PRELIMINARY DOCKET: Examiner Hearing for August 22, 2024

Applications for hearing shall be filed at least thirty (30) days in advance of the hearing date. A party who intends to present evidence shall file a pre-hearing statement no later than the close of business on the Thursday prior to the hearing date and serve a copy on the other parties, if any. The hearing examiner will dismiss the application if the applicant does not file and serve a pre-hearing statement as specified above. A party desiring to use projection equipment at the hearing shall contact Florene Davidson, OCD Clerk, no later than seven (7) business days prior to the hearing.

(“Applicant”) seeks an order pooling all uncommitted interests in the Bone Spring formation underlying a 640-acre, more or less, standard horizontal spacing unit comprised of the W/2 of Sections 10 and 15, Township 18 South, Range 33 East, Lea County, New Mexico (“Unit”). Applicant seeks to dedicate the Unit to the following proposed wells (“Wells”): Smithers 10-15 Fed Com 101H Well, to be drilled from a surface hole location in the SE/4 SW/4 (Unit N) of Section 15 to a bottom hole location in the NW/4 NW/4 (Unit D) of Section 10; and the Smithers 10-15 Fed Com 102H, 103H, 201H, and 203H Wells, to be drilled from a surface hole location in the SE/4 SW/4 (Unit N) of Section 15 to a bottom hole location in the NE/4 NW/4 (Unit C) of Section 10. The completed interval of the Smithers 10-15 Fed Com 102H Well will be located within 330’of the quarter-quarter section line separating the W/2 W/2 and E/2 W/2 of Sections 10 and 15 to allow for the creation of a 640-acre standard horizontal spacing unit. The completed intervals of the Wells will be orthodox. Also to be considered will be the cost of drilling and completing the Wells and the allocation of the cost, the designation of Applicant as the operator of the Wells, and a 200% charge for the risk involved in drilling and completing the Wells. The Wells are located approximately 10 miles southeast of Maljamar, New Mexico.
2. 24679 Application of Tap Rock Operating, LLC for Compulsory Pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order pooling a standard 1920 acre, more or less, horizontal well spacing unit in the Wolfcamp formation comprised of all of Section 35, Township 24 South, Range 25 East, Section 36 in Township 24 South, Range 25 East, and Section 31 in Township 24 South Range 26 East, NMPM, Eddy County, New Mexico. Said unit will be initially dedicated to the proposed Shiner Rock Fed Com 202H, Shiner Rock Fed Com 204H, Shiner Rock Fed Com 211H, and Shiner Rock Fed Com 213H wells to be horizontally drilled as follows:
•    Shiner Rock Fed Com 202H, which will be drilled from a surface hole location 1168 Feet from the North Line of Section 31 and 1012 Feet from the East Line of Section 31 (Unit A) to a bottom hole located 5 Feet from the West Line in Section 35 and 1510 Feet from the North Line in Section 35 (Unit E).
•    Shiner Rock Fed Com 204H, which will be drilled from a surface hole location 1617 Feet from the South Line of Section 31 and 959 Feet from the East Line of Section 31 (Unit I) to a bottom hole located 5 Feet from the West Line in Section 35 and 660 Feet from the North Line in Section 35 (Unit M).
•    Shiner Rock Fed Com 211H, which will be drilled from a surface hole location 1162 Feet from the North Line of Section 31 and 1041 Feet from the East Line of Section 31 (Unit A) to a bottom hole located 5 Feet from the West Line in Section 35 and 381 Feet from the North Line in Section 35 (Unit D).
•    Shiner Rock Fed Com 213H, which will be drilled from a surface hole location 1617 Feet from the South Line of Section 31 and 989 Feet from the East Line of Section 31 (Unit I) to a bottom hole located 5 Feet from the West Line in Section 35 and 2360 Feet from the North Line in Section 35 (Unit L).

Also, to be considered will be the cost of drilling and completing the wells and the allocation of the cost thereof, actual operating costs and charges for supervision, designation of Tap Rock Operating, LLC as operator of the wells, and a 200% charge for risk involved in drilling said wells. The subject area is located approximately 3 miles east of Whites City, New Mexico.
