PRELIMINARY DOCKET: Examiner Hearing for Thursday, January 18, 2024

Applications for hearing shall be filed at least thirty (30) days in advance of the hearing date. A party who intends to present evidence shall file a pre-hearing statement no later than the close of business on the Thursday prior to the hearing date and serve a copy on the other parties, if any. The hearing examiner will dismiss the application if the applicant does not file and serve a pre-hearing statement as specified above. o    Evil Olive 26 35 Fed Com 4H, to be drilled from a surface location in the NE/4 SE/4 (Unit I) of Section 26 to a bottomhole location in the SE/4 SE/4 (Unit P) of Section 35; and

o    Evil Olive 26 35 Fed Com 71H, to be drilled from a surface location in the NE/4 SW/4 (Unit K) of Section 26 to a bottomhole location in the SW/4 SW/4 (Unit M) of Section 35.

This 960-acre non-standard horizontal well spacing unit will overlap an existing 240-acre standard horizontal well spacing unit comprised of the E/2 SE/4 of Section 26 and the E/2 E/2 of Section 35, Township 22 South, Range 31 East, NMPM, Eddy County, New Mexico, which is operated by COG Operating LLC and dedicated to the Tankless Federal Com #2H well (API: 30-015-44434) within the Livingston Ridge; Bone Spring (Pool Code 39350). Also, to be considered will be the cost of drilling and completing the wells and the allocation of the costs thereof, operating costs and charges for supervision, the designation of applicant as operator, and a 200% charge for risk involved in drilling and completing the wells. Said area is approximately 20 miles northeast of Loving, New Mexico.
2. 23918 Application of OXY USA Inc. for Approval of a 960-Acre Non-Standard Horizontal Well Spacing Unit and Compulsory Pooling, Eddy County, New Mexico. Applicant seeks an order (a) approving an overlapping 960-acre, more or less, non-standard horizontal well spacing unit in the Wolfcamp formation underlying Section 35 and the S/2 Section 26, Township 22 South, Range 31 East, NMPM, Eddy County, New Mexico, and (b) pooling all uncommitted mineral owners in this acreage. 3. 24065 Application of Spur Energy Partners LLC for Compulsory Pooling, Eddy County, New Mexico. Spur Energy Partners LLC seeks an order pooling all uncommitted interests in the Yeso formation underlying a 200-acre, more or less, standard horizontal spacing unit comprised of the NE/4 SE/4 of Section 29 and the N/2 S/2 of Section 28, Township 18 South, Range 26 East, Eddy County, New Mexico (“Unit”). Applicant seeks to dedicate the Unit to the Radiohead 29-28 Fee 10H and Radiohead 29-28 Fee 60H wells (“Wells”), which will be drilled from surface hole locations in the NW/4 SE/4 (Unit J) of Section 29 to bottom hole locations in the NE/4 SE/4 (Unit I) of Section 28. The completed intervals of the Wells will be orthodox. Also to be considered will be the cost of drilling and completing the Wells and the allocation of the costs, the designation of Applicant as the operator of the Wells, and a 200% charge for the risk involved in drilling and completing the Wells. The Wells are located approximately 8.69 miles South and .10 miles West of Artesia, NM.
4. 23985 Application of Colgate Production, LLC for Compulsory Pooling and Approval of Non-Standard Spacing Unit, Eddy County, New Mexico. Applicant applies for an order pooling all uncommitted interests in the Bone Spring formation underlying a 798.54-acre, more or less, non-standard horizontal spacing unit comprised of the N/2 of irregular Sections 3 and 4, and NE/4 of irregular Section 5, Township 20, Range 30 East, Eddy County, New Mexico (“Unit”). The Unit will be dedicated to the following wells (“Wells”): Michelada 5 Fed Com 121H and Michelada 5 Fed Com 131H, which will be drilled from surface hole locations in Lot 3 (NE/4 NW/4 equivalent) of Section 5 to bottom hole locations in the NE/4 NE/4 (Unit A) of Section 3; and Michelada 5 Fed Com 122H and Michelada 5 Fed Com 132H, which will be drilled from surface hole locations in Lot 3 (NE/4 NW/4 equivalent) of Section 5 to bottom hole locations in the SE/4 NE/4 (Unit H) of Section 3. The completed interval of the Wells will be orthodox. Also to be considered will be the cost of drilling and completing the Wells and the allocation of the costs, the designation of Permian Resources Operating LLC as operator of the Wells, and a 200% charge for the risk involved in drilling and completing the Wells. Applicant also requests approval of a non-standard spacing unit. The Wells are located approximately 21 miles northeast of Carlsbad, New Mexico.
