PRELIMINARY DOCKET: Special Examiner's Hearing set for October 14, 2025

For hearings by affidavit: presenting parties are required to submit a pre-hearing statement no later than the Thursday before the hearing. The pre-hearing statement shall include: 1) a list of disputed facts and issues; 2) identification of witnesses and their qualifications; and 3) all exhibits and written testimony a party intends to enter into evidence at the hearing and a full narrative for each.

For contested matters: pre-hearing statements shall be filed no later than 9:00 a.m., 4 business days prior to the hearing and in addition to the requirements of 19.15.4.13.B(1) NMAC, shall include: all evidentiary exhibits, documents, affidavits, and full-written testimony of any witness a party offers at the hearing. Exhibits must be sequentially marked on every page.

Failure to timely file a complete pre-hearing statement may cause the Hearing Examiner to continue the hearing and/or impose sanctions up to and including the exclusion of late-filed evidence. Evidentiary objections must be filed no later than 48 hours before the hearing. Rulings on the objections will be addressed as a preliminary matter when the case is called.

Mewbourne seeks to dedicate the above-referenced spacing unit to the proposed Kansas 28/33 Fed Com 556H well, to be drilled from a surface hole location in the NE/4 NE/4 (Unit A) of Section 28, a first take point in the NW/4 NE/4 (Unit B) of Section 28, and to a bottom hole location in the SW/4 SE/4 (Unit O) of Section 33. 5. 25519 Application of OXY USA Inc. to Amend and Expand the Proposed Closed Loop Gas Capture Injection Pilot Project Area and Add Additional Injection Wells, Eddy and Lea Counties, New Mexico. Applicant in the above-styled cause seeks an order amending the request under Case No. 23633 to (1) expand the closed loop gas capture injection project area; and (2) authorize seventeen additional injection wells for intermittent, temporary produced gas injection within the Bone Spring formation within the requested amended project area. The amendment will create a 5,158.08-acre, more or less, project area for this Pilot Project consisting of the following acreage identified below in Eddy and Lea Counties, New Mexico (the “Project Area”):

OXY seeks authority to utilize these producing wells to occasionally inject produced gas into the Bone Spring formation at total vertical depths of between approximately 9,081 feet to 10,303 feet along the horizontal portion of each wellbore at surface injection pressures of no more than 1,300 psi. at an average injection rate of 3 MMSCF per day and a maximum injection rate of 4 MMSCF per day. The source of the produced gas will be from the Bone Spring and Wolfcamp formations. The subject acreage is located approximately 41 miles southwest of Lovington, New Mexico.
6. 25577 Application of XTO Energy, Inc. for Compulsory Pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order pooling all uncommitted record title owners in the Wolfcamp formation underlying a standard 447.9-acre, more or less, horizontal well spacing unit comprised of the W/2 of Section 25 and the N/2 NW/4 and Lots 1 and 2 (NW/4 equivalent) of irregular Section 36, Township 26 South, Range 29 East, NMPM, Eddy County, New Mexico. Said area is located along the Texas and New Mexico border.
7. 25581 Application of MRC Toro, LLC for Compulsory Pooling, Lea County,
New Mexico. Applicant in the above-styled cause seeks an order pooling a
standard 553.55-acre, more or less, horizontal well spacing unit in the
Wolfcamp (oil) formation underlying the E/2 W/2 of Sections 14, 23, and
26, and the NE/4 NW/4 and Lot 3 (E/2 NW/4 equivalent) of irregular
Section 35, Township 26 South, Range 36 East, NMPM, Lea County, New
Mexico. Said unit will be initially dedicated to the proposed Kyle Pipkin
State Com 202H well, with a surface hole location in the NE/4 NW/4
(Unit C) of Section 14, a first take point in the NE/4 NW/4 (Unit C) of
Section 14 and a last take point in the Lot 3 (SE/4 NW/4 equivalent) of

New Mexico. Applicant in the above-styled cause seeks an order pooling a
standard 553.51-acre, more or less, horizontal well spacing unit in the
Wolfcamp (oil) formation underlying the W/2 E/2 of Sections 14, 23, and

