PRELIMINARY DOCKET: Examiner Hearing for December 5, 2024

Applications for hearing shall be filed at least thirty (30) days in advance of the hearing date. A party who intends to present evidence shall file a pre-hearing statement no later than the close of business on the Thursday prior to the hearing date and serve a copy on the other parties, if any. The hearing examiner will dismiss the application if the applicant does not file and serve a pre-hearing statement as specified above. A party desiring to use projection equipment at the hearing shall contact Florene Davidson, OCD Clerk, no later than seven (7) business days prior to the hearing.

1. 24366 Application of MRC Permian Company for Approval of an Overlapping Horizontal Well Spacing Unit and Compulsory Pooling, Lea County, New Mexico. Applicant in the above-styled cause seeks an order (a) approving a standard 320-acre, more or less, overlapping horizontal well spacing unit in the Bone Spring formation comprised of the E2 of Section 16, Township 19 South, Range 34 East, NMPM, Lea County, New Mexico, and (b) pooling all uncommitted mineral interests in this horizontal well spacing unit. Said unit will be initially dedicated to the proposed Cimarron State Com 1143H and Cimarron State Com 1243H “u-turn” wells to be horizontally drilled from a surface location in the NE4 of Section 16, with first take points in the NE4NE4 (Unit A) of Section 16 and last take points in the NW4NE4 (Unit B) of Section 16. This proposed horizontal well spacing unit will overlap the following existing spacing units in the Bone Spring formation:
•    A 160-acre horizontal well spacing unit comprised of the W2E2 of Section 16 currently dedicated to the Cimarron 16 19S 34E RN State Com 133H (30-025-42979) operated by Matador Production Company in a different interval of the Bone Spring formation and assigned to the Quail Ridge; Bone Spring Pool (50460); and
•    A 160-acre horizontal well spacing unit comprised of the E2E2 of Section 16 currently dedicated to the Cimarron 16 19S 34E RN State Com 134H (30-025-42352) operated by Matador Production Company in a different interval of the Bone Spring formation and assigned to the Quail Ridge; Bone Spring Pool (50460).
Also, to be considered will be the cost of drilling and completing the wells and the allocation of the cost thereof, actual operating costs and charges for supervision, designation of Matador Production Company as operator of the wells, and a 200% charge for risk involved in drilling said wells. The subject area is located approximately 17 miles northwest of Monument, New Mexico.
2. 24559 Application of Marathon Oil Permian LLC for Compulsory Pooling, Lea County, New Mexico. Applicant seeks an order from the Division pooling all uncommitted mineral interests within a standard 960-acre, more or less, Bone Spring horizontal spacing unit comprised of the E/2 of Sections 18, 19, and 30, Township 24 South, Range 35 East, NMPM, Lea County, New Mexico. This spacing unit will be dedicated to the Razor’s Edge Fee 101H, Razor’s Edge Fee 301H, and Razor’s Edge Fee 501H wells to be horizontally drilled with first take points in the NW4/NE4 (Unit B) of Section 18 and with last take points in the SW/4SE/4 (Unit O) of Section 30; and the Razor’s Edge Fee 102H, Razor’s Edge Fee 302H, and Razor’s Edge Fee 502H wells to be horizontally drilled with first take points in the NE4/NE4 (Unit A) of Section 18 and with last take points in the SE/4SE/4 (Unit P) of Section 30. The producing area for the wells is expected to be orthodox. The completed intervals for the Razor’s Edge Fee 101H, Razor’s Edge Fee 302H, and Razor’s Edge Fee 501H are expected to be less than 330 feet from the adjoining tracts thereby allowing for the inclusion of the proximity tracts within the proposed spacing unit. Also to be considered will be the cost of drilling and completing said wells, the allocation of these costs as well as the actual operating costs and charges for supervision, designation of Marathon as operator of the wells, and a 200% charge for risk involved in drilling said wells. Said area is located approximately 15 miles northwest of Jal, New Mexico.
