Unit N) of Section 28, Township 25 South, Range 35 East, Lea County, New Mexico, for the purpose of produced water disposal. Select Water seeks authorization to inject produced water into the Bell Canyon and Cherry Canyon formations (SWD; Bell Canyon-Cherry Canyon; Code 96802), at a depth of approximately 5,270 feet to 7,545 feet. Select Water proposes to inject an average of 15,000 barrels of water per day up to a maximum of 20,000 barrels of water per day, and requests that the Division approve a maximum surface injection pressure of 1,054 psi. The well is located approximately 10.85 miles west of Jal, New Mexico.
6. 25602 Application of Waterloo Resources LLC for Approval of a 1,276.76-acre Overlapping Non-Standard Horizontal Well Spacing Unit and Compulsory Pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order (a) approving a 1,276.76-acre, more or less, overlapping non-standard horizontal well spacing unit in the Bone Spring formation underlying Lots 1-4 (W/2 W/2 equivalent), E/2 W/2, and the E/2 of irregular Section 19, and all of Section 20, Township 19 South, Range 30 East, N.M.P.M., Eddy County, New Mexico, and (b) pooling all uncommitted interest owners in this acreage. The proposed spacing unit also overlaps the following existing spacing units in the Bone Spring formation: (1) a 195.94-acre horizontal well spacing unit comprised of Lot 1 (39.17 acres), Lot 2 (39.18 acres), Lot 3 (39.20 acres), and Lot 4 (39.21 acres) of Section 19, and Lot 4 (39.18 acres) of Section 18, Township 19 South, Range 30 East, N.M.P.M., Eddy County, New Mexico, operated by Marathon Oil Permian LLC and dedicated to the Parkway 19 18 Federal Com 1H (30-015-42545); (2) a 160.00-acre horizontal well spacing unit comprised of the W/2 E/2 of Section 19, Township 19 South, Range 30 East, N.M.P.M., Eddy County, New Mexico, operated by EOG Resources Inc. and dedicated to the Antweil ANU Federal 3H (30-015-40523). Also to be considered will be the cost of drilling and completing the wells and the allocation of the costs thereof, the operating costs and charges for supervision, the designation of applicant as operator of the proposed spacing unit, and a 200% charge for risk involved in drilling said wells. Said area is located approximately 18 miles northeast of Carlsbad, New Mexico.
7. 25634 Application of Mewbourne Oil Company for Compulsory Pooling, Eddy County, New Mexico. Applicant seeks an order pooling all uncommitted interests in the Second Bone Spring interval of the Bone Spring formation underlying an 876.42-acre, more or less, non-standard horizonal spacing unit comprised of the N/2 of Section 19, Township 18 South, Range 30 East, the N/2 of Section 24, Township 18 South, Range 29 East, and the N/2 of Section 23, excluding the E/2 NE/4, Township 18 South, Range 29 East, Eddy County, New Mexico (“Unit”). The Unit will be dedicated to the following wells (“Wells”): IOU 19/23 Fed Com #521H, which will be drilled from a surface hole location in the NW/4 NW/4 (Unit D) of Section 20, Township 18 South, Range 30 East, to a bottom hole location in the NW/4 NW/4 (Unit D) of Section 23, Township 18 South, Range 29 East; and IOU 19/23 Fed Com #523H, which will be drilled from a surface hole location in the NW/4 NW/4 (Unit D) of Section 20, Township 18 South, Range 30 East, to a bottom hole location in the SW/4 NW/4 (Unit E) of Section 23, Township 18 South, Range 29 East. The completed intervals of the Wells will be orthodox. Also to be considered will be the cost of drilling and completing the Wells, the allocation of the costs, the designation of Applicant as operator of the Wells and the Unit, and a 200% charge for the risk involved in drilling and completing the Wells. The Wells are located approximately 21 miles East-Southeast of Artesia, New Mexico.
8. 25638 Application of Mewbourne Oil Company for Compulsory Pooling, Lea County, New Mexico. Applicant seeks an order pooling all uncommitted interests in the Bone Spring formation underlying a 320-acre, more or less, standard, horizontal spacing unit comprised of the W/2 W/2 of Section 10, Township 26 South, Range 32 East, and the W/2 W/2 of Section 34, Township 25 South, Range 32 East, Lea County, New Mexico (“Unit”). The Unit will be dedicated to the Red Hills West Unit Com 40H well (“Well”), which will be drilled from a surface hole location in the SW/4 SW/4 (Unit M) of Section 10, Township 26 South, to a bottom hole location in the NW/4 NW/4 (Unit D) of Section 34, Township 25 South. The completed interval of the Well will be orthodox. Also to be considered will be the cost of drilling and completing the Well and the allocation of the cost, the designation of Applicant as operator of the Well, and a 200% charge for the risk involved in drilling and completing the Well. The Well is located approximately 28 miles southwest of Jal, New Mexico.