3. 24680 Application of Tap Rock Operating, LLC for Compulsory Pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order pooling a standard 480 acre, more or less, horizontal well spacing unit in the Bone Spring formation comprised of N2/S/2 of Section 35, Township 24 South, Range 25 East, the N2/S2 of Section 36 in Township 24 South, Range 25 East, and the N/2 S/2 of Section 31 in Township 24 South Range 26 East, NMPM, Eddy County, New Mexico. 4. 24681 Application of Tap Rock Operating, LLC for Compulsory Pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order pooling a standard 480 acre, more or less, horizontal well spacing unit in the Bone Spring formation comprised of S2/S/2 of Section 35, Township 24 South, Range 25 East, the S2/S2 of Section 36 in Township 24 South, Range 25 East, and the S/2 S/2 of Section 31 in Township 24 South Range 26 East, NMPM, Eddy County, New Mexico. Said unit will be initially dedicated to the proposed Shiner Rock Fed Com 154H well to be horizontally drilled from a surface location in the NE/4SE/4 (Unit I) of Section 31, with first take points in SE/4SE/4 (Unit P) of Section 31 and last take points in the SW/4SW/4 (Unit M) of Section 35. Also, to be considered will be the cost of drilling and completing the well and the allocation of the cost thereof, actual operating costs and charges for supervision, designation of Tap Rock Operating, LLC as operator of the well, and a 200% charge for risk involved in drilling said well. The subject area is located approximately 3 miles east of Whites City, New Mexico.
5. 24721 Application of Cimarex Energy Co. for the Creation of a Special Pool, a Wolfbone Pool, Pursuant to Order No. R-23132, to Reopen Case Nos. 22853 and 23295 and to Approve a Pooling Application for the Wolfbone Pool, Lea County, New Mexico. Applicant in the above- styled cause seeks an order from the Division creating a special pool, the proposed Quail Ridge; Wolfbone Pool (or pool name for the Wolfbone to be designated by the Division), pursuant to Order No. R-23132, within the W/2 W/2 of Sections 12 and 13, in Township 19 South, Range 34 East, NMPM, Lea County, New Mexico (“Subject Lands”). Applicant proposes that Division’s statewide rules apply to spacing units and well locations within the Quail Ridge; Wolfbone Pool. The vertical extent of the proposed Wolfbone Pool will be the stratigraphic equivalent of the top of the Third Bone Spring, as the upper limit, located at approximately 10,620 feet measured depth, to the stratigraphic equivalent of the base of the Wolfcamp A shale, being the lower limit, located at approximately 11,225 feet measured depth, as found in the triple combo well log for the Quail Ridge 32 State 2 well (API No. 30-025-37703). Applicant will seek an order from the Division for the vertical extent by requesting the contraction of two pools, the Scharb; Bone Spring (Code 55610), as referenced in Cimarex’s Exhibits for the Bone Spring, and the WC-025 G-09S203435D; Wolfcamp (Code 92847), as referenced in Pride’s Exhibits for the Upper Wolfcamp, in a manner that avoids overlap with the proposed Quail Ridge; Wolfbone Pool. The base of the Scharb; Bone Spring (Code 55610) is to be contracted to approximately 10,620 feet, a depth equivalent to the top of the Third Bone Spring, and the top of the WC-025 G-09S203435D; Wolfcamp (Code 92847) is to be contracted to approximately 11,225 feet, the depth of the base of the Wolfcamp A Shale, as found in said triple combo well log of the Quail Ridge 32 State 2 Well (API No. 30-025-37703). To the extent necessary, Cimarex will request authorization for surface commingling. Also to be considered will be the re-opening of Case Nos. 22853 and 23295, for the purpose of continuing the Division’s review of pooling applications filed in said Cases in order to determine operatorship of units and wells proposed by the pooling applications, including Applicant’s pooling application for the Wolfbone Pool underlying the Subject Lands, in which Applicant seeks an order from the Division pooling all mineral interests in the Wolfbone Pool, consisting of the Third Bone Spring and Upper Wolfcamp formations, underlying a standard 320-acre, more or less, horizontal spacing and proration unit comprised of the Subject Lands. The proposed well to be dedicated to the horizontal spacing unit is the Showbiz 13-12 State Com 301H Well, an oil well, to be horizontally drilled from a surface location in the SW/4 SW/4 (Unit M) of Section 13 to a bottom hole location in the NW/4 NW/4 (Unit D) of Section 12. The well will be orthodox, and the take points and completed interval will comply with the setback requirements under the statewide Rules; also to be considered will be the cost of drilling and completing the well and the allocation of the costs thereof; actual operating costs and charges for supervision; the designation of the Applicant as Operator of the wells and unit; and a 200% charge for the risk involved in drilling and completing the well. The Subject Lands are located approximately 20 miles of Southwest of Lovington, New Mexico.