3. 24864 Application of MRC Permian Company for Compulsory Pooling, Lea County, New Mexico. Applicant in the above-styled cause seeks an order pooling all uncommitted interests in a standard 320-acre, more or less, horizontal well spacing unit in the Bone Spring formation comprised of the W2E2 of Sections 11 and 14, Township 17 South, Range 37 East, NMPM, Lea County, New Mexico. Said unit will be initially dedicated to the proposed Monika 133H well, to be horizontally drilled from a surface location in the SE4 of Section 14, with a first take point in the SW4SE4 (Unit O) of Section 14 and a last take point in the NW4NE4 (Unit B) of Section 11. 4. 24865 Application of MRC Permian Company for Compulsory Pooling, Lea County, New Mexico. Applicant in the above-styled cause seeks an order pooling all uncommitted interests in a standard 640-acre, more or less, horizontal well spacing unit in the Wolfcamp formation comprised of the E2 of Sections 11 and 14, Township 17 South, Range 37 East, NMPM, Lea County, New Mexico. Said unit will be initially dedicated to the proposed Monika 203H well, to be horizontally drilled from a surface location in the SE4 of Section 14, with a first take point in the SE4SE4 (Unit P) of Section 14 and a last take point in the NE4NE4 (Unit A) of Section 11. The location of the proposed well is expected to remain within 330 feet of the offsetting quarter-quarter sections or equivalent tracts to allow inclusion of this acreage in the proposed horizontal well spacing unit. Also, to be considered will be the cost of drilling and completing the well and the allocation of the cost thereof, actual operating costs and charges for supervision, designation of Matador Production Company as operator of the proposed spacing unit, and a 200% charge for risk involved in drilling the proposed well. The subject area is located approximately 5.5 miles west of Knowles, New Mexico.
5. 24943 Application of MRC Permian Company for compulsory pooling and approval of overlapping well units, Eddy County, New Mexico. Applicant seeks an order pooling all mineral interest owners in the Bone Spring formation underlying a horizontal spacing unit comprised of the E/2 of Section 28 Township 23 South, Range 29 East, NMPM. MRC seeks to initially dedicate the above-referenced horizontal spacing unit to the proposed Anderson Laing Fed. Well No. 129H, to be horizontally drilled from a surface location in the SE/4SE/4 (Unit P) of Section 28 to a bottom hole location in the SW/4SE/4 (Unit M) of Section 28. The well is a U-turn well; The E2/E/2 of the well will contain the south-north lateral, and the W/2E/2 will contain the north-south lateral. MRC also requests approval for the well unit requested herein to overlap the following wells: The Cypress 28 Federal #001H (30-015-37249), Cypress 28 Federal #002H (30-015-37331), Cypress 28 Federal #003H (30-015-38287, and Cypress 28 Federal #004H (30-015-39330). Also to be considered will be the cost of drilling, completing, testing and equipping the well and the allocation of the cost thereof, as well as actual operating costs and charges for supervision, designation of applicant as operator of the well, and a 200% charge for the risk involved in drilling, completing, testing and equipping the well. The unit is located approximately 2-1/2 miles east-northeast of Harroun, New Mexico.
6. 24947 Application of COG Operating LLC for Compulsory Pooling and Approval of Non-Standard, Overlapping Spacing Unit, Lea County, New Mexico. COG Operating LLC (“Applicant”) seeks an order: (1) establishing a 1,268.12-acre, more or less, non-standard, overlapping horizontal spacing unit comprised of all of irregular Sections 6 and 7, Township 24 South, Range 33 East, Lea County, New Mexico (“Unit”); and (2) pooling all uncommitted interests in the Bone Spring formation underlying the Unit. 7. 24948 Application of BTA Oil Producers, LLC to Extend Time to Commence Drilling Operations, Lea County, New Mexico. BTA Oil Producers, LLC (“Applicant”), requests a one-year extension of time to commence drilling two of the wells authorized by Order R-23119. Order No. R-23119: pooled all uncommitted interests within the Ojo Chiso; Bone Spring, South pool (Code 97293) underlying a 640-acre, more or less, standard horizontal spacing unit comprised of the S/2 of 3 and 4, Township 23 South, Range 34 East, Lea County, New Mexico (“Unit”); designated Applicant as operator of the Unit; and dedicated the Unit to the Bobwhite 22304 4-3 Fed Com #1H, Bobwhite 22304 4-3 Fed Com #2H, Bobwhite 22304 4-3 Fed Com #3H, Bobwhite 22304 4-3 Fed Com #4H, and Bobwhite 22304 4-3 Fed Com #5H wells (“Wells”). The Order requires Applicant to commence drilling the Wells within one year of the date of the Order. Applicant requests that the Division extend the deadline to commence drilling the Bobwhite 22304 4-3 Fed Com #4H and Bobwhite 22304 4-3 #5H wells until March 27, 2026, due to a limitation on sour gas takeaway. The Wells are located approximately 20 miles west-southwest of Eunice, New Mexico.