The Well is located approximately 22 miles east-southeast of Artesia, New Mexico.
12. 25619 Application of Tascosa Energy Partners, LLC for Compulsory Pooling, Eddy County, New Mexico. Applicant seeks an order pooling all uncommitted interests in the Bone Spring formation underlying 720-acre, more or less, standard horizontal spacing unit comprised of the S/2 NE/4 and N/2 SE/4 of Section 7, the N/2 S/2 and S/2 N/2 of Section 8, and the S/2 NW/4, N/2 SW/4, SW/4 NE/4 and NW/4 SE/4 of Section 9, Township 20 South, Range 26 East, Eddy County, New Mexico (“Unit”). The Unit will be dedicated to the Anna 79 Fee #203H well (“Well”), which will be drilled from a surface hole location in the NE/4 SW/4 (Unit K) of Section 7 to a bottom hole location in the NW/4 SE/4 (Unit J) of Section 9. The completed interval of the Well will be orthodox. The completed interval of the Well will be located within 330’ of the quarter-quarter section line separating the S/2 N/2 and N/2 S/2 of Sections 7, 8, and 9 to allow for the creation of a 720-acre standard horizontal spacing unit. 16. 25643 Application of MRC Permian Company to Extend the Drilling Deadline Under Order No. R-23478, Lea County, New Mexico. Applicant in the above-styled cause seeks a year extension of time for drilling the initial well under Order No. R-23478. The Unit is comprised of a standard 324.32-acre, more or less, overlapping horizontal well spacing unit in the Bone Spring formation comprised of the W/2 W/2 of Section 34, Township 18 South, Range 34 East, and Lot 4, the SW/4 NW/4, and the W/2 SW/4 (W/2 W/2 equivalent) of irregular Section 3, Township 19 South, Range 34 East, NMPM, Lea County, New Mexico. Order No. R-23478 approved the overlapping spacing unit and pooled the uncommitted mineral interests in the Bone Spring formation and dedicated the Unit to the proposed initial Art Smith State Com 121H well, to be horizontally drilled from a surface location in the NE/4 NW/4 (Unit C) of Section 34, with a first take point in the NW/4 NW/4 (Unit D) of Section 34 and a last take point in the SW/4 SW/4 (Unit M) of irregular Section 3. The subject area is located approximately 22 miles west of Hobbs, New Mexico.
17. 25645 Application of MRC Permian Company to Extend the Drilling Deadline Under Order R-23479, Lea County, New Mexico. Applicant in the above-styled cause seeks a year extension of time for drilling the initial well under Order No. R-23479. The Unit is comprised of a standard 324.28-acre, more or less, overlapping horizontal well spacing unit in the Bone Spring formation comprised of the E/2 W/2 of Section 34, Township 18 South, Range 34 East, and Lot 3, the SE/4 NW/4, and the E/2 SW/4 (E/2 W/2 equivalent) of irregular Section 3, Township 19 South, Range 34 East, NMPM, Lea County, New Mexico. 18. 25646 Application of MRC Permian Company to Extend the Drilling Deadline Under Order No. R-23482, Lea County, New Mexico. Applicant in the above-styled cause seeks a year extension of time for drilling the initial well under Order No. R-23482. Applicant in the above-styled cause seeks an order order (1) approving a 640-acre, more or less, overlapping horizontal well spacing unit in a portion of the Wolfcamp formation (oil), measured from the stratigraphic equivalent between 12,600 feet total vertical depth to 13,812 feet total vertical depth beneath the surface, underlying the E/2 of Sections 8 and 17, Township 26 South, Range 33 East, NMPM, Lea County, New Mexico, and (2) pooling all uncommitted interests in this acreage. Applicant seeks to initially dedicate the above-referenced horizontal spacing unit to the proposed Tigercat Federal Com 801H well, to be drilled from surface location in the N/2 NE/4 of Section 8, a first take point in the NW/4 NE/4 (Unit B) of Section 8 and a last take point in the SW/4 SE/4 (Unit O) of Section 17; and Tigercat Federal Com 802H and Tigercat Federal Com 803H wells, both to be drilled from surface locations in the N/2 NE/4 of Section 8, first take points in the NE/4 NE/4 (Unit A) of Section 8 and last take points in the SE/4 SE/4 (Unit P) of Section 17. This proposed horizontal well spacing unit will overlap the following spacing units in the Wolcamp formation:
•    An existing 160-acre spacing unit in the Wolfcamp formation underlying the E/2 E/2 of Section 17, T26S-R33E, currently dedicated to COG Operating LLC’s Vast State 20H (API No. 30-025-43655), Vast State 21H (API No. 30-025-43550), Vast State 22H (API No. 30-025-43551) and Vast State 23H (API No. 30-025-43552); and
•    An existing 160-acre spacing unit in the Wolfcamp formation underlying the W/2 E/2 of Section 17, T26S-R33E, currently dedicated to COG Operating LLC’s Vast State 24H (API No. 30-025-43545), Vast State 25H (API No. 30-025-43546) and Vast State 26H (API No. 30-025-43547).
The completed interval of the Tigercat Federal Com 802H is expected within 330 feet of the adjoining quarter-quarter section (or equivalent) tracts to allow inclusion of these proximity tracts within the proposed horizontal spacing unit under 19.15.16.15.B(1)(b) NMAC. Also to be considered will be the cost of drilling and completing the wells and the allocation of the cost thereof, actual operating costs and charges for supervision, designation of Applicant as operator of the well, and a 200% charge for risk involved in drilling the wells. The subject area is located approximately 4 miles north of the Texas and New Mexico border.