6. 24736 Application of Pride Energy Company for creation of a special Wolfbone oil pool in parts of Sections 12 and 13, Township 19 South, Range 34 East, N.M.P.M., Lea County, New Mexico. Pride Energy Company seeks an order pursuant to Order No. R-23132, creating the proposed Quail Ridge; Wolfbone, Northeast Pool, covering the stratigraphic equivalent of the top of the Third Bone Spring Sand, located at approximately 10,775 feet measured depth, to the stratigraphic equivalent of the base of the Wolfcamp A shale, located at approximately 11,306 measured depth, as found in the compensated neutron density log of the Super Cobra State Com. Well No. 1H (API No. 30-025-41987), which is located in the same section as a portion of the proposed pool (Section 13, Township 19 South, Range 34 East, N.M.P.M.). Concurrently, the order would contract the vertical extent of the Scharb; Bone Spring Pool (Code 55610) and the WC-025 G-09S203435D; Wolfcamp Pool (Code 92847), in a manner that avoids overlap with the proposed Quail Ridge; Wolfbone, Northeast Pool. The proposed pool would (a) initially cover the W/2W/2 of Section 12 and the W/2W/2 of Section 13, Township 19 South, Range 34 East, NMPM, and (b) treat hydrocarbons as being produced equally from the Third Bone Spring Sand and the Wolfcamp A zone, on an acreage basis and the thicknesses of Third Bone Spring Sand and the Wolfcamp A. The proposed pool is located approximately 15-1/2 miles north-northeast of Halfway, New Mexico.
7. 24279 Application of Riley Permian Operating Company LLC for approval of a salt water disposal well in Eddy County, New Mexico; Applicant seeks an order for a salt water disposal well for its Angel Ranch SWD#1, (Pool Code 96099) to be drilled at a location 1,320' FNL and 1,320' FEL, Unit A, Section 12, Township 19 South, Range 27 East, N.M.P.M., Eddy County, New Mexico for injection into the Cisco formations at depths between 8,586' through 9,210' open hole. The well will be located approximately 18 miles north of Carlsbad, New Mexico.

Applicant in the above-styled cause seeks an order (a) approving a standard 320-acre, more or less, overlapping horizontal well spacing unit in the Bone Spring formation comprised of the W2W2 of Section 34, Township 18 South, Range 34 East and the W2W2 of Section 3, Township 19, South, Range 34 East, NMPM, Lea County, New Mexico, and (b) pooling all uncommitted mineral interests in this horizontal well spacing unit. Said unit will be initially dedicated to the proposed Art Smith State Com 111H and Art Smith State Com 121H wells to be horizontally drilled from a surface location in the NW4 of Section 34, with first take points in the NW4NW4 (Unit D) of Section 34 and last take points in the SW4SW4 (Unit M) of Section 3. This proposed horizontal well spacing unit will overlap the following existing or proposed horizonal well spacing units in the Bone Spring formation:
•    A 160-acre horizontal well spacing unit comprised of the W2W2 of Section 3 currently dedicated to the Tres Primos 3 State 2H (30-025-42129) operated by COG Operating LLC and assigned to the Scharb: Bone Spring Pool (55610).
•    A 160-acre horizontal well spacing unit comprised of the W2W2 of Section 34 proposed by MRC for the Art Smith State Com 131H well to be drilled in a different interval of the Bone Spring formation.
Also, to be considered will be the cost of drilling and completing the wells and the allocation of the cost thereof, actual operating costs and charges for supervision, designation of Matador Production Company as operator of the wells, and a 200% charge for risk involved in drilling said wells. The subject area is located approximately 22 miles west of Hobbs, New Mexico.
10. 24288 Application of MRC Permian Company for Approval of an Overlapping Horizontal Well Spacing Unit and Compulsory Pooling, Lea County, New Mexico. Applicant in the above-styled cause seeks an order (a) approving a standard 320-acre, more or less, overlapping horizontal well spacing unit in the Bone Spring formation comprised of the E2W2 of Section 34, Township 18 South, Range 34 East and the E2W2 of Section 3, Township 19, South, Range 34 East, NMPM, Lea County, New Mexico, and (b) pooling all uncommitted mineral interests in this horizontal well spacing unit. Applicant in the above-styled cause seeks an order pooling a standard 320-acre, more or less, horizontal well spacing unit in the Bone Spring formation comprised of the W2E2 of Section 34, Township 18 South, Range 34 East and the W2E2 of Section 3, Township 19, South, Range 34 East, NMPM, Lea County, New Mexico. •    A 160-acre horizontal well spacing unit comprised of the E2E2 of Section 34 proposed by MRC for the Art Smith State Com 134H well to be drilled in a different interval of the Bone Spring formation.
Also, to be considered will be the cost of drilling and completing the wells and the allocation of the cost thereof, actual operating costs and charges for supervision, designation of Matador Production Company as operator of the wells, and a 200% charge for risk involved in drilling said wells. Applicant in the above-styled cause seeks an order (a) approving a standard 160-acre, more or less, overlapping horizontal well spacing unit in the Bone Spring formation comprised of the W2W2 of Section 34, Township 18 South, Range 34 East and, NMPM, Lea County, New Mexico, and (b) pooling all uncommitted mineral interests in this horizontal well spacing unit. Said unit will be initially dedicated to the proposed Art Smith State Com 131H well to be horizontally drilled from a surface location in the NW4 of Section 34, with a first take point in the NW4NW4 (Unit D) and a last take point in the SW4SW4 (Unit M) of Section 34.