8. 24949 Application of COG Operating LLC for Compulsory Pooling and Approval of Non-Standard Spacing Unit, Lea County, New Mexico. 9. 24950 Application of Permian Resources Operating, LLC to Extend Time to Commence Drilling Operations, Eddy County, New Mexico. Permian Resources Operating, LLC (“Applicant”), requests a one-year extension of time to commence drilling the wells authorized by Order No. R-22959. Order No. R-22959: pooled all uncommitted interests within the Winchester; Wolfcamp (Gas) pool (Code 87760) underlying a 640-acre, more or less, standard horizontal spacing unit comprised of the S/2 of Sections 27 and 28, Township 19 South, Range 28 East, Eddy County, New Mexico (“Unit”); designated Applicant as operator of the Unit; and dedicated the Unit to the Big Burro 27 State Com #203H and Big Burro 27 State Com #204H wells (“Wells”). The Order requires Applicant to commence drilling the Wells within one year of the date of the Order. Applicant requests that the Division extend the deadline to commence drilling the Wells until November 15, 2025 due to the need to adjust rig scheduling to accommodate lease drilling obligations in this area. The Wells are located approximately 12 miles north of Carlsbad, New Mexico.
10. 24955 Application of Permian Resources Operating, LLC for Compulsory Pooling and Overlapping Spacing Unit, Lea County, New Mexico. Permian Resources Operating, LLC (“Applicant”) (OGRID No. 372165) applies for an order pooling uncommitted interests in the Bone Spring formation underlying a 480-acre, more or less, standard, overlapping horizontal spacing unit comprised of the W/2 W/2 of Sections 24, 25, and 36, Township 22 South, Range 34 East, Lea County, New Mexico (“Unit”). 12. 24957 Application of Permian Resources Operating, LLC for Compulsory Pooling, Eddy County, New Mexico. Applicant seeks an order pooling all uncommitted interests in the Bone Spring formation underlying an 800-acre, more or less, standard horizontal spacing unit comprised of the E/2 of Sections 9 and 16, and the NE/4 of Section 21, Township 19 South, Range 30 East, Eddy County, New Mexico (“Unit”). The Unit will be dedicated to the following wells (“Wells”): Star Fox 9 Fed Com 123H well, which will be drilled from a surface hole location in the SE/4 NW/4 (Unit F) of Section 21 to a bottom hole location in the NW/4 NE/4 (Unit B) of Section 9; and Star Fox 9 Fed Com 124H well, which will be drilled from a surface hole location in the SE/4 NW/4 (Unit F) of Section 21 to a bottom hole location in the NE/4 NE/4 (Unit A) of Section 9. 13. 24958 Application of Permian Resources Operating, LLC for Compulsory Pooling, Eddy County, New Mexico. Applicant seeks an order pooling all uncommitted interests in the Bone Spring formation, underlying an 800-acre, more or less, standard horizontal spacing unit comprised of the W/2 of Sections 9 and 16, and the NW/4 of Section 21, Township 19 South, Range 30 East, Eddy County, New Mexico (“Unit”). The Unit will be dedicated to the following wells (“Wells”): Star Fox 9 Fed Com 121H well, which will be drilled from a surface hole location in the SE/4 NW/4 (Unit F) of Section 21 to a bottom hole location in the NW/4 NW/4 (Unit D) of Section 9; and Star Fox 9 Fed Com 122H well, which will be drilled from a surface hole location in the SE/4 NW/4 (Unit F) of Section 21 to a bottom hole location in the NE/4 NW/4 (Unit C) of Section 9.

14. 24959 Application of Permian Resources Operating, LLC for Compulsory Pooling, Eddy County, New Mexico. Permian Resources Operating, LLC (“Applicant”) (OGRID No. 372165) applies for an order pooling all uncommitted interests from the top of the Bone Spring formation to the base of the Second Bone Spring interval underlying a 320-acre, more or less, standard horizontal spacing unit comprised of the N/2 N/2 of Sections 24 and 23, Township 20 South, Range 28 East, Eddy County, New Mexico (“Unit”). The Unit will be dedicated to the Bondi 24 Fed Com 121H well (“Well”), which will be drilled from a surface hole location in the NE/4 NE/4 (Unit A) of Section 24 to a bottom hole location in the NW/4 NW/4 (Unit D) of Section 23. The completed interval of the Well will be orthodox. Due to a depth severance in the Bone Spring Formation, Applicant seeks to pool uncommitted interests from the top of the Bone Spring formation to the base of the Second Bone Spring interval at a stratigraphic equivalent of approximately 7,624’ MD as observed on the Government AA #1 well log (API No. 30-015-21286). Also to be considered will be the cost of drilling and completing the Well and the allocation of the costs, the designation of Applicant as operator of the Well, and a 200% charge for the risk involved in drilling and completing the Well. The Well is located approximately 10.5 miles northeast of Carlsbad, New Mexico.

