PRELIMINARY DOCKET: Examiner Hearing for Thursday, May 2, 2024

Applications for hearing shall be filed at least thirty (30) days in advance of the hearing date. A party who intends to present evidence shall file a pre-hearing statement no later than the close of business on the Thursday prior to the hearing date and serve a copy on the other parties, if any. Applicant seeks an order from the Division pooling all uncommitted mineral interests within a 320-acre, more or less, Bone Spring horizontal spacing unit comprising the E/2 W/2 of Sections 20 and 29, Township 18 South, Range 35 East, N.M.P.M., Lea County, New Mexico. Franklin also seeks, to the extent necessary, approval of an overlapping spacing unit. Applicant in the above-styled cause seeks an order (a) approving a standard 320-acre, more or less, overlapping horizontal well spacing unit in the Bone Spring formation comprised of the W2W2 of Sections 20 and 29, Township 18 South, Range 35 East, NMPM, Lea County, New Mexico, and (b) pooling all uncommitted mineral interests in this horizontal well spacing unit. Said unit will be initially dedicated to the proposed Condor State Com 111H well to be horizontally drilled from a surface location in the SW4 of Section 29, with a first take point in the SW4SW4 (Unit M) of Section 29 and a last take point in the NW4NW4 (Unit D) of Section 20. This proposed horizontal well spacing unit will overlap the following existing spacing units in the Bone Spring formation:

Order No. R-14097: pooled all uncommitted interests in the Quail Ridge; Bone Spring Pool (Code 50640) underlying a 160-acre horizontal spacing unit comprised of the W/2 E/2 of Section 16, Township 19 South, Range 34 East, Lea County, New Mexico (“Unit”); dedicated the Unit to the Cimarron 16 19S 34E RN State Well No. 133H (“Well”); and designated Matador Production Company as operator of the Unit and Well. Applicant is a pooled working interest owner under the terms of Order No. R-14097 and proposes to drill the Cimarron 16 19 34 RN State Com #101H infill well (“Infill Well”) from a surface hole location in the NW/4 NE/4 (Unit B) of Section 16 to a bottom hole location in the SW/4 SE/4 (Unit O) of Section 16. The Infill Well will produce from the Quail Ridge; Bone Spring Pool (Code 50640). The Wells are located approximately 25 miles east of Hobbs, New Mexico.
10. 24180 Application of E.G.L. Resources, Inc. for Authorization to Drill and Operate an Infill Well Under Order No. R-13960, Lea County, New Mexico. E.G.L. Resources, Inc. (“Applicant”) seeks authorization to drill and operate an infill well under the terms of Division Order No. R-13960. Order No. R-13960: pooled all uncommitted interests in the Quail Ridge; Bone Spring Pool (Code 50640) underlying a 160-acre horizontal spacing unit comprised of the E/2 E/2 of Section 16, Township 19 South, Range 34 East, Lea County, New Mexico (“Unit”); dedicated the Unit to the Cimarron 16 19 34 RN State Well No. 134H (“Well”); and designated Matador Production Company as operator of the Unit and Well. Applicant is a pooled working interest owner under the terms of Order No. R-13960 and proposes to drill the Cimarron 16 19 34 RN State Com #102H infill well (“Infill Well”) from a surface hole location in the NW/4 NE/4 (Unit B) of Section 16 to a bottom hole location in the SE/4 SE/4 (Unit P) of Section 16. The Infill Well will produce from the Quail Ridge; Bone Spring Pool (Code 50640). The Wells are located approximately 25 miles east of Hobbs, New Mexico.
11. 24366 Application of MRC Permian Company for Approval of an Overlapping Horizontal Well Spacing Unit and Compulsory Pooling, Lea County, New Mexico. Applicant in the above-styled cause seeks an order (a) approving a standard 320-acre, more or less, overlapping horizontal well spacing unit in the Bone Spring formation comprised of the E2 of Section 16, Township 19 South, Range 34 East, NMPM, Lea County, New Mexico, and (b) pooling all uncommitted mineral interests in this horizontal well spacing unit. Said unit will be initially dedicated to the proposed Cimarron State Com 1143H and Cimarron State Com 1243H “u-turn” wells to be horizontally drilled from a surface location in the NE4 of Section 16, with first take points in the NE4NE4 (Unit A) of Section 16 and last take points in the NW4NE4 (Unit B) of Section 16. This proposed horizontal well spacing unit will overlap the following existing spacing units in the Bone Spring formation:

•    A 160-acre horizontal well spacing unit comprised of the E2E2 of Section 16 currently dedicated to the Cimarron 16 19S 34E RN State Com 134H (30-025-42352) operated by Matador Production Company in a different interval of the Bone Spring formation and assigned to the Quail Ridge; Bone Spring Pool (50460).