5. 24039 Application of Mewbourne Oil Company for compulsory pooling, Eddy County, New Mexico. Mewbourne Oil Company seeks an order pooling all uncommitted mineral interest owners in the Bone Spring formation underlying a horizontal spacing unit comprised of the S/2S/2 of Section 12, Township 21 South, Range 25 East, N.M.P.M., and the S/2S/2 of Section 7 and the SW/4SW/4 of Section 8, Township 21 South, Range 26 East, N.M.P.M., Eddy County, New Mexico. The unit will be dedicated to the Stage Fright 12/8 Fed. Com. Well No. 618H, with a first take point in the SW/4SW/4 of Section 12 and a last take point in the SW/4SW/4 of Section 8. Also to be considered will be the cost of drilling, completing, testing, and equipping the well and the allocation of the cost thereof, as well as actual operating costs and charges for supervision, designation of applicant as operator of the well, and a 200% charge for the risk involved in drilling, completing, testing, and equipping the well. The unit is located approximately 9 miles southeast of Seven Rivers, New Mexico.
6. 24058 Application of Cimarex Energy Co. to Amend Order No. R-22421, Eddy County, New Mexico. Cimarex Energy Co. seeks an order amending Order No. R-22421, entered on December 5, 2022, to extend the well commencement deadline one year, to December 5, 2024. Order No. R-22421 pooled uncommitted mineral interest owners in the Wolfcamp formation underlying a horizontal spacing unit comprised of the W/2 of Section 29 and the W/2 of Section 32, Township 25 South, Range 27 East, N.M.P.M., Eddy County, New Mexico, for the purpose of drilling the Southern Hills 32-29 State Fed. Com. Well No. 3H. Order No. R-22421 requires the commencement of drilling within one year of the date of the order unless the operator obtains an extension by amending the order for good cause shown. The unit is located approximately 7-1/2 miles south-southeast of Black River Village, New Mexico.
7. 24059 Application of COG Operating LLC for Compulsory Pooling and Approval of Non-Standard Spacing Unit, Lea County, New Mexico. Applicant applies for an order: (1) establishing a 1280-acre, more or less, non-standard horizontal spacing unit comprised of Sections 28 and 33, Township 25 South, Range 35 East, Lea County, New Mexico (“Unit”); and (2) pooling all uncommitted interests in the Wolfcamp formation underlying the Unit. The completed interval of the Well will be orthodox. Also to be considered will be the cost of drilling and completing the Well and the allocation of the costs, the designation of Applicant as the operator of the Well, and a 200% charge for the risk involved in drilling and completing the Well. The Well is located approximately 9.5 miles west of Jal, New Mexico.
10. 24062 Application of SPC Resources, LLC to Amend Order No. R-21096, As Amended, Eddy County, New Mexico. Applicant in the above-styled cause seeks to amend Order No. R-21096, as amended, to allow for a one-year extension of time to drill an initial a well under the Order until February 17, 2025. The Unit is comprised of the W/2 and E/2 of Section 12, Township 22 South, Range 26 East, and the W/2 and E/2 of Section 7, Township 22 South, Range 27 East, NMPM, Eddy County, New Mexico. Order No. R-21096 pooled the uncommitted interests in the Wolfcamp formation (Purple Sage; Wolfcamp Pool (Pool Code 98220)). The Unit is dedicated to the Caveman #402H well (API No. 30-015-53285), and the Caveman #442H well (API 30-015-53280). Portions of said area are located within the city limits of Carlsbad, New Mexico.
11. 24063 Application of Strata Production Co. to Extend the Drilling Deadline Under Order No. R-22417, Eddy County, New Mexico. Applicant in the above-styled cause seeks to amend Order No. 22417 to extend by one year, through December 5, 2024, the time to commence drilling the Pajarito Fed Com 31 19 AAL #4H well, proposed to be drilled into the Delaware formation (Forty Niner Ridge; Delaware [24750]) in a standard 320-acre, more or less, horizontal spacing and proration unit (“HSU”) comprised of the NE/4 NE/4 of Section 31, the E/2 E/2 of Section 30, and the E/2 SE/4 and SE/4 NE/4 of Section 19, Township 23 South, Range 31 East in Eddy County, New Mexico. The well and lands are located approximately 16 miles East of Loving, New Mexico.