•    A 40-acre spacing unit comprised of the SW4NE4 of Section 32 dedicated to the Max State No. 1 (30-025-26754); and
•    A 40-acre spacing unit comprised of the SE4NE4 of Section 32 dedicated to the Hulkster No. 5 (30-025-39572).
Also to be considered will be the cost of drilling and completing said wells, the allocation of these costs as well as the actual operating costs and charges for supervision, designation of Avant Operating, LLC as operator of the wells, and a 200% charge for risk involved in drilling said wells. Said area is located approximately 10 miles south of Maljamar, New Mexico.
49. 24946 Application of Avant Operating, LLC for approval of a non-standard unit, compulsory pooling, and, to the extent necessary, approval of an overlapping spacing unit, Lea County, New Mexico. Applicant seeks an order from the Division (a) approving a non-standard 640-acre spacing unit; (b) pooling all uncommitted interests within a 640-acre, more or less, Bone Spring horizontal spacing unit comprised of the S/2 of Sections 32 and 33, Township 18 South, Range 32 East, N.M.P.M., Lea County, New Mexico in the LUSK;BONE SPRING, NORTH (41450) pool; and (c) to the extent necessary, approving an overlapping spacing unit. This spacing unit will be dedicated to the Lobo Loco 34 Fed Com 304H, Lobo Loco 34 Fed Com 305H, Lobo Loco 34 Fed Com 504H and Lobo Loco 34 Fed Com 604H wells with proposed surface hole locations in the SE/4 SW/4 (Unit N) of Section 34 and proposed bottom hole locations in the NW/4 SW/4 (Unit L) of Section 32; and the Lobo Loco 34 Fed Com 306H, Lobo Loco 34 Fed Com 505H, Lobo Loco 34 Fed Com 506H, Lobo Loco 34 Fed Com 605H, and Lobo Loco 34 Fed Com 606H wells with proposed surface hole locations in the SE/4 SW/4 (Unit N) of Section 34 and proposed bottom hole locations in the SW/4 SW/4 (Unit M) of Section 32. The wells will be drilled at orthodox locations. This proposed spacing unit will overlap the following existing spacing units:
•    A 40-acre spacing unit comprised of the NW/4 SW/4 of Section 32 dedicated to OXY USA Inc’s North Lusk 32 State #001 (30-025-35748);
•    A 40-acre spacing unit comprised of the SW/4 SW/4 of Section 32 dedicated to OXY USA Inc’s North Lusk 32 State #005 (30-025-36982);
•    A 40-acre spacing unit comprised of the NE/4 SW/4 of Section 32 dedicated to OXY USA Inc’s North Lusk 32 State #003 (30-025-36953);
•    An 80-acre spacing unit comprised of the SE/4 SW/4 and the SW/4 SE/4 of Section 32 dedicated to COG Operating LLC’s Lear State #002H (30-025-38866);
•    An 80-acre spacing unit comprised of the E/2 SE/4 of Section 32 dedicated to COG Operating LLC’s Lear State #001H (30-025-38865);

50. 24928 Application of Devon Energy Production Company, L.P. to Amend Order R-23414 to Pool an Overlapping Horizontal Gas Spacing Unit Rather Than an Oil Spacing Unit, Eddy County, New Mexico. Applicant in the above-styled cause seeks to amend Order R-23414 to pool an 800-acre overlapping horizontal gas spacing unit rather than a horizontal oil spacing unit in an interval of the Bone Spring formation underlying the S2 of Section 9, the S2 of Section 10, and the SW4 of Section 11, Township 21 South, Range 27 East, NMPM, Eddy County, New Mexico. Order R-23414, issued in Case 24428, pooled an overlapping horizontal oil spacing unit in an interval of the Bone Spring formation underlying the S2S2 of Section 9, the S2S2 of Section 10, and the S2SW4 of Section 11, Township 21 South, Range 27 East, NMPM, Eddy County, New Mexico. This oil spacing unit is currently dedicated to the proposed Bent Tree 9-11 State Com 224H, to be horizontally drilled from a surface location in the SW4 of Section 9, with a first take point in the SW4SW4 (Unit M) of Section 9 and a last take point in SE4SW4 (Unit N) of Section 11. Devon seeks to amend the pooling order to accommodate the placement of the well in a gas pool rather than the anticipated oil pool. This proposed 800-acre gas spacing unit will overlap the 800-acre spacing unit approved under Order R-23415 for the Bent Tree 9-11 State 337H and 338H wells to be drilled in a deeper interval of the Bone Spring formation. Said area is located approximately 5 miles northeast of Carlsbad, New Mexico.