Also, to be considered will be the cost of drilling and completing the wells and the allocation of the cost thereof, actual operating costs and charges for supervision, designation of Matador Production Company as operator of the wells, and a 200% charge for risk involved in drilling said wells. The subject area is located approximately 17 miles northwest of Monument, New Mexico.
12. 24231 Application of Marathon Oil Permian LLC for Compulsory Pooling, and, to the Extent Necessary, Approval of an Overlapping Spacing Unit, Eddy County, New Mexico. Applicant seeks an order from the Division pooling all uncommitted mineral interests within a standard 960-acre, more or less, Bone Spring horizontal spacing unit underlying the S/2 of Sections 8 and 7, Township 23 South, Range 28 East, and the S/2 of Section 12, Township 23 South, Range 27 East, NMPM, Eddy County, New Mexico. This spacing unit will be dedicated to the Silver Snake Federal Com 301H and Silver Snake Federal Com 501H wells to be horizontally with first take points in the SE/4 SE/4 (Unit P) of Section 8 and last take points in the SW/4 SW/4 (Unit M) of Section 12; and the Silver Snake Federal Com 302H and Silver Snake Federal Com 502H wells to be horizontally drilled with first take points in the NE/4 SE/4 (Unit I) of Section 8 and last take points in the NW/4 SW/4 (Unit L) of Section 12. The producing area for the wells is expected to be orthodox. The completed intervals for the Silver Snake Federal Com 302H and Silver Snake Federal Com 501H wells are expected to be less than 330 feet from the adjoining tracts thereby allowing for the inclusion of the proximity tracts within the proposed spacing unit. Applicant also seeks, to the extent necessary, approval of an overlapping spacing unit. This proposed horizontal spacing unit will overlap with a 160-acre horizontal spacing unit comprised of the N/2 S/2 of Section 8, Township 23 South, Range 28 East, dedicated to OXY USA WTP Limited Partnership’s Villa A Fee Com #002H well (API 30-015-42284). Also to be considered will be the cost of drilling and completing said wells, the allocation of these costs as well as the actual operating costs and charges for supervision, designation of Marathon as operator of the wells, and a 200% charge for risk involved in drilling said wells. Said area is located approximately 9 miles southwest of Carlsbad, New Mexico.
13. 24232 Application of Marathon Oil Permian LLC for Compulsory Pooling, Eddy County, New Mexico. Applicant seeks an order from the Division pooling all uncommitted mineral interests within a standard 960-acre, more or less, Bone Spring horizontal spacing unit underlying the N/2 of Sections 8 and 7, Township 23 South, Range 28 East, and the N/2 of Section 12, Township 23 South, Range 27 East, NMPM, Eddy County, New Mexico. COG Production LLC (“COG” or “Applicant”) seeks an order: (1) establishing an 1,279.08-acre, more or less, non-standard horizontal spacing unit comprised of all of irregular Section 5 and Section 8, Township 24 South, Range 33 East, Lea County, New Mexico (“Unit”); and (2) pooling all uncommitted interests in the Bone Spring formation underlying the Unit. Applicant seeks to dedicate the Unit to the following proposed wells (“Wells”): Eata Fajita State Com 601H, which will be drilled from a surface hole location in the SE/4 SE/4 (Unit P) of Section 8 to a bottom hole location in Lot 1 (NE/4 NE/4 equivalent) of Section 5; Eata Fajita State Com 603H, which will be drilled from a surface hole location in the SE/4 SE/4 (Unit P) of Section 8 to a bottom hole location in Lot 2 (NW/4 NE/4 equivalent) of Section 5; Eata Fajita State Com 605H, which will be drilled from a surface hole location in the SE/4 SW/4 (Unit N) of Section 8 to a bottom hole location in Lot 3 (NE/4 NW/4 equivalent) of Section 5; and Eata Fajita State Com 607H, which will be drilled from a surface hole location in the SW/4 SW/4 (Unit M) of Section 8 to a bottom hole location in Lot 4 (NW/4 NW/4 equivalent) of Section 5. 15. 24373 Application of COG Production LLC for Compulsory Pooling and Approval of Non-Standard Spacing Unit, Lea County, New Mexico. COG Production LLC (“COG” or “Applicant”) seeks an order: (1) establishing an 1,279.08-acre, more or less, non-standard horizontal spacing unit comprised of all of irregular Section 5 and Section 8, Township 24 South, Range 33 East, Lea County, New Mexico (“Unit”); and (2) pooling all uncommitted interests in the Wolfcamp formation underlying the Unit. Applicant seeks to dedicate the Unit to the following proposed wells (“Wells”): Eata Fajita State Com 602H, which will be drilled from a surface hole location in the SE/4 SE/4 (Unit P) of Section 8 to a bottom hole location in Lot 1 (NE/4 NE/4 equivalent) of Section 5; Eata Fajita State Com 604H, which will be drilled from a surface hole location in the SE/4 SE/4 (Unit P) of Section 8 to a bottom hole location in Lot 2 (NW/4 NE/4 equivalent) of Section 5; Eata Fajita State Com 606H, which will be drilled from a surface hole location in the SW/4 SW/4 (Unit M) of Section 8 to a bottom hole location in Lot 3 (NE/4 NW/4 equivalent) of Section 5; and Eata Fajita State Com 608H, which will be drilled from a surface hole location in the SW/4 SW/4 (Unit M) of Section 8 to a bottom hole location in Lot 4 (NW/4 NW/4 equivalent) of Section 5. Applicant in the above-styled cause seeks an extension of time to drill the initial well under pooling Order No. R-22121. This Order pooled the Bone Spring formation underlying a standard 320-acre horizontal well spacing unit comprised of the W/2 W/2 of Sections 22 and 15, Township 20 South, Range 32 East, NMPM, Lea County, New Mexico. Fasken is the designated operator under the pooling order and the pooled spacing unit is initially dedicated to the proposed Baetz 22/15 Fed Com 1H well to be horizontally drilled from a surface location in the SW/4 SW/4 (Unit M) of Section 22, to a bottom hole location in the NW/4 NW/4 (Unit D) of Section 15. Said area is located 29 miles northeast of Carlsbad, New Mexico.
