09/29/2025 Liner report rejected for the following reasons: 1) This application has been rejected because the C-141 is incomplete. The submitted application indicates a conflict between the questions answered and the attachments that have been submitted. For example, the answer “No” was selected when requesting a remediation plan approval; however, your attachments indicate that your intent is to request a remediation closure report approval. Please review the December 1, 2023 Public Notice titled “Implementation of Digital C-141 and New Incident Statuses” found on the EMNRD website. Review your C-141 submission and submit a new C-141 answering the appropriate questions for your circumstance. 2) Per the NOR, the GPS coordinates of 32.269000001,-103.74098 were provided for the release location; however, the report puts the release at this location: 32.269714,-103.758175. The facility named FAPP2129138007 ALDABRA 26 & 27 BATTERY was registered with the OCD on 10/18/2021 and this location given: 32.269000001, -103.74098. Confirm the location of the release and the Aldabra 26 & 27 Battery. 3) Under the Site Characterization portion of the C-141 application, to the question: “What is the minimum distance, between the closest lateral extents of the release and the following surface areas: A continuously flowing watercourse or any other significant watercourse,” was answered, “Greater than 5 (mi.).” According to 19.15.17 NMAC, a “significant watercourse” is defined as a watercourse with a defined bed and bank either named or identified by a dashed blue line on a USGS 7.5 minute quadrangle map or the next lower order tributary with a defined bed and bank of such watercourse. There is a significant watercourse located 3.7 miles west of release location. 4) Under the Site Characterization portion of the C-141 application, to the question: “What is the minimum distance, between the closest lateral extents of the release and the following surface areas: Any lakebed, sinkhole, or playa lake” and “A wetland,” was answered, “Greater than 5 (mi.).” Referring to the National Wetlands Inventory mapper, there are freshwater emergent wetlands (also known as playas) located 3.67 miles to the SE. Also referring to the National Wetlands Inventory mapper, the nearest wetland is a wetland (riverine) located 3.16 miles to the SW. 5) Under the Site Characterization portion of the C-141 application, to the question: “What is the minimum distance, between the closest lateral extents of the release and the following surface areas: A spring or private domestic fresh water well used by less than five households for domestic or stock watering purposes. OSE POD C-02348 is located .43 miles east of site and is used for stock watering purposes. The distances to all the site receptors listed above are required to be updated within the report itself and under the Site Characterization section of the C-141 application during application resubmission, to reflect the correct minimum distance.
