PRELIMINARY DOCKET: Examiner Hearing for December 4, 2025

For hearings by affidavit: presenting parties are required to submit a pre-hearing statement no later than the Thursday before the hearing. The pre-hearing statement shall include: 1) a list of disputed facts and issues; 2) identification of witnesses and their qualifications; and 3) all exhibits and written testimony a party intends to enter into evidence at the hearing and a full narrative for each.

For contested matters: pre-hearing statements shall be filed no later than 9:00 a.m., 4 business days prior to the hearing and in addition to the requirements of 19.15.4.13.B(1) NMAC, shall include: all evidentiary exhibits, documents, affidavits, and full-written testimony of any witness a party offers at the hearing. Exhibits must be sequentially marked on every page.

Failure to timely file a complete pre-hearing statement may cause the Hearing Examiner to continue the hearing and/or impose sanctions up to and including the exclusion of late-filed evidence. Evidentiary objections must be filed no later than 48 hours before the hearing. Rulings on the objections will be addressed as a preliminary matter when the case is called.

Applicant seeks an order from the Division pooling all uncommitted interests within a 320-acre, more or less, Wolfcamp horizontal spacing unit comprised of the E/2 of Section 8, Township 26 South, Range 33 East, NMPM, Lea County, New Mexico. This spacing unit will be dedicated to the following wells: Fat Chicken 8 Fed Com 701H, Fat Chicken 8 Fed Com 751H, and Fat Chicken 8 Fed Com 801H wells with proposed first take points in the SW/4SE/4 (Unit O) of Section 8 and proposed last take points in the NW/4NE/4 (Unit B) of Section 8; and Fat Chicken 8 Fed Com 702H, Fat Chicken 8 Fed Com 703H, Fat Chicken 8 Fed Com 752H, and Fat Chicken 8 Fed Com 802H wells with proposed first take points in the SE/4SE/4 (Unit P) of Section 8 and proposed last take points in the NE/4NE/4 (Unit A) of Section 8. The producing area for the wells is expected to be orthodox. The completed interval for the Fat Chicken 8 Fed Com 702H well is expected to be less than 330 feet from the adjoining tracts thereby allowing for the inclusion of the proximity tracts within the proposed spacing unit. Also to be considered will be the cost of drilling, completing, and equipping said wells, the allocation of these costs as well as the actual operating costs and charges for supervision while drilling and after completion, designation of as Paloma Permian AssetCo, LLC as operator of the wells, and a 200% charge for risk involved in drilling said wells. Said area is located approximately 24 miles southwest of Jal, New Mexico.
2. 25655 AMENDED Application of XTO Energy, Inc., for Approval of a Standard Horizontal Spacing Unit and Compulsory Pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order from the Division: (1) approving a 768.88-acre, more or less, standard horizontal well spacing unit (the “Unit” or “HSU”) comprised of the W/2 of Sections 20, 29, and 32, Township 26 South, Range 30 East, N.M.P.M., Eddy County, New Mexico (the “Application Lands”), and (2) pooling all uncommitted interests in the Wildcat G-03 S263016K; Bone Spring formation [Pool No. 97863], designated as an oil pool, underlying said HSU. The proposed wells to be dedicated to the horizontal spacing unit are the: Blanche 20 Fed Com 319H (API No. 30-015-Pending), which is an oil well that will be horizontally drilled from a surface location in the NE/4 NW/4 (Unit D) of Section 20, Township 26 South, Range 30 East, to a bottom hole location in the Bone Spring formation located in Lot 3 of Section 32, Township 26 South, Range 30 East, and the Blanche 20 Fed Com 321H (API No. 30-015-Pending), which is an oil well that will be horizontally drilled from a surface location in the NE/4 NW/4 (Unit D) of Section 20, Township 26 South, Range 30 East, to a bottom hole location in the Bone Spring formation located in Lot 3 of Section 32, Township 26 South, Range 30 East. The wells and lands are located approximately 18.4 miles southeast of Malaga, New Mexico.
3. 25679 Application of Enterprise Delaware Basin Treating LLC for Authorization to Inject, Lea County, New Mexico. Enterprise Delaware Basin Treating LLC (“Enterprise”) (OGRID No. 330718) seeks authorization to drill, complete, and operate an additional redundant acid gas injection (“AGI”) well at its Dark Horse Treating Facility. Enterprise proposes to inject treated acid gas (“TAG”) into the proposed Independence AGI #3 well (“Well”), which will be located in Section 20, Township 25 South, Range 36 East, in Lea County, New Mexico. The Well will be a deviated injection well and will be directionally drilled from a surface location approximately 529’ FNL and 1434’ FWL (Unit C) in Section 20, Township 25 South, Range 36 East, to a bottom hole location approximately 2064’ FSL and 60’ FWL (Unit L) in Section 17, Township 25 South, Range 36 East. The Well will inject TAG into the Siluro-Devonian formations, including the Devonian, Wristen, and Fusselman formations, at depths of approximately 16,056’ to 17,730’ TVD. Enterprise is requesting a combined allowable maximum daily injection rate of 45 million cubic feet per day (MMcf/D) to be shared between the proposed Well and the existing Independence AGI #1 and #2 wells. The Well’s maximum surface injection pressure will be approximately 4,929 pounds per square inch gauge. The Well is located approximately 6 miles west of Jal, New Mexico.