17. 24397 Application of Fasken Oil & Ranch, LTD to Extend the Drilling Deadline Under Order R-22122, Lea County, New Mexico. Applicant in the above-styled cause seeks an extension of time to drill the initial well under pooling Order No. R-22122. This Order pooled the Bone Spring formation underlying a standard 320-acre horizontal well spacing unit comprised of the E/2 W/2 of Sections 22 and 15, Township 20 South, Range 32 East, NMPM, Lea County, New Mexico. Fasken is the designated operator under the pooling order and the pooled spacing unit is initially dedicated to the proposed Baetz 22/15 Fed Com 2H well to be horizontally drilled from a surface location in the SW/4 SW/4 (Unit M) of Section 22, to a bottom hole location in the NE/4 NW/4 (Unit C) of Section 15. Said area is located 29 miles northeast of Carlsbad, New Mexico.
18. 24085 Application of Marathon Oil Permian LLC for compulsory pooling and, to the extent necessary, approval of an overlapping spacing unit, Eddy County, New Mexico. Applicant seeks an order from the Division pooling all uncommitted mineral interests within a standard 800-acre, more or less, Bone Spring horizontal spacing unit underlying the SE/4 of Section 25, the E/2 of Section 36, Township 24 South, Range 28 East, and the E/2 of Section 1, Township 25 South, Range 28 East, NMPM, Eddy County, New Mexico. 43. 24141 Application of Apache Corporation for Approval of a Non-Standard Horizontal Well Spacing Unit and Compulsory Pooling, Lea County, New Mexico. Applicant in the above-styled cause seeks an order (a) approving a non-standard 1280-acre horizontal well spacing unit in the Bone Spring formation underlying Sections 11 and 14, Township 19 South, Range 32 East, NMPM, Lea County, New Mexico and (b) pooling all uncommitted interests in this acreage. Applicant seeks to initially dedicate the above-referenced horizontal spacing unit to the following proposed wells to be drilled from shared surface locations in the S2S2 of Section 14:
• Dustbowl 11-14 Fed Com 101H and Dustbowl 11-14 Fed Com 201H
wells, with first take points in the SW4SW4 (Unit M) of Section 14 and
last take points in the NW4NW4 (Unit D) of Section 11;
• Dustbowl 11-14 Fed Com 102H and Dustbowl 11-14 Fed Com 202H
wells, with first take points in the SE4SW4 (Unit N) of Section 14 and
last take points in the NE4NW4 (Unit C) of Section 11;
• Dustbowl 11-14 Fed Com 103H and Dustbowl 11-14 Fed Com 203H
wells, with first take points in the SW4SE4 (Unit O) of Section 14 and
last take points in the NW4NE4 (Unit B) of Section 11; and
• Dustbowl 11-14 Fed Com 104H and Dustbowl 11-14 Fed Com 204H
wells, with first take points in the SE4SE4 (Unit P) of Section 14 and
last take points in the NE4NE4 (Unit A) of Section 11.
Also, to be considered will be the cost of drilling and completing the wells, the allocation of the cost thereof, the actual operating costs and charges for supervision, the designation of applicant as operator, and the imposition of 200% charge for risk involved in drilling and completing each well. Said area is located approximately 33 miles west of Hobbs, New Mexico.
