Under Action ID 367526, XTO requested a cessation of operations between 2024-08-19 through 2025-01-31 to perform upgrades to the recycling facility including the installation of mechanical and electrical infrastructure to support upcoming developments and eliminate the use of temporary pumps. Due to unforeseen complications, this work was delayed, and the cessation of operations at the pond was required to be extended to 2025-06-28. XTO executed an extension of State Business Lease No. BL-2511 with the New Mexico State Land Office which was approved on October 9, 2024. This business lease extension timeline was not accounted for in the previously proposed schedule, extending out the construction completion date. In addition, complications were encountered during construction that slowed construction progress, further extending the construction completion date. During the cessation of operations, the recycling containments were emptied, cleaned, and thereafter kept clean and dry for the duration of construction, including the removal of rainwater. Prior to restart of operation at the recycling facility and recycling containment, potential leak points and tears in the primary liners of the recycling containment were repaired to ensure integrity of the primary liner. Operations at the recycling facility commenced on 2025-06-28 including the filling of the recycling containments. |