4. 25680 Application of Civitas Permian Operating, LLC (Operator No. 332195) for Compulsory Pooling, Lea County, New Mexico. Applicant in the above-styled case seeks an order from the Division pooling all uncommitted mineral interests in the Avalon and Bone Spring Formations underlying a standard 640-acres, more or less, stand-up spacing unit comprised of the E/2 of Section 10 and the E/2 of Section 15, Township 20 South, Range 32 East, NMPM, Lea County, New Mexico. The proposed horizontal spacing unit will be dedicated to the following wells to be horizontally drilled: (1) Queenie Fed Com 101H (Avalon) to be horizontally drilled with first take points in the SE/4SE/4 (Unit P) of Section 15 and last take points in the NE/4NE/4 (Unit A) of Section 10; (2) Queenie Fed Com 102H (Avalon) to be horizontally drilled with first take points in the SW/4SE/4 (Unit O) of Section 15 and last take points in the NW/4NE/4 (Unit B) of Section 10; (3) Queenie Fed Com 113H (First Bone Spring) to be horizontally drilled with first take points in the SW/4SE/4 (Unit O) of Section 15 and last take points in the NW/4NE/4 (Unit B) of Section 10; (4) Queenie Fed Com 114H (First Bone Spring) to be horizontally drilled with first take points in the SE/4SE/4 (Unit P) of Section 15 and last take points in the NE/4NE/4 (Unit A) of Section 10; (5) Queenie Fed Com 133H (Third Bone Spring) to be horizontally drilled with first take points in the SW/4SE/4 (Unit O) of Section 15 and last take points in the NW/4NE/4 (Unit B) of Section 10; and (6) Queenie Fed Com 113H (Third Bone Spring) to be horizontally drilled with first take points in SE/4SE/4 (Unit P) of Section 15 and last take points in the NE/4NE/4 (Unit A) of Section 10. The completed interval for the Queenie Fed Com 114H Well and the Queenie Fed Com 134H are expected to be no less than 330 feet from the adjoining tracts thereby allowing for the inclusion of the proximity tracts within the Unit. Also to be considered will be the cost of drilling and completing the wells and the allocation of costs thereof; actual operating costs and charges for supervision; the designation of the Applicant of Operator of the wells and unit; and a 200% charge for the risk involved in drilling and completing the wells. The wells and lands are located approximately 30 miles NE of Carlsbad, New Mexico.
5. 25681 Application of Civitas Permian Operating, LLC (Operator No. 332195) for Compulsory Pooling, Lea County, New Mexico. Also to be considered will be the cost of drilling and completing the wells and the allocation of costs thereof; actual operating costs and charges for supervision; the designation of the Applicant of Operator of the wells and unit; and a 200% charge for the risk involved in drilling and completing the wells. The wells and lands are located approximately 30 miles NE of Carlsbad, New Mexico.
6. 25697 Application of MRC Permian Company for compulsory pooling and approval of overlapping spacing units, Lea County, New Mexico: MRC Permian Company (“Applicant”) has filed an application with the Oil Conservation Division for an order pooling all uncommitted mineral interest owners in the Bone Spring formation underlying a horizontal spacing unit comprised of the W/2 of Section 17, Township 24 South, Range 34 East, NMPM, Lea County, New Mexico (the “Unit). Applicant proposes to drill the Carl Mottek Fed. Well Nos. 100H, 130H, and 140H in the Unit. The wells will be horizontally drilled from surface locations and first take points in the NW/4NW/4 (Unit D) of Section 17 to bottom hole locations and last take points in the NE/4NW/4 (Unit C) of Section 17. The wells are U-turn wells: The W/2W/2 of Section 17 will contain the north-south laterals, and the E/2W/2 of Section 17 will contain the south-north laterals. Also to be considered will be the cost of drilling, completing, testing, and equipping the wells, and the allocation of the cost thereof among the wells’ working interest owners, designation of Matador Production Company as operator of the wells and the Unit, approval of actual operating charges and costs charged for supervision, together with a provision adjusting the rates pursuant to the COPAS accounting procedure, and setting a 200% charge for the risk involved in drilling, completing, testing, and equipping the wells in the event a working interest owner elects not to participate in the wells. Applicant also requests approval for the Unit to overlap the W/2W/2 of Section 17 spacing unit for the (i) Carl Mottek Federal Well No. 121H (API No. 30-025-44936), and (ii) Carl Mottek Federal Well No. 125H (API No. 30-025-44937), both operated by Matador Production Company. The Unit is located approximately 21 miles southwest of Eunice, New Mexico.