12. 24077 Application of Riley Permian Operating Company, LLC for a Horizontal Spacing Unit and Compulsory Pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order from the Division: (1) creating a standard 320-acre, more or less, spacing and proration unit comprised of the S/2N/2 and N/2S/2 of Section 9, Township 18 South, Range 27 East, N.M.P.M, Eddy County, New Mexico, and (2) pooling all uncommitted mineral interests in the Yeso formation, designated as an oil pool, underlying said unit. The proposed wells to be dedicated to the horizontal spacing unit are the Hawk 9 Federal Com 3H Well and Hawk 9 Federal Com 4H Well, which are oil wells that will be horizontally drilled from a surface location in the SW¼NW¼ of Section 10 with a bottom hole location in the Yeso Formation in the NW¼SW¼ of Section 9, and the Hawk 9 Federal Com 5H Well, Hawk 9 Federal Com 7H Well, and Hawk 9 Federal Com 8H Well, which are oil wells that will be horizontally drilled from a surface location in the SW¼NW¼ of Section 10 to a bottom hole location in the Yeso Formation in the SW¼NW¼ of Section 9. The wells are orthodox in location and the take points and laterals comply with Statewide Rules for setbacks; also to be considered will be the cost of drilling and completing the wells and the allocation of the costs thereof; actual operating costs and charges for supervision; the designation of the Applicant as Operator of the wells and unit; and a 200% charge for the risk involved in drilling and completing the wells. The wells and lands are located approximately 10 miles from Artesia, New Mexico.
13. 24103 Application of Franklin Mountain Energy 3, LLC for compulsory pooling, Lea County, New Mexico. Applicant seeks an order from the Division pooling all uncommitted mineral interests within a 319.68-acre, more or less, Wolfcamp horizontal spacing unit comprising the E/2 E/2 of Section 33, Township 18 South, Range 35 East, and Lot 1, the SE/4 NE/4 and E/2 SE/4 of Section 4 (E/2 E/2 equivalent), Township 19 South, Range 35 East, N.M.P.M., Lea County, New Mexico. This spacing unit will be dedicated to the Alpha State Com 704H and Alpha State Com 804H wells, to be horizontally drilled. The producing area for the wells are expected to be orthodox. Also to be considered will be the cost of drilling and completing said wells, the allocation of these costs as well as the actual operating costs and charges for supervision, designation of Franklin Mountain Energy 3, LLC as operator of the wells, and a 200% charge for risk involved in drilling said wells. 14. 24104 Application of Franklin Mountain Energy 3, LLC for compulsory pooling and, to the extent necessary, approval of an overlapping spacing unit, Lea County, New Mexico. Applicant seeks an order from the Division pooling all uncommitted mineral interests within a 319.70-acre, more or less, Bone Spring horizontal spacing unit comprising the E/2 W/2 of Section 33, Township 18 South, Range 35 East, and Lot 3, the SE/4 NW/4 and E/2 SW/4 of Section 4 (E/2 W/2 equivalent), Township 19 South, Range 35 East, N.M.P.M., Lea County, New Mexico. Franklin also seeks, to the extent necessary, approval of an overlapping spacing unit. •    A 320-acre horizontal spacing comprised of the SW/SW of Section 4 dedicated to Franklin Mountain’s Cable 19 35 9 State Com #001H well (API 30-025-46140).
Also to be considered will be the cost of drilling and completing said wells, the allocation of these costs as well as the actual operating costs and charges for supervision, designation of Franklin Mountain Energy 3, LLC as operator of the wells, and a 200% charge for risk involved in drilling said wells. Said area is located approximately 16 miles west of Hobbs, New Mexico.
20. 22917 Application of Matador Production Company for Approval of an Overlapping Horizontal Well Spacing Unit and Compulsory Pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order (a) approving a 780.68 acre, more or less, overlapping horizontal well spacing unit in the Wolfcamp formation comprised of S/2 of Sections 1 and 2, Township 21 South, Range 28 East, and Lots 17-18, NE/4 SW/4 and SE/4 SW/4 of Section 6, Township 21 South, Range 29 East, NMPM, Eddy County, New Mexico, and (b) pooling all uncommitted mineral interests in this overlapping horizontal well spacing unit. The above-referenced unit will be dedicated to the to the proposed Simon Camamile 0206 Fed Com #226H to be drilled from a surface location within the SW/4 SW/4 of Section 2, T-21-S, R-28-E to a bottom hole location within NE/4 SW/4 of Section 6, T-21-S, R-29-E. This 780.68-acre horizontal well spacing unit will overlap the following proposed horizontal well spacing units covering portions of the subject acreage:
o    A 390.36-acre, more or less, horizontal well spacing unit comprised of the N/2 SW/4 and N/2 SE/4 of Sections 1 and 2, T-21-S, R-28-E, and Lot 17 and NE/4 SW/4 of Section 6, T-21-S, R-29-E to be dedicated to the proposed Simon Camamile 0206 Fed Com #205H well, and
o    A 390.32-acre, more or less, horizontal well spacing unit comprised of the S/2 SW/4 and S/2 SE/4 of Sections 1 and 2, T-21-S, R-28-E, and Lot 18 and SE/4 SW/4 of Section 6, T-21-S, R-29-E to be dedicated to the proposed Simon Camamile 0206 Fed Com #206H well.