44. 24393 Application of Flat Creek Resources, LLC for Compulsory Pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order from the Division pooling all uncommitted mineral interests in the Bone Spring formation (Cottonwood Draw; Bone Spring (O) [97494]) in a standard 320-acre, more or less, horizontal spacing and proration unit (“HSU”), comprised of the W/2W/2 of Section 3, Township 25 South, Range 26 East and the W/2W/2 of Section 34, Township 24 South, Range 26 East, in Eddy County, New Mexico. Applicant proposes to drill the following 2-mile well in the HSU: Bombsite Fed Com BS #4H well, to be horizontally drilled from a surface hole location approximately 640’ FNL and 960’ FWL of Section 10, T25S-R26E to a bottom hole location approximately 100’ FNL and 590’ FWL of Section 34, T24S-R26E. The completed intervals and first and last take points will meet statewide setback requirements for horizontal oil wells. Also to be considered will be the cost of drilling and completing the well and the allocation of the costs, the designation of Applicant as Operator of the well, and a 200% charge for the risk involved in drilling and completing the well. The well and land are approximately 6 miles Southeast of Whites City, New Mexico.
45. 24125 Application of Permian Oilfield Partners, LLC for approval of a salt water disposal well in Lea County, New Mexico. Applicant seeks an order approving disposal into the Silurian-Devonian formation through the Imperative SWD Well #1 well at a surface location 795’ from the North line and 2600’ from the East line, Unit C, Section 11, Township 20 South, Range 33 East, NMPM, Lea County, New Mexico for the purpose of operating a produced water disposal well. Applicant seeks authority to inject produced water into the Silurian-Devonian formation at a depth of approximately 14,796 feet to 15,868 feet. Applicant further requests that the Division approve a maximum daily injection rate for the well of 50,000 bbls per day. Said area is located approximately 22 miles WSW of Monument, New Mexico.
46. 24054 Application of Pilot Water Solutions SWD, LLC for an order approving a salt water disposal well for its Cannon SWD No. 1, (Pool Code 96121) to be drilled at a location 2,363’ FNL and 1,271’ FEL, Unit H, Section 9, Township 19 South, Range 37 East, N.M.P.M., Lea County, New Mexico. Applicant proposes to set a packer at 4,237’ feet below the surface of the earth and then inject into the San Andres formation at depths between 4,237’ through 5,568’ open hole. The well is to be located approximately six miles southwest of Hobbs, NM.
47. 24322 Application of MRC Permian Company for Compulsory Pooling, Eddy County, New Mexico. Applicant in the above-styled cause seeks an order pooling a standard 320-acre, more or less, horizontal well spacing unit in the Bone Spring formation comprised of the N2S2 of Sections 32 and 33, Township 17 South, Range 30 East, NMPM, Eddy County, New Mexico. Said unit will be initially dedicated to the proposed Coach Joe 3332 Fed Com 123H well to be horizontally drilled from a surface location in the SW4 of Section 34, with a first take point in the NW4SE4 (Unit I) of Section 33 and a last take point in the NW4SW4 (Unit L) of Section 32. Also, to be considered will be the cost of drilling and completing the well and the allocation of the cost thereof, actual operating costs and charges for supervision, designation of Matador Production Company as operator of the proposed spacing unit, and a 200% charge for risk involved in drilling said well. The subject area is located approximately two miles north of Loco Hills, New Mexico.
48. 24388 Application of EOG Resources, Inc. for compulsory pooling, Lea
County, New Mexico. Applicant in the above-styled cause seeks an order pooling all uncommitted mineral owners in the Bone Spring formation underlying a standard 960-acre, more or less, horizontal spacing unit comprised of the W/2 of Sections 15, 22, and 27, Township 25 South, Range 34 East, NMPM, Lea County, New Mexico. Applicant seeks to dedicate the above-referenced horizontal spacing unit to the Pistolero 15 Fed Com # 202H, Pistolero 15 Fed Com # 301H, Pistolero 15 Fed Com # 505H, and Pistolero 15 Fed Com # 506H, all oil wells, to be horizontally drilled from a surface location in the NW/4NW/4 (Unit D) of Section 15 to a bottom hole location in the SE/4SW/4 (Unit N) of Section 27. Applicant additionally dedicates the Pistolero 15 Fed Com # 203H, Pistolero 15 Fed Com # 307H, Pistolero 15 Fed Com # 308H, and Pistolero 15 Fed Com # 507H, all oil wells, to be horizontally drilled from a surface location in the NW/4NW/4 (Unit D) of Section 15 to a bottom hole location in the SW/4SW/4 (Unit M) of Section 27. The completed interval for all proposed wells is expected to comply with the setback requirements for the Bone Spring formation. Also, to be considered will be the cost of drilling and completing the wells, the allocation of the cost thereof, the actual operating costs and charges for supervision, the designation of applicant as operator, and the imposition of 200% charge for risk involved in drilling and completing each well. Said area is located approximately 15 miles west of Jal, New Mexico.