13. 25706 Application of Matador Production Company to Amend Order R-21271, As Amended, to Add Additional Pooled Parties, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order amending pooling Order R-21271, as amended, to add an additional record title owner to the pooling order. 14. 25707 Application of 3R Operating, LLC for Compulsory Pooling, Lea County, New Mexico. Applicant applies for an order pooling all uncommitted interests in the Woodford formation underlying a 320-acre, more or less, standard horizontal spacing unit comprised of the W/2 W/2 of Sections 28 and 21, Township 26 South, Range 37 East, Lea County, New Mexico (“Unit”). The Unit will be dedicated to the Pioneer 21 28 Fed Com 951H well (“Well”), which will be drilled from a surface hole location in the NW/4 NW/4 (Unit D) of Section 21 to a bottom hole location in the SW/4 SW/4 (Unit P) of Section 28. The completed interval of the Well will be orthodox. Also to be considered will be the cost of drilling and completing the Well and the allocation of the costs, the designation of Applicant as the operator of the Well, and a 200% charge for the risk involved in drilling and completing the Well. The Well is located approximately 5 miles south of Jal, New Mexico.
15. 25710 Application of Tap Rock Operating, LLC for approval to compulsory pool additional interest owners under Order R-23945, Eddy County, New Mexico. Tap Rock in the above-styled cause seeks an order from the Division pooling additional mineral interest owners under Order No. R-23945. The order pooled uncommitted mineral interest owners in the Wolfcamp formation underlying a standard horizontal spacing unit comprised of all of Sections 3 and 4 Township 25 South, Range 25 East, N.M.P.M., Eddy County, New Mexico. Tap Rock has determined that that are additional uncommitted and unleased mineral interest owners in the Unit who were not pooled by Order No. R-23945, including the New Mexico Department of Transportation. Tap Rock is the designated operator under the pooling order. Order R-23945 dedicated the Unit to the proposed initial wells including: Beer 30 Fed Com 202H (API No. 30-015-57254), Beer 30 Fed Com 204H (API No. 30-015-57256), Beer 30 Fed Com 211H (API No. 30-015-57255), and Beer 30 Fed Com 213H (API No. 30-015-57257). The wells and lands are located approximately 1 mile southeast of Whites City, New Mexico.
16. 25711 Application of High Plains Natural Resources, LLC to Extend Time to Commence Drilling Operations Under Order Nos. R-22915 and R-22915-A, Lea County, New Mexico. High Plains Natural Resources, LLC (“Applicant”) seeks an order extending the deadline to commence drilling the well authorized by Order No. R-22915 (“Order”) until October 20, 2026. Applicant is successor in interest to Steward Energy II, LLC. Order No. R-22915: pooled all uncommitted interests in the San Andres formation underlying a 265.00-acre, more or less, standard horizontal spacing unit comprised of the E/2 of irregular Section 11, Township 13 South, Range 38 East, Lea County, New Mexico (“Unit”); dedicated the Unit to the Gale Federal 2H well (“Well”); and designated Steward Energy II, LLC as operator of the Unit and the Well. The Division subsequently entered Order No. R-22915-A, granting an extension of time to commence drilling operations to October 20, 2025. Applicant requests that the Division extend the deadline to commence drilling the Well until October 20, 2026. Applicant further requests that the Division designate Burk Royalty Co., LTD (OGRID No. 3053) as the operator of the Unit and Well. The Well is located approximately 14.8 miles southeast of Tatum, New Mexico.
17. 25712 Application of COG Operating LLC for Compulsory Pooling, Eddy County, New Mexico. Applicant seeks an order pooling all uncommitted interests in the Wolfcamp formation underlying a 640-acre, more or less, standard horizontal spacing unit comprised of the E/2 of Sections 12 and 13, Township 26 South, Range 28 East, Eddy County, New Mexico (“Unit”). The Unit will be dedicated to the following wells (“Wells”): Tater Salad Fed Com 701H, Tater Salad Fed Com 704H, Tater Salad Fed Com 901H, Tater Salad Fed Com 902H, and Tater Salad Fed Com 904H, which will be drilled from surface hole locations in the NE/4 NE/4 (Unit A) of Section 24 to bottom hole locations in the NE/4 NE/4 (Unit A) of Section 12; and Tater Salad Fed Com 702H, Tater Salad Fed Com 703H, Tater Salad Fed Com 903H, and Tater Salad Fed Com 905H, which will be drilled from surface hole locations in the NE/4 NE/4 (Unit A) of Section 24 to bottom hole locations in the NW/4 NE/4 (Unit B) of Section 12. Applicant in the above-styled cause seeks an order pooling the uncommitted interest owners in a standard 339.78-acre, more or less, horizontal well spacing unit in the Bone Spring formation underlying Lots 4, 5, 12, 13, 17 & 18 (W/2 W/2 equivalent) of irregular Section 6, Township 21 South, Range 32 East, as well as the E/2 SW/4 of Section 36, Township 20 South, Range 32 East, NMPM, Lea County, New Mexico.