9. 25641 Application of Mewbourne Oil Company for Compulsory Pooling, Lea County, New Mexico. Applicant seeks an order pooling all uncommitted interests in the Bone Spring formation underlying a 960-acre, more or less, non-standard, horizontal spacing unit comprised of the W/2 of Sections 3 and 10, Township 26 South, Range 32 East, and the W/2 of Section 34, Township 25 South, Range 32 East, Lea County, New Mexico (“Unit”). The Unit will be dedicated to the following wells (“Wells”): Red Hills West Unit Com 35H and Red Hills West Unit Com 41H wells, which will be drilled from surface hole locations in the SW/4 SW/4 (Unit M) of Section 10, Township 26 South, to bottom hole locations in the NW/4 NW/4 (Unit D) of Section 34, Township 25 South; and Red Hills West Unit Com 36H, Red Hills West Unit Com 37H, and Red Hills West Unit Com 38H wells, which will be drilled from surface hole locations in the SW/4 SW/4 (Unit M) of Section 10, Township 26 South, to bottom hole locations in the NE/4 NW/4 (Unit C) of Section 34, Township 25 South. The completed intervals of the Wells will be orthodox. Applicant is separately seeking administrative approval of the non-standard horizontal spacing unit. Also to be considered will be the cost of drilling and completing the Wells and the allocation of the cost, the designation of Applicant as operator of the Wells, and a 200% charge for the risk involved in drilling and completing the Wells. The Wells are located approximately 28 miles southwest of Jal, New Mexico.
10. 25639 Application of Tap Rock Operating, LLC for Compulsory Pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order pooling all uncommitted interest owners in a standard 640-acre, more or less, well spacing unit in the Purple Sage Wolfcamp formation underlying the N/2 of Sections 32 and 33, Township 25 South, Range 26 East, NMPM, Eddy County, New Mexico. Tap Rock seeks to dedicate the above-referenced spacing unit to the proposed Always Smooth Fed Com #211H well to be drilled from a surface hole location in the SW/4 SW/4 of Section 29 to a bottom hole location in the NE/4 NE/4 of Section 33 and the proposed Always Smooth Fed Com #212H well to be drilled from a surface hole location in the SW/4 SW/4 of Section 29 to a bottom hole location in the SE/4 NE/4 of Section 33. Also to be considered will be the cost of drilling, equipping and completing the well, the allocation of the cost thereof, as well as actual operating costs and charges for supervision, designation of Applicant as operator, and a 200% charge for risk involved in drilling, equipping and completing the well. Said wells and lands are located approximately 7.5 miles southeast of Whites City, New Mexico.
11. 25640 Application of Tap Rock Operating, LLC for Compulsory Pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order pooling all uncommitted interest owners in a standard 640-acre, more or less, well spacing unit in the Purple Sage Wolfcamp formation underlying the S/2 of Sections 28 and 29, Township 25 South, Range 26 East, NMPM, Eddy County, New Mexico. Tap Rock seeks to dedicate the above-referenced spacing unit to the proposed Keystone Light Fed Com #213H well to be drilled from a surface hole location in the SW/4 SW/4 of Section 29 to a bottom hole location in the NE/4 SE/4 of Section 28 and the proposed Keystone Light Fed Com #214H well to be drilled from a surface hole location in the SW/4 SW/4 of Section 29 to a bottom hole location in the SE/4 SE/4 of Section 28. Also to be considered will be the cost of drilling, equipping and completing the well, the allocation of the cost thereof, as well as actual operating costs and charges for supervision, designation of Applicant as operator, and a 200% charge for risk involved in drilling, equipping and completing the well. Said wells and lands are located approximately 7.5 miles southeast of Whites City, New Mexico.
12. 25667 Application of Sarvis Permian Land Fund I SC, LLC for Compulsory Pooling, Eddy County, New Mexico. Applicant seeks an order pooling all uncommitted mineral owners in a standard 640-acre, more or less, horizontal well spacing unit in the Wolfcamp formation comprised of the S/2 of Section 29 and the SE/4, E/2 SW/4 and Lots 3-4 (S/2 equivalent) of irregular Section 30, Township 22 South, Range 26 East, NMPM, Eddy County, New Mexico.
