01/02/2025 Remediation closure approved. Sampling notice was provided for 11/22/24 but not for 11/26 and 12/2/24. Operator failed to provide proper Sampling Notification pursuant to 19.15.29.12.D.(1).(a) NMAC. Failure to provide proper sampling notice is a compliance issue and the OCD may pursue compliance actions pursuant to 19.15.5 NMAC. Operator shall ensure future compliance with 19.15.29.12.D.(1).(a) NMAC.

10/18/2024 The Remediation Plan is Conditionally Approved. All samples must be analyzed for all constituents listed in Table I of 19.15.29.12 NMAC. Floor confirmation samples should be delineated/excavated to meet closure criteria standards from Table 1 of the OCD Spill Rule for site assessment/characterization/proven depth to water determination. Sidewall/Edge samples should be delineated/excavated to 600 mg/kg for chlorides and 100 mg/kg for TPH to define the edge of the release. The largest variance confirmation floor sample size that the OCD can currently grant is 400 ft2. The variance is approved for 400 ft2 floor confirmation samples. The release area will still need confirmation sidewall samples representing no more than 200 ft2. All sidewall samples should be taken from the sidewall of the excavation. Please make sure that the edge of the release extent is accurately defined. All off-pad areas must meet reclamation/revegetation standards set forth in the OCD Spill Rule.
